1 1. Introduction The scope of this publication is to assist boat owners in the preparation of boat inspection under the provisions of the Powerboats Ordinance 2001. Within this booklet you will find information on the survey procedure and advice on the safety equipment that should be onboard during the inspection. 2. Definitions competent authority operator owner powerboat jet ski fee length means the Chief Officer and includes any person authorized by him in that behalf; means a person who drives a powerboat and includes a person who has the control of a powerboat while it is moored and operate or operating shall be construed accordingly means the person in whose name a powerboat is registered under the appropriate Republican Law or, where the powerboat is not yet registered as aforesaid, means the person who is in possession of the powerboat including a person who is in possession by virtue of a hire purchase or other agreement; means a mechanically propelled vessel not exceeding 15 meters in length, which is capable of attaining a speed of 15 knots or more means a small powerboat propelled by an outboard or inboard water jet propulsion system means any fee imposed by or under the legislation of the Republic in relation to fees and taxation relating to merchant shipping; in relation to the dimensions of any powerboat to which these regulations apply, means the length of the hull of the vessel concerned; 1

2 registration mark the Ordinance category A category B in relation to a powerboat means the registration mark, consisting of numerals or letters or both, allocated to a powerboat and recorded in the Register of Small Craft for the Areas or in the corresponding register of the Republic kept under the legislation of the Republic in relation to the registration of small craft, and registration and cognate expressions shall be construed accordingly. means the Powerboats Ordinance being a powerboat for private use and used exclusively for recreation and for no reward; being a powerboat for public use and offered by its registered owner to third persons for reward **Above and below categories are not related between them. Legislation The legal framework under the boat inspection is covered is the following: THE EMERGENCY POWERS (CONTROL OF SMALL VESSELS) REGULATIONS 1955 THE POWERBOATS ORDINANCE 1999 as amended in 2001 4. Types of Inspection With reference to the Powerboats Ordinance 2001 / Reg.8.2 a boat is subjected to an inspection by a competent authority or a person authorised by it, in the following cases: 1. an initial inspection before the boat is put into service for the first time (initial registration of the boat) 2. an annual inspection (category B boat) 3. a 5 yearly inspection (category A boat) 4. an extraordinary inspection (where boat has suffered damage or has undergone an alteration in its construction, or whenever the competent authority deems appropriate) According to the Powerboats Ordinance 2001 the validity of the circulation licence is as follows: Category A: end of June following the expiry of five (5) years from the time of issue and shall be renewable every 5 years Category B: end of June following the year of its issue and shall be renewable annually upon payment of the prescribed fee. The above inspections shall be carried out in the first six months of the year in which they fall to be carried out. (i.e. between December and June of the year of expiry) Upon the satisfactory outcome of the inspection and settlement of financial obligations the Administration may issue a circulation licence according to the Powerboats Ordinance 2001 / Reg.9.1 3

4 5. Procedure of Inspection The below procedure need to be followed in order to smoothly arrange for the boat inspection: 1. The boat must be registered in SBA s boat registry and bear a valid certificate of ownership. 2. The owner or a person authorised by the owner shall complete the Form MC/PB/001/2012 Application for Survey attached in Annex I and send it to the surveying company according to the instructions written on the specific form. 3. A confirmation email or fax will be sent stating that your application has been received and is under process. 4. Another email or fax will be sent within seven (7) days informing about the place and date of inspection. 5. The owner must make the boat available for inspection at the designated location and date preferably on its trailer. 6. Upon payment of the survey fee the inspection will commence. 7. During the inspection the safety equipment a described later in this booklet and general condition of the boat is observed along with boat s documentation. Documentation includes ALL paperwork related to the boat and engine(s) such as Declaration of Conformity, Owner s Manuals, Certificate of Ownership, Circulation Licence (for existing boats) etc. 8. Upon completion of the inspection the surveyor will inform the owner as to the success or failure with compliance of the boat with the provisions of the Power Boats Ordinance 2001 and issue to the owner the form MC/PB/003/2012 Certificate of survey completion. 9. The original stamped form MC/PB/003/2012 Certificate of survey completion shall be presented to the Administration for the issuance of the boat s circulation licence. 4

5 10. In the case that the boat has been found not to comply, the form MC/PB/004/2012 Notice of recommendation will be issued to the owner stating the reasons of the non compliance. Should the owner would like to proceed with another inspection at a later date, a new application form MC/PB/001/2012 Application for Survey will have to be re submitted and an additional inspection scheduled. Additional survey fees apply as for the first inspection. 5.1 Important things to know 1. It is highly suggested that the boat is presented with its trailer so that the underwater hull part may be examined at some point during the inspection. 2. The boat will definitely need to go waterborne so that stability condition is checked as well. 3. The engine(s) must be able to start and run. 5

List of Safety Equipment S B A CUSTOMS & IMMIGRATION Powerboats Category A Jet Skis Equipment Remarks L 6m L < 6m Inboard / Outboard engine An engine, the horsepower of which shall not exceed the limits of resistance and safe navigation of the powerboat in accordance with the specifications of the manufacturer of the powerboat; Lifejackets or buoyancy aids of a number which shall exceed by at least one the number of persons on board. 7 An anchor or other means of anchorage, which is suitable for the powerboat having regard to its displacement Length of rope approx. 3 times the intended anchoring depth. 5 to 8 meters of anchor chain between anchor and rope is suggested. Either two oars with crutches or thole pins and thole holes, manufactured, placed and secured with an appropriate rope, in accordance with the specifications of the manufacturer, or with some other auxiliary means of propulsion; A water bucket, attached to a rope the length of which is at least twice the height of the freeboard of the powerboat; At least one foam fire extinguisher, of at least two (2) kg in content weight, which shall be refilled as soon as practicable after it has been used and immediately upon expiry of the period during which it remains effective; Must bear valid service /refill certificate A waterproof electric light suitable for Morse signals, with spare batteries and bulb; 7

8 A readily accessible first aid box with the principal first aid articles being within their respective effective dates for use, including dressings, local antiseptic, sun cream and medicine to combat stings by fish or other sea organisms Two (2) distress smoke flares producing orangecolored smoke and two distress parachute type red flares (S.O.L.A.S APPROVED) **They must be stored in a weatherproof container for protection from humidity cat. A- * cat. B- One siren of any type, capable of producing a constant sonic signal and having satisfactory sonic capacity; Except for powerboats moving only between sunrise and sunset, navigation lights which satisfy the provisions of the Convention of International Regulations for Preventing Collisions at Sea 1972 (Ratification) and Related Matters Laws 1980 to 1989 of the Republic; a direction compass; Type approved by the country of manufacture 8

9 Except in relation to a powerboat which is less than six meters in length and which does not have a deck, a fixed or portable manual pump capable of pumping water from the hold of the powerboat; For a powerboat of six meters or more in length, a radio transmitter (VHF) of marine frequencies with a maximum power of twenty five watts For a powerboat of less than six meters in length and without a deck, not being a category B jet ski, a portable waterproof floating radio transmitter (VHF) of marine frequencies with a minimum power of three watts. A waterproof case maybe used. Every powerboat shall be fitted with a device which when attached to the body of an operator will cause the engine of the powerboat automatically to cut out if the operator falls overboard or is otherwise propelled away from the vessel. cat. Marking of the boat According to the Powerboats Ordinance 2001 Reg.7 (2) the marking of the boat should be as follows: A powerboat shall bear its registration mark clearly and distinctively above the waterline on each of its sides, and in the case of a category B powerboat, the letter B shall be inscribed after the registration mark. the height of each numeral and letter shall be equal and at least 20cm and be of an appropriate width; if, by reason of the small size of the powerboat, the application of above is not possible, the height of each numeral and letter may be reduced to not less than 5cm and be of an appropriate width; the numerals and letters shall be placed above the middle of the height of the topsides of the powerboat; the colour of all of the numerals and letters shall be the same and shall be in sharp contrast to that of the background, so that they shall be very easily discernible from a long distance; the competent authority, where it deems such action appropriate, may request the marking of a powerboat to be at a different position and with different dimensions to those described in sub paragraphs above. 10
