ATHLETICS AUSTRALIA SELECTION POLICY 16 th IAAF WORLD CHAMPIONSHIPS LONDON, GREAT BRITAIN 4 th to 13 th AUGUST 2017 This document sets out the basis on which Athletics Australia will select athletes for the IAAF World Championships in London, Great Britain, 4-13 August 2017. Amendment note: 1 December 2016 - the IAAF released standards for all events. AA have adopted these standards and updated this policy accordingly. On 21 February 2017 the policy was updated to reflect the addition of the 5000m event to those that are subject to the roll down process. Additionally, clarification was added to wind assisted performances in clause 6.5. 18 May 2017 Following confirmation of the automatic qualification for the Men s 4x100m and Women s 4x400m relay teams and the Men s 4x100m relay teams invitation to the London Diamond League (9 July), the selection meeting date for the relay teams has been amended as below; 1 Aims Men s 4x100m week of 26 June, 2017 Women s 4x400m week of 17 July, 2017 The aim of Athletics Australia s Selection Policy for the World Championships is to nominate the most competitive possible team to represent Australia. The policy is aligned with the Athletics Australia Strategic Plan (2017-2020) and with the Australian Institute of Sport Winning Edge Program. For this World Championships Athletics Australia will select the maximum number of individual athletes eligible within this policy and the IAAF limits of, for example, three athletes per individual event. In those cases where the selectors will have a choice of qualified athletes they will be guided by this policy and will prioritise those athletes who are likely to be the most competitive in London. The selectors will consider each athlete s competitive record and demonstrated ability to plan the peak of their season at a major championship event. Page 1 v1.10 25/05/2017

2 Standards, criteria and athlete numbers 2.1 Athletes can only compete at the World Championships if invited by the IAAF and if Athletics Australia accepts the invitation. Athletics Australia is under no obligation to accept the invitation of any particular athlete. 2.2 Individual athletes can qualify by: 2.2.1 Achieving the relevant IAAF Status Qualification or IAAF Standard (listed in Appendix 1) or 2.2.2 Receiving a Roll Down position to complete the overall field size set by the IAAF. The IAAF will offer Roll Down positions based on world ranking within the IAAF qualification period. (See Appendix 3 for guideline athlete numbers per event.) 2.3 Normally the IAAF will invite up to a maximum of three athletes per event from any one country. 2.3.1 A fourth athlete can be added where they are the reigning World Champion from 2015 or Diamond League Champion from 2016. 2.3.2 If both the reigning World Champion from 2015 and Diamond League Champion from 2016 in any one event are different athletes from the same nation, that nation can only choose one of those athletes. 2.4 The selectors will not accept IAAF invitations for athletes qualified only by IAAF status qualification achieved through winning the 2017 Oceania Championships. 2.5 Relay teams can qualify by: 2.5.1 Having placed in the top eight at the 2017 World Relay Championships or 2.5.2 By receiving a Roll Down position to complete the overall field size (16 teams) set by the IAAF. The IAAF will offer Roll Down positions based on world ranking within the IAAF qualification period. 2.5.3 Athletes do not need to have achieved any specific time to be named in a relay squad, although all individual entries in the 100m must be included in the relevant 4x100m squad and all individual entries in the 400m must be included in the relevant 4x400m squad. Being named in a relay squad does not guarantee competing in the relay at the World Championships. Any team member initially selected for any event can be selected to compete in the relays at the World Championships. 3 Selection and Selection Priority 3.1 AA will not accept IAAF invitations for athletes who: 3.1.1 Do not meet the Athlete Eligibility Criteria (see Section 4). 3.1.2 Only qualify by placing first at the 2017 Oceania Championships, Page 2 v1.10 25/05/2017

3.1.3 Only qualify by a performance or performances that were set outside the Qualification Period (see Section 5) or were not an Eligible Performance (see Section 6). 3.2 Selection for all events except the 10,000m, combined events, relays, walks and marathon. 3.2.1 Priority Status will be given to any eligible athletes who achieves an IAAF Status Qualification or IAAF Standard (see Appendix 1) within the Qualification Period. 3.2.2 National Champion status will be given to the first eligible Australian athlete in the Australian Athletics Championships (the Nationals ). 3.2.3 Top 8 status will be given to any athlete that finished in the Top 8 in the Rio Olympic Games (the Olympics ). 3.2.4 At the initial selection meeting (held immediately following the Nationals) athletes will be selected as follows: a) If the National Champion also has Priority Status then he or she will be selected. b) If any other athlete has Top 8 status and also has Priority Status, then he or she will be selected. c) Additional athletes holding Priority Status can be selected at this stage, provided space is left for the National Champion and any Top 8 athletes (if they are not selected at this stage). d) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion and any Top 8 athlete if they hold Priority Status. e) At each stage the selectors will be guided by the notes in Section 7. 3.2.5 At the final selection meeting the selectors may select additional athletes. The order of adding additional athletes will be: a) The National Champion if he or she has not already been selected and if they now hold Priority Status. b) Any other athlete with Top 8 status if they have not already been selected and if they now hold Priority Status. c) Any other athletes holding Priority Status. d) For the avoidance of doubt the selectors must consider athletes in the order above but they are not obliged to select an athlete, other than the National Champion and any athlete with Top 8 status, at any stage. e) The selectors will be guided by the notes in Section 7. 3.2.6 At the end of the IAAF selection period, the IAAF will apply a Roll Down process inviting additional athletes to complete the overall field size for each event at the World Championships. The IAAF will offer Roll Down positions based on world ranking within the IAAF qualification period. (See Appendix 3 for guideline Page 3 v1.10 25/05/2017

athlete numbers per event). AA will accept all Roll Down invitations for each athlete who meets the Athlete Eligibility Criteria of this policy (see Section 4) and that the qualifying performance meets the Eligible Performance Criteria of this policy (see Section 6) except for the date of performance. a) Selectors do not have to leave any team places open to account for this possibility. b) If circumstances mean that the Selection Panel must choose between one or more athletes at this stage then they must select the National Champion if applicable otherwise they will be guided by the notes in Section 7. c) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete at this stage, other than the National Champion where applicable. 3.2.7 Due to the IAAF invitation process, athletes not selected by AA in the final selection meeting (3.2.5) will not be considered by the IAAF for invitation through the Roll Down. 3.3 Selection for Relays 3.3.1 AA will accept all relay team invitations received from the IAAF to compete at the London World Championships (W 4x100m, W 4x400m, M 4x100m and M 4x400m). This means that each team must: a) Have placed in the top eight at the 2017 World Relay Championships or b) Have received a Roll Down position to complete the overall field size (16 teams) set by the IAAF. The IAAF will offer Roll Down positions based on world ranking within the IAAF qualification period. 3.3.2 Athletes entered in the individual 100m and 400m will be automatically included in the relevant Relay Team. 3.3.3 Relay Team members not picked automatically may be added to the team and do not need to achieve any other IAAF performance standard. 3.3.4 The World Championships Relay Teams will consist of up to six athletes per relay discipline made up of any automatic Relay Team members (clause 3.3.2) and any other selections at the absolute discretion of the Selectors. 3.3.5 The World Championships Relay Team members will be nominated to create the most competitive possible team based on applicable relay skills, team cohesiveness and compliance with the AA relay program. Results in individual events (e.g. 100m, 200m or 400m), while important, will not be the sole criteria for nomination to the relay teams. 3.3.6 The World Championships Relay Team members will be confirmed at the relevant relay selection meeting. 3.3.7 The nomination of the travelling Relay Team members is at the absolute discretion of AA selectors. 3.3.8 For the avoidance of doubt, at the Championships any athlete on the Team may be chosen to compete in the relays. Being a member of the travelling Relay Page 4 v1.10 25/05/2017

Team does not guarantee competing in the relay at the Championships. The choice of athletes and their running order will be made by the Head Coach in consultation with the High Performance Director and the relevant team relay coach(es). 3.4 Selection for the 20km Walk 3.4.1 Priority Status will be given to any eligible athletes who achieves an IAAF Status Qualification or IAAF Standard (see Appendix 1) within the Qualification Period. 3.4.2 National Champion status will be given to the first eligible Australian athlete in the Australian Athletics 20km Walk Championships (the 20km Nationals ) 3.4.3 Top 8 status will be given to any athlete that finished in the Top 8 at the Rio Olympic Games (the Olympics ) 3.4.4 At the initial 20km walk selection meeting (held the week commencing after the 20km Nationals) athletes will be selected as follows: a) If the National Champion also has Priority Status then he or she will be selected. b) Any other athlete with Top 8 Status that also has Priority Status will be selected. c) Additional athletes holding Priority Status can be selected at this stage, provided space is left for the National Champion and any athlete holding Top 8 status (if they are not selected at this stage). d) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion and any Top 8 athlete if they hold Priority Status. e) The selectors will be guided by the notes in Section 7. 3.4.5 At the final 20km selection meeting the selectors may select additional athletes. The order of adding additional athletes will be: a) The National Champion if he or she has not already been selected and if they now hold Priority Status. b) Any other athlete with Top 8 Status if they have not already been selected and if they now hold Priority Status. c) Additional athletes holding Priority Status. d) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion and any Top 8 athlete if they hold Priority Status. e) The selectors will be guided by the notes in Section 7. 3.4.6 There will be no selections made based on performances achieved after the Athletics Australia qualification period for the 20km walks has closed (see Section 5). 3.5 Selection for the 50km Walk 3.5.1 The 50km walk is a very physically challenging event and AA reserves the right, at its sole discretion, not to select an athlete for the World Championships 50km walk if it believes that competing will not be in the long term interests of the athlete for example a young athlete who has not previously competed at an open benchmark championships in either the 20km or 50km walk events. 3.5.2 The IAAF has confirmed that women will be eligible to compete in the 50km Walk alongside male athletes in a mixed event. Women achieving the IAAF Status Qualification or IAAF Standard will be considered along with men under this Clause 3.5. 3.5.3 Priority Status will be given to any eligible athletes who achieve an IAAF Status Qualification or IAAF Standard (see Appendix 1) within the Qualification Period. 3.5.4 National Champion status will be given to the first eligible Australian athlete in the Australian Athletics 50km Walks Championships (the 50km Nationals ) 3.5.5 Top 8 status will be given to any athlete that finished in the Top 8 at the Rio Olympic Games (the Olympics ) 3.5.6 At the initial 50km walk selection meeting (held the week commencing after the 50km Nationals) athletes will be selected as follows: a) If the National Champion also has Priority Status then he or she will, subject to point 3.5.1, be selected. b) Any other athlete with Top 8 Status that also has Priority Status will, subject to point 3.5.1, be selected. c) Additional athletes holding Priority Status can be selected at this stage, provided space is left for the National Champion and any athlete holding Top 8 status (if they are not selected at this stage). d) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion and any Top 8 athlete if they hold Priority Status. e) The selectors will be guided by the notes in Section 7. 3.5.7 At the final 50km selection meeting the selectors may select additional athletes. The order of adding additional athletes will be: a) The National Champion, subject to point 3.5.1, if he or she has not already been selected and if they now hold Priority Status. b) Any other athlete with Top 8 Status, subject to point 3.5.1, if they have not already been selected and if they now hold Priority Status. c) Additional athletes holding Priority Status, subject to point 3.5.1. d) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion and any Top 8 athlete (subject to 3.5.1) if they hold Priority Status. e) The selectors will be guided by the notes in Section 7. 3.5.8 There will be no selections made based on performances achieved after the Athletics Australia qualification period for the 50km walks has closed (see Section 5). 3.6 Selection for 10,000m 3.6.1 Priority Status will be given to any eligible athletes who achieves an IAAF Status Qualification or IAAF Standard (see Appendix 1) within the Qualification Period. 3.6.2 National Champion status will be given to the first eligible Australian athlete in the Australian Athletics 10,000m Championships (the 10,000m Nationals ). 3.6.3 Top 8 status will be given to any athlete that finished in the Top 8 in the Rio Olympic Games (the Olympics ). 3.6.4 At the initial 10,000m selection meeting (held the week commencing after the Nationals) athletes will be selected as follows: a) If the National Champion also has Priority Status then he or she will be selected. b) Any other athletes with Top 8 status that also have Priority Status will be selected. c) Additional athletes holding Priority Status can be selected at this stage, provided space is left for the National Champion and any Top 8 athletes (if they have not been selected at this stage). d) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion and any Top 8 athlete if they hold Priority Status. e) The selectors will be guided by the notes in Section 7. 3.6.5 At the final 10,000m selection meeting the selectors may select additional athletes. 3.7 Selection for the Marathon 3.7.1 There is no trials event for the Marathon. 3.7.2 At the Marathon selection meeting the selectors will select qualified athletes as outlined in Section 7. 3.7.3 There will be no selections made based on performances achieved after the Athletics Australia qualification period for the marathon has closed (see Section 5). 3.8 Selection for Combined Events 3.8.1 Priority Status will be given to any eligible athletes who achieves an IAAF Status Qualification or IAAF Standard (see Appendix 1) within the Qualification Period. 3.8.2 National Champion status will be given to the first eligible Australian athlete in the Australian Athletics National Championships and Trials (the Nationals ). 3.8.3 Top 8 status will be given to any athlete that finished in the Top 8 in the Rio Olympic Games (the Olympics ). 3.8.4 At the initial selection meeting (held immediately following the Nationals) athletes will be selected as follows: a) If the National Champion also has Priority Status then he or she will be selected. b) Any other athletes with Top 8 status that also have Priority Status will be selected. c) Additional athletes holding Priority Status can be selected at this stage, provided space is left for the National Champion and any Top 8 athletes (if they are not selected at this stage). d) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion and any Top 8 athlete if they hold Priority Status. e) The selectors will be guided by the notes in Section 7. 3.8.5 At the final selection meeting the selectors may select additional athletes. The order of adding additional athletes will be: a) The National Champion if he or she has not already been selected and if he or she now hold a Status Qualification or IAAF Standard (see Appendix 1). b) Any other athlete with Top 8 status if they have not already been selected and if they now hold Priority Status. c) Any other athletes holding priority status. d) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion and any Top 8 athlete if they hold Priority Status. e) The selectors will be guided by the notes in Section 7. 3.8.6 At the end of the IAAF selection period, the IAAF will apply a Roll Down process inviting additional athletes to complete the overall field size for each event at the World Championships. The IAAF will offer Roll Down positions based on world ranking within the IAAF qualification period. (See Appendix 3 for guideline athlete numbers per event). AA will accept all Roll Down invitations for each athlete who meets the Athlete Eligibility Criteria of this policy (see Section 4) and that the qualifying performance meets the Eligible Performance Criteria of this policy (see Section 6) except for the date of performance. a) Selectors do not have to leave any team places open to account for this possibility. b) If circumstances mean that the Selection Panel must choose between one or more athletes at this stage then they must select the National Champion if applicable otherwise they will be guided by the notes in Section 7. c) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete at this stage, other than the National Champion where applicable. 3.8.7 Due to the IAAF invitation process, athletes not selected by AA in the final selection meeting will not be considered by the IAAF for invitation through the Roll Down. 4 Athlete Eligibility Criteria Only those athletes who qualify according to this clause will be eligible for selection in the Team: 4.1 Satisfy all IAAF eligibility, nationality and World Championships Participation Rules. 4.2 Be a citizen of Australia. 4.3 Be a registered member of Athletics Australia through their Member Association. 4.4 Complete and submit the online Application for Consideration for Selection form (which can be found at www.athletics.com.au) for each event in which the athlete is seeking selection. The form must be submitted by the dates shown in Section 5. The date for submission of the Application for Selection may be extended at the discretion of the Chairman of Selectors on the recommendation of the Director of High Performance. 4.5 Commit to signing the Athletics Australia Code of Conduct. 4.6 Be and remain in good standing with Athletics Australia and at all times comply with Athletics Australia s Code of Conduct and conduct themselves in a way that does not bring themselves, their sport or the National Team into disrepute. Athletics Australia may consider past and present behavioural conduct in determining whether an athlete is in good standing. If Athletics Australia determines that an athlete is not in good standing with Athletics Australia, in its absolute discretion Athletics Australia may choose not to select that athlete. 4.7 Agree to comply with a pre-championships preparation policy that will be published by Athletics Australia s High Performance Director. This policy may include the requirement to prove form and fitness to compete in the 2017 World Championships prior to the final Athletics Australia selection date of 24 July 2017. Failure by a previously selected athlete to comply with the pre-championships preparation policy will, at the discretion of the High Performance Director, result in an athlete who has been named by Athletics Australia at an earlier date not being selected in the final team for the World Championships. 4.8 Agree to undertake all reasonably expected education courses, including but not limited to ASADA e-learning modules level 1 & 2. 5 Qualification Periods, Nomination and Selection Dates 5.1 All qualification performances must be achieved between the dates shown below. 5.2 Selection meetings will be held in the week commencing the date shown (marked ) or on the day shown. 6 Eligible Performance Criteria 6.1 Performances must be achieved during competitions organised or authorised by IAAF, its Area Associations or its National Member Federations. Results achieved at university or school competitions must be certified by Athletics Australia or the National Federation of the country in which the competition was organised. 6.2 Performances must be achieved during an official competition organised in conformity with IAAF Rules. 6.3 To be recognised for the purposes of this Policy, performances achieved in Australia must be achieved in a competition sanctioned by Athletics Australia as an Athletics Australia National Permit Meeting. Athletics Australia operates a sanctioning process across all meets that involves the issuing of a permit National Permit or Recreational (State) Permit. A current list of all National Permit meetings will be available on the Athletics Australia website. 6.4 Performances achieved in mixed events, on the track and completely in the Stadium, shall not normally be accepted. If athletes and/or coaches are in doubt as to the interpretation of the IAAF and Athletics Australia Rules in relation to qualifying performances in Mixed Events they should contact the Competitions Manager of Athletics Australia. 6.5 Wind-assisted performances, beyond legal readings recognised by the IAAF, or performances for which a wind reading is not available will not be accepted. 6.6 Hand-timed performances in 100m, 200m, 400m, 800m 110m/100m Hurdles, 400m Hurdles and 4x100m relay will not be accepted. 6.7 Junior athletes (any athlete aged 18 or 19 years on 31 December 2017) may compete in any event except the Marathon and 50km Race Walk. 6.8 Youth athletes (any athlete aged 16 or 17 years on 31 December 2017) may compete in any event except the throwing events, the Combined Events, 10,000m, the Race Walks and Marathon. 6.9 Athletes younger than 16 years on 31 December 2017 CANNOT be entered in any event. 6.10 Performances must be achieved in a competition where a minimum of three athletes are competing. 6.10.1 For throwing events, all three athletes must be competing with the same implement specifications. 6.10.2 For hurdle events, all three athletes must be competing with the same hurdle heights. 7 Prioritising athletes at the final selection meetings 7.1 The Selectors will only consider Eligible Athletes holding an IAAF Status Qualification or IAAF Standard set within the relevant Qualification Period. 7.2 The selectors will prioritise athletes who have demonstrated their competitive ability and ability to plan the peak of their season at a major championship event. Specifically where the selectors have a choice between two or more athletes for selection for a particular event then they will prioritise in the following order: 7.2.1 See sections 3.2, 3.4, 3.5, 3.6 and 3.8 for the prioritisation of National Champions and athletes that finished in the Top 8 at the Rio Olympic Games. 7.2.2 The selectors will prioritise other athletes by their likely finishing position at the 2017 World Championship. To do so they will use the following criteria, in consultation with the Head Coach and High Performance Director, in any order that they consider appropriate: World ranking lists Previous Benchmark event results An athlete s: o Repeat performances at or near the IAAF Standard o Finishing position at the relevant Australian Championships o Head-to-head record within the Qualification Period o o Other relevant Head-to-head performances Previous Championships record with special reference given to results at the: 2015 World Championships; 2016 World Walk Team Championships; 2016 World Walks Challenge; 2016 Olympic Games; 2017 World Cross Country o Current form and fitness Any other relevant information 7.3 For the avoidance of doubt only athletes who have met the Eligibility Requirements may be nominated subject to the application of Sections 2 and 4. Furthermore the nomination of any athlete is at the absolute discretion of Athletics Australia. Page 12 v1.10 25/05/2017

8. Further Obligations after Selection Athletes selected in the Team for the IAAF World Championships in Great Britain according to the process and criteria set out in this Policy will be required to prove their fitness to compete in the World Championships by the achievement of a performance standard to be set by the Head Coach. The process and standards will be published separately. Failure by a selected athlete to meet the performance standard will, at the discretion of the Director of High Performance, in consultation with the Head Coach, result in an athlete who has been selected in the Team being withdrawn from the World Championships Team. 9. Appeal Process The appeal process is attached hereto as Appendix 4. 10. Amendment to Policy This Policy can be amended at any time by Athletics Australia if it is of the opinion that such an amendment is necessary as a result of any change to the Participation Rules, to give effect to the Policy following discovery of a drafting error or oversight, or for any other reason determined to be in the best interests of Athletics Australia. Appendix 4 Appeal Process ATHLETICS AUSTRALIA 2017 WORLD CHAMPIONSHIPS IN ATHLETICS SELECTION APPEALS PROCEDURE REGULATION 1.0 Event Selections finalised prior to 24 July 2017 In the case of any event where either the final selection date has occurred on or prior to 24 July 2017 (10000m, marathon and race walks), or where all possible places in an event have been filled by the Selectors, or in respect of the selection of any athlete in any other event which has been finalised prior to 24 July 2017, the normal appeal process according to AA By Law 8 will apply. Any appeal process applicable to any such situation must have been initiated in accordance with By law 8.4 by 1 July 2017 or will be invalid. 2.0 Relay Selections There will be no appeal process available in respect of selection as a travelling Relay Team member, except insofar that a selected athlete does not meet the Athlete Eligibility Criteria. In any such case, the Appeal (detailing the specific nature of the non-compliance) shall be made in writing to the Chief Executive Officer within 24 hours of the posting of the final team selections on the Athletics Australia website (which unless otherwise advised shall be 12 noon on Monday 24 July 2017), or if the non-compliance is not known at that time, within 24 hours of such non-compliance being made generally known. The CEO shall investigate the matters raised (including providing the adversely affected athlete of the right to be heard) solely in his absolute discretion shall determine such an appeal within 24 hours of receiving same and shall where necessary request, or direct, the Selectors to make any applicable change to the athletes selected. 3.0 Remaining Selections As the IAAF closing date is 24 July 2017 and there are only limited options for changing athletes within the IAAF entry system after that date, the default Athletics Australia Selection Appeal provisions (By Law 8) will not be appropriate in the circumstances. In lieu thereof, the following Fast Track procedure will apply in accordance with these Regulations. 3.1 The Selection Appeals Tribunal will consist of one person only who shall preferably be knowledgeable both of the sport of athletics and the law, but at least one of those areas; 3.2 An athlete not selected in the 2017 World Championships, other than under the circumstances set out in Regulations 1.0 or 2.0 above, may appeal his/her nonselection to the Selection Appeals Tribunal in accordance with this Regulation 3.0. 3.3 The appeal must be made in writing and reach the CEO of Athletics Australia by hand delivery, facsimile or electronic transmission by no later than five (5) hours after the posting of the final team selections (or subsequent alterations thereto) on the Athletics Page 18 v1.10 25/05/2017

Australia website, which unless otherwise advised shall be 12 noon on Monday 24 July 2017. 3.4 An athlete may not appeal unless he/she has achieved the relevant IAAF entry standard or roll down position for the event in respect of which the appeal is made, If the appeal seeks the replacement of another athlete by the Appellant, status to appeal is also allowed if by virtue of being successful in the appeal, the roll down position would be achieved by the Appellant. 3.5 The appeal must be accompanied by a cash or electronic funds transfer payment of $AUD500. If the fee is not paid, the athlete will be deemed to have withdrawn the appeal. 3.6 The sole grounds of appeal are that: (a) (b) (c) a selected athlete whom the Appellant seeks to replace does not meet the Athlete Eligibility Criteria; the Appellant s omission from the Team was otherwise a result of a failure by the Selectors to properly apply the Selection Criteria set out in the Policy; there were no grounds on which the selection decision could reasonably be based. 3.7 The Appellant can withdraw an appeal at any time. 3.8 The Tribunal will hear the appeal either in person or by telephone as soon as practicable after its lodgement and always bearing in mind the advice of the CEO as to the practicalities of being able to make any necessary changes within the IAAF entry system. 3.9 If the appeal has no impact on any other athlete (ie there is a vacancy available within the IAAF entry rules), the Tribunal will consider submissions, either orally or in writing, from or on behalf of the Appellant and the Selectors only. The Tribunal may consult any officer of Athletics Australia or other person it deems necessary to reach a fair and correct decision 3.10 If the appeal impacts on an athlete already selected (ie the appeal if successful would involve the substitution of that athlete with the Appellant), the Tribunal will also consider submissions by or on behalf of that athlete. 3.11 If more than one appeal affects selection in the same event, the appeals will be held concurrently and submissions considered from all relevant parties according to regulations 3.9 and 3.10. 3.12 The Tribunal has no power of selection or re-selection. The Tribunal may review the matter(s) set out in the appeal and may (as appropriate) refer the matter back to The Selectors for consideration. 3.13 The decision of the Tribunal will be binding on the parties and no further appeal, including to CAS, shall be allowed. 3.14 Hearing of the Appeal (a) The Tribunal shall, as soon as practical after receiving the appeal documents, investigate and consider the matter and determine whether: Page 19 v1.10 25/05/2017

(1) the matter should be dismissed because, in the opinion of the Tribunal, there is no credible evidence, submission or argument upon which the Tribunal could be satisfied that a ground of the appeal can be made out; or (2) the appeal should be the subject of a hearing as set below. (b) (c) (d) If the Tribunal determines the matter should be dismissed under Regulation 3.14(a)(1) above that decision is final and the appeal has failed. If the Tribunal determines that the appeal should be dismissed without a hearing, the Appellant's appeal fee of $500 is forfeited to Athletics Australia as the costs of the appeal. If the Tribunal determines the matter warrants a hearing, the Tribunal will advise the Appellant and set the date for such a hearing as soon as practicable and necessary having regard to the timing of selection and the proximity of relevant events, in accordance with Regulation 3.8. The Tribunal must conduct any appeal hearing as follows: (1) it must observe the principles of natural justice; (2) it is not bound by the rules of evidence and may inform itself as to any matter in such manner as it thinks fit; (3) it will conduct its hearings with as little formality and technicality and with as much expedition as the proper consideration of the matter permits; (4) hearings may occur in such manner as the Tribunal decides; (5) the Appellant must establish one or more grounds of appeal to the reasonable satisfaction of the Tribunal with full regard to the importance and gravity of the issue; (6) all persons appearing before the Tribunal have the right, at his, her or its expense, to legal representation; (e) Following consideration of all information that the Tribunal considers relevant the Tribunal shall arrive at a finding; (1) the Tribunal shall notify the CEO of its findings as soon as practicable; (2) if the Tribunal considers the ground(s) alleged by the Appellant to be made out, it shall recommend that The Selectors reconsider the relevant selection or nomination decision; (3) where the Tribunal considers that a ground of appeal has been made out, it may stipulate that all or part of the appeal fee be refunded to the Appellant; (4) The Selectors shall comply with any direction of the Tribunal to reconsider the relevant selection or nomination decision; (5) any further nomination or selection decision of The Selectors under the direction of the Tribunal shall be final and binding, and no further appeal shall be available to the Appellant in respect of that selection.
