All rented spaces will be charged a 7% sales tax (6% state and 1% county) that is included already in the vending fee. Farmer s Markets are considered businesses renting commercial spaces and are not exempt from sales tax with the Department of Revenue. Kissimmee Main Street reserves the right to change the amount for rent at any time. VENDOR APPLICATION APPROVAL PROCESS Fill out the attached application and submit to the Kissimmee Main Street Market Manager. The Market Manager will be your point of contact for the Market. Kissimmee Main Street is responsible for making the final decision about new vendors. Your application will be reviewed, and once it has been tentatively determined that your products are the quality and type to fit the market, you may be invited to vend at the market so that a complete assessment of your product, booth setup, and your personal presentation can be determined. Each vendor must file and keep current the copies of any applicable licenses and permits with the Market Manager. We reserve the right to restrict the number of vendors who carry similar types of products. We will notify the applicant and keep the application for future openings. Vendors are not permitted to add additional product lines outside the products described in their market application and approved by Kissimmee Main Street. Any subsequent additions to their initial product line will need to be reviewed by and approved by Kissimmee Main Street. If a vendor has a question on whether a specific addition will be deemed outside the existing product line, the vendor should first contact the Market Manager for prior approval of the item. RENTAL PROCESS Once a vendor has been approved, the vendor will pay the weekly rent on the day of the Market before the vendor is allowed to setup their booth. This rent will be collected by the Market Manager. Payment may be required prior to this upon the discretion of the Market Manager and is subject to change. Cash, credit cards, and debit cards are accepted. No personal checks are allowed. ATTENDANCE Weekly attendance to the market is required to be a vendor. If you have an emergency you must contact the Market Manager as soon as possible. Any vendor with two consecutive unexcused absences will be subject to a review from the Main Street staff and up for possible removal from the market. SETUP Arrival Vendors may unload their product(s) starting at 2 p.m. Set Up Should be completed no later than 3 p.m. Parking Vendors may park cars/trucks/vans at any permitted parking space. Location Vendors are NOT guaranteed a specific location or spot and are assigned by Kissimmee Main Street on a week-to-week basis. Check with the Market Manger on your arrival to the Market to confirm your location. Kissimmee Main Street will do its best to meet the specific needs and requests of each vendor, while balancing the overall needs of the market. Equipment Vendors are responsible for supplying all of their booth materials including, but not limited to tables, tents, chairs, trash receptacles etc. Canopies/ Tents- EACH leg of vendor s required tent must be held down by a 24 pound weight, there are no exceptions. (Please see attached photos) Fire Protection Any vendor with any open flame MUST have a fire extinguisher on hand. Obstacles The vendor must minimize any obstacles (such as signs) that might impede free flow of pedestrian traffic. The Market Manager may at any time require the removal of anything he/she deems an impediment.

Selling Vendors shall limit their sales activities to their designated booth area. In addition, NO mega phones, microphones, speakers or any device used to project sound shall be used. In addition no out crying, loud clamor, noise, uproar or any act that would be disruptive to neighboring vendors shall be permitted. Flyers Vendor may only distribute flyers within their designated booth space. Vendors shall not go into other vendor s assigned area to distribute flyers. Garbage Vendors are responsible for providing their own trash receptacle as well as breaking down and bagging all their garbage and for taking it away at the end of the day. Violations of this policy shall be turned over to the Farmer s Market Committee for appropriate corrective action and sanctions. Wind WEIGHTS ARE REQUIRED for a tent at all times because of the possibility of windy conditions. Gallon jugs of sand or water hung from a long bungee cord are acceptable. Each tent leg is required to have a 24 pound weight. (Please see attached photos) Dogs Dogs are allowed at the market, providing they are on a leash. Please inform a market representative if a dog is behaving in a disruptive manner. Change Plan to bring adequate change (bills and coins) with you. Kissimmee Main Street will not provide change. A few vendors tend to primarily get asked for change, which is an imposition on serving their customers and your actions will be considered in allowing your continued participation in the Market. You may take checks from customers at your own discretion. BREAKDOWN Clean-up Vendors are responsible for leaving their area free of garbage and debris. Clean-up should be complete by 8:00 p.m. Please make sure to clean up after yourself to help keep Downtown Kissimmee beautiful. Vending Duration Vendors are expected to remain open for business until the close of the Market, unless they sell out of all of their products. If a vendor does leave before the end of the Market, they shall inform the Market Manager. WEATHER CLOSING The Market Manager will have the final say on all weather closings relevant to the market. If rain threatens after the market opens, the Market Manager will actively monitor radar on the Web to determine if and when to close. The Market Manager will make all attempts to contact the vendors and inform them of the Market being closed (please ensure all phone numbers are up to date). If a vendor chooses to leave early, the weekly rent will not be adjusted or reimbursed. The market provides a blanket City of Kissimmee Business Tax Receipt for all participating vendors (that applies only while they are vending at the market). Sales tax, where required by the State, is the responsibility of the vendor. If selling food items under Cottage Law, you must notify Kissimmee Main Street during your approval process for the Market. You must also have all proper packaging for your product (i.e. labels stating item was made following Cottage Law and signage) as stated by the Florida Department of Agriculture. To read more about the Cottage Law visit: http://www.freshfromflorida.com/fs/cottagefoodadvisorymay%202012withformnumber.pdf GENERAL GUIDELINES Vendors are required to cover tables with a table cloth. It is important that your booth reflects your produ ct nicely and helps sell your product. We strongly suggest signage including banners as well as boards or cards that display the price of your product. The more welcoming your booth looks, the better you will move your product from your table to the customer s shopping bags! Substitute Representatives If a vendor is going to be absent for a day and have a representative stand in for them, they must inform the Market Manager of this in advance. It s also very important that the substitute read our Vendor Guidelines so that they are well informed about our policies and practices. Community Behavior Vendors are expected to be courteous to customers, vendors, and market staff. Any disagreements need to be handled in a constructive and civil manner. Inappropriate behavior (such as loud angry conversation or obscenities) is cause for immediate and permanent removal from the market. Smoking Smoking by vendors is prohibited in the market area. Alcohol No vendor shall possess or sell any alcoholic beverages. Solicitation Solicitation of any type from non-participating vendors (distribution of flyers, requests for money, etc.) is not allowed within the Market boundaries unless the proper permits have been acquired through the Kissimmee Police Department. Please inform the Market Manager if you see solicitation occurring. ENFORCEMENT OF RULES Any grievance regarding the actions of other vendors should be brought to the attention of the Market Manager, and not directed to the vendor in question. Any vendor not in compliance with the above regulations may be asked by the Market Manager to leave the premises immediately. No refund will be given. Approval for further participation is subject to the discretion of Kissimmee Main Street. For more information, contact the Market Manager, Jazmyne Smith: Office: 407-846-4643 or Email: jsmith@kissimmeemainstreet.com These rules have been developed by the Kissimmee Main Street Farmers Market Committee and are subject to change upon review.
