WHEREAS Section 102 of the Municipal Act, R.S.O. 1990, c. M.45, as amended, provides that every council may pass by-laws and make such regulations for the health, safety, morality and welfare of the inhabitants of the municipality in matters not specifically provided for by the Municipal Act as may be deemed expedient and are not contrary to law; AND WHEREAS Sections 178 and 185 of the Highway Trdi5c Act, R.S.O. 1990, c. H.8, as amended, set out specific rules for the operation of bicycles and motor assisted vehicles on a highway; AND WHEREAS the Council of the Corporation of the County of Prince Edward deems it necessary to restrict the use of skateboards, inline skates and bicycles on certain sidewalks, intersections and highways within the boundaries of the County of Prince Edward; AND WHEREAS the Council of the Corporation of the County of Prince Edward has dedicated funds for a skateboarding area upon the grounds of the Prince Edward Community Centre; AND WHEREAS the safety and welfare of pedestrims on sidewalks with the County of Prince Edward are deemed by Council to be in jeopardy with the continued use of skateboards, inline skates and bicycles. NOW THEREFORE the Council of the Corporation of the County of Pdnce Edward enacts as follows: DEFINITIONS (b) (c) (d) (e) (f) "Bicycle" includes a tricycle and a unicycle, but does not include a motor assisted bicycle utilized by a person with a physical defect or disability. "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle within the County of Prince Edward designed and intended, or used by the general public, for the passage of vehicles. "Inline Skates" includes all footwear with wheels attached. "Intersection" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other. "Queen's Highway" includes the secondary highways and tertiary roads designated under The Public Transportation and Highway Improvement Act. "Motor assisted bicycle" means a bicycle, (1) fitted with pedals which are operable at all times to propel the bicycle; (2) weighing not more than 54.5 kilos (120 pounds); (3) which has no hand or foot operated clutch or gearbox driven by the motor and transferring power to the driven wheel; (4) having an attached motor driven by electricity or having a piston displacement of not more than fifty cubic centimetres; and (5) which does not have sufficient power to enable the bicycle to attain a speed greater than 50 kilornctres per hour on level ground within a distance of 2 kilometres from a standing start.

(h) (i) (i) "Sidewalk" means an area intended specifically for pedestrians. "Skateboard" means a board with wheels attached. "Wheelchair" means a chair mounted on wheels driven by muscular or any other kind of power used for the carriage of a person having a physical defect or disability. GENERAL 1. No person upon inline skates, skateboards or similar devices shall go upon any highway withii Ward 1 (Picton), County of Prince Edward. 2. No person upon inline skates, skateboards or similar devices shall go upon any sidewalk on Main Street from the intersection of Bridge Street and Main Street (top of the Town Hill) to the intersection of Main Street and Lake Street and Talbot Street within Ward 1 (Picton), County ofprince Edward. 3. No person upon in line skates, skateboards or similar devices shall enter the intersections in Ward 1 (Picton), County of Prince Edward, listed hereunder: @) intersection of Main Street and Bridge Street; intersection of Main Street and Lake Street and Talbot Street. 4. No person upon inline skates, skateboards or similar devices shall enter upon the following municipal propem within Ward 1 (Picton), County of Prince Edward: @) (c) (d) the Market Square Market Lane parking area Mary Street free parking lot Shire Hall parking area 5. No person shall ride or permit any child in his or her custody or care to ride a bicycle or tricycle with one or more wheels more than 0.5 metres in diameter upon a sidewalk. 6. No person shall ride or permit any child in his or her custody or care to ride a bicycle or tricycle upon a sidewalk or highway in such a manner as to interfere with other persons using the said sidewalk or highway. 7. Every person who contravenes any of the provisions of this by-law is guilty of an offence and upon conviction is liable to a fine of not more than $2,000.00, exclusive of costs, recoverable under the Provincial Offences Act. 8. All by-laws or parts of by-laws of the former ten municipalities relating to restrictions upon the use of skateboards, inline skates and bicycles inconsistent with this by-law are rescinded with the passing of this by-law. READ a first, second and third time and finally passed this xth day of September, 1998.
