The terms and conditions of this contract are as follows: I. The stallion fee includes a non-refundable booking fee of $200, payable with this contract. Mare care, veterinary fees, semen container deposit and container shipping fees are additional and discussed later in this contract. The remaining balance will be due in full before the semen will be shipped. II. This contract is not transferable. In the event that the mare is sold, the fee shall immediately become due and payable and no refund will be due under any circumstances. III. It is agreed that should the stallion herein named die, be sold by the owner, or become unfit for service before serving the herein named mare, or, if the mare dies or becomes unfit for breeding, then this contract is and shall become null and void. LIVE COVER IV. Mare owner certifies by signing this document that the mare is healthy and in sound breeding condition. Upon arrival, all mares shall be accompanied by a health certificate indicating a current Coggins test (less that one year old), negative uterine culture and current vaccination record. Rebecca McGregor reserves the right to refuse to breed any mare who might be detrimental to the health and welfare of the stallion or those people attending the stallion. V. Mare owner agrees to allow a qualified veterinarian check the mare for normal breeding conditions, and to perform such other veterinary services that are deemed necessary to the proper treatment and protection of the mare. This is to be at the mare owner's expense and will be billed and paid prior to mare's departure. VI. The Mare Owner shall NOT be responsible for the injury, death, or illness of the stallion or of any of the Breeder's other horses when the mare is on the farm. In recognition of the risks inherent in breeding operations, the Breeder agrees to perform his services in the usual and customary fashion, but shall NOT be responsible for any sickness, disease, theft, death or injury which may be suffered by the mare and/or foal. This includes, but is not limited to, any personal injury or disability which the Mare Owner may receive while at Top Notch Equestrian Centre. The Mare Owner fully understands that Rebecca McGregor, Rebedon Farm and Top Notch Equestrian Centre does not cover any outside horses that are in their possession for breeding and boarding on any public liability, accidental injury, theft or equine mortality insurance and that all risks connected with breeding and boarding of the mare are to be borne by the Mare Owner. The Mare Owner shall assume all responsibility for the condition of the mare and shall assume risk of loss or damage to the mare whether by death, disease, injury, infection or otherwise, and by any cause whatsoever, and therefore agrees to hold Rebecca McGregor (or any person employed by or associated with Rebedon Farm or Top Notch Equestrian Centre) harmless for any and all damages associated therewith.
VII Required Testing: In the event the mare should be boarded with the Breeder for a period of less than 45 days, the Mare Owner agrees to provide the Breeder with evidence of: (a) a pregnancy test performed by a licensed veterinarian between the 18th and 20th day following the mare's last day of contact with the stallion; and, (b) a pregnancy test performed by a licensed veterinarian between the 40th and 45th day following the mare's last day of contact with the stallion. Certified results of said tests are to be delivered to the Breeder within 48 hours of each of said tests. The Mare Owner agrees to be responsible for the payment of all expenses and fees associated with such testing and to hold the Breeder, its officers, agents and employees harmless therefrom. VIII. This contract guarantees a return service privilege in the same year for the same mare to the same stallion if the mare is examined by a veterinarian and found to be barren at 60 days (or earlier) from the date of last service. If after three covered heat cycles the mare does not conceive, the mare owner may substitute another mare. Should the mare not produce a live foal that stands, nurses, lives for 48 hours, the mare owner shall be entitled to a return services for the same mare or another mare to the same stallion in the 2012 breeding year. This guarantee shall apply only if Rebecca McGregor is notified by certified mail within 10 days of the death of the foal. A statement of details by a veterinarian must follow within 10 days or the guarantee becomes null and void. This clause is also binding in the case of abortion. IX. Mares that are not halter broken will not be accepted. It is requested that mares arrive at the farm unshod or hind shoes will be removed at mare owners expense. X. Board per day for the mare is Ten Dollars ($20.00) or Fifteen Dollars ($30.00) with a foal at foot. Full payment of board is due before the mare leaves Top Notch Equestrian Center premises. Current negative Coggins must be received prior to arrival to Top Notch Equestrian Centre. XI. Services to perform artificial insemination, if required or desired, will be provided. The Mare Owner agrees to be responsible for the payment of all expenses associated with artificial insemination and to hold the Breeder, its officers, agents and employees harmless therefrom. TRANSPORTED SEMEN XI. Mare owner shall submit a veterinary health certificate and current negative uterine culture showing the mare to be in sound breeding condition and certified free of infection. This is a condition of this service and it must be received before semen is shipped.
XII. The insemination shall be executed by a licensed veterinarian on the day of delivery of the semen or the Mare Owner shall not be considered to have fulfilled the contractual obligations herein and all privileges and guarantees in this contract shall consequently not apply. Rebecca McGregor assumes responsibility for the viable condition of semen only to the time of shipment to the Mare Owner. It is recommended that the Mare be ultrasounded at approximately 15 days after insemination. Should the mare require more than one shipment of semen, a collection and processing fee of $270 plus shipping fees per collection shall apply. Twenty-four hour notice is mandatory for collection or semen will not be shipped. XIII. A container deposit of Forty Dollars ($40.00) is due before delivery of semen. If the container is returned within five (5) days the Forty Dollars ($40.00) will be returned to mare owner. Shipping fees are the responsibility ofthe mare owner. This contract constitutes the entire agreement between parties hereto, and may only be modified by written agreement of all parties. This contract shall not be assigned or transferred by either party hereto without written consent of all parties. To become valid and binding, this contract (executed in duplicate) must be signed by both parties and the original on file with Rebecca McGregor. Shipment is to be used on designated mare ONLY. It is the mare owner's responsibility to be following mare's

Please plan ahead. Rebecca Poff and clients attend many shows during the breeding season; we will do our best to get the shipment to you pending our show schedule. This is why communication and notification of your mare's cycle is so important. Breeding season runs from February 1 to July 15. We will not be shipping on show dates. Please call for info.
