A. General provisions Art. 1 Organization 1.1 The issue and organization of Totogoal bets is governed by the Federal Act on Lotteries and Commercial Gambling of 8 June 1923, the Implementing Ordinance of 27 May 1924 to this Act, and the corresponding intercantonal and cantonal lottery regulations. 1.2 Swisslos, a cooperative domiciled in Basel, organizes Totogoal bets in the territory of German-speaking Switzerland 1, Ticino and the Principality of Liechtenstein (collectively the Swisslos Contract Territory ) in accordance with the present Totogoal Terms and Rules. 1.3 While so doing, Swisslos works with the Société de la Loterie de la Suisse Romande ( Loterie Romande or LoRo ), which organizes Totogoal bets in the territory of French-speaking Switzerland 2 (the LoRo Contract Territory ) according to its own Terms and Rules, with Totogoal bets organized in a common pool This means that stakes wagered in the Swisslos Contract Territory are pooled with those wagered in the LoRo Contract Territory, that with regard to both Contract Territories the matches selected for Totogoal bets are chosen jointly, and that winnings are also determined on a joint basis. Consequently, specific organizational modalities are defined by Swisslos in consultation with Loterie Romande, including in particular the closing time for placing and accepting bets. In all other respects, both Swisslos and Loterie Romande run Totogoal bets autonomously in their respective Contract Territories, for own account, at their own risk and for their own profit, each relying on their own technical and administrative infrastructure. 1.4 The common characteristics of the Totogoal bets organized in both the Swisslos Contract Territory and the LoRo Contract Territory are guaranteed by the fact that both the present Totogoal Terms and Rules as well as the Totogoal betting Terms and Rules issued by Loterie Romande are based on the same uniform regulations. 1.5 Totogoal bets as defined in the present Totogoal Terms and Rules are placed via the online system (including the Internet Gaming Platform [Internet]) made available by Swisslos. Subject to issuance of the necessary licences, Swisslos reserves the right to offer other options for participating in Totogoal bets. 1.6 The present Totogoal Terms and Rules supplement the provisions governing the playing of Swisslos products via sales outlets and via Internet/mobile device. 1 ZH, BE, LU, UR, SZ, OW, NW, GL, ZG, SO, BS, BL, SH, AI, AR, SG, GR, AG, TG 2 FR, VD, VS, NE, GE, JU 3
B. The nature of Totogoal bets Art. 2 The nature of Totogoal bets Totogoal bets are played on a totalizator system based on 14 matches. Players have to predict the outcome (home win = 1, draw = X, away win = 2) of matches 1 to 13 selected for the Totogoal bet and indicated on the free information sheet available at sales outlets. Additionally, they have to predict the result (0, 1, 2, 3, 4+ to 0, 1, 2, 3, 4+) of match 14 (also referred to as R ). C. Participation Art. 3 General remarks Players take part in a Totogoal bet using physical and electronic play slips (documents with data carrier function) issued by Swisslos on which players can indicate their own predictions, or quick picks produced by Swisslos on a random generator. Players can choose between individual picks and system plays (combination with two-way and three-way predictions). Art. 4 Play slips / quick picks 4.1 Individual picks The play slips contain grids with a triple column for predicting the outcome of matches 1 to 13 (home win, draw or away win) as well as a double column for predicting the result of match 14 (R) by entering 0, 1, 2, 3, 4+ to 0, 1, 2, 3, 4+ in the relevant fields. The match numbers printed on the play slips correspond to the numbers listed in the official betting programmes. Only one prediction is permitted per match outcome or result. 4.2 System plays Swisslos issues special play slips that enable players to make system plays with full combinations in simplified form. Only the full variation system picks printed on the play slip are permitted. Field 1 contains the grids with a triple column for predicting the outcome of matches 1 to 13 (home win, draw, or away win) and a double column for predicting the result of match 14 (R) by entering 0, 1, 2, 3, 4+ to 0, 1, 2, 3, 4+ in the relevant fields. By marking the corresponding boxes, players can make two picks (two-way predictions: 1 and X, 1 and 2 or X and 2 ) for up to 11 matches and three picks (three-way predictions: all three possible outcomes) for up to 6 matches. The number of combinations of two-way and three-way predictions is limited, however. Field 2 contains the matrix of permitted combinations of two-way and threeway predictions together with the corresponding stakes. Field 3 contains 4 grids for making additional predictions of the result of match 14 (R) by entering 0, 1, 2, 3, 4+ to 0, 1, 2, 3, 4+ in the relevant fields. 4
Detailed information can be found in the Totogoal system brochure. 4.3 Quick pick Players can also opt to play by making a quick pick instead of using the play slip. Quick picks are predictions produced at the Swisslos data processing centre via a random generator on the basis of the player s instructions stipulating the stake, the number of quick picks required and, where applicable, the system number. These picks are recorded at the data processing centre, stored there and then transmitted to the online terminal or via Internet/mobile device without any need to fill out a play slip. In principle, the same picks can be made using the quick pick option as are available on the play slips. 4.4 Subscription plays Subscription plays are only permitted via an ISP. Players with a Totogoal Abo Fix subscription can select between two and ten bets that they wish to participate in. Players with a Totogoal Abo Nonstop subscription can play for as long as they have a sufficient balance or until the subscription is cancelled. Subscription players may only use the quick pick option. Art. 5 Conclusion of a contract Participation in Totogoal bets in accordance with the present Terms and Rules is open only to persons who conclude a corresponding Gaming Contract with Swisslos. In concluding a Gaming Contract with Swisslos, the player recognizes unreservedly the present Totogoal Terms and Rules, including any addendums, as well as the Terms and Rules of the sales channel chosen (sales outlet or Internet/ mobile device). Art. 6 Stake 6.1 The minimum stake on a play slip is CHF 3.00 for the first level (i.e. 2 grids), regardless of whether a play slip is used to play or the quick pick option is chosen. Each further level (of 2 grids) costs an additional CHF 3.00. The stakes for system plays are shown on the play slips. Additional predictions of the result of match 14 (R) multiply the stake accordingly (by a maximum of five times). Furthermore, in the case of plays under a Totogoal Abo Fix subscription, the subscription period selected by the player, i.e. the number of bets selected by the player, has to be factored in. 6.2 Each grid counts as a single play, to be assessed separately. Art. 7 Deadline The deadline for submitting play slips and quick picks, i.e. the closing time for accepting Totogoal bets, is set by Swisslos in consultation with Loterie Romande (see Art. 1.3) and announced via the sales outlets in the Swisslos Contract Territory as well as via the electronic information channels used by Swisslos (online terminal, Internet). after the closing time and, accordingly, no Gaming Contract is concluded. D. Treatment of data Art. 8 Collection and storage of data 8.1 After the data on the play slips has been read in at an online terminal or entered via Internet/mobile device, it is transmitted to Swisslos; quick picks are generated at the Swisslos data processing centre after the relevant instructions have been transmitted by the sales outlet or via Internet/mobile device. All data is recorded at the data processing centre for evaluation purposes and stored and secured on a suitable medium protected with physical or digital safeguards. 8.2 If for any reason the data cannot be correctly forwarded to or stored at Swisslos such as to allow holders of a prizewinning ticket to claim their prize, or if for any reason a fundamentally valid winning ticket or confirmation of a valid prize claim cannot be honoured on presentation, the liability borne by Swisslos shall be limited to reimbursement of the players stake, excluding all other compensation to be provided by Swisslos, its representatives or agents, or the manager of a sales outlet. The stake will be reimbursed on condition that the player furnishes proof that the corresponding play slip or quick picks were duly submitted and the stake paid. No reimbursement or replacement will be provided if a ticket has been tampered with in any way. E. Determining the definitive results / Evaluation Art. 9 Determining the definitive results and match postponements / Evaluation 9.1 TIn terms of assessing which is the correct prediction, the result at the end of regular playing time or at the end of the playing time fixed before the start of the game is deemed to be definitive. Any extra time and subsequent result changes decided on the basis of protests or forfeits will not be factored in. 9.2 In principle, only matches played on the date of the Totogoal bet will count for the evaluation. 9.3 A match is deemed postponed if, for whatever reason, it is not played on the date of the bet, it is rescheduled to an earlier or later date or, for any reason, is broken off before the end of the agreed playing time. 9.4 Publicized championship or cup matches played as friendlies will likewise be deemed postponed. 6
9.5 After the closing time (Art. 7) for acceptance of the corresponding Totogoal bet, a replacement outcome is drawn by lot for all postponed games. The draw is made with the aid of a special IT program tested by the competent supervisory body and is binding in respect of entitlement to winnings under the relevant Totogoal bet. 9.6 Totogoal matches which are not played as printed in the betting programme are decided by lot on the basis of the trend observed. The same applies to match 14 (R), for which a separate result trend is ascertained. 9.7 Players are credited with one point for each correct prediction for matches 1 to 13 and for predicting the exact result of match 14 (R). The point for predicting the exact result is counted only if the outcome of all of matches 1 to 13 are correctly predicted. The total of all points earned in one grid determines the ranking (13 correct predictions plus the exact result earn 13 points + R = 14 points, 13 correct predictions earn 13 points, 12 correct predictions earn 12 points, 11 correct predictions earn 11 points, 10 correct predictions earn 10 points). F. Winnings Art. 10 Determination and distribution of prizes 10.1 In principle, 60 percent of Totogoal stakes in both the Swisslos Contract Territory and the LoRo Contract Territory are distributed as winnings to players in the two territories ( total prize payout ). 10.2 Totogoal bet prize categories are as follows: Prize category 1: Prize category 13+R = 14 points (13 correct outcomes for matches 1 to 13 and the exact result of match 14 [R]). If no player achieves 14 points, the winnings in this prize category are rolled over to the same prize category in the next Totogoal bet in which 14 points are earned (jackpot system). Prize category 2: Prize category 13 correct = 13 points (13 correct outcomes for matches 1 to 13). If no player achieves 13 points, the available winnings in this prize category are rolled over in equal parts to the remaining payable lower Totogoal bet prize categories. Prize category 3: Prize category 12 correct = 12 points (12 correct outcomes for matches 1 to 13). If no player achieves 12 points, the available winnings in this prize category are rolled over in equal parts to the remaining payable lower Totogoal bet prize categories. 7
Prize category 4: Prize category 11 correct = 11 points (11 correct outcomes for matches 1 to 13). If no player achieves 11 points, the available winnings in this prize category are rolled over to the remaining payable lower Totogoal bet prize category. Prize category 5: Prize category 10 correct = 10 points (10 correct outcomes for matches 1 to 13). If no player achieves 10 points, the available winnings in this prize category are rolled over to prize category 1 (13 + R, i.e. 14 points) in the next Totogoal bet in which 14 points are earned (jackpot system). 10.3 All players who earned points by entering a specific number of correct predictions in a grid are placed in the corresponding prize category. 10.4 Each grid consisting of a triple column for predictions for matches 1 to 13 and a double column for the prediction for match 14 (R) counts as a single complete pick in terms of the evaluation. 10.5 If only one prizewinning grid is identified in a given prize category, the entire winnings for this prize category are paid out on that grid. 10.6 If several prizewinning grids are identified in a given prize category, the winnings for this prize category are paid out in equal parts on these grids. 10.7 If the prize money per prizewinning grid is lower for a given prize category than for the next lowest prize category, the winnings for the two prize categories are combined and paid out in equal parts on the prizewinning grids in both prize categories. 10.8 Each individual grid which satisfies the specified conditions will entitle the player to a prize, with the proviso that a prize won in a given prize category excludes entitlement to a prize in a lower prize category. 10.9 In accordance with common commercial practice, all prizes are rounded to the nearest 5 cents. 10.10 Prizes of less than CHF 0.10 will not be paid out. The available winnings are rolled over to the next lowest payable prize category (applies to categories two to four) or to prize category 1 in the next Totogoal bet (applies to category five). 10.11 In contrast to Art. 20.2 /1st prize category, when Totogoal ends, any jackpot will be rolled over to the highest prize category in which prizes have been identified. The last Totogoal draw takes place in calendar week 52/2017, on the weekend of 8
the 30 / 31 December 2017. If, in this last draw, no prize is identified in any of the prize categories 1 to 5 defined in the Terms and Rules, Totogoal will be extended until such time as a draw produces a prize in the prize categories 1 to 5. Art. 11 Breakdown of prizes Winnings are spread over prize categories 1 to 5 as follows: Prize category 1, 13+R = 14 points: 50 percent of winnings plus any amount accumulated in the jackpot Prize category 2, 13 points: 20 percent of winnings Prize category 3, 12 points: 10 percent of winnings Prize category 4, 11 points: 10 percent of winnings Prize category 5, 10 points: 10 percent of winnings G. Notification of evaluation / payment of prizes / forfeit of prizes Art. 12 Notification of evaluation 12.1 All information relating to the organization of individual Totogoal bets, in particular exceptional changes in the closing time for accepting bets, is published via the electronic information channels used by Swisslos (Internet, online terminal). 12.2 Public notification of the evaluation of Totogoal bets, i.e. announcement of the winning columns and prize money, is in the form of prize bulletins published by Swisslos. They are generally available as of the Totogoal bet evaluation day (payout release date) usually Monday for a period of 26 weeks at sales outlets in the Swisslos Contract Territory or can be obtained from Swisslos. The date of public notification of the evaluation of Totogoal bets is relevant for calculation of the deadline according to Art. 13. Given that Totogoal bets are placed anonymously, prizewinners cannot be notified in person. Special provisions apply to entries submitted via Internet/mobile device. Art. 13 Conditions for the payment of prizes 13.1 Swisslos is deemed to have met, and been released from, its obligation to pay prizes when it, or a Swisslos sales outlet acting on its behalf, makes payment to the bearer of a valid document evidencing the claim to the prize. 13.2 If, prior to payment of a prize, Swisslos should receive information that entitlement to a document evidencing the claim to said prize has been contested, it is entitled to suspend payment and grant the claimant a deadline by which to assert his or her superior right or prove that the question of 9
entitlement to the document evidencing the claim to the prize warrants court proceedings. Swisslos will make a final decision on the basis of the evidence presented. If the claimant makes the outcome dependent on court proceedings, Swisslos will wait until the court has issued a final and absolute ruling. Art. 14 Forfeit of prizes Prizes which are not claimed within 26 weeks of the date of public notification of the outcome of the Totogoal bet (Art. 12.2) are forfeited and used for the charitable purpose to which Swisslos contributes. H. Objections Art. 15 Objections 15.1 Players whose alleged prizes were not paid out on their assertion of a claim in accordance with the present Totogoal Terms and Rules may lodge an objection within 10 days of the date of refusal of payment, but by no later than within 26 weeks of the date of public notification of the outcome of the Totogoal bet (Art. 12.2). In the event of bets placed via Internet/mobile device, the period for objection will begin on the date on which due note is taken of non-payment or non-grant. 15.2 The objection must be submitted by registered letter addressed to Swisslos and handed in at an office of Swiss Post by no later than the final day of the period for objection. The objection must include the player s name and address, the designation of the sales outlet or any communication channels or agents used to transfer the data, the number or date of the Totogoal bet in question and of the ticket, as well as the grounds for objection. Moreover, the ticket supporting the claim, or any other documents supporting the claim, must be enclosed. Objections received late or which do not include all the necessary information cannot be considered. 15.3 Solely those predictions which are stored with Swisslos in compliance with the regulatory provisions are relevant for the assessment of entitlement to a prize in accordance with the present Totogoal Terms and Rules. I. Publication medium Art. 16 Publication medium Subject to the provisions under Art. 12.1 and 12.2, all notices from Swisslos as well as additional organizational provisions of a general nature regarding Totogoal bets are published in the Swiss Official Gazette of Commerce as official publication. New organizational provisions are published at least two weeks prior to entry into force. 10
K. Final provisions Art. 17 Operating licences Granted in compliance with the relevant lottery legislation, the licences to issue and operate Totogoal bets in accordance with the present Totogoal Terms and Rules, together with the associated activities, apply solely to Swisslos itself (Art. 1.2). 19.2 Where the English, French or Italian version of the present Terms and Rules deviates from the German version, the German version alone is binding. 19.3 These Terms and Rules are published on www.swisslos.ch or can be obtained from Swisslos, P. O. Box, 4002 Basel. Art. 18 Decisions of the company management All decisions in respect of Totogoal bets are taken by the Swisslos company management. Insofar as these decisions also affect the LoRo Contract Territory, they will be taken in consultation with Loterie Romande. All decisions taken in this manner will be deemed to be decisions of the Swisslos company management. Decisions are final and no correspondence will be entered into. Art. 19 Validity 19.1 The present Totogoal Terms and Rules govern only participation in Totogoal bets in the Swisslos Contract Territory. They enter into force on 1 September 2017. Thereafter, all previous provisions issued governing participation in Totogoal bets are no longer valid. Swisslos reserves the right to amend the present Terms and Rules. 11
