Millbrk Hmewner s Assciatin Bat Owner s Rules and Regulatins These Rules and Regulatins are a cmpilatin f the many cmments and requests f Millbrk s Members and have been carefully structured t create, t the maximum extent pssible, an equal availability f services and amenities and t prmte harmny. By yur gracius agreement t abide by them yu becme ne f ur cnsiderate, understanding and mutually supprtive Membership and entitled t all Member privileges. Administratin All bat wner slips are the prperty f Millbrk Hme Owners Assciatin. A prperty wner is nly a renter f these slips and pssesses n wnership rights, in any r all manner, t the slips in any frm. Millbrk Hme Owners Assciatin has the authrity, in its sle discretin t mve any prperty wner wh is renting a slip fr reasns f necessity at any time t anther slip f its chsing. Only Millbrk prperty wners in gd standing may have use f a bat wner slip. Bat slips are nn-transferable upn sale f a hme r lt. Millbrk s dcks will be remved during the fall wrk weekend. Members shuld have their bat remved befre this time. Millbrk is nt respnsible fr any bat left after the dcks are remved during the fall wrk weekend. Hmewners and/r prperty wners wh have cmmitted t build within six (6) mnths, wh pay their dues, slip buy-in fees in full by the due date (February 1 st ) will maintain their slip privileges and will maintain r btain their slip assignment by March 1 st. Hmewners wh relinquish their slip privileges by failing t remain a hmewner in gd standing (paying their dues and slip fees in full) r by vilating Assciatin rules, d s with the knwledge that t regain slip privileges, they must reapply as called fr in this plicy and the current buy-in fee. On March 1 st - assigned and tentatively assigned slips that have nt been paid in full will be returned t the inventry f slips available fr rental. The Millbrk Dck Master will then assign the remaining pen slips t thse awaiting rental requests. Tentative assignments will be cmmunicated and cnfirmed by Millbrk Hmewner Assciatin receipt f the slip fee by the last Saturday in April therwise the slip will be returned t the inventry f slips available fr rental. Any abandned bat left in the Millbrk Hmewners Assciatin slip after mving frm the cmmunity shall give up any and all rights t the bat wner s dcks. Millbrk Hmewners Assciatin hlds the right, in its sle discretin, t make necessary decisins fr the remval r strage f such bats (with any related csts being billed t the last bat wner) s that current r ptential renters have every pprtunity t rent that water slip. Sunken r partially sunken bats are nt permitted. All such craft are subject t remval frm Millbrk Hme Owner Assciatin dcks at the wner s expense. 1 P a g e

Members must ensure that their children and guests d nt ffend ther peple n the premises r damage any f Millbrk s facilities. Members hereby agree t c-perate with the Millbrk Hmewners Assciatin in the enfrcement f prper behavir and at the request f Millbrk t require their guests r members f their family t leave the premises in the event f any inapprpriate behavir. Members shall be respnsible fr any damage arising frm Member s use, including but nt limited t vessel fire & explsin, imprperly securing Member s bat, cllisin with ther bats r Millbrk Hmewner Assciatin dcks, sinking, r any ther negligent, accidental, r intentinal damage t dcks r ther prperty. Health & Safety Standards Members shall cmply with ALL safety, health, and fire standards. Open flames and barbeques are STRICTLY PROHIBITED anywhere n the dcks and abard Member s vessel while dcked in a Millbrk slip. N vehicles are t be parked r perated n r alng the walkway t the bat dck. The nly exceptin t this PP&L regulatin is wrk weekend There shall be NO swimming NO DIVING r water sprts allwed ANYWHERE inside the dck area. Fishing is nt permitted frm swimming, diving, and bat ramp dcks r in the general beach area. Fishing shall nly be permitted frm bat slip dcks n weekdays. N Sun bathing shall be permitted n the bat ramp dcks. Children under the age f 10 are nt permitted n the bat dcks withut adult supervisin. Yuths under the age f 18 are nt permitted n the bat dcks withut adult supervisin after dusk. Members will at ALL TIMES cmply with N Wake znes and buy markers. N Wakes Within 100 Feet f the dck area. N Litering r Hrseplay Allwed n the dcks. N Bat Mring at the Ends f the Dcks. Members shall cmply with all Pennsylvania State Laws including Envirnmental Laws. 2 P a g e
Millbrk Hmewner s Assciatin Bat Owner s Rules and Regulatins Vessels with bathrm facilities must have a Black Water hlding tank. Black Water discharge int the lake is prhibited. Washing bats such that nn-envirnmentally friendly sap, detergents, cleaners, slvents r ther chemicals being discharged int the lake r anywhere n-shre upn premises is prhibited. Persnal Prperty Persnal prperty f any kind may nt be stred anywhere n slips, dcks, walkways areas. Members shall remve ALL garbage, trash and waste in the prper and healthful fashin and keep their bat clean and free f unsightly debris at all times. Upn terminatin f the slip rental fr any reasn Members are respnsible fr remving all persnal prperty frm dcks. Any items nt remved at time f terminatin shall be deemed abandned and shall becme prperty f Millbrk Hme Owners Assciatin. Anyne Caught Tampering with the Bats r Dcks Will Be Prsecuted. Alteratin t Dck Structure Members are prhibited frm making any additins, imprvements r mdificatins f any kind t slips, dcks r walkways withut the express prir written permissin f Millbrk Hmewners Assciatin. Only exceptins t this rule are the items listed in the Securing yur Bat sectin. Securing yur Bat Yu are required t install prtective guarding n the dcks at all lcatins where the bat may cme in direct cntact and/r secure yur bat in a manner in which the bat remains as far back as pssible as t nt cme in cntact with the dck. Rpe used t secure bats must be ½ r larger and f n less quality than duble gld braid. All bats shall have a minimum f tw (2) lines tied frm the bat t the dck. One shall keep the bw and the ther shall keep the stern f the bat frm making cntact with the dck. It is the respnsibility f Member t prperly secure their bat at all times. All prtective bumpers and any hardware r items attached t the dcks shuld be remved at the end f the bating seasn. Millbrk is nt respnsible fr any damage r theft f any hardware frm yur slip. If yu d nt remve yur hardware yu leave such items at yur wn risk. Styrfam, fire hses r tires May Nt Be Used. 3 P a g e
Millbrk Hmewner s Assciatin Bat Owner s Rules and Regulatins Trailer Strage Bat trailers are ONLY t be parked in the assigned trailer area f the parking lt. Trailers may nt t be stred vernight r n a cntinual basis in the parking lt. Requirements, Limitatins and Restrictins f Occupancy Strage is limited t ne bat per slip r space, and is nly fr the strage f the bat identified in the Member s rental cntract. A change f bat being stred and/r change in bat wnership requires IMMEDIATE ntificatin t Millbrk Hmewners Assciatin and executin f any new dcumentatin required by Millbrk s dck master. A current cpy f the bat registratin and Millbrk Hmewners infrmatin frms are required befre the watercraft is dcked in a Millbrk Hmewners Assciatin slip. Due t the amunt f water space between the slip fingers, yur watercraft cannt exceed twenty-five (25) feet in length, and/r eight and 1/2 (8-½) feet in width. Due t the design and specificatins f the dcks and slip fingers, yur watercraft cannt exceed eight thusand five hundred (8,500) lbs. in grss weight f the vessel. Member acknwledges that Millbrk Hme Owners Assciatin reserves the right t withhld this privilege if Millbrk s Dck Master decides it cannt reasnably and safely accmmdate the watercraft in the slip fr any reasn. Member s bat MUST ccupy Member s cntractually assigned slip AT ALL TIMES. Member IS NOT ENTITLED t place THAT SAME BOAT in ANY OTHER slip withut infrming and receiving the apprval f Millbrk s Dck Master in advance, and executing any dcumentatin required at the sle discretin f Millbrk s Dck Master. Only the watercraft which is registered with Millbrk Hmewners Assciatin is the nly bat permitted in that slip. If yu are purchasing a new bat r yu will be using a different bat besides yur wn, the Millbrk Dck Master must be ntified f the change in advance. Each slip is limited t ne Member Primary Cntact fr receipt f ALL cmmunicatins frm Millbrk Hmewners Assciatin. It is the respnsibility f the Member Primary Cntact t relay ANY cmmunicatin frm ALL ther accunt participants. Only Member s immediate family living in the same husehld may have use f the slip. Members cannt lend r brrw their slip t anyne. N Member, Guest r any f the bating public is entitled t take ccupancy f ANY unccupied slip fr bat parking, including behind a slipped bat, fr hwever brief a perid. Member agrees that Millbrk may, at its sle discretin and withut prir ntificatin t and/r apprval f Member, enter upn Member s bat and if necessary mve Member s bat in cases f emergency, threat t prperty r public safety. 4 P a g e
Millbrk Hmewner s Assciatin Bat Owner s Rules and Regulatins Rental Slip Requirements, Limitatins and Restrictins f Occupancy Any persn(s) wh rent(s) a Millbrk Hmewners Assciatin MUST cmply with all Millbrk Hmewners Assciatin Bat Owners Rules and Regulatins. Millbrk prperty wners must request a rental slip in writing and send the request and cmmensurate slip rental fee t Millbrk Hmewners Assciatin, P.O. Bx 37, Greentwn PA 18426-0037. All request will be dated n the date f receipt and added t ne f tw waiting list: The first waiting list will be fr an existing hmewner that is requesting their first slip. The secnd waiting list will be fr an existing hmewner requesting a secnd slip. A first slip fr a lt wner will be added t the secnd slip waiting list. Requests that are submitted n the same date will be handled in the fllwing manner: The first waiting list will manage each request fr the riginal date submitted, the first waiting list request will rll frm year t year until the request is cmpleted. The secnd waiting list request will need t be submitted fr each bating seasn. The request will be handled by the senirity f the request. The senirity f the request means the date that it has been submitted and the amunt f times a secnd slip request has been cntinuusly submitted fr each bating seasn. When a slip becmes available, the Millbrk Dck Master will ntify the first persn n the waiting list. The prperty wner will have a grace perid f ten (10) days t respnd t the ffer f the available slip. If there is n respnse, the slip will be ffered t the next persn n the waiting list. Shuld a member neglect t respnd r yu decline this ffer fr 2 cnsecutive years, that member will be cnsidered inactive n the list and will n lnger be ffered a slip withut anther written request. All slip renters are financially respnsible fr any damage caused by their bat. A hmewner can sublet their slip by ntifying the Millbrk Dck Master f the request, all sublet fees will be paid t Millbrk Hmewners Assciatin nly. Millbrk Hmewners Assciatin will reimburse the hmewner requesting t sublet their rental fee nly after the slip has been rented. A hmewner may sublet their slip withut penalty fr tw cnsecutive years, if the hmewner request t sublet their slip fr a third year and there is a waiting list fr hmewners requesting a first slip, the hmewner requesting t sublet their slip will autmatically lse their slip and the initial buy in fee will be reimbursed. All rentals shall be charged the full yearly rent amunt. 5 P a g e
