HILLCREST SKI & SNOWBOARD CLUB 2018 The Club will go to Mohawk Mountain On the Friday Evenings of January 5 th; 19 th & 26 th Snow date: February 2 This packet Is DUE no later than Wednesday, November 10 2017 fivesatins@hotmail.com

We are planning to take three (3) Friday trips to Mohawk Mountain in Cornwall, CT. If you wish to check out the mountain you may view it online at www.mohawkmtn.com In order for your child to attend, you will need to complete all the paperwork included in this packet and return it to school with the appropriate payment no later than Friday, Nov. 10, 2017. The Ski Club can be no larger than 150 members (approximately 50 from each grade) each trip, so please make sure you take the time to complete the paperwork correctly and hand it in AS SOON AS POSSIBLE. We do date stamp the paperwork EACH day during collection to avoid any discrepancies about when your child actually handed the paperwork in. If a bus fills up prior to the deadline available seating will be determined based on a first come first serve basis and your child may be bumped to another grade level bus. We will leave Hillcrest directly after dismissal on coach buses and will ski until approximately 8:45 pm. We will return to school around 10:15 pm. Your children are notified about 15 minutes out to give you a call for pick up. Please understand that there can be NO ONE-WAY bus riding. All Ski Club members must ride to and from the mountain on the Hillcrest bus he/she is assigned to unless prior arrangements have been made. All Ski Club equipment MUST be labeled and transported to Hillcrest by a parent the afternoon of each trip. Ski equipment is NOT allowed to be brought on the regular school bus. Drop off of all equipment will be in the REAR of the school between 1:45 pm 2:30 pm. Equipment will be directly loaded onto your child s bus by you after checking in with a parent volunteer. Please note that Hillcrest Middle School, the Trumbull Board of Education &/or the club volunteers are not responsible for any lost or stolen items. Please note that we cannot run this club without the help of parent chaperones. Please consider chaperoning! General Club Information We will hold the following date as a backup ski day should we need to cancel any of our pre-set dates: February 2 rd. We will not refund any monies if you cannot make these trip dates. Should you not be able to attend a club trip that you are signed up to attend including makeup date; you may not transfer, swap &/or sell your spot unless such a transaction is approved for at least 7 calendar days in advance of said trip by a Club Chair and such approval will be granted provided that the replacing person is already an eligible, waitlisted HMS Club Member with all of their paperwork completed. There are no refunds or credits for trips that your child is unable to attend for any reason.. Ski Club will automatically be cancelled if there is a Trumbull Public School announced snow day or an early dismissal. Ski Club will go on as scheduled if there is a Trumbull Public School delayed opening. Should we need to cancel Ski Club due to anticipated severe temperatures or weather, we will send out an E-blast notification If you are chaperoning, please do your best to be behind Hillcrest School on your scheduled date by 1:30 pm. We will have at least two teacher chaperones per bus for each trip. We will need 1 to 2 parent chaperones per bus as well. If some emergency arises and you absolutely cannot make the trip you signed up to chaperone, please text Nikki (203-455-4915) right away as we will need to try and schedule an alternate chaperone. If your child does not follow the RULES set forth by the Ski Club, the bus company, or the mountain, please be aware that your child will be removed from the Ski Club with no refund. You will be notified of any action taken by the school

Please note that all ski club correspondence will come via the PTA e- Blast email server. Please read carefully EMAIL NOTIFICATION Instructions on page 10. Our busses will leave HMS promptly at 2:45 we cannot wait beyond this time for parents dropping off equipment and we won t leave club children at Hillcrest. In the event you miss the bus we encourage you to meet us at the Mountain with their equipment so that your child will be able to ski. The lodge can get crowded so the children are required to check in all their belongings before skiing/boarding. They will receive a tag from the chaperones which they will label and place on their bags. They are also required to label their belongings prior to the trip and to not bring any valuables. Money for the canteen should be kept on the child s person so they don t need to uncheck and recheck their bag. The ski school requires that children, who wish to take lessons, do so consecutively, so that the group in which they are placed progresses at the same rate. If you wish to sign up for fewer than three lessons, the ski school asks that you select your dates consecutively, starting on the date of the first trip. If your child s first trip is the second or third club trip it may not be possible to accommodate lessons for them. There is a mid mountain restaurant with table service. We discourage club members from eating at this restaurant without adult supervision for a variety of reasons including calculating and the tipping of the wait staff. Please discuss this rule with your children. *********************NOTE*********************** Helmets are REQUIRED to ski/snowboard. NO ONE will be permitted on the slopes without one. If your child does not own one, please make sure to rent one.

Rules & Safety Agreement HMS Ski Club at Mohawk Mountain Family Name: Mohawk Mountain believes that all skiers and boarders have the right to a safe and pleasant place to ski. Equally each skier and boarder has the responsibility to protect others rights to the same skiing/boarding environment. Therefore, the Management, the Rangers, the Ski Patrol and Ski School Instructors are authorized to rescind the skiing privileges of anyone who creates a nuisance or endangers themselves or others. Chaperones Needed!! Parents we need your help. We MUST have an adequate number of chaperones per trip in order to ensure the safety of the students. You don t have to ski to chaperone. If you choose to ski, you will be provided with a FREE PASS, compliments of the mountain. Chaperones need to be at Hillcrest by 1:35 pm to help with the loading of ski equipment, and attendance to and from the mountain. To provide as many seats as possible to our children there are a limited number of parent chaperone seats available on each bus if you are not selected to chaperone, we encourage you to drive up to the mountain and meet us. In addition we need one parent to drive ahead of the busses to pick up lift tickets, to reserve tables and to meet the busses upon our arrival to distribute tickets. (the Facility ), the participant, or his/her parent(s) or legal guardian(s), (collectively the Participant ), for himself/herself and on behalf of his/her heirs, assigns, personal representatives and next of kin, does hereby agree to the following: a) TO WAIVE ALL CLAIMS that Participant has or may have against the Facility arising out of the inherent risks of participating in the Activities; b) TO ASSUME ALL RISKS INHERENT IN PARTICIPATING IN THE ACTIVITIES; and c) TO RELEASE the Facility, its owners, affiliates, officers, directors, employees, agents, and shareholders, from all liability for any loss, damage, injury, or expense that the Participant (or his/her next of kin) may suffer, arising out of the inherent risks of participation in the Activities, which inherent risks include, but are not limited to, the instruction (related to both skiing and use of ski lifts) received while participating in the Activities. d) Participant hereby grants to the Facility, its representatives, and employees the right to take photographs of Participant in connection with Participant s use of the Facility. Participant hereby authorizes the Facility to copyright, use, and publish the same in print and/or electronically. Participant hereby agrees that the Facility may use such photographs of Participant for any lawful purpose, including but not limited to publicity, illustration, advertising, and Web content. The Participant acknowledges and agrees that the inherent risks of participating in the Activities are in addition to those referenced in Connecticut General Statutes 29-212. The Participant also acknowledges that this agreement does not, in any way, change the rights or obligations of the Facility or the Participant, as set forth in Connecticut General Statutes 29-211, et. seq., other than as set forth in this agreement. Participant, and his/her parent(s)/legal guardian(s) if Participant is a minor, hereby agrees to submit any dispute arising from this Agreement and/or Participant s use of the Facility to binding arbitration. For such disputes, there shall be a three-member arbitration panel, consisting of two party-appointed arbitrators (one arbitrator to be appointed by each party) and one neutral arbitrator (collectively, the Panel ), to be chosen by the party-appointed arbitrators. In the event that the two partyappointed arbitrators are not able to agree on a third, neutral arbitrator, the neutral arbitrator shall be appointed by the United States District Court, for the District of Connecticut. Each party shall pay its own costs, including the costs associated with the party-appointed arbitrators, and the parties shall share equally the costs associated with the neutral arbitrator. The arbitration proceeding shall proceed in West Hartford, Connecticut, and shall be governed by the Federal Rules of Evidence. The Panel shall establish a reasonable and appropriate discovery schedule to expeditiously resolve this matter. If the dispute arises from a personal injury or death, the first phase of the arbitration shall be to determine whether said injury or death arose from a hazard/risk inherent in the sport of skiing. In the event that the Panel determines the alleged injury/death arose from a hazard/risk inherent in the sport of skiing, the claim shall be deemed barred, as a matter of law, and the Participant, and/or his/her parent(s)/legal guardian(s), shall be barred from recovering any compensation from Mohawk. In the event that the Panel determines the alleged injury did not arise from a hazard/risk inherent in the sport of skiing, the Panel may, at its discretion, allow for additional discovery and evidence, and then it shall decide any remaining issues on the merits. I hereby agree to the fullest extent permitted by law, as follows: 1)TO WAIVE ALL CLAIMS that I have or may have against Mohawk and all manufacturers and distributors of the equipment, caused by the use of this equipment and/or the inherent hazards/risks of the sport of skiing, as defined in Conn. Gen. Stat. 29-211, et seq.; 2)TO ASSUME ALL HAZARDS/RISKS INHERENT IN SKIING; 3)TO RELEASE Mohawk and all manufacturers and distributors of the equipment, from all liability for any loss, damage, injury, or expense I (or my next of kin) may suffer, caused by the use of the equipment and/or the inherent hazards/risks of the sport of skiing; 4)I FURTHER AGREE TO INDEMNIFY and hold harmless Mohawk and the manufacturers and distributors of the equipment for any loss or damage including any that results from claims or lawsuits for personal injury, death, or property loss and

Arbitration I hereby agree to submit all claims against the manufacturers or distributors of the rental equipment rented and/or used by me at Mohawk to binding arbitration. I further agree to submit any other dispute with Mohawk, which arises from use of the equipment and/or skiing at Mohawk Mountain Ski Area, Inc. to binding arbitration. For any dispute submitted to binding arbitration pursuant to this agreement, there shall be a three-member arbitration panel, consisting of two party-appointed arbitrators (one arbitrator to be appointed by each party) and one neutral arbitrator (collectively, the Panel ), to be chosen by the party-appointed arbitrators. In the event that the two party-appointed arbitrators are not able to agree on a third, neutral arbitrator, the neutral arbitrator shall be appointed by the United States District Court, for the District of Connecticut. Each party shall pay its own costs, including the costs associated with the party-appointed arbitrators, and the parties shall share equally the costs associated with the neutral arbitrator. The arbitration proceeding shall proceed in West Hartford, Connecticut and shall be governed by the Federal Rules of Evidence. The Panel shall establish a reasonable and appropriate discovery schedule to expeditiously resolve this matter. With regard to disputes between me and Mohawk, if the dispute arises from a personal injury or death, the first phase of the arbitration shall be to determine whether said injury or death arose from a hazard/risk inherent in skiing. In the event that the Panel determines the alleged injury/death arose from a hazard/risk inherent in skiing, the claim shall be deemed barred, as a matter of law, and the Participant shall be barred from recovering any compensation from Mohawk. In the event that the Panel determines the alleged injury did not arise from a hazard/risk inherent in skiing, the Panel may, at its discretion, allow for additional discovery and evidence, and then it shall decide any remaining issues on the merits. GENERAL TERMS Daily rentals end at the close of business on the date that the equipment is rented. All equipment rented on a daily basis must be returned to Mohawk on the same date. Seasonal rental equipment must be returned to Mohawk by no later than May 1, 20178. For any equipment returned after May 1, 20178, a Late Fee of $10.00 per week, per piece of equipment, shall be assessed. Mohawk reserves all rights to commence legal action to recover any and all rental equipment that is not returned in a timely manner, or to recover damages for equipment returned in broken or damaged condition (not including normal wear and tear), including reasonable attorneys fees incurred in any action to recover same. THIS DOCUMENT IS A LEGALLY BINDING CONTRACT which supersedes any other agreements or representations by or between the parties. It shall be interpreted to provide as broad and inclusive a release of liability as is legally possible, but is not intended to assert any claims or defenses which are prohibited by law. If any part of this agreement is deemed void or unenforceable, the remainder shall be given full force and effect. The specific rights of the parties under this contract may vary from state to state.
