AMG Customer Sports Championship 2015/2016 TERMS OF PARTICIPATION Section 1 Fundamentals of the AMG Customer Sports Championship (1) The AMG Customer Sports Championship is a competition organized by ('M-AMG'). All drivers and teams who race AMG customer sport SLS AMG GT3 and Mercedes-AMG GT3 vehicles in national and international motor races and/or racing series during the classification period stated in the terms of participation, are eligible to enter. PRO DRIVERS, DRIVERS and TEAMS, collectively referred to below as 'Participants' may participate in the Championship. (2) Drivers who are members of the M-AMG Driver Pool, M-AMG works drivers, and brand ambassadors of Daimler AG and of M-AMG are prohibited from participating in the driver classification of the AMG Customer Sports Championship. However, they will be included in the classification list with an indication that they belong to the above categories. If a team books an M-AMG pool driver, an M-AMG works driver, or a brand ambassador of Daimler AG or of M-AMG, all the team points scored will be credited in full to the team's account. (3) The prizes are awarded by M-AMG. M-AMG also deals with general questions about the AMG Customer Sports Championship and with all aspects of the rules of the AMG Customer Sports Championship.
Section 2 Driver Categorization (1) The AMG Customer Sports Championship distinguishes between PRO DRIVERS and DRIVERS. M-AMG categorizes the Participants. If any Participant does not agree with M-AMG's classification, they may seek a correction by submitting their official FIA driver categorization. All drivers who are listed in the FIA's Platinum, Gold, or Silver categories will be regarded as PRO DRIVERS. Accordingly DRIVERS are those who meet the FIA Bronze standard. (2) M-AMG points out that no Participants will be eligible to win prizes unless they have submitted their official FIA categorization. Only PRO DRIVERS or DRIVERS who have proven their FIA driver classification to M-AMG by November 30, 2016 at the latest will be eligible to win prizes (see section 6 (1)). M-AMG will contact drivers who have the prospect of finishing in a prize-winning position. The FIA updates driver categorizations during the course of the year. The FIA categorization as at September 1, 2016 will be applied by M-AMG to the full classification period. Changes to the driver categorization made by the FIA after September 1, 2016 will not affect the driver's categorization for the AMG Customer Sports Championship. Should a driver register for the AMG Customer Sports Championship after September 1, 2016 and not be categorized by the FIA until after that date, this categorization will be used for the entire classification period. M-AMG wishes to point out that FIA categorization can be obtained online. (3) Drivers who have not yet reached the age of 18 may participate in the AMG Customer Sports Championship. However, Participants must be over the age of 16.
Section 3 Registration for the AMG Customer Sports Championship (1) Participants must register for the 2015/2016 season (see section 4 (1)) of the AMG Customer Sports Championship via M-AMG's customer sports page (www.mercedesamg.com/customersports). Registration must have been received by M-AMG by October 31, 2016 at the latest. (2) Once Participants have validly registered for the AMG Customer Sports Championship they will receive an email containing access details for the AMG Customer Sports Portal ('CSP'). (3) All adults are eligible to participate provided they declare, when registering, that they agree to the Terms of Participation. (4) Minors over the age of 16 may participate if they can provide written evidence of their parent or legal guardian's consent to their registration and to the Terms of Participation. The return of the signed declaration of consent to M-AMG by email (amg-customer-sports@daimler.com) satisfies this requirement. (5) PRO DRIVERS and DRIVERS may only register under their actual (real) names and not under a pseudonym, unless the pseudonym was used in the official application to the FIA and has been noted in the license granted to the driver concerned. By registering for the Championship, however, PRO DRIVERS and DRIVERS driving under official pseudonyms agree that in the event of a win their real name will be published when the prizes are awarded. (6) The team manager must register teams in writing. Return of the registration form to M-AMG by email (amg-customer-sports@daimler.com) satisfies this requirement.
(7) By registering for the AMG Customer Sports Championship the Participants grant M-AMG all copyright and image rights from the classification races, without restriction in terms of place and time, including the right of digital image enhancement and the right to use images for general reporting, publicity and promotional purposes. Section 4 Classification (1) The classification season for the AMG Customer Sports Championship commences on December 1, 2015 and ends on November 30, 2016. Accordingly, only those events that have taken place between December 1, 2015 and November 30, 2016, and for which the results have been finalized and verified by November 30, 2016, will be included in the classification. (2)(a) The AMG Customer Sports Championship comprises the series of races set out in Annex 1 'Racing Series with Categorization of Classes'. (b) The differences between the power classes in a racing series can be seen from the coefficients shown in Annex 1 'Racing Series with Categorization of Classes'. If other national or international racing series are included in the sporting calendar during the classification season, and are integrated by M-AMG into the AMG Customer Sports Championship, they will be assessed and rated by M-AMG. The Participants will be automatically informed of the inclusion of new racing series and of other changes relating to the assessment via the CSP. (3) The CSP offers Participants the opportunity to obtain information automatically via email on all matters connected to the AMG Customer Sports Championship. The CSP provides Participants with up-to-date information on current Championship standings and all race results from around the world.
The results of the races and the points obtained by the Participants for the AMG Customer Sports Championship will be published under their actual (real) names on the online platform unless a pseudonym has been officially registered with FIA and has been noted in the racing license of the driver concerned. The content of the online platform is not exhaustive. Accordingly, Participants are obliged to review their classifications, to retroactively submit proof of their results, and to correct erroneous data and complete missing data by November 30, 2016 at the latest. No changes made after November 30, 2016 will be considered. (4) Results obtained by Participants in the AMG Customer Sports Championship driving a vehicle other than an SLS AMG GT3 or a Mercedes-AMG GT3 will not be included in the classification. (5) Only those vehicles that, after the end of the race, have been listed and classified in the official results for the race series will be included in the classification. (6) If a driver enters several vehicles in a classification race, only the best result for that driver will be classified. (7) If a team vehicle is driven by several drivers in one classification race, only the vehicle will be classified (once). (8) If a team uses several vehicles in one classification race, every result achieved by a team vehicle will be included in the team classification. (9) A team participating under different names in various racing series is obliged to inform M-AMG in advance of all names under which the team will be appearing. Following the evaluation of the race, the team points achieved will always be credited to the main team. Retroactive nominations are possible until November 30, 2016. (10) If teams cooperate with one another, the team that has obtained the nomination from the event organizer will be credited with the points obtained. It is not possible for different cooperation partners to be classified multiple times; in other words, only one team will receive the points obtained. If it is not clear beyond doubt which of the teams has obtained the nomination, the result
concerned will not be included in the classification and the points will be forfeited. M-AMG reserves the right to demand evidence that the team has been nominated. (11) If a driver switches teams during the classification season, the team points achieved will remain with the team for which they were obtained. (12) Participants are not permitted to transfer points. (13) If a race is ended prematurely, the classification will be carried out in accordance with the FIA standard, i.e. the results from the official ranking list will be used. Section 5 Awarding of AMG Customer Sports Championship Points (1) For each classification race, the points will be awarded to the Participants in accordance with the table set out below: 1st place 25 points 6th place 8 points 2nd place 18 points 7th place 6 points 3rd place 15 points 8th place 4 points 4th place 12 points 9th place 2 points 5th place 10 points 10th place 1 point
(2) Multiplication factors will be applied to fixed-duration classification races as follows: Duration 24h Factor 4.00 Duration 12h to < 24h Factor 2.50 Duration 6h to < 12h Factor 1.75 Duration 4h to < 6h Factor 1.50 Duration 3h to < 4h Factor 1.30 Duration 2h to < 3h Factor 1.10 Duration 1h to < 2h Factor 1.00 Duration 0.5h to < 1h Factor 0.75 Duration < 0.5h Factor 0.50 (a) The duration is determined in accordance with the published description of the classification race. Where the duration is less than 30 minutes, the distance factor will be rounded up to 0.5 hours. In other instances durations that fall within the defined ranges will always be rounded down to the lower distance factor (example: a 9.6-hour-race will be rounded down to 6 hours). (b) If a classification race is described exclusively in terms of distance or lap information, M-AMG determines the duration on the basis of the winner's time in the results list. In this case too, figures within the time-based distance range will always be rounded down to the lower distance factor (example: winning time of 9.6 hours will be rounded down to 6 hours).
(3) Multiplication factors will be allocated to the classes within a race series as follows: Racing category A Factor 2.0 Racing category B Factor 1.5 Racing category C Factor 1.0 The categorization of the specific class in a racing series is carried out at the start of the classification season, based on the relevant entry list. M-AMG reserves the right to make adjustments after the final starting list has been published for the classification races in a racing series. The Participants will be informed in advance of any changes to the categorization via the CSP. (4) If fewer than four vehicles in any one class start a race, Participants will be awarded half points rather than the full points score. Section 6 Prizes (1) M-AMG and the AMG Customer Sports Championship partners will award prizes for exceptional performance in AMG customer sports both to PRO DRIVERS and to DRIVERS. The best drivers from both categories will be recognized in this way. Only PRO DRIVERS or DRIVERS who have provided evidence of their FIA driver classification to M-AMG on or before November 30, 2016 will be eligible to be awarded prizes (see section 2 (2)).

(b) The following prizes will be awarded for DRIVERS in the AMG Customer Sports Championship 2015/2016: 1st place Mercedes-AMG CLA 45 2nd place 3rd place IWC Ingenieur Automatic AMG Black Series Ceramic watch Limited edition AMG Rotwild Bike The top ten DRIVERS also win an AMG Customer Sports Championship trophy. (2) The following prizes will be awarded for TEAMS in the AMG Customer Sports Championship 2015/2016: 1st place CSP credit worth 50,000 2nd place CSP credit worth 40,000 3rd place CSP credit worth 30,000 4th place CSP credit worth 20,000 5th place CSP credit worth 10,000 The top ten TEAMS also win an AMG Customer Sports Championship trophy.
(3) Where Participants have achieved the same number of points, positions will be determined by the highest number of wins within the class, then by the number of 2nd place classifications in the class, then by the number of 3rd place classifications in the class. If the number of points is still equal, the Participant with the greater number of pole positions will be the winner. The parameters cited refer to the races driven during the classification period. If the points scores are still equal, the time of registration for the AMG Customer Sports Championship will apply. This time is determined automatically by computer. If Participants are still tied, lots will be drawn. (4) The awards ceremony will take place following the end of the classification period, provisionally in December 2016. (a) All customer teams and all drivers will be invited to attend the end-of-season party hosted by AMG Customer Sports in the Stuttgart region. Should any of the award winners be unable to attend, the award will be presented at a separate event in Affalterbach. (b) Only PRO DRIVERS and DRIVERS may assign the award to third parties; it is not permissible for TEAMS to do so. The award winners must notify M-AMG of the planned assignment on or before November 30, 2016. Unless M-AMG has received a written notice of assignment, it is under no obligation to disburse the prizes to third parties. (c) Prizes cannot be paid in cash or otherwise converted. No alternative will be offered if a prize is rejected. (d) Prizewinners pay their own travel and accommodation expenses.
Section 7 Exclusion of Recourse to Legal Action; Jurisdiction (1) The decision of M-AMG as adjudicator within the meaning of section 661 German Civil Code (BGB) is final, and legal recourse is excluded. (2) The parties are not permitted to appeal to sports arbitration bodies in connection with the AMG Customer Sports Championship. (3) These Terms are governed exclusively by German substantive law, so far as permitted by law. If there is no provision excluding the right of recourse and if claims may be brought against M-AMG and a jurisdiction agreement is permitted pursuant to section 38 German Code of Civil Procedure (ZPO), it is hereby agreed that the courts of Affalterbach will have jurisdiction, as the place where M-AMG has its registered office. Section 8 Miscellaneous Provisions (1) M-AMG reserves the right to exclude from the AMG Customer Sports Championship Participants who have been punished for a violation of sports laws or who have conducted themselves in a manner detrimental to the reputation of the AMG Customer Sports Championship on multiple occasions or in such a way that its reputation is gravely damaged. (2) Should individual provisions of these Terms of Participation be or become ineffective, this will not affect the effectiveness of the other provisions. The ineffective provisions will be replaced by an appropriate provision that most closely corresponds to the purpose of the ineffective provisions.
