SHOW AND SALE Please bring this catalog to the sale. RED POLL SHOW & SALE General Information Date, Time, and Place: Friday, February 19, and Saturday, February 20, 2016. Show 4:00 p.m. Friday Sale 9:30 a.m. Saturday. Terms: Terms of the sale are cash unless other arrangements are made with the individual owner before the sale. The auctioneer will settle any disputes as to bids. Each animal will be sold to the highest bidder without reservation and will be at the purchaser s risk as soon as sold and can be moved after settlement is made. Registration Certificates: The cattle are registered in the Herd Book of the American Red Poll Association. Certificates of registration will be furnished, with transfers recorded, free of extra cost to buyers. Health Papers: Cattle, except official vaccinates that are under age, will have a 30-day negative test for TB and Brucellois, except for cattle from Certified and Accredited herds. It is advisable to know your own state s health requirements on bringing cattle in from out of state. Some states require permits. Consignor s Responsibility: The seller is the responsible party for all representations made about his cattle. The management of the sale assumes no liability, legal or otherwise, but will endeavor to protect the interest of both the buyer and seller. Guarantee: This sale will be conducted under the Red Poll Breeding Guarantee. Liability: The Kentucky Red Poll Association, American Red Poll Association, Kentucky Department of Agriculture and Kentucky Beef Expo act as sale agents only for the consignors of this sale and assume no liability as to accidents to or by any animal. The guarantees given above are made by each consignor for his own animals which are selling. Transportation: Transportation will be available. Check with clerk at time of settlement. She s as long and level as we have had here on the farm and what impreses me the most is the natural muscle shape and thickness she possesses when viewed from behind. The icing on the cake is that we are offering her as a bred heifer. We decided to breed her for a Fall 2016 calf to our new herd bull, MFF Sheldon, a powerful Navigator son (NAILE GC Bull - 2009), out of one of our donors, MB Shelby (NAILE GC Female - 2013). His first two calves were out of first calf heifers and both were under 60 lbs. Annabell s pedigree is stacked with names that are recognized over the last few years as winners Mattingly, Esquire, Jackson, Parkstyle, Doll, and Shutter. She has a very similar pedigree to Rosie as well, being sired by our up and coming herd bull, Shuter s Marshall, one of the last bulls bred on the Marshall Mohler farm. Her dam is one of, if not my favorite cow in the herd. She traces to the powerful, performance oriented WFB Daisy cow family as well. We kept a bunch of fall heifers out of some of our older cows this year and since her dam is still young and in her prime, we felt like we could let Mabel find a new home. Buy with confidence here. Bylaw 38 The Public Auction Sales Code In the selling of registered Red Poll cattle, a complete statement of facts shall be made, along with all information on animal sold. Sale Title - This shall be a definite statement of dispersal, partial dispersal or consignment, as the case may be, designating any cattle reserved. a) Dispersal Sale: Complete sell out, no salable cattle reserved. If a member of the firm or family wishes to purchase any animal to establish another herd, this fact should be stated in the catalog. b) Partial Dispersal: Selling part of the herd. Explanation must be made. c) Consignment Sale: Sale of animals consigned by different breeders. It is recommended that both consignor and breeder be listed on the pedigree of each animal in a consignment sale catalog. Terms & Conditions BREEDING GUARANTEE 1. The breeding guarantee shall constitute a contract between the seller and buyer of each animal sold at public or private sale, except for that in the case of complete Dispersal Sales, the seller may choose between selling and not selling under the Breeding Guarantee. 2. Proper care must be given by the purchaser to protect breeding qualities and health of guaranteed animals. 3. Bulls sold as separate lots are guaranteed breeders. a. Provided: (1) They are not allowed to serve until 14 months of age. (2) Or allowed to run with the herd until 20 months of age. (3) Notice of failure to settle cows is given within 6 months of purchase or 6 months after bull becomes serviceable age. 1. The highest bidder shall be the buyer. 2. The auctioneer selling will settle any dispute as to the bids by declaring all bids off and reselling the animal in question. 3. Cattle are property of purchasers as soon as sold by auctioneer, but will be cared for free of charge until delivered to buyer. 4. Terms of the sale are cash, unless other arrangements have been made with the owner before the sale. 5. Cattle are sold subject to health regulations of any state or country. 6. Breeding dates for animals that have been bred and not listed in the catalog will be given sale day. 7. If errors are noted in the catalog, announcements will take precedence over the matter in the catalog. 8. Each animal is recorded, or will be recorded in the Herd Books of the American Red Poll Association. Certificates of registry and transfer will be recorded by the seller and furnished the purchaser free of charge. 9. Owner warrants clear title to the property and right to sell the same. 10. Unless otherwise noted in a catalog or announced from the auction stand, each animal is sold as sound. b. Bull calves under 8 months of age sold at sides of dams are not guaranteed breeders. 4. Guarantee of Females a. All females over 14 months of age, sold open, are guaranteed open and breeders. (1) If not settled in 6 months, they shall be reported to seller. (2) Heifers under 14 months of age are to be open, and, if in calf, shall be reported promptly to the seller. b. Females sold as bred animals, but not in calf, must be reported to seller within 3 months of sale date. c. Females bred within less than 8 months prior to date of sale are not guaranteed to be in calf but are guaranteed breeders. d. Heifers under 8 months of age are not guaranteed breeders if sold at sides of dams. 5. Adjustments a. Seller may replace animal in question, with another of equal value, at time of purchase to the satisfaction of the buyer, OR b. Seller may refund purchase price. No interest, feed, transportation or fees to be charged to seller. Salvage goes to seller. c. Seller may elect retrial period, not to exceed 6 months. (1) Transportation to be paid by seller. (2) If animal proves to be a breeder, it shall be returned to purchaser at the expense of purchaser. (3) No feed, fees or maintenance charge will be made by either buyer or seller. 20 21
