Regulatory Division SAS-0-0077 DEPARTMENT OF THE ARMY REGIONAL GENERAL PERMIT 8 Construction, Maintenance and Modification of Recreational Dock Facilities and Associated Structures in Non-Tidal Navigable Waters of the United States Within the State of Georgia SUBJECT: Regional Permit No. 8 Effective Date: December, 0 Expiration Date: December, 09 REGIONAL PERMIT 8 (RP 8) : On the recommendation of the Chief of Engineers authority is hereby given for the construction of recreational dock facilities and associated water-based structures in the non -tidal, navigable waters of the United States, within the State of Georgia, that are subject to the jurisdiction of the U.S. Army Corps of Engineers (Corps), pursuant to Section 0 of the Rivers and Harbors Act (RHA) of 899 ( U.S.C. 0) DESCRIPTION OF WORK AND ACTIVITIES AUTHORIZED BY RP 8: The construction, modification and maintenance of non-commercial, recreational, singlefamily, multi-family, community, and public, floating and/or pile-supported dock facilities; and associated floating and/or pile-supported, water-based structures. Associated water-based structures include, but are not limited to walkways, fixed decks, connecting ramps, boat hoists, boathouses, jet-ski floats, screened dock houses, mooring buoys, mooring pilings and dolphins. LOCATIONS WHERE WORK AND ACTIVITIES ARE AUTHORIZED BY RP 8: Work and activities are authorized in certain sections of the following rivers and their navigable tributaries: Altamaha River; Chattahoochee River; Conasauga River; Coosa River; Flint River; Ocmulgee River; Ochlocknee River; Oconee River; Ogeechee River; Ohoopee River; Satilla River; Savannah River; Suwannee River; Toccoa River; and Tallapoosa River. The map attached at Appendix A depicts the major river systems in Georgia that are subject to Corps jurisdiction under Section 0 of the RHA, and where RP 8 may be applicable. A list of all navigable waters in Georgia that are subject to Corps' jurisdiction under Section 0 of the RHA is attached at Appendix B.

LOCATIONS WHERE WORK AND ACITIVITIES ARE NOT AUTHORIZED BY RP 8 :. Tidal Waters. Activities are not authorized by RP 8 in tidal waters in the coastal Georgia, including the following sections of major coastal rivers : on the Savannah River from the Atlantic Ocean, inland to Ebhenezer Landing; on the Ogeechee River from Ossabaw Sound, inland to Morgan's Bridge; on the Canoochee River from its confluence with the Ogeechee River, to the mouth of Savage Creek; on the Altamaha River from Altamaha Sound, inland to Fort Barrington; on the Satilla River from St. Andrew Sound, inland to Big Oak and Limerock; and on the St. Marys River from the Atlantic Ocean, inland to Trader Hill and Highway 0. The map attached at Appendix C depicts the portions of the above listed rivers where the use of RP 8 is not authorized. Programmatic General Permit 8 (PGP 8) authorizes certain recreational dock facilities in these areas and other tidal waters of the U.S.. Georgia Power Lakes. Activities are not authorized by RP 8 in the following lakes that are operated by the Georgia Power Company: Goat Rock Lake; Lake Harding; Lansdale; Morgan Falls; North Highland; Lake Oliver; Riverview; and Lake Worth. Programmatic General Permit 9 (PGP 9) authorizes certain recreational dock facilities in these lakes.. Lake Blackshear. Activities are not authorized by RP 8 in Lake Blackshear, which is operated by the Crisp County Power Commission. Programmatic General Permit 8 (PGP 8) authorizes certain recreational dock facilities in this lake.. U.S. Army Corps of Engineers' Lakes : A. Activities are not authorized by RP 8 in the following Mobile District Corps lakes: Allatoona Lake; Carters Lake; George W. Andrews Lake; Lake Sidney Lanier; Water F. Georgia Lake; and West Point Lake. In these lakes, activities are authorized by the Rules and Regulations Governing Public use of Corps of Engineers Water Resources Development Projects (Title ), and by Regional Permits (RPs) 0,,,,,,, 7, 9,,, 7, 9, 0,, and. B. Activities are not authorized by RP 8 in Lake Seminole, a Mobile District Corps lake. In this lake activities are authorized by Title and by RPs 7, 8, 9, 0 and. C. Activities are not authorized by RP 8 in the following Savannah District Corps lakes: Hartwell Lake; Lake Russell; and Thurmond Lake. In these lakes activities are authorized by Title and by RPs,,,,, 7, 8, 9, 0,, and. GENERAL CONDITIONS:. For the purpose of RP 8, the Applicant is any agent, individual, or government who submits a written request to the Corps for use of the RP, at least days prior to the planned construction start date for a proposed recreational dock facility.

. For the purpose of RP 8, the Permittee is any Applicant who rece ives written verification from the Corps that a proposed recreational dock facility, and associated structure(s), if applicable, is authorized by the RP.. Facilities that are not specified in RP 8 or which exceed the limitations of the RP would require prior authorization under a Department of the Army Individual Permit, Letter of Permission or General Permit. The District Commander may also require submission of an Individual Permit application if he determines that authorization under RP 8 for a specific project needs individual public review. Additional permit information is available at http ://www.sas.usace.army.mii/missions/regulatorv.aspx.. All activities identified and authorized herein sha ll be consistent with the terms and condition s of RP 8. Activities not specifically identified and authorized herein shall constitute a violation of the terms and conditions of the RP which may result in the modification, suspension, or revocation of RP 8, in whole or in part, as set forth more specifi cally in the following General Conditions and, and in the institution of such legal proceedings as the United States Government may consider appropriate, whether or not the RP has been previously modified, suspended, or revoked in whole or in part.. RP 8 may be summarily suspended, in whole or in part, upon a finding by the District Commander that immediate suspension of the activity authorized herein would be in the general public interest. Such suspension shall be effective upon receipt by a Permittee of a written notice thereof which shall indicate: (a) the extent of the suspension; (b) the reasons for this action; and (c) any corrective or preventative measures to be taken by a Permittee which are deemed necessary by the District Commander to abate imminent hazards to the general public interest. A Permittee shall take immediate action to comply with the provisions of this notice. Within 0 days following receipt of this notice of suspension the Permittee may request a hearing in order to present information relevant to a decision as to whether his permit should be reinstated, modified, or revoked. If a hearing is requested, it sha ll be conducted pursuant to procedures prescribed by the Chief of Engineers. After completion of the hearing, or within a reasonable time after issuance of the suspension notice to the Permittee, if no hearing is requested, the permit will either be reinstated, modified or revoked.. RP 8, or an individual activity authorized under RP 8, may be either modified, suspended, or revoked, in whole or in part, pursuant to the procedures under CFR.7. In issuing authorizations under RP 8, the Government has relied on the information and data which the Permittee has provided in connection with his permit application. If, subsequent to the issuance of a project-specific authorization under RP 8, such information and data prove to have been false, incomplete, or inaccurate, the authorization may be modified, suspended, or revoked, in whole or in part, and/or the Government may, in addition, institute appropriate legal proceedings. 7. Any modification, suspension, or revocation of RP 8 shall not be the basis for any claim for damages against the United States.

8. The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the Corps, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made aga inst the United States on account of any such removal or alteration. 9. The Permittee, upon receipt of a notice of revocation of this perm it or upon its expiration before completion of the work will, without expe nse to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the affected water of the United States to its former condition. 0. The Permittee shall make every reasonable effort to prosecute the work authorized herein in a manner so as to minimize any adverse impact of the work on fish, wildlife, and natural environmental values.. RP 8 does not convey any property rights, either in real estate or material, or any exclusive privi leges; and that they do not authorize any injury to prope rty or invasion of rights or any infringement of Federal, State, or local laws or regulations.. RP 8 does not obviate the requirement for the Permittee to obta in State or local assent requ ired by law for any activity authorized by the RP.. RP 8 does not authorize the interference with any existing or proposed Federal project and the Perm ittee shall not be entitled to compensation for damage or injury to the structures or works authorized herein which may be caused by or results from existing or future operations undertaken by the United States in the public interest.. If a Permittee desires to abandon a facility authorized by RP 8, unless such abandonment involves a Permittee transferring interests to a third party, the Permittee must restore the area to a condition satisfactory to the District Commander.. The Permittee must maintain all dock facilities authorized by RP 8 in good condition and in conformance with the terms and conditions of the RP. The Permittee is not relieved of this requirement if the structure or work is abandoned. Transfer in fee simp le of a RP 8 authorized dock facility automatically transfers RP 8 authorization to the new property owner; with all of the rights and responsib ilities enumerated herein. The Permittee sha ll inform any subsequent property owner of all activities undertaken under the authority of RP 8 and provide the subsequent owner with a copy of the terms and conditions the RP.. The Permittee will allow the District Commander or his representative to inspect the authorized facility at any time deemed necessary to assure that work is being performed or the facility maintained in accordance with Special and General Conditions of RP 8.

7. The facilities authorized by RP 8 must not interfere with the public's right to free navigation on all navigable waters of the U.S. No attempt will be made by the Permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized facility for a reason other than safety. 8. In issuing RP 8, the Federal Government does not assume liability for: damages to the permitted facility or uses thereof as a result of other permitted or unpermitted activities or from natural causes; damages to the permitted facility or uses thereof as a result of current or future activities undertaken by or on behalf of the United States in the public interest; damages to persons, property, or to other permitted or unpermitted activities or structures caused by the facility authorized by RP 8; des ign or construction deficiencies associated with a permitted facility; and/or damage claims associated with any future modification, suspension, or revocation of RP 8. 9. At any time during processing of an application for a proposed dock facility, the District Commander may determine that RP 8 will not be applicable to the specific proposal. In such a case, the procedures for processing an Individual Permit in accordance with CFR will be available. SPECIAL CONDITIONS:. No work shall be performed under authority of RP 8 until after an App licant submits a complete Department of the Army Individual Permit application to the Corps and the Permittee receives written verification from the Corps that the facility is authorized in accordance with the terms and conditions of the RP. A tillable application form (CESAS Form 9), instructions for completing the form and an example of a completed form are available at http://www.sas.usace.army.mii/missions/regulatorv.aspx. At a minimum, an application must include the following information: vicinity map; site location map, project description; plans and drawings; and "Adjacent Property Owner Notification" forms (Appendix D) that have been completed and signed by the property owners located upstream and downstream of the project site.. The Applicant shall submit a complete RP 8 application package to the appropriate Corps' office for processing. The map at Appendix E depicts the Georgia counties that are served by each of the three Corps' offices that process RP 8 applications. US Army Corps of Engineers Attention: Piedmont Branch 90 Adamson Parkway, Suite 00 Morrow, Georgia 00. Facilities proposed at sites located adjacent to federally authorized waterways or projects will be reviewed by the Corps on a case-by-case basis. Project specific setbacks from federal projects wi ll be determined by the Corps, if necessary, and will be included in the Corps' written verification of use of RP 8, issued to a Permittee.. RP 8 does not authorize: A. The construction across or into any natural or manmade channel, or water body in any manner that may adversely affect navigation by the general public in navigable waters of the Un ited States. B. The installation of fueling facilities. C. The construction of commercial structures or facilities. D. Habitable structures. E. Structures that do not have a water-related use. F. The discharge of dredged or fill material into waters of the United States, including the discharge of uncured concrete. (NOTE: The RP does not authorize any impacts to wetlands or other waters of the U.S. for the construction of walkways leading to the river/stream bank where the dock walkway begins. The discharge of fill material or installation of pile supports for such walkways would require separate authorization.) G. Any facility that the Corps determines would adversely affect: () Rivers named in Section of the Wild and Scen ic Rivers Act ( U.S.C. 7), those proposed for inclusion as provided by Sections and of the Act and wild, scenic and recreational rivers established by state and local entities. () Historic, cultural or archeological sites listed in or eligible for inclusion in the National Register of Historic Places as defined in the National Historic Preservation Act of 9 and its codified regulations, the National Historic Preservation Amendment Acts of 980 and 99, the Abandoned Shipwreck Act of 987 and the Native American Graves Protection and Repatriation Act. () Sites included in or determined elig ible for listing in the National Registry of Natural Landmarks. () A National Wildlife Refuge.

. Restrictions and limitations for the construction of private recreational dock facilities: (NOTE: On a case-by-case basis the Corps may authorize, in writing, exceptions to the following restrictions/ limitations, based on site-specific conditions or other factors.) A. Structures may be extended or located up to 00 feet waterward of the Ordinary High Water Mark (OHWM) elevation contour or one-third (/) the width of a natural water body, whichever is closer to the shoreline, except as otherwise governed by the presence of a federally maintained channel. B. The width of walkways shall not exceed six () feet. C. Boathouses, boat shelters and boatlifts shall not exceed 00 square feet. D. Fixed docks, floating docks, boathouses, boatlifts and boat shelters shall not be constructed over wetlands. E. Walkways that extend over wetlands shall be elevated sufficiently (minimum of feet from the bottom stringer to the water bottom) to prevent total shading of vegetation. F. No dock facility shall be enclosed with wood, glass, fiberglass, metal, or any other solid type materials; however, screening of dock facilities is authorized.. Restrictions and limitations for the construction of proposed public recreational dock facilities will be determined by the Corps on a case -by-case basis. Factors that will be considered by the Corps with regard to the waterward extent, size, and other aspects of proposed public facilities may include, but are not limited to: the need and purpose of the facility; the site-specific conditions at the proposed project location; public safety; handicapped access; and navigation.. Floating structures will installed to provide for fluctuations of water elevation, designed so that the structure will not rest on the water bottom at any time and secured in such a manner as to not break away. Floating structures will be supported by materials that will not become waterlogged or sink when punctured (i.e., not over -/ percent by volume American Society for Testing and Materials standards). Metal covered or injected drum flotation is not allowed. Foam-bead flotation is authorized if it is not subject to deterioration through loss of beads, meets the above standard, and has a minimum density of. pounds/cubic foot, is authorized. Foam bead flotation with a density less than of. lb/cu ft is authorized, provided it is encased in a protective coating that meets the above standard. 7. It is possible that the authorized structure may be damaged by wave-wash from passing vessels. The Permittee shall take proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The Permittee wil l not hold the United States liable for any such damage. 7

8. RP 8 does not authorize any facility that will adversely affect any threatened or endangered species or a species proposed for such designation, or their designated critical habitat as identified under the Federal Endangered Species Act (ESA) ( U.S.C. ). The U.S. Fish and Wildlife Service "Initial Project Seeping (IPaC)" printout identifying federally-listed threatened and endangered species that may occur in the vicinity of the project site, is available at http://ecos.fws.gov/ipac/. Applicants shall notify the Corps if any listed species or designated critical habitat might be affected by the proposed dock faci lity, and for such a proposal, may not begin work until notified by the Corps that the requirements of the ESA have been satisfied. Applicants are advised that for a project proposed in a county where there is an IPaC listed "Clam" species and/or critica l habitat for a "Clam" species, a survey may be required for listed biva lves (mussels) at the project site and the area downstream of the project site. 9. If, during the execution of the work authorized by RP 8, the permittee encounters a previously unidentified cultural resource that might be considered eligib le for inclusion in the National Register of Historic Places (NRHP); the permittee shall cease work and immediately notify the Corps. Upon notification by the permittee of the identification of a potentially eligible cultural resource within the vicinity of a RP 8 authorized dock facility, the Corps will conduct a preliminary review to determine if the resource would warrant further investigation. If, based on the Corps' prelim inary review the resource appears to be eligible for inclusion in the NRHP, the Corps will initiate consultation with the Georgia Department of Natural Resources, Historic Preservation Division (Georgia HPD), pursuant to Section 7 of the National Historic Preservation Act. Based on the outcome of the Corps' review and consultation with Georgia HPD, measures deemed necessary to mitigate impacts to cu ltural resources wou ld be incorporated as special conditions into the authorization issued under authority of RP 8. The permittee would then be notified of the addition of such special permit conditions, if applicable. 0. Permittees are advised that development activities in or near a f loodway may be subject to the National Flood Insurance Program that prohibits any development, includ ing fill, within a floodway that results in any increase in base flood elevations. RP 8 does not authorize activities prohibited by the National Flood Insurance Program.. The Permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
