Name of Work: SCOPE OF THE WORK A. Supply and commissioning of Cricket Bowling Machine at Pushpa Gujral Science City, Kapurthala, Punjab. The details and specifications are indicated below. B. AMC for maintenance and repairing of cricket bowling machine for the next 3 years after the expiry of warranty period of one year from the commissioning. C. Training of the staff of PGSC/ User (if any) required for effective operation and Maintenance of the system should also be included in the cost of equipment. Specifications: 1) Definition of Exhibit: Cricket bowling machine is a device which enables a batsman to practice in the nets and to hone specific skills through repetition of the ball being bowled at a certain length, line and speed. It can also be used when there is no-one available to bowl. 2) Description of the Exhibit: The bowling machine will work with any ball (Lawn tennis Balls / Cricket Balls) of roughly the right size and weight balls. The equipment should have functionality as follows: To bowl various types of balling as Spins Swings Change in Pace Change in length Ability to randomly select different balling actions (such as out swing, in swing, pace, spin etc.) Digital meter to display the speed of bowling (Min 40 kmph to Max of 170 kmph) Counter which counts delivered balls up to 9,99,999 in no. The auto feeder attached to the machine should feed one tennis ball at a time. On start machine will bowl n number of balls as selected by the player. N number of balls will bowled one at a time with a regular interval. Each bowling will randomly select the various speeds with different variations like in-swing, out-swing and with change in line and length. Machine should be able to bowl minimum of 20 variations in random mode. The counter on the control panel will count the delivered balls up to 9,99,999 nos. Anyone can t reduce or reset the counting and after 9,99,999 nos. it again start from the 1st no. Bowling machine will have auto-feeder which can store up to 50 balls at a time Machine should have well balanced robust tripod stand with break wheels. Note: 1. Deviations, if any, can be brought into the notice of PGSC one week prior to the last date of submission of tender. After this, no deviation will be entertained. 2. If any item, fail to conform to the specifications, the PGSC may reject them and the supplier shall either replace the rejected goods or make all alternations necessary to meet specifications requirements free of cost to the purchaser. INSTRUCTIONS Supply and Commissioning of Cricket Bowling Machine at Pushpa Gujral Science City, Kapurthala, Punjab Sealed tenders are invited from experienced and reputed Manufacturers / Suppliers for Supply and Commissioning of cricket bowling machine at Pushpa Gujral Science City, Kapurthala. 1. The offer should be submitted in three separate envelopes. Part I (Envelope - I): containing Earnest Money Deposit (EMD) + Tender Fee (In case of Downloaded Tender) Part II (Envelope - II): containing Technical Bid Part III (Envelope - III): containing Financial Bid 2. ENVELOPE - III: superscribed FINANCIAL BID for Cricket Bowling Machine at PGSC, Kapurthala should contain only the price bid. The price bid shall be opened on the date and time as decided by the Committee to be constituted by the PGSC for this purpose. 3. The procedure of opening the tender shall be as follows: Envelope I shall be opened in first instance. rejected and Envelope II and III shall not be opened. Envelope II shall only be opened with Earnest Money or Tender Fee (in case of Downloaded Tender) in Envelope I as required and the Technical Bid will be evaluated by the Evaluation Committee constituted for the purpose. Envelope - III of only those bidders shall be opened who are technically qualified in Part II (Envelope II). All the envelopes mentioned above should be submitted in a larger envelope double-sealed cover, super-scribing the Tender for Cricket Bowling Machine at PGSC, Kapurthala within due date. 4. PART I: EARNEST MONEY DEPOSIT (EMD) 4.1 The Technical Bid shall accompany with the EMD of Rs. 5,000/- (Rupees Five Thousand only). The EMD to be paid through a Demand Draft drawn in favour of Pushpa Gujral Science City payable at Chandigarh and issued by any nationalized bank or scheduled bank. 4.2 Tender submitted without the Earnest Money will be summarily rejected. 4.3 The earnest money deposited with PGSC will be refunded to the unsuccessful tender after finalization and the award of work as per terms & conditions of the contract. 4.4 In case of successful Tenderer, the Earnest Money will be retained as part of the Security Deposit/ Retention Money for satisfactory execution of the contract. 4.5 A tender once submitted shall not be withdrawn within a period of Four (4) months from the last day of receipt of the tenders. In the event of a Tenderer withdrawing his tender before the expiry of four months from the date fixed for receiving the tender, his tender would be cancelled and the Earnest money deposited with the Pushpa Gujral Science City will be forfeited. 4.6 No interest can be claimed for the deposit of earnest or Retention money / security money, which will be lying with Pushpa Gujral Science City. 4.7 If after opening the tenders, a Tenderer revokes his tender or increases his earlier quoted rate or after acceptance of his tender does not commence the work in stipulated time and accordance with the instructions of PGSC, the Earnest Money deposited by him will be forfeited. 4.8 EMD would be forfeited if the successful Tenderer fails to commence and carry out the work as per terms & conditions of the Tender Document. 5. PART: II TECHNICAL BID 5.1 COMPANY PROFILE Intending Tenderers must have the experience of executing similar type of work. The following documents must be enclosed along with the offer: 5.1.1 Power of Attorney in the name of the person, who has signed the Tender Document. 5.1.2 Copies of Testimonials/Certificates/Work Orders etc. regarding past experience of the similar work done by the Tenderer. 5.1.3 Brochure / Leaflet / Printed material containing technical specifications and picture of the equipment, which is being thought to be supplied. 5.1.4 Photographic reference of earlier works carried out by the Tenderer 5.1.5 Sales, Service Tax and VAT (if applicable) Registration Certificates including latest VAT Clearance Certificate. 5.1.6 Income Tax Clearance Certificates from the Income Tax Office concerned along with their tenders. 5.1.7 Sales tax registration/clearance certificate of work contract from respective authorities 5.2 Tender Document 5.2.1 All entries in the tender documents shall be in one ink. Erasing and over writings are not permitted. The concerned tenderer with proper indication of the name, designation and address of the signee should duly sign all pages including cancellations and insertions. 5.2.2 Should a tenderer find discrepancies or omissions in the tender document or in doubt as to their meanings, he should at once address to the authority inviting the tender for clarifications. Every endeavor is made to avoid any error which can materially effect the basis of the tender but the successful tenderer shall take upon himself to provide for the risk of any error which may be subsequently discovered and shall make no subsequent claim on account thereof. 5.2.3 In the event of tender being submitted by a firm, the tender be signed separately and legibly by each partner or member of firm or in their absence, by the person holding the power of Attorney on behalf of the firm concerned. In the later case, a copy of the Power of Attorney duly attested by a Gazetted Officer must accompany the tender. 5.2.4 Conditional and unsigned tenders, tenders containing absurd rates and amounts, tender which are incomplete or otherwise considered defective, tenders which are not in accordance with the tender conditions laid down by the Accepting Officer and tenders not submitted in the prescribed forms are liable to be rejected. 5.2.5 The PGSC reserves the right to reject any or all the tenders received or accepts any tender or part thereof without assigning any reason thereof. In the case of acceptance of a part of tender, the time for completion may also be reduced to the extent considered appropriate by the accepting authority. 5.2.6 The tenderer shall specially note that it is tenderer's responsibility to provide any item which is not specifically mentioned in the specifications, but which may be necessary to complete the work. 5.2.7 Any bid received after the deadline for submission of bids shall be rejected or returned un-opened to the Tenderer. 5.2.8 Tenders submitted by post / Courier should be posted with due allowance for any delay in postal delivery. Tenders received after the due date and time of opening, tenders shall be rejected. 5.2.9 If the Tenderer deliberately gives wrong information in his tender, then PGSC Authorities reserves the right to reject such tender at any stage. 5.2.10Words imparting the singular number shall also be deemed to include the plural number and vice-versa where the context so requires. 5.2.11The supplier's responsibility under this contract shall commence from the date of receipt of the acceptance of this tender. 5.2.12If a Tenderer expires after the submission of his tender or after the acceptance of his tender, the PGSC may at their discretion cancel such tender. If a partner of the firm expires after the submission of the tender or after the acceptance of the tender PGSC Authorities may cancel such tender at their discretion unless the firm retains its character/s. 5.2.13 The PGSC Authorities will not be bound by any Power of Attorney granted by the tenderer or by changes in the composition of the firm made subsequent to the execution of the contract. They may however, recognize such power of Attorney and changes after obtaining proper legal advice, the cost of which will be chargeable to the supplier concerned. 5.3 OTHER DOCUMENTS Tenderers can attach any other documents to show his/her strengths for completing the project. 6. PART III: FINANCIAL BID 6.1 Rates quoted by technically qualified tenderers will be opened and evaluated. 6.2 The tenderer should submit price bid duly signed on the original Financial Bid to be attached with this tender document. Anything with regard of financial condition, payment terms, rebate etc. mentioned in financial bid may make the tender invalid. 6.3 The envelope shall be addressed to the Director General, Pushpa Gujral Science City, S.C.O. NO. 60-61, 3 rd Floor, Sector-34-A, Chandigarh 160 022 super scribed with FINANCIAL BID FOR CRICKET BOWLING MACHINE AT PGSC, KAPURTHALA. 6.4 Rates should be quoted in figures as well as in words in Indian/Foreign currency only and in English. 6.5 In case the rates quoted in figures differ from those quoted in words, the rates quoted in words will be taken as the tendered rate and shall be binding on the Tenderers. 6.6 In quoting their rates, the Tenderers are advised to take into account all factors including fluctuations in market rates. No claim for enhanced rates will be entertained on this account after acceptance of the tender or during the currency of the contract. 6.7 The prices quoted shall be fixed & firm in all respects. 6.8 The price should also be inclusive of transportation of materials to the site (Pushpa Gujral Science City, Kapurthala) and loading & unloading etc. 6.9 The supplier shall arrange security for storage of their material to avoid any theft or losses during execution of work. PGSC, in no case, shall be responsible for providing any security for the materials & equipment lying at site during execution of work. 6.10 The Tenderer should quote their rate including all related and necessary expenditure. 6.11 Any or all taxes applicable on the said work are to be quoted in the Financial Bid. No taxes other than the indicated in the Financial Bid will be paid by the PGSC. 7. GENERAL CONDITIONS OF CONTRACT 1. WORKING CONDITIONS 1.1 The standard quality of components, wherever applicable, will only be used. 2. Inspections 2.1 If inspected or tested goods fail to conform to the specifications, the PGSC may reject them and the supplier shall either replace the rejected goods or make all alternations necessary to meet specifications requirements free of cost to the purchaser within stipulated period of supply commissioning. 2.2 After the supply of the machine. The tenderer has to run the machine to the satisfaction of PGSC 3. PAYMENT SCHEDULE 3.1 No advance payments will be made at the time of placing of firm order. 3.2 90% payment of the quoted amount as per each exhibit will be released after the supply/installation and commissioning of bowling machine at PGSC, Kapurthala to the satisfaction of the PGSC. 3.3 Remaining 10% payment will be retained as performance warrantee for a period of one year and would be released after receipt of Bank Guarantee of equivalent amount valid for next three (3) years. 3.4 TDS and/or any other tax will be deducted as per rules. 4. TIME SCHEDULE AND DELAYS 4.1 Contract time: The time of completion of the work would be one (01) month from the award of work. 4.2 Time is the essence of the contract and supplier shall undertake to complete the work within stipulated time. In the event the supplier does not complete the work, the supplier shall have to make good the loss the PGSC is likely to suffer. 4.3 Within one fortnight of the occurrence of any of the following, which the supplier might regard as impediments in the progress of work, the supplier shall apply in writing to the Director, PGSC for extension of time, setting out the reasons for delays sought to be condoned. a. Addition, alteration or substitution ordered in the work, which could have a significant time impact and issued to the supplier under an official change order only. b. Act of God or force majure, i.e. a situation arising out of any occurrence totally beyond the control of the supplier, and explicitly excluding consequences of actions of the supplier or his staff or agents. c. Forced closure of the works by a general political strike and unrest not related to supplier s labour or personnel. Pushpa Gujral Science City: Cricket Bowling Machine Page 17

d. The supplier shall not be entitled to extension of item if he fails to apply as above. 4.4 The supplier s application for extension of time in any of the above circumstances shall be considered by DG, PGSC and his decision shall be final and binding. 4.5 The granting of any extension of time shall not entitle the supplier to claim any additional remuneration or consideration whatever for costs incurred as a result of such delays or due to cost escalation. 4.6 Compensation for Delay: The time allowed for carrying out the work as entered in the Tender shall be strictly observed by the Supplier and shall be reckoned from the date on which the order to commence work is given to the Supplier. The work shall throughout the stipulated period of the Contract be proceeded with all due diligence and the supplier shall pay as Liquidated Damages and not by way of penalty an amount equal to one percent of accepted Tender for every week or part of a week that the work remains uncommenced or unfinished after the expiry of the completion date. Provided always that the entire amount of compensation to be paid under the provisions of the clause shall not exceed ten percent of the value of the accepted Tender. Director General, PGSC may on representation from the Supplier reduce the amount of compensation and his decision in writing shall be final. 5. WARRANTY / QUALITY: 5.1 The supplier firm shall warrant as per standards for quality that anything to be furnished shall be free from all defects and faults in material and workmanship. The manufacturer shall be of the highest grade and consistent with established and generally accepted standards. The material of the type ordered, shall be in full conformity with the specifications, drawing or samples if any and shall operate properly. 5.2 In addition to the warranty as already provided, the supplier / firm shall guarantee satisfactory performance of the equipment and shall be responsible for any defects that may develop for the period or up to the date specified in sub clause(c). Here after the equipment has been accepted by the PGSC. Such defects shall be removed at his own cost when called upon to do so by the PGSC. 5.3 The WARRANTY period shall be 12 months after commissioning of the bowling machine at the site. This warranty covers spare parts and labor cost. Exclusion from warranty: Consumables etc. 5.4 The supplier firm shall rectify defects developed in the system within guarantee period within days of occurrence of any fault promptly. For delays beyond 10 days a penalty will be effective @ 1% of exhibit cost per week Pushpa Gujral Science City: Cricket Bowling Machine Page 18

w.e.f. time of complaint recorded. In case the supplier firm does not rectify with the defects in further 10 days, PGSC shall have full liberty to restore the system in working condition. The expenditure so incurred by PGSC shall be deducted from the supplier firm pending claims, security deposit or in other law full manner. 6. PATENT RIGHT AND ROYALTIES: The tenderer shall indemnify the PGSC against all third party claims of infringement of patent, royalties trademark or industrial design rights arising from use of the goods or any part thereof. 7. GENERAL 7.1 The Director General, PGSC reserves the right to reject any or all tenders without assigning any reason whatsoever. 7.2 The tenders will be opened on the date and time indicated in the tender notice in the presence of tenderers, if any, present on the occasion. 7.3 All damaged or unapproved goods shall be returned at the risk and cost of the tenderer and the incidental expenditure thereupon shall be recovered from the concerned party. 7.4 Tenderer must supply the technical details of items especially for the peripherals / display lighting etc. in a proper catalogue or brochure. 7.5 Any damage which may occur on the Site, while transporting, installation will have to be rectified by the firm or paid in lieu of, as decided by the competent authority. 7.6 Legal jurisdiction will be judicial courts of Kapurthala District. 7.7 No accommodation shall be provided by PGSC for storage of materials or for labour and the Agency shall have to arrange it at its own cost. 7.8 All disputes and differences arising out of or in connection with, touching or concerning this work shall be referred to the sole Arbitrator appointed for the purpose by the Director General. The decision of the Arbitrator shall be final and shall be binding on both the parties subject to the provisions of the Indian Reconciliation and Arbitration Act, 1996 or any statutory modifications or reenactment there of and the rules made thereunder and for the time being in force shall apply to the arbitration proceeding under this clause. 7.9 Clean up of the site after completion of work will be the entire responsibility of the supplier.
