Summary What is Rule 40.3? Simply put, Rule 40.3 is about how your name and image is used in marketing, sponsorship, communications, social media and promotional activities by you and your personal sponsors during the period of the PyeongChang 2018 Olympic Winter Games. Who are these Guidelines for? These Guidelines are intended for Australian athletes (and/or managers or agents) who are or will become members of the 2018 Australian Olympic Team, to help you understand what can and cannot be done by way of marketing, communication and promotional activities during the period of the PyeongChang Olympic Winter Games. Any of your personal sponsors that are not sponsors of the Australian Olympic Committee (AOC) will also have an interest in these Guidelines. They are referred to as Non-Olympic Commercial Partners throughout this document. These guidelines supplement the AOC's Rule 40.3 Policy which is contained in the Team Membership Agreement. These Guidelines are not exhaustive and are for illustrative purposes only. In case of any discrepancy, the AOC Rule 40.3 Policy prevails. Any capitalised terms in these Guidelines have the meaning ascribed to them in the defi nitions of the AOC Rule 40.3 Policy. 2 AUSTRALIAN OLYMPIC COMMITTEE

WHY DOES RULE 40.3 EXIST? The fi nancial viability of the Olympic Movement in Australia and the ability to send present and future Australian Olympic Teams to the Olympic Games depends on the AOC being able to effectively manage, optimize and monetize their rights. Since the AOC is entirely privately funded and does not receive any Federal Government funding, the AOC needs to protect the rights and associated revenues that it generates from the Australian Olympic Foundation, sponsors, licensed merchandise, digital marketing and fundraising. WHY DOES RULE 40.3 MATTER TO ME? Like other conditions in the AOC Team Membership Agreement, compliance with Rule 40.3 is mandated by the IOC and AOC as a condition of participation in the Olympic Games. For decades, Australian Olympians have adhered to Rule 40.3. Compliance with Rule 40.3 is your responsibility. Without this funding, the dreams of Australian athletes every four years to compete at the Olympic Winter Games would remain, just that: a dream. 3 AUSTRALIAN OLYMPIC COMMITTEE

When Does Rule 40.3 Apply? RULE 40.3 IS IN EFFECT FROM In 2017/2018 there are three other important timings for you and your Non-Olympic Commercial Partners to be aware of: 01 August 2017 Deadline for Non-Olympic Commercial Partners to submit any use of your image, name or likeliness they wish to use during the Games Period. to 31 January 2018 Cut-off date for Historical Content containing Non-Olympic Commercial Partners to be posted on your personal Digital Platforms. THIS IS KNOWN AS THE GAMES PERIOD (OR MORE COMMONLY AS THE 'BLACKOUT PERIOD'). Within 14 days Of you being named to the Team, you are required to inform the AOC of your personal sponsors by emailing them to marketing@olympics.com.au 4 AUSTRALIAN OLYMPIC COMMITTEE

Background Rule 40.3 is governed by a number of legal documents. These Guidelines are intended to accompany the AOC Rule 40.3 Policy by making it more visual, but you may want read this in conjunction with the following: IOC Olympic Charter Olympic Insignia Protection Act 1987 (and Amendment Bill 1993; Amendment Act 2001) AOC Team Membership Agreement Athletes, which includes: o IOC Rule 40.3 Guidelines o Reference to IOC Social and Digital Media Guidelines for persons accredited to the Games of the XXIII Olympic Winter Games o AOC Rule 40.3 Policy OLYMPIC CHARTER IN FORCE AS FROM 2 AUGUST 2015 Lausanne October 2015 IOC Social and Digital Media Guidelines for persons accredited to the Games of the XXXI Olympiad Rio 2016 Introduction The International Olympic Committee (the IOC ) encourages participants and other persons accredited at the Games of the XXXI Olympiad Rio 2016 (the Games ) to take part in social and digital media and to share their experiences with their friends, family and supporters. These guidelines are designed to ensure that this activity respects the Olympic values and the rights of third parties. These guidelines apply to all participants and more generally to all accredited persons at the Games, i.e. all athletes, coaches, officials, personnel of National Olympic Committees and of International Federations and members of accredited media. They apply from the opening of the Olympic Village, on 24 July 2016, until the closing of the Olympic Village, on 24 August 2016. Please also refer to the Frequently Asked Questions section for more detailed information on these guidelines. 1. General principles It is entirely acceptable for accredited persons to share their experience at the Games through internet or any other type of social and digital media, provided that it is done in a first-person, diary-type format and that the other requirements included in these guidelines are respected. Only the persons who are accredited as media may act as journalists, reporters or in any other media capacity while they are at the Games. Postings made by, or on behalf of, accredited persons should at all times conform to the Olympic values of excellence, respect and friendship and must not be undertaken for the purposes of demonstration or any form of political, religious or racial propaganda. Such postings should be within the bounds of dignity and good taste and should not be discriminatory, offensive, hateful, defamatory or otherwise illegal. The use of vulgar or obscene words or images is prohibited. In addition to these guidelines, accredited persons may be submitted to additional guidelines related to the use of social and digital media, issued by National Olympic Committees or other organisations. 2. Photographs, video and audio Accredited persons can post or otherwise share on social and digital media still photographs taken within Olympic venues (i.e. all venues which require an Olympic accreditation card or ticket to gain entry, including the Olympic Village, Olympic Village Plaza, the competition venues, the training and practice venues and the Barra Olympic Park) for personal use. It is not permitted to commercialise, sell or otherwise distribute these photographs. Moreover, to respect the privacy of residents, no pictures shall be taken in the areas of the Olympic Village designated as no picture areas. Accredited persons are allowed to capture audio or video of the events, competitions or any other activities which occur at Olympic venues for their personal use. However, such audio or video content must not be made available on social and digital media (e.g. by posting or streaming) or on any other type of media without the IOC s prior approval. What do I do now? Being Rule 40.3 ready forms a part of your preparation to become a member of the Australian Olympic Team. Be sure to: 1. Read and understand these Guidelines and the AOC Rule 40.3 Policy. 2. Make sure your manager/agent and your personal sponsors who are Non-Olympic Commercial Partners or Institutional Supporters read and understand these Guidelines, the AOC Rule 40.3 Policy and associated documents. 3. Make sure that your personal sponsors, Non-Olympic Commercial Partners and Institutional Supporters submit to the AOC, before 01 August 2017, their plans if they want to use your name, image or likeness during the Games Period. 4.
