Wu Chi School of Arts Welcome to Wu Chi School of Arts! We are excited to welcome you to our School and for you to get started on your journey into the world of Wu Chi Tao. If you have any queries or require further information, please contact John Grant on 0420 517 993. This Agreement includes the following 3 parts: 1. Membership Application Form ( Application ) 2. Membership Terms ( Terms or Membership Terms ) 3. Wu Chi School of Arts Code of Conduct ( Code ) By completing and signing the Application, you acknowledge having read each of the Terms and the Code and agree to be bound by this Agreement. In this Agreement: Activities means any Wu Chi Tao Martial Arts or related physical activities which Participants engage in at the School; Applicant and I and you means the person completing the Application and applying to be a member of Wu Chi School of Arts and includes the Guardian, where the Applicant is under 18 years of age; Guardian means the parent or legal guardian of the Applicant who executes the Application; Membership means any membership granted to the Applicant which enables them to participate in the Activities, as described in this Application and the Terms; Participant means any person to whom membership in the Wu Chi School of Arts is given, and includes the Applicant in the event that this Application is accepted by us; School means the Wu Chi School of Arts premises from which the Services are provided; Services means the Activities provided by us to Participants; Wu Chi School of Arts or us means WU-CHI SCHOOL OF ARTS INCORPORATED INC1700023 an association incorporated in the State of New South Wales and includes its director, John Grant and all instructors, agents, servants, contractors and employees. PLEASE NOTE: WU CHI SCHOOL OF ARTS RESERVES THE RIGHT TO REFUSE TO GRANT MEMBERSHIP TO ANY PERSON AND TO CANCEL THE MEMBERSHIP OF ANY PERSON AT ANY TIME WHERE A PARTICIPANT FAILS TO COMPLY WITH THIS AGREEMENT, INCLUDING THE CODE OR ANY DIRECTION OF A WU CHI SCHOOL OF ARTS INSTRUCTORS. Membership Terms Martial Arts Are Dangerous (but Fun)! The following Terms must be read carefully: General The Applicant, hereby agrees to be bound by these Terms and this Agreement and acknowledges and agrees that the Services provided by Wu Chi School of Arts are provided subject to the terms and conditions: (a) Club Fees The Applicant will pay on demand the stated fees for the Services as set out in the Application or as notified to the Applicant, displayed in the School or verbally communicated by us. The fees may be increased by the

School at any time unless a Membership is paid for a prescribed term. (b) Fitness to Participate The Applicant warrants that he or she: has not at any time suffered any blackout, seizure, convulsion, fainting or dizzy spells and is not presently receiving treatment for any illness, disorder or injury which would render it unsafe for the Applicant to take part in the Activities; has provided information on any and all pre-existing medical conditions and injuries; is aware that the Activities may involve the use of weapons, equipment, obstacles, overexertion, and physical engagement and accidents with other Participants or spectators; is mentally and physically able to participate in the Activities; understands that he or she should not participate in the Activities unless he or she have trained appropriately and are in good physical condition; will participate within his or her own skill level and capability during the Activities; consents to emergency medical care and transportation in order to obtain treatment in the event of injury as medical professionals may deem appropriate. (c) Exclusion of Applicant The Applicant warrants that he or she has not at any time been excluded from Martial Arts by a medical practitioner or any person or entity including a Martial Arts Club. (d) Waiver and Indemnity For the purpose of the Civil Liability Act 2002 (NSW) and section 139 of the Competition and Consumer Act 2010 (Cth), the Applicant acknowledges that the Activities are recreational services and are dangerous and that there is a significant and obvious risk to his or her health and safety in participating in the Activities. The potential risks include, but are not limited to: death; physical or mental injury (e.g. twists, sprains, broken bones, spinal injury, paralysis); contraction, aggravation or acceleration of a disease; the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs that is or may be harmful or disadvantageous to me. The Applicant acknowledges, agrees, and understands that the risk warning in the preceding paragraph constitutes a 'risk warning' for the purposes of relevant legislation, including for the purpose of Section 5M of the Civil Liability Act 2002 (NSW). The Applicant acknowledges that Wu Chi School of Art s liability arising from the Activities is excluded or reduced in so far as is possible as a result of the risk warning. By signing this Agreement, the Applicant acknowledges, agrees and understand that, to the full extent permitted by law (including by section 5N of the Civil Liability Act 2002 (NSW) and section 139A of the Competition and Consumer Act 2010 (Cth)): the Applicant s rights to sue Wu Chi School of Art in relation to the Activities, if the Activities or associated Services were not provided in accordance with any express or implied warranty or guarantee that the services will be provided with reasonable care and skill, are excluded or alternatively limited to a refund of the cost of the Activities; and the Applicant releases Wu Chi School of Art from all liability for a failure to comply with any express or implied warranty or guarantee that the services will be provided with reasonable care and skill, in so far as the Activities result in death or injury. In addition to any other releases, exclusions and warranties in this Waiver, to the full extent permitted by law, the Applicant (including his or her heirs, successors, executors, administrators, agents and assigns) agree to waive, release and indemnify Wu Chi School of Art in respect of any losses, damages, claims, injuries, liabilities, costs, charges or expenses whatsoever in connection, directly or indirectly, with the Applicant s participation in the Activities, including without limitation those arising under statute, tort, contract, common law or equity (including for the Wu Chi School of Art s negligence). The Applicant acknowledges that he or she does not have to agree to exclude, restrict or modify or waive his or her rights against, or release, Wu Chi School of Art, however Wu Chi School of Art may refuse to allow the Applicant to participate in the Activities. Where this Agreement is signed by the Guardian of the Participant, the Guardian consents to the minor s participation in the Activities and provides the acknowledgements and indemnities in this Waiver in its own right and on the Participant s behalf. If the Competition and Consumer Act 2010 applies to this Agreement then certain terms and rights may be implied into this Agreement which operate for the benefit of the Applicant. Under the provision of that legislation, those terms and rights, and any liability of the supplier flowing from them, cannot be excluded, restricted or modified by any provision of the Agreement. (e) Martial Arts not to be taught by Applicant The Applicant agrees that he/she is in no way qualified or authorized to teach Wu Chi publicly or privately in any way whatsoever for personal, monetary or any form of gain whatsoever without the written authorization of Wu Chi School of Arts. (f) Agreement to abide by the Code The Applicant agrees that he or she will abide by the Code, a copy of which is attached and which the Applicant has read and understood. The Applicant agrees and acknowledges that any failure to abide by the Code may result in his or her expulsion from the Wu Chi School of Arts. (g) Governing Law This Agreement is to be governed by the laws of the State of New South Wales and the Courts of New South Wales shall have exclusive jurisdiction to entertain any action in respect of any such agreement.

Code of Conduct This code of conduct must to be read and retained by the Applicant Objectives The Wu Chi School of Arts has as its key objectives: 1. Providing instruction in a safe environment in the martial art of Wu Chi Tao. 2. Developing the mental and physical tools for improving personal safety and security. 3. Promotion of good health and vitality. 4. Development of positive self-esteem and selfconfidence. 5. Development of people as positive role models in the community. 6. Creating expertise in confrontation management. 7. Pro-active crime prevention through increased awareness and positive attitudes. 8. Developing healthy community attitudes and values. All persons participating in a class or course conducted by the Wu Chi School of Arts must agree to be bound by this Code of Conduct. The Wu Chi School of Arts reserves the right to make amendments or additions to this Code of Conduct at any time. Participant Understanding Wu Chi Tao is a contact martial art, meaning it involves physical contact with one or more other practitioners in ways designed to simulate as closely as possible the self-defence options available to a practitioner when confronted with physical aggression and/or threatening behaviour. As in any other physically demanding recreational activity, there is always a risk of injury. Any person participating in a class conducted by the Wu Chi School of Arts does so with the full understanding that whilst it is the policy of the Wu Chi School of Arts to minimise this risk, the nature of such close contact physical activity prevents its total elimination. Persons participating in a class conducted by the Wu Chi School of Arts do so of their own volition and at their own risk. Instructor & Assistant Instructor Qualifications 1. An Instructor is a person who has final authority/management over the conduct of the class. 2. An Assistant Instructor is a person who assists an Instructor in the management & conduct of a class. 3. All Instructors and Assistant Instructors will be bound by this Code of Conduct. 4. All Instructors must have current Work Cover - approved Senior First Aid certification.

Safety 1. Instructors will ensure that the training area is clear of any dangerous and/or sharp objects that may provide a risk of injury. 2. Instructors will have access at all times to a fully equipped first aid kit. 3. Persons must not wear jewellery or watches during training. Any piercings must be removed or taped over prior to practice. 4. All persons participating in training agree to maintain self-control at all times and maintain all care in the application of any technique. 5. All persons whilst attending a class whether participating or not, agree to obey the instructions and directions of the Instructor. 6. Any person who, in training, exhibits behaviour that, in the judgment of the Instructor, is a danger to other participants, shall not be allowed to continue training until the Instructor determines the danger is no longer present. Class Etiquette 1. Persons will bow in the appropriate manner upon entering and leaving the class. 2. Shoes should be worn to and from class, and at all times when not in the class, especially when accessing the toilets. 3. Persons must be punctual, preferably early, so that they are ready to train when class commences. If arriving late, a person must wait at the back of the class until the Instructor signals they may join the class. 4. Persons must not chew gum whilst training. 5. Food and/or drink with the exception of water must not be consumed whilst in the class. 6. Mobile phones must be turned off during training. Mobile phones inadvertently left on during training may not be answered. Any person who is on-call for work, or other purpose may seek approval from the Instructor prior to the commencement of class to leave his or her mobile phone on. Uniforms & Training Gear All Persons must wear the following approved clothing during all training sessions: 1. Uniform: New students can wear suitable clothing for intensive exercise until the end of the current six week block where you will need to obtain a uniform. Only the official uniform sanctioned by the Wu Chi School of Arts will be worn during a formal class. In adverse environmental conditions the instructor leading the class can determine appropriate amendments to the official uniform. 2. Footwear: Training can be done in bare feet or suitable white sole shoes, students choosing bare feet must ensure their feet are clean before entering the class. 3. Belts: Ungraded graded students shall wear a white belt with the knot turned to the back of the student. Graded students will wear the colour of belt they earned in their previous grading. 4. Female students: In the interests of discretion, female students shall also wear a t-shirt or sports-top underneath their uniform jacket if a jacket is required as part of their uniform. 5. All clothing must be free of all logos and markings. 6. Persons inappropriately attired will not be allowed to train. 7. In addition to the general uniform requirements, persons should bring a towel and full water bottle to each training session. Sickness or Injury Persons must not train if they are suffering from the flu or any other infection that may be passed on to other persons. Persons must advise the Instructor before each and every class if suffering from any injury or medical condition, either permanent or temporary, which may be adversely affected by certain types of training. Some examples of this may include blood pressure problems and cardiac disorders; neck, back and joint injuries; sprains and strains; diabetes and asthma. If requested by the Instructor, persons with the above or like conditions must show this Code of Conduct to their physician and secure a medical certificate clearly stating that the person is able to participate in classes conducted by the Wu Chi School of Arts and whether there are any restrictions or conditions applicable.

Other Health Issues 1. Persons must not attend training under the influence of alcohol or illegal drugs. 2. While members of the Wu Chi School of Arts will never find themselves in competitions representing the Wu Chi School of Arts due to the non-competitive nature of Wu Chi, we nevertheless support the MAIA Anti-doping Policy. 3. Smoking is not allowed in the class or surrounding area. 4. Persons training must give proper attention to personal hygiene, exhibit clean grooming, and ensure that fingernails and toenails are trimmed and clean. 5. Persons with a cut or bleeding injury must cease training immediately and receive appropriate first aid. Re-joining the training session will not be allowed until the Instructor has deemed that it is safe to do so. 6. Any blood on the training floor or any other part of the classroom must be cleaned up immediately. All precautions must be taken to ensure contact is not made with any blood, or other body fluids. 7. Persons administering first aid to a person suffering a cut or bleeding injury, or cleaning up any blood spills, must wear protective gloves. Training Area Ethics 1. Persons must always be courteous and helpful to each other. 2. Students should perform a Respect Kung to the instructor after the instructor has finished giving instruction for each technique. 3. Physical contact between persons who are training must be appropriate to the situation and necessary for the skill development of those persons. 4. Sexual harassment, defined as being where a person is subjected to unwanted or uninvited sexual behaviour, will not be tolerated. 5. Any form of discrimination based on sex, ethnic origin, language, colour, or other form of differentiation will not be tolerated. Grading Conditions 1. Grading in the Wu Chi School of Arts will be held immediately after the week off when required. A person may only grade at these times subject to the final determination of the Instructor. 2. Grading fees must be paid prior to the grading. 3. In assessing a person s readiness to grade, the Instructor takes into consideration such factors as consistency of attendance, attitude, focus, and attention during class, as much as a person s knowledge of the Wu Chi School of Arts Grading Syllabus. 4. To secure grading under the Wu Chi School of Arts, a person must be a current financial member. 5. Membership in the Wu Chi School of Arts requires a person to agree to be bound by this Code of Conduct. 6. The Wu Chi School of Arts reserves the right to revoke the grading of any person who breaches this Code of Conduct or is convicted of any criminal offence. Class Restrictions 1. Persons will initially be required to practise more basic forms of training until such time as their skill level warrants involvement in more advanced classes. 2. A person s participation in classes will depend upon the Instructor s assessment of their competence. Beginner students may be asked to practice only part of an advanced technique, or, at times, to sit aside and watch more advanced techniques, until such time as the Instructor determines their competence warrants their involvement in the full activity. 3. Students should not undertake any techniques unless authorised by the Instructor. Basic Etiquette 1. Be punctual, and preferably early, for class to help prepare the dojo (i.e. wherever possible, arrive 15 mins before the scheduled start time). If late to class, try to minimise disturbance to others by waiting for an appropriate time to enter the class. Get changed and wait quietly at the back of the dojo until your instructor signals for you to bow in, warm up and join the class. 2. Each time you enter or leave the class, perform a Respect Kung. 3. Ensure the class is swept and wiped down after every class.

4. Keep talking in the class to a minimum and keep your language clean. Prior to class, students should focus and clear their minds while warming up quietly. Save socializing for after class. 5. Maintain an alert and respectful posture at all times. Whenever your instructor is demonstrating a technique to the class watch quietly. 6. Train safely and non-competitively at all times, protecting your partner through respect for their limits and experience. Keep your ego in check. 7. As a courtesy, inform your instructor in advance if you are going to be absent from class 8. Tuition fees and grading fees are to be paid in full and on time.
