In order to provide you with the flawless holiday you expect from The Moorings, we require that specific information be provided in ii. a timely manner. Prompt return of your signed Terms & Conditions is requested within 14 days of your initial deposit. Please return all other items, such as the guest list, beverage selections, provisioning selections, resumes and the liability indemnification, to us at least 90 days prior to your charter start. iii. Any information provided or changed within 90 days of your holiday start date, which The Moorings considers crucial to the planning process, is subject to an additional fee. See Details, Details for more information on late change fees. PRE-CHARTER BRIEFING & YACHT ORIENTATION All head charterers are required to attend a pre-charter briefing and yacht orientation prior to the charter start. If you are not taking an evening start, you are urged to arrive the day before your charter. See Details for a briefing schedule. You will be advised of navigation and customs procedures between the various islands, points of interest, proper yacht and equipment operation and emergency information. Please hold all questions of this nature until that time. Specific yacht operation and navigation questions will be addressed during this briefing. A Moorings Yacht Operations Manual will be aboard the yacht for your use. ENTRY REQUIREMENTS A VALID PASSPORT IS REQUIRED ON ALL MOORINGS HOLIDAYS Expiration date must be no earlier than 3 months after your planned return, although most countries require passports to be valid for at least six months after you return. A valid passport is required for citizens of all countries, to enter or re-enter the United States and therefore Puerto Rico or the USVI. If you have a hired skipper and are planning to visit The US or Spanish Virgin Islands please notify The Moorings in advance of your charter. The US Department of Homeland Security requires all yachts with hired skippers provide at least 24 hours notice prior to visiting these islands. The Moorings will handle the necessary paperwork. Please check with the Department of Foreign Affairs & Trade regarding Visa requirements - www.dfat.gov.au. WHAT TO PACK Our years of experience have taught us that extra time planning your wardrobe in advance guarantees a hassle-free holiday. Life aboard a sailing yacht requires some packing strategy. We recommend the following guidelines to enhance your holiday: Pack clothing suitable to your destination; know the climate you will be visiting. A Moorings holiday is leisurely and rarely requires anything more than casual attire. Pack clothing that is multi-purpose and easily washed. Less luggage means less burden. Soft duffel type luggage eases storage aboard both the yacht and the airplane. Try not to have check-in baggage at the airport. Should you need to pack check-in luggage, make sure it contains less essential items in case it is lost. Non-skid rubber-soled shoes, sun screening products and insect repellent are a must for life aboard a sailing yacht. Pack an adequate supply of all prescription medications with a doctor s permit. The Moorings has a zero tolerance policy in regard to illegal drugs and weapons. Remember to take along your CharterCare Protection policy (if applicable.) In case of an emergency you will need to refer to the claim procedures specified in the policy. ARRIVAL DETAILS Please fill out your arrival details on the forms even if you do not require a transfer. Please tick if you would like a transfer arranged or not.
PASSENGER DETAILS We would like to remind you that overseas port regulations require us to have full passport names, ages and passport numbers and place of birth for all party members of a yacht charter. Please fill out all the passenger details on the form to avoid any unnecessary delays to the start of your charter. We need a booking form filled out for every charter; we have to have these for our records. Please make sure you send the booking back ASAP. Please inform us of any late crew members. BAREBOAT SAILING REQUIREMENTS The Mediterranean GREECE BAREBOATING REQUIREMENTS To charter a yacht in Greece, there must be at least one certified skipper and one experienced crew member, both over 18 years old. The skipper should be competent at handling a yacht in close quarters, anchoring and mooring in varying conditions and be able to use navigation and pilotage skills to plan the day s sailing and know your position at any time. The Skipper should be accompanied by at least one crew member (First Mate) of Competent Crew level or a similar/equivalent certification from any recognised sailing association.* As a yacht skipper, you are required to have a sailing license or a certificate from a recognised sailing association AND/OR an ICC or IPC as detailed below: Skipper is REQUIRED to have one (1) of the following: ICC (International Certificate of Competence), International Prerequisites: RYA Day Skipper Course or similar/equivalent certification from any recognised sailing association or complete the ICC Assessment form to prove competence from previous experience. A copy of sailing certificates must be sent to the base and received at least 2 weeks before the start of the charter. It is vital that skippers take their original copies of certificates with them, as it is likely that they are requested to present them in person. The Croatian Government requires all recreational skippers chartering Croatian flagged vessels to have a certificate of competence. Under Croatian law, the Ministry of Maritime Affairs, Transport, and Infrastructure recognises licenses issued by the national authorities of other countries. Tourists in Croatia can also be certified at harbormasters' offices in Pula, Rijeka, Senj, Zadar, Sibenik, Split, Ploce, and Dubrovnik, as well as at the Ministry in Zagreb by passing a test. The skipper is responsible for confirming that the specifications of his license are consistent with the required competency in commanding a yacht of the size/type he or she will be chartering, as well as navigating waters comparable to those he or she will be visiting. ADDITIONAL INFORMATION FOR YACHT CHARTERS LATE CHANGE FEES When changes are made to existing crewed yacht or bareboat charter agreements a change fee will be applied in order to offset communication, material, and handling cost incurred in implementing the change. Should charterer require changes to existing reservations, the following policy will apply: Charter location changes more than 90 days prior to charter start date will incur a $100 fee. Charter location, yacht type or date changes within 90 days of charter start date will be deemed a cancellation and will incur any penalties mentioned under Defaults and Cancellations section of this sheet. Any other changes to the charter reservation within 90 days of charter start date will incur a $100 fee. ENVIRONMENTAL DAMAGE Charterer shall be solely responsible for any fees or fines determined by the laws of the country in which the environmental damage occurred. Damage to the environment includes but is not limited to damage to natural or artificial reefs. LOSS DAMAGE WAIVER/RISK ASSUMPTION OPTION Our insurance policy provides comprehensive and adequate cover for the equipment and yachts for your skipper and crew. The Company cannot be held responsible for any loss which you may suffer as a result of the insurers refusing cover, including without limitation, which is as a result of you providing incorrect information, such as previous sailing experience, when requested, or due to your negligence, deliberate default or willful misconduct. Should damage or loss to yachts and equipment be caused as a result of not obeying the Company s instructions, you will be liable for the full amount of repair or replacement and any resulting costs. Adults will at all times be responsible for minors in their charge. The Company agrees to insure and keep insured the yacht against public liability and marine public liability to such an extent as the Company in its absolute sole discretion shall deem appropriate. Such insurance policy does not cover loss of life (except that caused through the negligence of the Company), or damage to or loss of property of any person on board against which you must insure prior to the charter. Advice about such insurance is available from the Company on request. Collision Damage Waiver and Security Deposits Please note that for all sailing holidays featured, you will be required to provide cover against accidental damage or loss to the vessel and ancillary equipment and either pay a Security Deposit at the base or purchase Yacht Damage Waiver as further detailed below. In the event you or your party cause damage or loss to the vessel (howsoever caused) or to property belonging to a third party and you have opted to take the Security Deposit option you will be liable for the full extent of the loss suffered and our right to claim against you will not be limited or waived by the payment of the Security Deposit. If you or your party cause damage or loss to the vessel, any ancillary equipment or to property belonging to a third party and such damage or loss is caused as a result of your gross negligence or reckless conduct you will be liable for the full extent of the loss suffered and our right to claim against you will not be limited or waived in any way by the payment of the Security Deposit or purchase of Yacht Damage Waiver. Acts that will be considered as gross negligence or reckless conduct will include, without limitation, sailing outside of defined sailing areas and/or hours, sailing the vessel under the influence of alcohol and/or drugs, not having sufficient crew in charge of the vessel at all times, not being in control of the vessel.
During the booking process you will be provided with the option of either purchasing Yacht Damage Waiver or paying a Security Deposit. You will not be able to proceed with your booking unless you agree to one of the options and by asking us to confirm your booking you are agreeing to comply with the content of this section and make any required payment. You will be provided with the cost of purchasing the Yacht Damage Waiver during the booking process which will be added to your overall holiday cost. In addition, you will be expected to pay the above relevant amount (or equivalent in local currency) as damage deposit upon arrival at the yacht base. The damage deposit will be taken prior to embarkation and if you do not pay we reserve the right to cancel your booking without further liability and without any right to a refund and you will not be entitled to continue with the charter. Option 2: Security Deposit If you choose to pay a Security Deposit you will be asked to pay the above relevant amount (or equivalent in local currency) as damage deposit upon arrival at the yacht base. The damage deposit will be taken prior to embarkation and if you do not pay we reserve the right to cancel your booking without further liability and without any right to a refund and you will not be entitled to continue with the charter. The damage deposit paid under either Option 1 or Option 2 will be used as security for any loss or damages suffered by the Company as a result of any breach by you of these booking conditions and any damage caused to the yacht or its contents during the period of your arrangements. You can not apply or deduct any portion of the damage deposit from the final balance payable for your travel arrangements. You will be asked to sign a form before embarkation confirming that you fully understand your obligations in the event of any loss or damage to the vessel, ancillary equipment or third party property. On return of the yacht to the base following the charter period and following inspection of the yacht by our base staff, in the event that we are satisfied that there is no apparent damage to the yacht on its return from you, our base staff shall, where applicable, refund the relevant damage deposit paid by you (please note that Yacht Damage Waiver monies will not be refunded) to you as soon as reasonably possible. In the event that we determine that accidental damage or loss was caused to the yacht and/or its contents during the period of your arrangements, you will be liable to us for all losses and damages incurred by us as a result except if you have purchased Yacht Damage Waiver in which case the extent of your liability will be the value of the deposit paid. In the event that we determine that damage or loss was caused to the yacht and/or its contents during the period of your arrangements as a result of your gross negligence or reckless conduct, you will be liable to us for all losses and damages incurred by us as a result. In both instances we reserve the right to retain, where applicable, part or all of the relevant damage deposit paid by you. We may use all or part of the damage deposit paid by you to repair any damage caused to the yacht or its contents during the period of your arrangements, including without limitation the costs involved in lifting the yacht for a full inspection to assess the damage to the yacht. Retention of the damage deposit will not in any way limit or prejudice any claim which we may have over and above the sum of the damage deposit paid by you where (i) you decided to take Option 2 and pay the Security Deposit; and/or (ii)
the loss or damage was caused or contributed to by your gross negligence or reckless conduct and in these circumstances you will remain liable to us for the balance of any such losses or damages incurred by us over and above the sum of the damage deposit paid by you. In the event that the losses or damages suffered by us as a result of any breach by you of these booking conditions and any damage caused to the yacht or its contents during the period of your arrangements is less than the relevant damage deposit paid by you, we shall refund, as relevant, part of the damage deposit paid by you to you as soon as reasonably possible after the damage has been repaired or the repair costs have been ascertained. In the event of any disagreement over damage or loss, we shall retain the relevant damage deposit paid by you until the matter is resolved. Please note that if (i) loss or damage caused by your gross negligence or reckless conduct is in excess of the level of the damage deposit; and/or (ii) loss or damage caused by you is in excess of the level of the damage deposit and you decided to take Option 2 and pay the Security Deposit; we reserve the right to pursue a claim against you for the full extent of our loss. For the avoidance of doubt, where we make any refund to you of the relevant damage deposit paid by you, any Yacht Damage Waiver fees also paid by you will not be refunded. THE MOORINGS BAREBOAT PRODUCT GUARANTEE The Moorings guarantees that if a breakdown of essential equipment occurs during your charter, we will complete a repair within four working hours of notification or you will be provided compensatory sailing time for any time exceeding four hours. To be covered under this guarantee the yacht must be within a twenty mile radius of a Moorings base. Please see The Moorings Guarantee for details. DETAILS, DETAILS...
