Rangitikei District Council CONTROL OF SKATEBOARDING BYLAW 2010 1. TITLE The title of this bylaw is the Rangitikei District Council Control of Skateboarding Bylaw 2010. 2. SCOPE This bylaw is made under the authority of section 145 of the Local Government Act 2002. The purpose of this bylaw is to control the use of skateboards and similar wheeled devices on footpaths and in public places where a nuisance or injury may be caused to pedestrians or damage caused to property. 3. COMMENCEMENT This bylaw comes into force on 1 September 2010. 4. INTERPRETATION In this bylaw unless the context otherwise requires: a) OFFICER means any Police Officer or Authorised Council Officer. b) THE COUNCIL means the Rangitikei District Council. c) THIS BYLAW means the Rangitikei District Council Control of Skateboarding Bylaw. d) SKATEBOARD means a wheeled device controlled or propelled by gravity or by the energy of the rider, and includes roller skates, scooters, rollerblades, in-line skates and other wheeled devices used primarily for recreational purposes. A skateboard does not include any wheelchair, perambulator, push chair, shopping trundler, wheelbarrow or other device constructed and used for the purpose of assisting transportation of disabled persons, young children, or personal effects. 5. OFFENCE a) A skateboard or similar recreational device must not be used on the footpaths, berm, road or street, in any area identified in the first schedule of this bylaw.

b) A skateboard or similar recreational device must not be used in any public place, so as to cause, or is likely to cause damage to any property, or is likely to cause injury to any person. 6. PENALTY FOR BREACH OF BYLAW Any person who acts in breach of this bylaw commits an offence and is liable on summary conviction to a penalty up to the maximum as provided by S242 (4) of the Local Government Act 2002. A fee of $50.00 (fifty dollars) will be levied against the owner for the retrieval (after one week) of any skateboard impounded under S164 of the Local Government Act 2002. 7. ENFORCEMENT OF BYLAW The Police and Authorised Council Officers will enforce this Bylaw under the powers of arrest, search and seizure found in sections 169, 170 and 177 of the Local Government Act 2002. 8. DATE BYLAW MADE This Bylaw was adopted by the Rangitikei District Council on 24 June 2010.
