1) Please return this completed Merchandise Vendor Agreement and 50% of the rental fee no later than December 1, 2015. The balance must be paid no later than January 15, 2016. Rental payment is to be made in cash, money order, credit card (Visa, MC, Discover). If the full amount is not paid by January 15th, the space will be forfeited and rented to another vendor NO EXCEPTIONS! Please note that deposits and rental fees are non-refundable. 2) The cost for space rental is $50 per linear foot. For example, a 10 wide X 15 deep space would be $500 ($50 X 10 = $500). A 20 X 15 space would be $1,000 ($50 X 20 = $1,000). 3) Vendors shall have the sole responsibility for obtaining all applicable business privilege licenses as required by law or ordinance, and are solely responsible for the collection and payment of all applicable City and State taxes. Tucson telephone number for City Business License is (520) 791-4566. 4) Due to exclusive licensing Agreement, we cannot allow the sale of cowboys hats, logo t-shirts, jackets and sweatshirts. Also, no novelties or clothing with ProRodeo or similar logos (i.e. PBR, PRCA, WNFR, WPRA or National Sponsor logo merchandise) will be allowed for sale. No signage in any vendor space will be allowed promoting any brand of shirts or jeans in competition with Wrangler, or any brand of boots in competition with Justin Boots. Please call if you have any questions about these restrictions. 5) Soft drinks, bottled water, sports drinks, juice and enhanced bottled water may be sold only if they are products sold by Kalil Bottling Company of Tucson. Soft drinks may only be sold in containers and sizes approved by the Tucson Rodeo Committee. These products must be purchased on-site or in advance directly from Kalil Bottling Company. 6) Vendors must supply photos of their entire display area, including any trailers, tents or other sales displays. If a trailer is to be incorporated into the space rented, the trailer width and length (including tongue), and how it will be positioned. Vendors whose display will not fit within the space rented will be required to lease additional space, if available. If additional space is not available, the vendor will not be allowed to set up and will forfeit all rental fees paid. 7) All vendors participating in the 2016 Tucson Rodeo will provide the Tucson Rodeo Committee with a Certificate of Liability, which must name the Tucson Rodeo Committee, Inc., it directors, officers, employees and volunteers, and the City of Tucson, Arizona as additional insured s. Said Certificate is due in the rodeo office

Failure to provide said insurance will result the Insurance Requirements Are As Follows: All insurance coverage must be effective on the first date of entry on the property through the date of departure. Fire and extended coverage coverage must include fire and fire damage as well as occurrences included in the standard extended coverage endorsement, including vandalism and malicious mischief on equipment, fixtures and other personal property owned by vendor. Public liability and property damage coverage must include $1,000,000 single limit per occurrence bodily injury, property damage and product liability coverage. The Certificate of Liability Insurance must indicate the effective dates of fire, liability and property damage insurance policies, and the amount of insurance provided by those policies. The Certificate must also provide that if the policy or policies should be cancelled by the insurance company or the vendor during the term of this Agreement, ten days written notice prior to the effective date of such cancellation will be given to the Tucson Rodeo Committee. 8) The term of the Agreement shall begin upon its execution and terminate at 11:59 p.m. March 1, 2016. 9) Vendors may NOT sublease the concession space. Subleasing is grounds for immediate termination of this Agreement, and expulsion from the Tucson Rodeo grounds. 10) Vendor will not be permitted to sell any alcoholic beverages. 11) The terms Tucson Rodeo", "La Fiesta de los Vaqueros and Tucson Rodeo logo are registered trademarks and cannot be used in any way. 12) Vendors are expected to open for business during all six (6) rodeo performances. Vendors that open on one or both slack days must notify the Tucson Rodeo Committee. Rental fee will be due and payable to the Rodeo Committee for all sales made on slack days. Vendors, who, without permission of the Concessions Committee, fail to open for business or fail to open for business ON TIME on all six (6) days, will not be invited back in future years. Vendors must be open for business no later than 11:00 a.m. on all days and shall close no earlier than 5:00 p.m. on February 20-21 and February 25 28, 2016. Slack days (February 22-23) are optional - it is up to the Vendor whether to open or not. There will be no activities planned for Wednesday, February 24th, so there is no need to be at the rodeo
grounds. Vendors who operate during this slack time shall operate during appropriate times to serve customers. 13) Vehicles used for unloading goods must be outside of the perimeter fence no later than 10:30 a.m. each day. 14) All gates will be locked at 8:00 p.m. daily, and all vendors and their vehicles must be out by that time. The Tucson Rodeo Committee, Inc., and the City of Tucson will not be responsible for the loss of any property for any reason. 15) Vendors are solely liable for the security of their merchandise and for their own booth set-up, security and daily cleaning of leased space. 16) Persons staffing concession areas shall be employed by vendor and shall not be employees of the Tucson Rodeo Committee or the City of Tucson. Only the personnel performing services for vendor shall be granted admission to rodeo grounds. Designated vendor tags must be presented to gain admittance and must be worn at all times while on the property. 17) A designated parking area will be provided for vendor vehicles. There will be no electric, sanitary or water services available. There is no parking in unauthorized areas. Vendors must present authorized parking pass when entering the designated parking area gate. No vehicles may be left within the perimeter fence overnight. All vehicles operated on rodeo grounds property will be operated in a safe and prudent manner at all times. Speed limit on all rodeo grounds property is 10 miles per hour. 18) Every concessionaire will receive up to four (4) vendor passes (depending on your space rental size). Your vendor pass will allow you to park in the general parking area, and allow you to come through the gate. If you need more passes, they will cost $20 each. Additional passes may be purchased at the Rodeo Office. 19) No selling in the stands, bleachers or any area other than the designated space assigned will be permitted at any time. 20) No amplification equipment, televisions, radios or music of any kind will be allowed in the concession area. 21) No weapons (or anything that could be considered a weapon) will be allowed on display or for sale in any of the vendor spaces. Pocket or folding knives may be accepted.
22) No spray paint will be allowed in any of the vendor spaces at the Tucson Rodeo grounds. 23) Electricity is provided for lighting only. Space heaters and other electrical or gas equipment will not be permitted. 24) Raffles conducted in vendor spaces must have a clearly visible sign indicating what is being raffled and the individual/organization responsible for the awards. Vendors must adhere to all state and local lows pertaining to raffles. Raffle tickets may only be sold within the confines of the spaces leased. 25) The signature of the vendor on this Agreement signifies that he/she understands and will comply with all terms of this Agreement. 26) The signature of the vendor on this Agreement signifies that he/she agrees to indemnify and save harmless the Tucson Rodeo Committee, Inc., its directors, volunteers, employees, sponsors and the City of Tucson, Arizona from all fines, suites, claims, demands or action of any kind and nature by reason of any and all vendor s operations hereunder, and does agree to and does assume all risks in the operations of his/her operation hereunder. 27) Failure to comply with the conditions found herein, misrepresentation of sales statistics in any way, misrepresentation of any nature and/or failure to abide by any rules, laws or regulations will result in the immediate removal from the Tucson Rodeo grounds and the loss of future participation with the Tucson Rodeo. 28) Vendors will be allowed on the Tucson Rodeo grounds beginning Wednesday, February 17, 2016. Vendors will not be allowed to park or store equipment on the rodeo grounds prior to that date. Please see information sheet for additional information.
