Clause 4 3 The following officials shall be the competent officials to issue a gambling license under Schedule B annexed to this Act, as well as a license to organize a prizewinning game by way of gambling in any form as part of a commercial or professional activity pursuant to Section 8: (1) Director of the Investigation and Legal Affairs Bureau, Department of Provincial Administration, for Bangkok Metropolitan; (2) Chief of Amphoe, or Deputy Chief of Amphoe who is head of King Amphoe, for other provinces apart from Bangkok Metropolitan. For the issuance of licenses under Paragraph 1, the license issuing official shall issue a license in accordance with the following conditions: a. The license issuing official may issue a license for the following gambling games: (1) Horse racing or racing involving other animals without totalisator, sweep, or bookmaking; (2) Race of bulls and men without totalisator, sweep, or bookmaking; (3) Mahjong, domino, or other card games, except poker and chinese poker; (4) Duad; (5) Kong-aoy; (6) Sabatoy; (7) Sabashoot; (8) Boxing or wrestling. 3 Clause 4 was amended by the Ministerial Regulation No. 44 (B.E. 2548 (2005)) issued under the Gambling Act, B.E. 2478 (1935).

b. With respect to the following gambling games, in Bangkok Metropolitan, a license may be issued upon approval by the Director-General of the Department of Provincial Administration. As for other provinces apart from Bangkok Metropolitan, a license may be issued upon approval by the Provincial Governor; (1) Animal fighting; (2) Poker or chinese poker; (3) Billiard; commercial or professional activity. (4) Prize-winning games by way of gambling in any form as part of a c. With respect to the following gambling games, a license may be issued upon approval by the Minister of Interior: coins, respectively); (1) Rue-pung race or rue-lor race (race games using wooden boat toys and (2) Chee-roob (picture-pointing game); (3) Ring toss game; (4) Game consisting in tossing coins or any other objects in a recipient; (5) Fishing game; (6) Prize draws in any form; (7) Shooting game; animal or any other articles; (8) Game consisting in throwing at objects representing a human face, an (9) Tao-kam-dan (game using dices); (10) Mak-gaew (a kind of board game);

(11) Mak-hua-daeng (a kind of board game); (12) Bingo; (13) Lottery, raffle or any other gambling games in which one of the players will receive money or other benefits; (14) Horse racing or racing involving other animals with totalisator, sweep or bookmaking; (15) Race of bulls and men with totalisator, sweep or bookmaking; (16) Totalisator for any game; (17) Sweep for any game; (18) Bookmaking for any game; (19) Sale of lottery, raffle or sweep tickets which are not issued in Thailand, but are legally organized under the law of the country where they are held; (20) Table football; (21) Gaming machines using mechanics, electricity, light or any other types of power, by touching, sliding, pressing, flicking, pulling, pushing, shooting, throwing, revolving, spinning, or any other ways which allow players to win or lose, regardless of whether there are counting points or any other symbols or not. Clause 5 The validity period of a license to play gambling games as listed in Schedule B shall not exceed a certain number of days and the games shall take place during certain hours as prescribed as follows: during the prescribed hours: (a) The following games shall not exceed one day and shall take place

(b) The following gambling games shall not exceed the number of days starting from the license issue date to the draw date. If several draws are anticipated, the license shall be valid until the time of the last draw. If such games are organized in Thailand, whether for a single draw or several draws, it shall take place during on a specified date. 1. Lottery, raffle or any other gambling games in which one of the players will receive money or other benefits; 2. Sweep for any game; 3. Sale of lottery, raffle or sweep tickets which are not issued in Thailand, but are legally organized under the law of the country where they are held.

(c) 4 With respect to billiard, table football or gaming machines using mechanics, electricity, light or any other types of power, by touching, sliding, pressing, flicking, pulling, pushing, shooting, throwing, revolving, spinning, or any other ways which allow players to win or lose, regardless of whether there are counting points or any other symbols or not, the validity period of a license shall not exceed thirty days from the license issue date, and the games shall be played during 17 23 hrs. Clause 6 With respect to prize-winning games by way of gambling in any form as part of a commercial or professional activity, the validity period of a license shall be from the license issue date to the date prescribed by the license issuing official as he sees fit, and the gambling shall take place during of a specified date. Clause 7 With respect to the following gambling games in Schedule B, a license shall permit the organizing of such games only during public festive events, annual holidays, or other special occasions: 1. Chee-roob (picture-pointing game); 2. Ring toss game; 3. Game consisting in tossing coins or any other objects in a recipient; 4. Fishing game; 5. Prize draws in any form; 6. Shooting game; 4 Clause 5 (c) was amended by the Ministerial Regulation No. 23 (B.E. 2530 (1987)) issued under the Gambling Act, B.E. 2478 (1935).

7. Game consisting in throwing at objects representing a human face, an animal or any other articles; 8. Tao-kam-dan (game using dices); 9. Mak-gaew (a kind of board game); 10. Mak-hua-daeng (a kind of board game); 11. Bingo. Clause 8 With respect to the following gambling games in Schedule B, every day, the licensee shall make a daily report of income and expenses and submit it to the license issuing official on the next day. 1. totalisator for any game; 2.bookmaking for any game. Clause 9 With respect to the following gambling games in Schedule B, upon a request by the license issuing official, the licensee shall submit a report presenting the amount of lottery/ raffle sales: 1. lottery, raffle or any other gambling games in which one of the players will receive money or other benefits; 2. sweep for any game; 3. sale of lottery, raffle or sweep tickets which are not issued in Thailand, but are legally organized under the law of the country where they are held.

Clause 10 With respect to the following gambling games in Schedule B, the licensee shall notify the license issuing official of the venue, date and time for the draws at least three days before the draws take place, and the license issuing official shall provide an acknowledgement of receipt of such notification. 1. lottery, raffle or any other gambling games in which one of the players will receive money or other benefits; 2. sweep for any game. Clause 11 With respect to the following gambling games in Schedule B, the licensee shall keep a sales account, and the license issuing official shall have the power to audit the said account. 1. lottery, raffle or any other gambling games in which one of the players will receive money or other benefits; 2. totalisator for any kind of game; 3. sweep for any kind of game; 4. bookmaking for any kind of game; 5. sale of lottery, raffle or sweep tickets which are not issued in Thailand, but are legally organized under the law of the country where they are held. Section 16 bis as follows: in the following terms: Clause 12 Taxes shall be prescribed pursuant to Section 16, paragraph 1 and (1) Licensee with a license to use totalisator for any kind of game shall pay a tax

(4) 5 Licensee with a license to organize a lottery for charitable purposes by approval of the Cabinet shall pay a tax at a rate of 0.5 percent of earnings from lottery sales before deducting expenses. Clause 13 The following games in Schedule B may be organized without license: (1) bridge which is played in a club among its members or other persons authorized by the club, or in a house among family members and friends, and the club or the house owner who organizes the bridge does not request payment or receive any benefits, directly or indirectly, from such game; (2) 6 billiard which is played in a house with large private space, with not more than one table, and the organizer or the owner, as the case may be, does not request payment or receive any benefits, directly or indirectly, from such game. Or the billiard is played for pleasure in a club established under the Civil and Commercial Code, with not more than five tables, and the club shall collect a reasonable fee for the game and organize it on official working days, during 15.00 hrs. 01.00 hrs of the next day, and on weekends, during 11.00 hrs. 01.00 hrs. of the next day, as well as comply with restrictions and conditions prescribed in the license form for the organizing of billiard, mutatis mutandis. 5 Clause 12 (4) was added by the Ministerial Regulation No. 43 (B.E. 2543 (2000)) issued under the Gambling Act, B.E. 2478 (1935). 6 Clause 13 (2) was amended by the Ministerial Regulation No. 27 (B.E. 2534 (1991)) issued under the Gambling Act, B.E. 2478 (1935).

Clause 15 7 Any person wishing to organize a gambling game in Schedule B, or organize a prize-winning game by way of gambling in any form as part of a commercial or professional activity under Section 8, shall use the application form annexed to this Ministerial Regulation and submit his or her application to the license issuing official of that area, as follows: (1) in Bangkok Metropolitan, the request shall be submitted to the Department of Provincial Administration; (2) in other provinces apart from Bangkok Metropolitan, the request shall be submitted to the office of Amphoe or the office of King Amphoe.
