CITY OF SNOHOMISH Snohomish, Washington ORDINANCE 1919 AN ORDINANCE OF THE CITY OF SNOHOMISH, WASHINGTON AMENDING SNOHOMISH MUNICIPAL CODE, CHAPTER 11.06 RELATING TO BICYCLES AND OTHER MANUALLY PROPELLED VEHICLES, DEVICES OR EQUIPMENT. WHEREAS, it is the intent of the City of Snohomish to enact laws that protect and preserve the public health and welfare of the general public; and WHEREAS, injuries involving bicyclists and other manually propelled vehicles, devices or equipment are frequently associated with improper or inadequate protective equipment; and WHEREAS, head injuries are a major cause of death or disability associated with the operation of bicycles and manually propelled vehicles devices or equipment on public right-of ways; and WHEREAS, persons operating or riding a bicycle or other manually propelled vehicle, device or equipment should be required to use helmets to deter potential injuries on public rightof-ways and publicly-owned facilities under the jurisdiction of the City of Snohomish; and WHEREAS, the City of Snohomish encourages bicycle helmet programs and the distribution of new helmets to low-income bicyclists, by interested groups such as the Bicycle Helmet Coalition, the Think First Head and Spinal Cord Injury Prevention Program, and Snohomish County Parks and Recreation, as well as through the Snohomish City Police and Snohomish County Fire District. WHEREAS, existing state law (RCW 46.04.670) includes bicycles in the definition of vehicle ; and WHEREAS, the City of Snohomish Police Department has jurisdiction over traffic laws for non-motorized vehicles on public right-of-ways and publicly owned facilities under the jurisdiction of the City of Snohomish; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SNOHOMISH, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Snohomish Municipal Code, Chapter 11.06, Bicycles and other manually propelled vehicles, is hereby amended to read as follows: -1-

Chapter 11.06 BICYCLES AND OTHER MANUALLY PROPELLED VEHICLES, DEVICES, OR EQUIPMENT Sections: 11.06.010 Purpose and Policy. 11.06.020 Definitions. 11.06.030 Bicycle Helmet Required. 11.06.040 Leasing or Loan of bicycles and/or manually propelled vehicles or devices. 11.06.050 Helmet Sales Safety Standards. 11.06.060 Careless riding, racing or operation. 11.06.070 Information and Education. 11.06.080 Penalties Traffic Infraction. 11.06.090 Severability. 11.06.010 Purpose and Policy A. This title is enacted as an exercise of the authority of the City of Snohomish to protect and preserve the public health and welfare. B. It is the express purpose of this title to provide for and to promote the health and welfare of the general public and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this title. C. It is the specific intent of this title to place the obligation of complying with its requirements upon any person within this scope, and no provision or term used in, this title is intended to impose any duty whatsoever upon the City of Snohomish or any of its officers or employees for who the implementation or enforcement of this title shall be discretionary and not mandatory. D. Nothing contained in this title is intended to be, nor shall be construed to create or to form the basis for, a liability on the part of the City of Snohomish, or its officers, employees or agents, for any injury or damage resulting from the failure of any person subject to this chapter to comply with this chapter, or by reason or in consequence of any act or omission in connection with the implementation or enforcement of this chapter on the part of the City of Snohomish by its officers, employees or agents. 11.06.020 Definitions. As used in this Chapter, the following terms shall have the meanings indicated unless the context clearly requires otherwise: Bicycle means every device propelled soley by human power upon which a person or persons may ride, having two tandem wheels, either of which is sixteen inches or more in diameter, or three wheels, any one of which is more than twenty inches in diameter (RCW 46.04.071). Within this chapter, the term bicycle shall include any attached trailers, sidecars, and/or other -2-

device being towed by a bicycle. Guardian means a parent, legal guardian, an adult with custody, or temporary guardian, who maintains responsibility, whether voluntary or otherwise for the safety and welfare of a person under the age of eighteen years. Helmet means a head covering that meets or exceeds safety standards adopted by Standard Z- 90.4 set by the American National Standards Institute (ANSI), or the Snell Foundation, or such subsequent nationally-recognized standard for bicycle helmet performance as the City Council may adopt. Manually propelled vehicle, device or sporting equipment means any manually propelled transportation that includes, but is not limited to, carts, tricycles, push carts, kiddy carts, sleds, skateboards, roller blades, scooters, wagons, roller skates or any other contrivance, or vehicle, propelled by human power. Public area means public roadways, bicycle paths, parks, or any right-of-way or public-owned facility under the jurisdiction of the City of Snohomish. 11.06.030 Bicycle Helmet Required. A. Any person bicycling or riding as a bicycle passenger on or in tow of a bicycle upon any public area in the City of Snohomish shall wear an approved bicycle helmet designed for safety that meets or exceeds the standards adopted in Section 11.06.020, and shall have either the neck or chin strap of the helmet fastened securely while the device is in motion. B. Any person using a manually propelled vehicle or device upon any public area in the City of Snohomish shall wear an approved bicycle helmet designed for safety that meets or exceeds the standards adopted in Section 11.06.020, and shall have either the neck or chin strap of the helmet fastened securely while the device is in motion. C. No person shall transport another person on or in tow of a bicycle or other manually propelled vehicle upon any public area in the jurisdiction of the City of Snohomish, unless the passenger is wearing a bicycle helmet that meets the requirements of this Chapter. D. A parent or guardian is responsible for requiring that a child under the age of eighteen years wears an approved bicycle helmet while bicycling or riding as a passenger, or using or operating any other manually propelled transportation in any public area in the City of Snohomish, and has the neck or chin strap of the helmet fastened securely. 11.06.040 Leasing or Loan of bicycles and/or manually propelled vehicles or devices. A. Any person in the business of renting or loaning (e.g. a test drive ) any bicycle or manually propelled vehicle or device in any public place in the City of Snohomish shall supply the persons leasing or using the equipment with approved bicycle helmets as defined herein, unless the rider and/or passengers possess approved bicycle helmets of their own, and offer proof thereof. B. The rental papers (contract, agreement, or receipt) must advise the person renting the bicycle -3-

and/or other manually propelled equipment of the bicycle helmet requirements of this Chapter. C. It is a defense to this Section for a person wearing an unapproved bicycle helmet that the helmet was furnished in conjunction with his or her lease of a bicycle or manually propelled device by a person engaged in the business of renting bicycles, and that the helmet was fastened securely while in use. 11.06.050 Helmet Sales Safety Standards. A. No person shall sell or offer for sale a bicycle helmet that does not meet or exceed the safety standards set by the American National Standards Institute (ANSI) Standard Z-90.4, or the Snell Foundation, or such subsequent nationally-recognized standards for bicycle helmet performance as the City of Snohomish may adopt. B. It is a defense that the sale or offer for sale was an isolated sale of used merchandise made by an individual who was not engaged in the business of selling or repairing recreational equipment, such as a seller at a garage or rummage sale. 11.06.060 Careless riding, racing or operation. All reckless or careless riding, racing or operation of any bicycle or other manually propelled equipment on any street, sidewalk, alley, or other public place within the City is prohibited. Any activity endangering the health and welfare of pedestrians and/or that interferes with motorized vehicle operation is prohibited. Operation of any manually propelled equipment on private property signed to prohibit such operation is prohibited. 11.06.070 Information and Education. A. Information about the need for bicycle helmets, safe helmet use, safe bicycle operation, and existing safety programs shall be available at the City of Snohomish Police and Fire Departments. B. The City of Snohomish encourages any person engaging in the business of selling bicycles and/or other manually propelled vehicle, device or equipment to include information on bicycle safety and the bicycle helmet requirements of this Chapter with each bicycle or manually propelled vehicle, device or equipment sold. C. The City of Snohomish encourages any person engaging in the business of selling bicycle helmets to include information on safe helmet usage with each helmet sold. 11.06.080 Penalties Traffic Infraction. A. Any person violating any of the provisions of the Chapter shall have committed a traffic infraction and shall be liable for monetary penalties as set forth in RCW 46.63, not to exceed $25.00. B. The Court may waive, reduce or suspend the penalty and clear the notice of violation as a warning for an individual who has not received a notice of violation of this Chapter within one year, and provides proof that he or she has acquired an approved bicycle helmet at the -4-

time of appearance in Court. C. Each violation of Section 11.06.030 and 11.06.040 shall represent a separate violation. D. The City of Snohomish Police Department shall be responsible for enforcing the provisions of this Chapter. For the purpose of this Chapter, law enforcement officers may at their discretion: 1. Enter, during business hours, the premises of a business selling, repairing, or renting bicycles or other manually propelled vehicles, devices or sporting equipment to determine compliance with this Chapter. 2. Stop a bicycle race, a bicycle tour, or an organized event involving bicycling, other manually propelled vehicles, devices or sporting equipment that takes place in a public area, when there is conspicuous disregard for the requirements of this Chapter. -5-

11.06.090 Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance to any person or circumstance shall not affect the validity of the remainder of this ordinance or the validity of its application to other persons or circumstances. 1999.
