Est. 1970 + Volume 45 + Number 2 + sprig 2016 Krisaa Park Movig Forward with Coservatio Overlay By Becca Dierschow, Preservatio ad Research Coordiator Whe Dever s zoig code was updated i 2010, the city moved from the traditioal, sigle use (or Euclidia) zoig code, which establishes zoe districts restricted by use. Istead, the city opted for a form-based zoig code, a model which is at the forefrot of urba plaig policy. Propoets of form-based zoig maitai that these codes are a superior zoig model because they idetify geographic areas or groups of areas ad create zoes for each that are based ot o uses, but o desired commuity character, itesity of lad use, ad built form. Ideed, as we ve see i Dever, may of our most popular eighborhoods such as Highlad, Lower Dowtow, ad Uptow, could ot have bee built uder our previous use-based zoig code, because they mix residetial, commercial, ad commual uses. The ew form-based code tries to foster mixed use commuities by dictatig buildig form (height, setback, desity) while icludig mixed uses as a itegral part of the code. As with ay large scale documet, there are a umber of tweaks to be made alog the way. After all, the documet does cover 153 square miles of lad. Now that eighbors have lived with the code for 6 years the city is seeig a umber of rezoig applicatios as people work to fid the most appropriate forms for their eighborhoods. Oe of the most promisig tools icluded i the ew zoig code is the coservatio overlay. A zoig overlay ca come i may differet forms, but essetially it provides a refiemet of the base zoig to more accurately reflect the desired patter of a eighborhood. A coservatio overlay idetifies key features of a existig eighborhood, ad, through specific zoig requiremets, shapes future developmet to be more compatible with those existig coditios. To date, there are four coservatio overlays i Dever, coverig parts of Curtis Park, Hilltop ad Highlad. Because a coservatio overlay is desiged to shape zoig for a particular cotext, these overlays are relatively small ad cover oly residetial properties i these eighborhoods. Coservatio overlays require the support of at least 51% of icluded ladowers. Coservatio overlays ca be simple, oly addressig oe characteristic of a eighborhood such as miimum lot size, as i Hilltop. Coservatio overlays ca also be more complex, as i Highlad, where they cover several characteristics such as roof height ad pitch ad side set back requiremets. Overlays do t ecessarily have to be more restrictive, either. I Curtis Park, the coservatio overlay is more permissive tha the uderlyig zoig, allowig larger garages or accessory dwellig uits tha allowed i the uderlyig urba residetial zoe district because this reflects the historical patter of developmet i the eighborhood. Oe proposed coservatio overlay curretly movig forward through the city process is i the Krisaa Park eighborhood. Historic Dever has bee workig with Krisaa Park i various capacities over the last few years, ad we are excited to see them move forward with this overlay proposal. Krisaa Park is a four block eclave of Midcetury Moder homes i Virgiia Village, desiged i a Califoria Cotemporary, Eichler-ispired style. Built i 1954, developer Brad Wolff declared that it was Dever s first properly plaed subdivisio. The homes were carefully sited o each lot to maximize outdoor space ad privacy. The homes were all oe story with carports ad large back patios. The homes feature low-pitched roofs with wide-overhagig eaves, large widows overlookig the backyard ad a ope floor pla. These desig features are all hallmarks of the Midcetury Moder style ad make Krisaa Park stad out amidst a sea of Miimal Traditioal Rach homes i southeast Dever. Two years ago, Historic Dever worked with the eighborhood to idetify the uique characteristics of the eighborhood. With a grat from the Natioal Trust for Historic Preservatio, we partered with the Ceter of Preservatio Research at the Uiversity of Colorado Dever to create the Krisaa Park Patter ad Desig Idea Book. Historic Dever News FROM THE DIRECTOR Photo: Havey Productios BULLDOZERS have bee makig frequet appearaces i eighborhoods across the city over the last year ad 2015 statistics cofirm that there were more demolitio permits issued i Dever tha ay other year sice 2006, whe Dever s Ladmark Ordiace was ameded to provide a demolitio review provisio iteded to idetify potetially sigificat structures before their demise. Betwee Jauary ad October of 2015, 632 demolitios applicatios were submitted, as well as 105 Certificates of No-Historic Status (CNH) applicatios. Of these 737 applicatios, 34 were cosidered potetially eligible for idividual ladmark status. By year-ed, aother six potetially eligible properties were posted as part of a demolitio otice or Certificate of No-Historic Status. This geerated a lot of work for Historic Dever, ad obviously a lot of cocer i eighborhoods that struggled to respod. The fast-paced ature of the curret developmet cycle, ad recet preservatio cotroversies, have created cofusio about the demolitio review process, ad particularly the role of the Certificate of No-Historic Status. Sice the begiig of 2016 this cofusio has led more tha oe historic buildig ower to apply for a CNH whe it was ot eeded, which causes uecessary heartbur for both the owers ad the commuity. As a result, Historic Dever has bee workig to create educatioal resources about the demolitio review process, ad the protocols commuity members ca use to egage with property owers whe a property has bee posted as potetially eligible for historic desigatio as part of the demolitio review process. The Certificate of No-Historic Status was created as part of the demolitio review ordiace i 2006. It was iteded to give property owers the optio to gai certaity about a buildig s potetial for historic desigatio, eve if demolitio plas are ot immiet. Ulike a demolitio permit, a CNH is valid for five years ad rus with the property, ot the ower. Durig that five-year period the ower ca pursue a demolitio permit with o further historic review by city staff. A CNH is grated if a buildig does ot potetially meet two of out of the three required desigatio criteria (history, architecture ad geography), or if it does meet those criteria ad is posted for public otice, but receives o respose (i.e. a desigatio applicatio) from the commuity. A CNH is also grated if a desigatio applicatio is filed but is ot complete, or if a applicatio is ot approved by the Ladmark Commissio or City Coucil. Despite its ame, the CNH does ot automatically mea that the property has o historic merit. Ideed, after the five year CNH period the property could be recosidered for desigatio, or would at least be flagged agai if a ew CNH were filed. However, the most commo ad practical reasos property owers may apply for a CNH are if: demolitio is desired; a site is beig marketed for sale as a scrape site; or as part of a purchaser s due diligece if they are iterested i scrapig. I these circumstaces the CNH allows the ower to test the waters ad gauge the commuity setimet about a particular buildig. Based o the commuity s reactio, the ower ca chose whether to proceed with the applicatio despite objectios ad risk the cotroversy, or withdraw ad pursue aother aveue. A CNH is absolutely ot ecessary if a ower simply plas to reovate a o-desigated, potetially historic structure. A CNH is also ot ecessary if the ower plas to sell a site but believes it will be reused ad remai itact. I these circumstaces a CNH will oly serve to create commuity cocer ad costeratio, ad ivite uecessary cotroversy. But how does the commuity kow if the CNH is a real threat? What actios ca commuity members take to ecourage a preservatio outcome? First, ad most importatly, commuity members ca cotact the ower. A applicatio for No-Historic Status is a public documet ad ayoe ca ask the city for a copy i order to obtai accurate cotact iformatio. Because there ca be varied reasos someoe has applied for a CNH, icludig a misuderstadig about what the certificate is used for, a simple phoe call ca help determie the ower s plas. This is also a opportuity to explai to the ower what is special about the buildig, ad why the commuity cares. Fially, owers are ot always aware of the various icetives available to help support property owers, ad this first call ca be used to begi a coversatio. Commuity members ca, of course, also cotact Historic Dever. I the curret climate Historic Dever does ot have the capacity to react to every demolitio ad CNH otice, but we do review them all ad use our ow iteral evaluatio to determie if actio is warrated. Oe evaluatio criteria we use is whether there is clear iterest i the commuity, ad whether there are commuity members willig to be ivolved. We also cosider the historic sigificace of the property, its public beefit i terms of the umber of people likely to be affected by demolitio, ad the likeliess of fidig a outcome or compromise that works for all parties. Historic Dever ever takes actio related to a CNH postig, or a demolitio postig, without first cotactig the ower. I a umber of cases this cotact has resulted i a positive preservatio outcome, with the ower volutarily withdrawig the CNH applicatio. For example, i 2015 Historic Dever saved five posted properties through commuicatio with the owers ad clarificatios about the processes ad optios. This icluded a high profile save at 1899 York Street. More recetly Historic Dever worked with the ower of 3064 Speer ad 2822 Federal, ad i both cases the owers withdrew their applicatio so that they ca lear more about preservatio optios. I this heighteed climate of frequet demolitios, it is easy to feel alarmed whe a CNH applicatio or demolitio otice is posted o a property you care about. We hope that the protocols posted o our website ca serve as a guide for commuity members, so that preservatio is give every cosideratio. We also ecourage commuity members to work proactively to foster preservatio actio, either through historic district efforts, or by givig a friedly call to the ower of your favorite local buildig ad providig them with preservatio resource iformatio before major decisios are made. Historic Dever recogizes that Dever is chagig, ad that demolitio is ot goig away, but through positive ad costructive actio, we ca esure that Dever retais its importat ladmarks ad uique character. The patter book is iteded to highlight the special features of Midcetury Moder homes ad help eighbors fid ways to sesitively remodel their homes to hoor the uique character of the eighborhood. As Dever chages, the Midcetury Moder character of Krisaa Park is beig threateed by iappropriate pop-tops ad the loomig specter of fullscale demolitio. Today s families may fid the origial 1200 square feet to be a tight squeeze, ad the lack of garage a remider of their home s advacig age. Fortuately, these homes were desiged to be easily expaded. Some moder expasios, however, such as a full two story additio, egatively affect the historic character of the eighborhood ad ifrige o the prized privacy of the backyard ext door. As the eighbors worked with Historic Dever, they leared more about other tools they might use to protect the character of their eighborhood. As is typical, it ca be hard to view middle class, post-war housig as historic or worthy of preservatio. Additioally, may eighbors did t wat the desig review that comes with historic district desigatio. As such, a historic district was t the right fit for the eighborhood. Istead, a group of eighbors o S. Ediso Way spet a etire year learig about coservatio overlays, idetifyig the key features of their eighborhood that they wated to protect, ad workig with the city to tur those features ito zoig code laguage. This ability to tur architectural characteristics ito code is a key differece betwee sigle-use zoig ad form-based zoig. Form-based zoig describes the geeral character of a area, startig at the eighborhood level ad workig dow to the lot. The zoig code otes the commo street ad block patters; buildig placemet ad locatio; buildig height; ad mobility (i.e., the trasportatio optios available i the area). These preexistig eighborhood characteristics serve the basis of the resultig forms proscribed i the zoig code. The curret zoig for Krisaa Park is S-SU-D, which stads for Suburba - Sigle Uit - 6,000 sq ft lot. I the S-SU zoe district, buildigs ca be 2.5 stories, with a maximum height of 30 feet. The code also dictates set back requiremets based o lot size, ad eve cotais some desig stadards such as requirig a etry way o the primary street façade to promote pedestria access. Krisaa Park eighbors idetified four characteristics they cosidered to be defiig features of their eighborhood: placemet of the homes o the lots to esure privacy; low pitched rooflies with horizotal emphasis; low scale, sigle story or split level buildigs; ad subordiate additios. These idetifyig characteristics are subjective oe perso s subordiate additio may stick out like a sore thumb to someoe else. Because the eighborhood was ot lookig for historic desigatio ad the resultig Desig Review from the Ladmark Preservatio Commissio, they eeded to tur these characteristics ito objective laguage ad buildig forms that ca be regulated through the zoig code. The resultig coservatio overlay targets five aspects of the buildig form ad lot, to esure that future developmets or additios are i keepig with the Midcetury Moder character of the eighborhood. The maximum buildig height has bee reduced from 2.5 stories to 1.5, or 18 feet, whichever is shorter. The maximum roof pitch is set at 3:12, which will maitai the low-slug character of the buildigs. To maitai privacy i the expasive backyards, roof top decks are prohibited. To offset the edict agaist a full secod-story additio, the zoig code has reduced the miimum rear set back requiremet from twety feet to fiftee feet. This will allow homeowers to build larger additios to the rear of the property. Oly future additios or redevelopmet projects will be required to adhere to the ew zoig i the coservatio overlay. Existig additios that do ot meet the ew stadards are allowed to remai. As eighborhoods throughout Dever work to idetify ad articulate their uique characteristics ad decide the best ways to hoor those traits, coservatio overlays deserve a close examiatio. As a less itese alterative to historic districts, they are ideal for eighborhoods that wat to ecourage thoughtful redevelopmet that is i keepig with wider eighborhood character. As Dever cotiues to feel the pich of developmet across the city, coservatio overlays provide a opportuity to recogize the micro-cotext of a area ad to promote a fie-grai approach to developmet that is ot always possible with stadard zoig. The Natioal Wester Stock Show has historically bee ad cotiues to be a major ecoomic evet for Dever ad Colorado, drawig farmers, rachers, ad tourists from aroud the atio. Historic Dever is glad to see the City of Dever formally ackowledgig the historic importace of this buildig ad protectig the legacy of the Stock Show for geeratios to come. Photo: Dever Public Library Wester History Collectio Stadium Area Gais Local Historic Desigatio This sprig, the City of Dever, followig a recommedatio from the Master Pla for the Natioal Wester Complex (2014), moved forward with a historic desigatio for the 1908-09 Stadium Area. Approved by the Ladmark Preservatio Commissio o March 15th, the desigatio wet before City Coucil for a public hearig ad a fial vote o April 18th. Historic Dever has worked hard over the last five years to ecourage preservatio at the Stock Show site, ad we were pleased to provide public testimoy i support of this desigatio. City Coucil approved the desigatio with uaimous support. The Stock Show Master Pla idetifies the Stadium Area, the oldest buildig costructed for the Stock Show, as a key historic buildig o the site. Oe of the stated goals i the Master Pla is to hoor the autheticity ad origis of the site, preservig architecture ad features that have historic ad cultural merit, while efficietly reusig them ad itegratig with ew facilities. The desigatio applicatio is the result of more tha three years of aalysis, coversatio ad plaig about this importat historic site. It provides opportuity for both meaigful preservatio ad sigificat redevelopmet. These coversatios were the result of commuity iterest geerated i 2012 whe DPS aouced its plas to move the school ad sell the site, ad applied for a Certificate of No-Historic Status, which allows for demolitio withi a five-year period. Historic Dever received immediate respose from commuity members, ad asked DPS to cosider a more i-depth process before movig forward, a process that would hoor the DPS policy o historic schools, established i cosultatio with Historic Dever i the early 2000s. By the 1920s, the school was so popular that DPS ivested i a expasio, costructig the buildig that ow sits at the corer of 12th & Welto. It was expaded with two sigificat additios i 1947 ad 1956, completig the build-out of the Welto Street side of the block ad replacig the 1880s Logfellow School that Griffith had first used. The origial 1926 buildig was desiged by E. Floyd Reddig. The two additios were desiged by Gordo Jamieso i the early 1940s. Jamieso was a otable moderist architect who oce worked with Eugee Groves, ad his desigs were implemeted over time as the school developed the resources for ew costructio. The 1926, 1947 ad 1956 buildigs are iter-coected ad today are experieced as oe buildig with multiple etraces. All three sectios are four stories tall ad costructed with Dever s sigature red brick ad terracotta. These buildigs represet the most historically, architecturally ad geographically sigificat aspects of the Emily Griffith site, represetig the story of the school, Griffith s legacy, ad the importace of the school site i the developmet of dowtow Dever. The Welto Buildigs, as the itercoected structure has come to be kow, are the cotributig buildigs i the desigatio applicatio ad are to be protected ad preserved. Gradually DPS also acquired lad to the east of the origial buildig ad costructed a series of mostly oe-story shops o Glearm Place. While iterestig i terms of their coectio to the techical programs of the Opportuity School, the buildigs have less architectural ad geographical sigificace, ad as a result the easter portio of the block is deemed o-cotributig i the desigatio applicatio. O this portio of the site a future developer ca build accordig to the Dowtow zoig, dowtow desig guidelies, ad a special set of site-specific guidelies iteded to esure compatibility ad itegratio with the historic structures o Welto. There is o particular height limit i this sectio of dowtow, as height is a factor of use ad floor area ratio. Additioally, the desigatio applicatio defies a trasitioal area at the ceter rear portio of the Welto buildigs where a coectio to the ew developmet to the east may be made. This coectio ca physically attach to the historic structures if eeded, ad partial demolitio i this area is described as allowable i the applicatio. However, the street view of the Welto Street Buildig from three sides will be carefully preserved ad this trasitioal area, if used by a future developer, will be perceived as a rear additio to the origial structure, steppig up to a potetially larger structure o the Glearm side of the block. DPS officially listed the property for sale the same week the desigatio was filed. The itetio is for the desigatio ad sales process to occur cocurretly, with the desigatio becomig official before a sale closes. DPS has icluded iformatio about the preservatio provisios i a request for proposals from developers. Block of Licol Street Seeks Historic District Homeowers i the 200 block of South Licol Street are movig forward with a local historic district o their block. The block ecompasses fiftee homes built betwee 1889 ad 1895, all of which embody Quee Ae architecture. Oe of these homes (227 S. Licol St.) was desigated a idividual historic ladmark i 2015. William Lag desiged eight houses o the west side of proposed historic district. The block is believed to be the largest collectio of itact Lag-desiged homes i Dever. Bor i Illiois i 1845, William Lag moved aroud the Midwest before settlig i Dever i 1885. It is ot clear if he ever had formal traiig as a architect or was etirely self-taught. Either way, he had a prolific career i Dever, desigig over 250 buildigs, icludig the Molly Brow House, Castle Mare Masio, ad St Mark s Parish Church. All of the homes o South Licol Street have Lag s quitessetial hallmarks of Quee Ae desig, which ofte icludes asymmetrical forms, steeply pitched roofs, varyig wall textures, wrap-aroud porches ad tured porch spidles. Thousads were movig to the growig city, icludig JJ ad Margaret Brow. They, alog with their two childre, moved to Dever i 1894. The Brow s ew residece was elegat. The Quee Ae style home located at 1340 Pesylvaia Aveue was located i the popular ad up-ad-comig Capitol Hill eighborhood. Built by otable Dever architect William Lag, the three-story house had four fireplaces, two large lio statues guardig the frot of the house, ad boasted ew ad moder techologies, icludig electricity, cetral heatig, idoor plumbig, ad a had-crak telephoe. There was also a carriage house at the back of the property. This, of course, is the Molly Brow House Museum today. Despite the popular belief that Margaret ad JJ were shued by Dever s high society, they were very much part of it. I fact, from 1894 to the early 1920s, the Brows took up more space i Dever s society pages tha early ay other Dever family. As Dever grew, high society bega to thrive, ad the Brows were very active i the world of Dever s upper class. JJ ad Margaret would have ejoyed lucheos, parties, ad other social evets o a regular basis. The famous Brow Palace Hotel o 17th Judge Bejami Lidsey, ofte kow as Dever s Kids Judge for his pioeerig reform of Dever s juveile court system. So similar, ad ot to metio boisterous about their passios, were Margaret ad Justice Lidsey that before they first met at a Dever dier party the host remarked Mrs. Shafroth ad I had a wager as to which oe would outtalk the other. Youth justice reform was oly oe of Margaret ad Justice Lidsey s causes. The two were also both strog propoets of geder equality. Justice Lidsey i particular advocated for equal rights to be shared i a marriage ad for both parties to have a say regardig procreatio, child-rearig, ad eve divorce, all of which were very taboo subjects durig the period. Lidsey was so committed to these ideals that i 1927, alog with coauthor Wairight Evas, he published The Compaioate Marriage a book that outlied the priciples ad structure of marriage ad geder equality that Lidsey so strogly believed i. For Lidsey, The Compaioate Marriage was a way for him to outlie i legal terms, social ad private cocepts that he believed were ready to be implemeted throughout America. I the itroductio of the book Lidsey defied a compaioate marriage as legal marriage with legalized birth cotrol, ad with the right to divorce by mutual coset for childless couples, usually without paymet or alimoy. These priciples, blasphemous for a majority of the coutry ad for may of Lidsey s readers, were met with strog criticism. Lidsey most certaily was prepared for this criticism, as he had dealt with critics his etire life. With houses of early every style datig betwee the 1880s ad the early 20 th cetury, River Drive remais remarkably preserved ad itact somethig oe certaily caot say for the rapidly-chagig Jefferso Park eighborhood that surrouds it. As you might expect, there are plety of stories that this short stretch of pavemet ca tell us ad may that may surface agai. Prior to the arrival of I-25, River Drive saked dow the hillside to the Platte River that gives the street its ame. But the oly thig flowig o River Drive was the beer brewed at the earby Zag ad Tivoli breweries. Zag Brewery, located o earby Water Street, was the successor of the first brewery i Dever, the Rocky Moutai Brewery. Phillip Zag, a immigrat from Barvaria, via Ketucky, origially started out as the maager of the brewery, usig his previous brewig experiece to quickly become idispesable to the compay. Zag bought it out i 1872, chagig the ame to the Zag Brewery. While Philip died i 1899, his so Adolph carried o operatios util 1913. What started out as a 2,000 barrel operatio became Dever s largest brewery, producig early 175,000 barrels a year at the height of productio. Prohibitio, however, proved to be disastrous for the brewery, which shuttered i 1927. The site of the brewery is ow home to the Dever Aquarium, although two related historic buildigs reamai o Water Street. Zag hired Theodore Beck to be head brewer i the 1880s. Today, the Beck House sits at the ed of River Drive, where it is still possible to view what s left of the Zag Brewery o the other side of the iterstate. Above groud, what stads out perhaps the most about River Drive is the way that otherwise stadard home desigs were adapted to the road s uusual grade. A ewspaper report from 1898, whe the houses were just a hadful of years old, referred to the road s grade as precipitous, ad the Quee Ae homes were built with uusual etraces. A trio of houses colloquially kow as the three triplets all built aroud 1890 are located toward the orthwest ed of River Drive. Each features a differet take o the modified etrace look. Late 19 th cetury photos of some of the houses are part of the Dever Public Library s collectio ad they reveal that the houses remai largely uchaged today. The first two have suke frot porches that could almost be called subterraea, beig a few steps below road level, while the third marries Quee Ae architecture with a half doze steps up to its ew porch. Walk a few houses dow the street, closer to the Platte River, ad three more houses appear to be pushed ito the earth. A terrace-style, two-story quadplex, like those built i so may other parts of Dever, is also half-suke, creatig a Europeastyle garde apartmet. However, the uusual bridges required to access its secod floor uits from the street hardly look origial, so a more thorough study of the buildig s past may be due. The street was graded i its curret cofiguratio i the 1950s, supposedly whe ew pipes were buried to address draiage issues of what is possibly Dever s most ueve street. The origial flagstoe has sice bee replaced by a arrow cocrete sidewalk. At the time, or at least ot log after, may of the street s homes were owed by members of the same family. Although the family has sice moved o from the eighborhood, log-time residet Joa Body recalled that uits of the family would routiely swap houses betwee each other. That sort of camaraderie remais o River Drive today, which stads as somethig of a islad i moder, boxy Jefferso Park. Eve a quick jaut dow this hidde gem reveals a full tour of late 19 th ad early 20 th cetury architecture. If you did t kow better, you could be forgive for thikig that the buildigs had bee relocated to this agled stretch of Northwest Dever i order to give passersby a glimpse of old Dever.
