Our experiences with.. The development of a new EAD (for a product characteristic not covered by ETAG 001) Timescale and procedure acceptable EAD is already published in the OJEU and used also by other manufacturers for ETAs The transition of a CUAP into an EAD (based on one ETA application) Timescale and procedure acceptable EAD is finished since 2014 First ETA issued in January 2015 But: EAD is still not published in OJEU (last checked in October 2016) -> no Notified Body published in NANDO -> no legal CE marking and DoP! The transition of a CUAP into an EAD (based on several ETA applications at two different TABs) TABs did not find an agreement 2 concurrent EAD drafts have been presented to EOTA Situation was solved only by withdrawal of one ETA application. 7 Our experiences with.. The transition of a ETAG 001 into an EAD Precedence case for all other ETAGs? Pre-condition, based on an agreement between EOTA and European Commission: No technical changes in the first edition of this EAD -> simple transformation of the ETAG content into the new philosophy of ETAs under the CPR and into the EAD format Technical work in EOTA WG Strong influence of the Commission services Several correction loops and changes of the EAD format Technical level of ETAs for mechanical anchors frozen since 2013 -> No coverage of innovative products and of new performances Immediate need for revision of the new EAD! 8 4
But this is the past let s talk about the future! Open questions How can the publication of finished EADs in the OJEU be speed up? How can the problem of the (non-)availability of Notified Bodies for new (and revised?) EADs can be solved in a short term? EAD is only published in the OJEU, after the first manufacturer uses a CE mark for a product with an ETA based on this EAD Notified bodies are published in NANDO only after the publication of the EAD in the OJEU For the manufacturer, there is no legal way to CE mark his product without a Notified Body! -> Back to start! How to handle new aspects (special applications etc.), coming from ETA applications, which are not covered by a present EAD? Incorporation into the basic EAD or separate EAD? Can ETA, DoP and CE mark refer to only one EAD or to a combination of technical specifications like EAD1+EAD2 or hen+ead? 9 Let s talk about the future! Questions around the revision process of EADs Need for a change-log (missing in the first 01- and 02-versions!) Procedure for the adaption of ETAs, which are issued based on the previous EAD versions (if the changes in the EAD are safety relevant) - Guideline by EOTA necessary for manufacturers, distributors, end users and market surveillance! Notification of bodies based on the previous EAD version should be valid also for the new version Availability of the previous EAD versions necessary for reference purposes 10 5
Potential for improvements of the CPR Clarifications regarding the (unlimited) validity of ETAs - Which do no longer reflect the state of the art after EAD revisions or - Which contain safety relevant mistakes - E. g.: bending strength of the screw for a plastic anchor calculated based on the outside diameter, not core diameter DoP should not be mandatory for products with ETA - ETA contains all relevant information - End users still prefer the ETA and do not understand the purpose of an (additional) DoP Consideration of aspects of the practical use of construction products on site ( robustness against foreseeable deviations from the manufacturers instructions) Review of procedural aspects (Annex II etc.) 11 Thank you very much for your attention The CFE companies and national associations T.
