Procedure Title: PUBLIC WORKS Processing Requests & Petitions For Streets To Be Improved/Chip Sealed Beginning in May each year, residents are invited to fill out the PETITION FOR CHIPSEAL Form (Attachment 1) and attach a list of signatures from property owners who wish to have a certain road chip sealed or paved (Attachment 2). An instruction on how to complete the form is also included (Attachment 3). The following describes the schedule, events, requirements and procedures from petition to final approval of a street to be improved through the Petition Process. 1. All Petition Forms are to be delivered to Nye County Public Works Department office in Pahrump or indirectly through County Commissioners, by October 31st of each calendar year. 2. Petitioners willing to share half the cost of improvement will mark the appropriate boxes on the Petition Form. 2.1. Petitioners willing to share cost of road improvements with County will receive special consideration. 2.2. The cost of the road improvement includes all preparatory work including base, sub base, sub grade, drainage preparation, and surface treatments or asphalt paving. 3. Public Works will: 3.1. Research Right-of-Way (ROW) to ensure dedicated full width ROW. If the ROW is not full width and dedicated a list will be generated of property owners and parcel needing to dedicate ROW. Work with the Planning Department to fill out ROW dedications. Contact property owners, with no promise of road improvements, to determine if they are willing to make the necessary ROW dedications. 3.2. Conduct a field investigation to determine the following: Number of residences and businesses Type of business 1 of 2

Processing Requests & Petitions For Streets To Be Improved/Chip Sealed (continued) Existing topology and current condition of grading or previous improvements Soil types Drainage issues Encroachment issues Nearest hard surface street for road connection Volume and type of traffic 3.3. Conduct office research and document the following: The PM 10 air pollutant generation zone to which the street belongs based on NDEP PM 10 map Level-of-Service (LOS) of surface designation such as major or minor collector Width of ROW proposed by Master Plan Zoning designated by the Mater Plan Determine if it is a bus or truck route If there are any currently proposed projects in area that will impact or contribute to cost of proposed street improvement Any soil reports completed by other projects in the area 3.4. Prepare preliminary plan for a public workshop with the following: Recommendations to pave or chip seal with rationale ROW information Traffic section Important Issue clarification Chip Seal costs Pavement costs Drainage costs; and Assumptions and conditions 4. An Annual Public Workshop for Chip Sealing/Paving will be held on Monday the third week of February for public viewing and discussion on the proposed Chip Sealing or Paving Plan for the following fiscal year. 5. Subsequent to the Annual Public Workshop for Chip Sealing/Paving and no later than the third week of March, Public Works will submit a final plan for the RTC and BOCC approval with cost estimate and back up of rationales. 6. Chip seal and paving contracts are expected to go out for bid by the first week of April. 7. Chip sealing and paving works are expected to commence on the third week of June subject to permitting of weather and unusual circumstances. 2 of 2

Attachment 3 CHIPSEAL PETITION FORM INSTRUCTION SHEET 1. Contact Name and Contact Phone Number - This is the person that will interface with the County if it becomes necessary. This person will act as a liaison between County personnel and the petitioners on all matters. 2. Road Name, From Road, and To Road - Place the name of the road that is to be chip sealed in the first column. The second column is where the chip seal will start and the to road is where chip seal will end. Use one row for each road being petitioned. In order for the chip seal surface to last, the County likes to start from a road already paved or chip sealed and end on a road already paved or chip sealed. 3. Number of Homes - Place the total number of occupied homes that address off the street being petitioned. 4. Number & Types of Businesses - Place the number and types of businesses that address off the street being petitioned. 5. School Bus Route # (If applicable) - Place the route number(s) of the school buses that use this road. 6. Voting District - Please check the appropriate box for the voting district that the petitioned road is in. This information is used to identify the Commissioner for that district. 7. Are petitioners willing to share the costs of half the road? Yes No - If the petitioners are willing to share half the costs of road improvement including all preparatory work of the base, subbase, subgrade, drainage preparation, surface treatment or asphalt pavement then check yes. If not, check no. 8. Additional Comments - Provide any unusual and supporting reasons why the street petitioned should be chip sealed. 9. If yes, do petitioners want to consider pavement or chip seal - If the petitioners are willing to share the costs and want to consider pavement instead of chip seal. Pavement will last longer and take heavier loads while standing up to stopping and turning better. However, it is more expensive. Please check the appropriate box for an estimate. Check both boxes if petitioners would like to see both costs. 10. Please fill out the form completely for best consideration. Attach maps if available - Lack of information may cause the petition to not be given full consideration. For example if there are two school buses using the route and nothing placed in the box, the road will be ranked lower then streets that have one bus. Attach an assessor s map or other map highlighting the roads being petitioned. 11. Print Name, Address, Phone Number, and Signature For each person signing the petition please fill out all the information. Please do not have people sign twice.
