tem of nterest ---TAMPA -- ASPCA settles out of court A legal battle that has dragged on for more than a decade between one of the country's bggest anmal welfare groups and a celebrated crcus has been settled out of court. The Amercan Socety for the Preventon of Cruelty to Anmals has agreed to pay $9.3 mllon to the owners of the Rnglng Bros. and Barnum & Baley Crcus, accordng to court documents. The ltgaton has spanned 12 years and stems from allegatons of elephant abuse the ASPCA made aganst the crcus. The settlement was reached earler ths month; the socety pad the money to Feld Entertanment, the owners ofthe crcus, on Thursday. "Ths case was never about elephants," sad Steve Payne, spokesman for the Venna, Va.based Feld Entertanment. "t was about ther poltcal agenda." Feld Entertanment has deep tes to the Tampa area, whch s the crcus' wnter home. The company also owns the 200-acre Center for Elephant Conservaton n Polk County. Kenneth Feld, the owner of the Feld Entertanment, sad the settlement s a major vctory aganst the anmal rghts actvsts who have been "attackng our famly, our company and our employees for decades because they oppose anmals n crcuses." The settlement, Feld sad, "s a vndcaton not just for the company but also for the dedcated men and women who spend ther lves workng and carng for all the anmals wth Rnglng Bros. n the face of such targeted, malcous rhetorc." Socety offcals sad n a statement released Frday that "t s n the best nterests of the organzaton to resolve ths expensve, protracted ltgaton." The organzaton declned to comment further. Payne sad the lawsut has cost hs company $20 mllon over the years. Feld Entertanment wll proceed wth lawsuts aganst the remanng sx defendants n the federal case, whch ncludes the Humane Socety of the Unted States, he sad. The orgnal lawsut fled by the anmal rghts groups clamed the crcus volated the elephants' protecton under the Endangered Speces Act. Traners, the lawsut sad, used metal-tpped prods and chans on the elephants. At the tral n 2009, Kenneth Feld testfed the elephants were not hurt and that the nstruments were necessary to keep the anmals under control and to protect the publc. n January 2010, U.S. Dstrct Court Judge Emmet Sullvan ruled n favor of Rnglng Bros. and found that a former Rnglng employee, Tom Ryder, dd not have legal standng to sue the crcus. The U.S. Dstrct Court of Appeals n Washngton upheld Sullvan's rulng, fndng that Ryder was "essentally a pad plantff' because he receved at least $190,000 from the anmal rghts actvsts pursung the case. The ASPCA sad n a statement that t admtted no wrongdong or lablty n agreeng to pay the $9.3 mllon settlement. "The court decded... on the ssue of standng, and never ruled on the merts of the elephant abuse allegatons," socety offcals sad. Payne sad Feld Entertanment and the crcus takes good care of ts anmals. The Rnglng Bros. crcus wll be n Tampa on Jan. 2-6, and the publc wll have opportuntes to see elephants and other anmals up close at what the crcus calls ts Anmal Open House, he sad."come out and see for yourself," Payne sad. "See how our anmals are thrvng."
