Introduction The following Rules and Regulations have been set forth by the Board of Directors to govern the use of the common property and the improvements thereon. They are considered both reasonable and necessary to help ensure the enjoyment of the community for all residents. The governing documents for the Calusa Palms Master Association requires all owners, tenants, invitees and guests to obey said rules and regulations at all times. Said rules and regulations are as follows: General Provisions 1. No Smoking No person shall engage in smoking on any portion of the Calusa Palms Master Association recreational grounds or facilities located at the Clubhouse. This includes but is not limited to the interior of the clubhouse, the clubhouse grounds and parking area, the fenced in area of the swimming pool, bocce ball court, tennis court and putting green. Smoking shall mean inhaling, exhaling, burning, carrying or possessing any lighted tobacco product, including cigarettes, cigars, pipe tobacco and any other lighted tobacco products and includes electric cigarettes and vaporizers, vapors, and vape pens. Community Parking Rules 2. The ONLY permitted parking locations are driveways, garages, overflow parking lots and the streets of Calusa Palms from 6:00am to 12:00am (midnight). Street parking is limited to the sidewalk side of the street. Street parking past midnight is allowed on federally observed holidays such as New Years Day, Martin Luther King Day, Washington s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day. 3. Parking in the Calusa Palms overflow lots between the hours of midnight and 6:00 a.m. shall be on a First Come Basis except for the time period of December 15th to March 31st annually. During this time period, only vehicles that have been properly registered with the management company will be allowed to park in the overflow lots during the hours of midnight to 6:00 a.m. Any vehicle found in the parking lots that is not properly registered will be subject to towing and will be towed at the owner s expense. An owner may register one vehicle to park in the lots for no more than fifteen (15) days in any calendar month. To register a vehicle, the owner must provide the following information: - Owner s Calusa Palms Address - Vehicle description as to Year, Make, Model, Color, and License Plate Number - The Day(s) or range of days the vehicle will be in the lots The lots will be monitored and any vehicle parked in a lot for any amount of time on a day that is not registered with the management company or a vehicle that has exceeded the 15 day limit, will be noted, photographed, reported to the management company, and issued a warning. The warning will provide the vehicle owner a two day grace period during which the owner may remove the vehicle or properly register the vehicle with the management company. If the vehicle is not removed or properly registered, it may be towed at the owner s expense. 4. There is NO parking in front of fire hydrants, mailboxes or driveways. Page 1 Revised 05-03-2018
5. There is NO parking on sidewalks, grass aprons or grassed areas. Parking cars on, across or otherwise blocking a sidewalk violates the Americans with Disabilities Act (ADA). 6. There is NO storing of vehicles on any property, public or private, except in garages. 7. There is NO parking of commercial or recreational vehicles (including but not limited to vehicles with commercial lettering or equipment attached, stake body trucks, flatbeds, motor homes, trailers, boats and other watercrafts) on any lot of property unless it is enclosed in the garage. 8. Trailers and storage pods used to move in or from a property may remain in the driveway of that individual property for no longer than five (5) days. 9. Obey all speed restrictions, stop signs and handicapped signage. 10. Illegally parked vehicles may be FINED and/or TOWED, with the costs of reclamation at the owner s expense. Towing Company may change from time to time. Current information can be found on signs at the entrance of the community. Swimming Pool Rules 11. Swimming pool is open from dawn to dusk. There is NO swimming outside of these hours. 12. There is no lifeguard on duty so residents and their guests swim at their own risk. 13. Floats and rafts are permitted as occupancy allows (less than twelve (12) people in the pool). 14. Please shower before entering the pool. 15. Children still in diapers are required to wear swim diapers while in the pool. 16. Children under the age of fourteen (14) must be accompanied and supervised by an adult. 17. There is ABSOLUTLEY NO DIVING OR JUMPING INTO THE POOL. This pool is considered a shallow water pool and diving and jumping can present the risk of back, neck, and other severe and even life threatening injuries. 18. There is ABSOLUTLEY NO HORSEPLAY, BALL PLAYING OR RUNNING ON THE POOL DECK. There is NO horseplay in the swimming pool, including but not limited to, chicken fights, carrying someone on your shoulders and throwing people and/or things in the pool. 19. NO FOOD, DRINK, GLASS OR ALCOHOLIC BEVERAGES PERMITTED ON THE POOL DECK! Plastic bottled water is permitted. All coolers, food, drinks, etc. are to be left on the rear clubhouse deck with that area being designated as the area where food and drink are permitted. 20. Audio or other similar entertainment devices are permitted in the pool area with earbuds or earphones. Audio without those devices must be kept at a level consistent with county regulations. Music at an appropriate volume level is allowable for community events such as aquasize or other Board-approved activities 21. Entries to the swimming pool area including the clubhouse door and swimming pool fence gates may not be propped or left open. Page 2 Revised 05-03-2018
22. Parties are NOT permitted on the pool deck. CALUSA PALMS MASTER ASSOCIATION 23. Proper bathing attire is required for use of the Calusa Palms pool facilities. No cut-off jeans, underwear, thong bikinis, etc. are permitted for safety and health reasons. 24. NO pets, roller blades, skates, scooters, bicycles or similar items are allowed inside the fenced in pool area. THIS FACILITY IS FOR THE ENJOYMENT OF ALL RESIDENTS AND THEIR GUESTS. PLEASE BE COURTEOUS IN THE POOL AREA AND FOLLOW POSTED FOR HEALTH AND SAFETY REASONS. Clubhouse Rules 25. The Clubhouse is open from 5:00 a.m. to 10:00 p.m. 26. All persons using the Clubhouse facility are required to lock and secure the windows and doors of the facility when leaving as well as shutting off all lights, fans, and TVs. Clubhouse doors may not be propped or left open. 27. Residents may access the clubhouse and swimming pool with a key fob. Key fobs may be purchased from the management company. 28. The Association assumes no risk or responsibility for any person entering the facility or grounds. 29. Reservations are required for the use of the clubhouse for all board meetings or events. The clubhouse may be rented by residents for private events. Only CPMA sponsored events are exempt from clubhouse rental fees. Residents are prohibited from entering the clubhouse during private events and should access the restrooms from the outside entrance. 30. Rules and regulations that are posted in any particular area, room, or facility (i.e. the kitchen, gym, etc.) will control the use thereof and shall be deemed supplemental to these Rules and Regulations. 31. Owners and Renters are responsible for their guests and are expected to apprise them of the Rules and Regulations for the use of the facilities. Damage caused by Owners or Renters or their guests will result in the Owner or Renter being held responsible for the cost of the damage. 32. It is expected that all persons using the facilities shall conduct themselves in a courteous manner with due regard for the rights of others to use and enjoy the facilities. 33. It is expected that all persons using the Calusa Palms Clubhouse will be properly attired. Persons in bathing suits must wear an additional cover-up except around the pool area. All persons entering or exiting facilities must wear footwear for their protection. Footwear, bathing suits, and clothing must be thoroughly dry before entering the Clubhouse, in order to prevent slipping on wet floors or getting the furniture wet. 34. Advertising, signs, leaflets, petitions, papers or other written material shall NOT be distributed or posted on the premises without the written consent of the BOD. Sale of merchandise or fund soliciting is NOT permitted without BOD approval. Page 3 Revised 05-03-2018
35. The management company will have the facilities cleaned on a regular basis. Please do your part to keep YOUR clubhouse clean by removing food waste from the clubhouse and disposing of your trash. Any food left in the clubhouse will be assumed unwanted and thrown out upon cleaning. Please wipe down countertops and clean up any messes you create while enjoying the facilities. Additional it is expected that you return all furniture to its proper location and appearance. Bocce, Tennis and Putting Green Rules 36. Facilities are for owners, tenants and/or their guests. 37. Proper shoes are required. No spikes are permitted on any of the above surfaces. 38. No bicycles, scooters, skates, roller blades, etc or pets are allowed on any of the above areas. 39. Play is limited to one hour if there are other residents waiting to play Fitness Center Rules 40. The fitness center is open from 5:00 a.m. to 10:00 p.m. 41. No one under 14 years of age is permitted inside the fitness room for any reason. 42. Any people using this facility must do so at their own risk and the Association assumes no responsibility for any action-taking place in this room. 43. Anyone using the fitness room must bring a towel with them to wipe down the equipment. 44. Proper attire must be worn at all times: this includes closed shoes (no sandals), sneakers, shorts/pants, and a shirt. Bare chests and/or bathing suits are not permitted. 45. Entertainment players are permitted with earplugs/headphones. 46. Anyone damaging or misusing equipment will pay for its repair or replacement. If you do not know how to use a piece of equipment DO NOT USE IT. 47. Time limit on exercise equipment is 30 minutes if people are waiting to use the equipment. Please be courteous to others who are waiting their turn. 48. No food or drink is permitted in this area except bottled water. 49. The Association is not responsible for personal items left in this room. Entry Gate and Clubhouse Security Rules 50. Access into the community is obtained by use of a Personal Identification (PIN) number or transmitter. Access to the clubhouse is obtained by use of a Key Fob. Transmitters and Key Fobs may be purchased from the management company. Owners are required to fill out and submit an Access Device Request Form which can be obtained from the management company. When purchasing a new device, owners are required to report any lost or stolen devices so that they may be removed from the security system. 51. All access devices must be registered with the management company under the owner s name and community address. Failure to do so could result in your device being accidently deleted from the system. 52. Owners who rent their home or unit must obtain access devices for their tenants. The association will not sell a device to anyone but the owner or their designated agent. 53. PIN s are assigned by the association and are for the personal use of the owners or their tenants. Owners are not permitted to provide their PIN number to others. Doing so will allow nonresidents to access the community. Residents should use the system s Guest Entry feature to provide access for contractors or guests. If you have a tenant that has left the community or believe that someone else may be using your PIN number, please contact the management office to have it changed. Enforcement Any violations of the rules and regulations may result in a fine or a suspension of your right to use certain amenities for a reasonable period of time. Violations will be enforced in accordance with the Calusa Palms Master Association governing documents and the enforcement procedures and policies set forth by the Board of Directors.
