HORNED AND POLLED HEREFORDS TERMS AND CONDITIONS Bidding: Each animal offered for sale will be sold to the highest bidder. Each bid shall constitute an offer to purchase and the final bid shall constitute a binding contract between buyer and seller. The auctioneer will settle any disputes as to bids and his decision on such matters shall be final. Terms: Terms of the sale are cash or bankable check (U.S. funds) unless prior arrangements have been made. All settlements are to be made with the clerks of the sale immediately following the conclusion of the sale. All embryos will be shipped at the buyer s expense from the embryo clinics where they are stored unless other arrangements are made between buyer and seller. Delivery of pregnant recipients should be arranged between buyer and seller. Announcements: Any changes from printed information of any kind will be announced from the auction block and such announcements shall take precedence. Registration Certificates: A certificate of registration and transfer will be furnished for each animal at no cost to the buyer. Identification: Seller offers each animal with a readable tattoo corresponding to registration. Buyer agrees to check tattoos for accuracy. Handling and Risks: Each animal will be the purchaser s risk as soon as sold. Rights and Obligations: In the event of default in any part on the Terms and Conditions concerning the sale by either the buyer or seller, it shall be the responsibility of either the buyer or the seller to instigate any action necessary to bring about a fair settlement of any claims arising from this sale and to be responsible for any and all costs involved therein. The sale management assumes no responsibility, legal or otherwise, for the failure of either the seller or buyer to fulfill their obligations. All persons who attend the sale do so at their own risk. Neither the sale manager nor any other person connected with the sale assumes any liability, legal or otherwise. Delivery: Sale management will assist in making the delivery. All such deliveries will be made at the buyer s risk. Livestock Mortality Insurance: Harding and Harding Insurance will be available. Please notify the clerk if you wish to insure your purchase. Health Guarantees: 1. All bulls will be tested for Brucellosis and appropriate health papers will be made available for immediate shipment. All females are officially Brucellosis vaccinated. Cattle selling to any area that requires additional testing will have to complete tests prior to shipment. 2. All bulls born prior to Jan. 1, 2017, have passed a semen evaluation by an accredited veterinarian. These results will accompany the bull s health papers. HOW TO PARTICIPATE AS AN ABSENTEE BUYER We have made preparations to bid and buy livestock through Superior Productions Call or Click-To-Bid service for those unable to attend in person on sale day. Please note that all of the lots in the sale will also be available for viewing online prior to sale day at www.superiorlivestock.com. HERE S HOW IT WORKS Turn in Bids Over the Phone. This is our traditional method of buying livestock. To get started simply go online to www.superiorlivestock.com and click on the tab titled Register for a Buyer Number. Select the registration form for Superior Productions and print the registration form, fill it out and fax it in to Superior Productions at 817-378-3380 with a signature on it, or scan and email the form to info@superiorauction.com. You can also mail it in to the address provided on the form. Upon receipt of this information Superior will call you with a buyer s number and the bid line phone number that you will use on sale day to place bids over the phone. Click-To-Bid This is Superior s online bidding platform for cattle buying. Please note that high speed internet is required this is not for dial-up or satellite internet.
