PENALTY: A person convicted of Failure Obtain Landowner Permission for Hunting shall be fined an amount of not more than $. COUNT VI: TAMPERING WITH OR FABRICATING PHYSICAL EVIDENCE, a felony, in violation of Montana Code Annotated --, in that the defendant, believing an official proceeding or investigation is pending or about to be instituted, altered, destroyed, concealed, or removed any record, document, or thing with purpose to impair its verity or availability in the proceeding or investigation. Specifically, in September or October, in Fergus County after Fish, Wildlife, and Parks executed a search warrant at the Meadow Creek Ranch, the defendant cut the antlers of a trophy bull elk skull and threw them into a pond (Bull No. ).
