6. BlueLine Grandfather Clause - Rights to Prior Year Advertisements If a parent or player completes the sale of an ad which had in the past been procured by another and current Royal s parent or player for prior edition(s) of the magazine then the initial parent or player retains rights to equal revenue value from the ad providing they can demonstrate proof of an effort in re-signing the advertiser for the current BlueLine edition. This defines Ad Revenue Mediation procedures. It has 6 purposes/premises: A. The prime intent is to prevent putting the advertiser in the awkward position of being the arbitrator of ad revenue disputes and having the uneasy knowledge that his or her ad money is in dispute. It is becoming more difficult to obtain such revenues and the Royals do not wish to ruin Relationships developed with advertisers by involving them in revenue disputes. Doing so would only diminish the Royal s position in the advertiser s eyes and risk future revenues. B. Royal s members involved. The Calgary Royals Athletic Association relies It serves to officially acknowledge that prior claim does exist for those who have previously, successfully enlisted an advertiser. C. It also serves to acknowledge that an advertiser may designate an alternative ad solicitor. This addresses the advertiser's intent, which sometimes is defined by the advertiser's business relationship with individuals who seek to obtain ads. D. It places first responsibility for dispute resolution in the hands of the on its Royal s members to work such disputes out between themselves. They must not involve the advertiser in such disputes in any way, shape or form. E. In absence of the parties resolving their dispute it places the final arbitration decision in the hands of the Calgary Royals Athletic Association s BlueLine Coordinator with Equal Revenue Sharing as the preferred solution. F. It sets out a formula for use as an alternative to equal sharing in the event that serious objection be made to equal sharing by one or more of the parties in dispute: Individuals with prior claim to an ad are guaranteed at least the same level of ad income as earned from the previous year's edition provided: 1. The value of the current years AD is equal or higher. 2. The individual claiming prior rights has proof of effort in renewing the AD for the current year s BlueLine edition. 5
