Attached financial reports include the Balance Sheet and Year to Date Income Statement as of October 15. Also attached is a draft budget for the next fiscal year. A final budget needs to be approved at the November meeting. Please note that the current draft budget calls for another substantial surplus. This is great for the stability of the organization. However, given that our current reserves are well in excess of our annual needs, it may not be prudent to continue with annual surpluses. This practice could invite IRS scrutiny or legitimate questions from members. We have been making ad hoc allocations for renting Tall Scoring Boards at championship meets and timing fees for open water events. Perhaps these should be added to the budget. The surplus gives us an opportunity to fund and promote additional programs without endangering the financial stability of the organization. Open items Donation policy Chairman Michael Moore report of Nominating Committee Nomination and Election of PMS Officers Fall 2009 Committee members: Barry Fasbender, Bill Grohe, Alan Levinson Michael, Chair, Leianne, VP Administration, Kildene, Treasurer all expressed interest in continuing to serve intheir respective offices. Joan, Secretary, was willing to continue as Secretary unless another candidate stepped forward. Barry, VP Operations and Bill Member at Large, expressed their desire to leave office after this term. Treasurer Kildine Harms USMS 7% increase in membership, now stands at 52,000. Lisa Dahl, Regional Rep from the National Office, will help Pacific and other Reps will help other LMSCs. This is a paid position. The Brandon Carter letter stated he was upset with the swimsuit issue. LMSC minimum compensation, EC meeting will be a conference call October 28. Vice Chairman Administration Leianne Crittenden no report Vice Chairman Operations - Barry Fasbender no report Secretary Joan Alexander No Report At-Large Bill Grohe No Report Committee Reports Registration and Records - Registration Nancy Ridout PMS has registered 10,773 swimmers and 128 clubs as of 10/21/09. Two clubs have renewed or registered for 2010: Livermore valley Tennis Club is the first to renew and Lucas Valley Aquatic Masters is a new club and the first to register for 2010. Looking back through our history, we find we have registered 10,018 swimmers and 122 clubs as of 10/21/08; 9,877 & 112 as of 10/10/07; 10,091 & 117 as of 10/18/06; 9550 & 109 as of 10/15/05, 9,281 & 113 as of 9/24/04; 9,538 & 110 as of 9/20/03; 9,835 & 119 as of 9/25/02; 9,346 and 119 as of 9/17/01; 8,904 & 112 as of 9/22/00; 8,337 & 102 as of 9/3/99; 8,096 & 101 as of 9/18/98; 7,852 & 107 as of 9/12/97; 7,400 & 108 as of 9/20/96; 6,569 & 94 as of 9/8/95; 6,509 & 94 as of 9/16/94; 6,111 & 91 as of 9/15/93; 6,084 & 80 as of 9/11/92). We continue to increase our membership above and beyond our past - since 1971. An electronic letter was sent to each 2009 registered club on October 16 th with instructions as to how to register a club online with a credit card or by completing the attached form and submitted with a check. Until November 1 st, new members will continue to pay a reduced fee of $30 when joining. Any swimmers paying the full fee will be sent a $10 voucher with their cards to use for reducing their 2010 fee. On November 1 st, ALL new members will be required to register for 2010, as well as the remainder of 2009. They will no longer be able to register for just the rest of 2009 at the reduced fee. The 2010 fee is $42 that includes an increase of $2 in the USMS portion. PMS has not increased its portion.

Here is the proposed meeting calendar for 2010: Jan. 20, Feb. 17 cc, March 17, Apr. 21 cc, May 12, June 16 cc, July 14, Aug. 18 cc, Sept. 8, Oct. 20 cc, Nov. 17 Holiday Potluck, Dec. No Meeting Convention Report We ended up with 18 Pacific delegates, along with 6 PMS member delegates by virtue of their USMS responsibilities. We had 6 new delegates: Tracy Barbutes TCAM, Leon Kief SMMM, Cokie Lepinski MPM, Terri Maginnis RAMS, Susie Powell RHMS, and Arlene Proebsting TCAM. They were a welcomed addition to our delegation and worked very hard. We look forward to their continued leadership in Pacific Masters Swimming. 10,800 registered swimmers will give us another delegate. Top Ten/Records Nancy Ridout The Long Course Top Ten and records have been submitted. I m working now on submitting all the SCM records quickly so they can be included in the 2010 Rule Book. Coaches - Chris Campbell no report Communications/Newsletter - Joanne Berven Web Master-Michael Moore 1. Newsletter The November-December Issue has been sent to the publisher and out to the clubs. The next deadline is November 6 for the January-February issue. 2. Web Master No report Fitness Linda Shoenberger, no report Ad Facilities Coordinator Alexander I have booked the Community Center (our normal room) for our November Annual Meeting. The Walnut Creek facility will begin scheduling Friday for booking rooms. I will schedule meetings then. A swimmer missed his check in and swam in an empty lane. This was mentioned in the September report in the minutes. 2010 Bay Area Senior Games. Move to approve the 2010 Bay Area Senior on Saturday, April 10, 2010. 2009 SCM Championships. FastLane-Tek had trouble importing the SDIF file from Club Assistant into Meet Manager. This caused a delay in the posting of the psych sheets for the meet on WCM website. The problem was the result of a long hyphenated name that overflowed into some other fields. Franz

found the problem and corrected it by deleting the swimmers name in the file and then reentering the swimmer into Meet Manager by hand. Club Assistant has been informed about the problem with their software. Legislation/Rules Legislation/Rules Alan Levinson 1. Develop a Policy on Non-Sanctioned Swims Develop a policy on how Pacific Masters Swimming will handle requests regarding nonsanctioned events. Create a new section under 102. 1 General Administrative Policies: 102.1.B. External Organizations 1. A non-member organization that seeks the endorsement or support of Pacific Masters Swimming shall submit its request in writing to either the Chair of Pacific Masters Swimming and/or to Pacific Masters Swimming at its address of record. 2. Any request by an external organization for endorsement or support shall be considered by the Pacific Masters Swimming Committee at one of its regularly scheduled meetings. All such requests shall be considered on a case-by-case basis. 3. The Committee shall be guided by the understanding that the primary focus of Pacific Masters Swimming is to promote activities that conform to the goals of Pacific Masters Swimming and to provide benefit to Pacific Masters swimmers and its member clubs. B. Develop a Policy on how Pacific Masters makes financial donations Develop a policy on how Pacific Masters will make financial donations or contributions. Create a new section under Art. 102.2. Executive Committee Policies; 102.2.E. Treasurer 3. Process for Responding to Requests for Financial Assistance or Contribution a) Pacific Masters Swimming shall allocate an amount in its annual budget to be used for individual financial assistance and financial donations. b) An individual swimmer who seeks financial assistance or a member club that seeks a financial donation from Pacific Masters Swimming may do so by submitting a request in writing at least 90 days in advance of the anticipated date of use. c) Any request for individual financial assistance or a financial donation from Pacific Masters shall be considered on a case-by-case basis using the criteria set forth below. d) Contributions shall only be considered for individual members or member clubs in good standing. e) Requests for a financial donation from a member club shall be made in the form of a matching donation by that club. Proof that the member club has made its matching contribution shall be presented to Pacific Masters prior to Pacific Masters releasing its payment. f) Pacific Masters portion of a financial donation shall not exceed $500. g) Financial donations shall only be made to organizations approved by Pacific Masters and recognized as not-for-profit under Section 501(c)(3) of the Internal Revenue Code.

h) The Chair may appoint an ad-hoc committee to review such request(s) and to make a recommendation on the request(s) to the Pacific Masters Swimming Committee. Open Water - Glenda Carroll The chip timing company, Big Sky, contacted me about timing for the open water swims next season. They were the timers for the Hot August Chill. I'll talk with them and find out more. The majority of the crew that put on OW 101 are willing and able to do it again for 2010, as well as put on a OW 201 for the more experience open water swimmer. I'm now looking at dates for both. One question: Hot August Chill : 500 yard swim -- should OW swimmers receive points for it? (They did this year.)
