HONEYWOOD SWIMMING POOL RULES & REGULATIONS 2016 1. A MEMBER is defined as a Property Owner(s) of a Honeywood on the Potomac Subdivision lot whose homeowners Association dues are NOT in arrears. An ADULT is defined as a person eighteen (18) years of age or older. 2. All pool users both members and guests - MUST HAVE A RELEASE FORM ON RECORD BEFORE USING THE FACILITIES. 3. NO ONE, whether member or guest, is permitted to use the pool facilities until a SIGNED RELEASE is executed. (Minor children are to be signed for by their parents or legal guardian.) This will be enforced by the lifeguard. This means if YOU HAVE NOT RETURNED THE ATTACHED FORM, SIGNED AND DATED BY AN ADULT OR LEGAL GUARDIAN, YOU AND YOUR PARTY WILL BE ASKED TO LEAVE THE POOL AREA UNTIL THE FORM HAS BEEN RETURNED. You may return the signed form to the lifeguard or drop off to Jenny Mollica at 743 Colston Drive. 4. For members under the age of 18, the BUDDY SYSTEM must be followed when a lifeguard is not on duty. ANYONE UNDER THE AGE OF EIGHTEEN (18) MUST BE ACCOMPANIED BY AN ADULT MEMBER OUTSIDE LIFEGUARD HOURS. 5. After signing the release required by paragraph 3 above, all guests must be accompanied by a MEMBER or resident of that member s household who is 18 year old (or older) when the lifeguard is off duty. If eighteen year old (or older) children of MEMBERS who are at the pool after lifeguard hours without their parents, may have guests of their own only if their guests are also at least eighteen years old. If a visiting relative of a member is under 18 years of age, he/she may have unaccom panied pool privileges during lifeguard hours. Outside lifeguard hours, visiting relatives under the age of 18 years of age may only have pool privileges accompanied by the ADULT HOMEOWNER/MEMBER. MEMBERS MAY NOT GIVE POOL USE PRIVILEGES TO UNACCOMPANIED FRIENDS LIVING IN THE AREA! 6. The lifeguard is to be obeyed at all times. 7. Before entering the pool, a shower is recommended and highly preferred. Use of the pool should not take the place of a shower. 8. Bandages, hairpins, etc. must be removed before entering the pool. Small objects that may enter the filtering system must not be thrown into the pool. 9. No person with a communicable disease or open sore will be allowed in the pool. This is for the safety of ALL HOMEOW NERS who use the pool!!! 10. There will be no running or horseplay allowed. As well, all play should be at the courtesy of other pool patrons. Only swimming pool-type balls are permitted in the pool area, for example, a beach ball is permitted while a football, basketball or TENNIS BALL is not permitted. 11. It is forbidden to hang on the rope that separates the shallow and deep ends of the pool. This rope is easily damaged. 12. No large Styrofoam devices are allowed in the pool. Other flotation devices are left to the discretion of the lifeguard. 13. No food, gum, bottles, glasses, or glass containers will be allowed in the pool. 14. At the top of every hour, the pool will be cleared and only persons 16 years of age or older will be allowed in the water for the following 10 minutes for an ADULT SW IM. (NO EXECPTIONS) 15. The lifeguard has the authority to close the pool in case of inclement weather. Please understand it does not have to be raining to close the pool. If the lifeguard is aware of thunder/lightening in the area, the pool will be closed. 16. Only the lifeguard is allowed to use the lifeguard chair. W hen the lifeguard is not on duty, the chair will be used for safety purposes only. AT NO TIME SHALL ANY CHILD CLIMB ONTO THE CHAIR IN THE LIFEGUARD S ABSENCE. Parents are responsible to ensure no child plays on the lifeguard chair. ALL m em bers are responsible to ensure this rule is obeyed in the lifeguard s absence. 17. In the lifeguard s absence, both bathroom doors ARE TO REMAIN SHUT AND LOCKED. All keys have been rekeyed so that all members have a key to the gate and bathroom doors. If a member AND/OR guest uses the restroom, they are to close the door behind them and ensure it is locked. Members are to ensure the bathroom doors are shut upon their departure of the pool outside lifeguard hours. During lifeguard hours, the restroom doors will be open and the lifeguard is responsible for shutting and locking doors upon his/her departure. 18. The Pool is closed from 10:00 PM to 6:00 AM. No one is to be in the pool during those hours. Members who see anyone in the pool outside normal pool hours may approach the swimmers and ask them to leave or may contact authorities by calling 911. 19. No member shall open the gate to admit members without keys. BRING YOUR KEY FOR POOL AND RESTROOM ADMISSION. It is not the lifeguard s responsibility to open the gate or restroom to adm it m em bers and/or guests. The

gate must be kept closed at all times for safety reasons. Keys may be obtained by contacting Jim Davis, (304) 579-8262. 1. No pets will be permitted in the pool area. GROUND RULES 2. Food and drink will be permitted on the grassed areas and picnic tables/chairs only. Food and drink must not enter the pool. 3. Good judgment and discretion must be used with alcoholic beverages. Individuals must be 21 years of age to consume alcohol on Pool premises. Persons abusing this privilege will be told to leave the facility. 4. Glass containers of any kind will not be permitted in the facility. 5. All pool users must pick up and dispose of their litter before leaving the Pool area. 6. No personal items will be stored in the store room. All items brought to the pool should be removed when leaving. 7. Access to the store room will be limited to the lifeguard and other individuals charged with pool maintenance. 8. Any person who behaves in a disorderly manner or does not abide by the pool rules and regulations will be expelled from the pool area. WADING POOL RULES 1. Children are not allowed in the pool unless a parent or responsible adult is watching him/her. 2. Children over 7 years are not allowed in the wading pool except by expressed permission from the lifeguard. 3. Large Styrofoam devices are not allowed in the wading pool. The use of other flotation devices is at the discretion of the lifeguard. 4. Children who are not toilet trained shall wear tight fitting plastic underwear that will prevent leakage. 5. Children must be clean before entering the wading pool. 6. THE LIFEGUARD IS NOT RESPONSIBLE FOR GUARDING THE W ADING POOL. THIS IS THE RESPONSIBILITY OF THE PARENT OR OTHER ADULT SUPERVISING THE CHILD. POOL PARTY RULES 1. THE MEMBER (HOST) MUST BE PRESENT AT POOL PARTIES FOR THE DURATION OF THE PARTY. 2. The MEMBER host is personally responsible for the behavior of his/her guests and must see to it that guests abide by established pool rules. 3. The MEMBER host assumes all financial LIABILITY for any damage caused by party guests. 4. Under no circumstances can other pool members or their guests be excluded from the pool facilities during a party. 5. Pool party guests will not engage in activities that will dominate the pool or deny other pool MEMBERS full enjoyment of the pool facilities. 6. As a courtesy, members planning a pool party should post a notice on the bulletin board to inform the membership of the upcoming party one week in advance. This will allow others to plan their pool activities and will prevent the scheduling of 2 parties for the same time. Conflicts will be adjudicated by the Pool Committee. 7. If at all possible, all parties should be scheduled during time of minimal pool usage. 8. The MEMBER host is responsible for cleaning the pool area promptly after the party. This includes cleaning the rest rooms if needed. Any member who has a party IS RESPONSIBLE TO RETURN THE POOL AREA TO THE SAME STATE AS BEFORE THE PARTY. This includes removal of all trash (not putting trash in pool garbage cans but bringing trash bags and taking trash hom e), returning chairs and/or tables around the pool, using hose to wash down concrete apron etc. By accepting these responsibilities, you allow pool cleaners to do their job of cleaning the pool and not cleaning up after your party. 9. The MEMBER host will insure that the party will not become boisterous or noisy enough to disturb home owners living near the pool facilities.

THE HONEYW OOD HOMEOW NERS ASSOCIATION, THE BOARD OF DIRECTORS, THE POOL COMMITTEE, AND THE LIFEGUARD W ILL NOT BE LIABLE FOR ANY REASON. We, the adult members of the homeowners association, having read and understood the posted Rules and Regulations of the Honeywood Homeowners Association for ourselves and on behalf of our minor children and by our signatures below, do hereby release the Honeywood Homeowners Association, the Board of Directors and Officers, the lifeguards, the Pool Committee Chairpersons, the Pool Committee and anyone else involved with the maintenance and operation of the pool and pool area from any claims which we may have as a result of any injury or other loss or damage which might result from our use of the pool and the pool facilities at Honeywood. 2. We have directed the attention of any guests we might have to these Rules and Regulations and by their signatures below, they too agree to all of the above items of the release, and acknowledge, by their signature below that they also recognize inherent hazards associated with using the swimming pool, swimming and related pool activities and accept personal responsibility for using the pool and pool facilities at Honeywood. 3. We fully understand that swimming pool activities involve a certain level of risk of injury and that these risks and dangers exist while in the pool as well as in the surrounding pool area. These risks may include physical injuries, for example neardrowning and spinal cord injury, psychological injuries and even the possibility of the loss of life. 4. We hereby accept the risks of our participation in the swimming pool activities and will hold the operators of the swimming pool, its employees, agents, officers, trustees and affiliates harmless from any and all liability, actions, demands, damages, expenses, costs, claims and causes of action of any possible nature in respect of injury, death, loss or damage caused as a result of or in any way relating to activities in the swimming pool and around the pool area. 5. We understand that at times, there is NO LIFEGUARD ON DUTY, and that children must be accompanied by an adult at all times.

6. If, despite the signing of the waiver, a lawsuit is brought against the operators of the swimming pool, its employees, agents, officers, trustees or affiliates in relation to our participation in the swimming pool activities, we agree to pay for any and all court costs and attorneys fees incurred as a result of such litigation. 7. We also declare that we are not under the influence of any chemical substance including alcohol that may impair our mental faculties and sound judgment, at the time of the signing of this release or at the time of my participation and will not be at any time we participate in any pool activities. 8. We agree that if any provision of this release is found to be unenforceable or invalid in any way, the remaining provisions will remain in force and in effect. 9.
