State of Michigan Department of Environmental Quality Water Resources Division Gaylord Field Office 2100 West M-32 Gaylord MI, 49735-9282 989-731-4920 File Number 13-05-0069-P Date: January 10, 2014 PUBLIC NOTICE Dennis and Nancy Schreur, 9470 Eastern Avenue, Byron Center, Michigan 49315, has applied to this office for a permit under authority of Part 301, Inland Lakes and Streams, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. The applicants propose to construct a new four slip boathouse, boat well, permanent dock, and place sand/peastone for a swim area on Clam Lake at 6833 Crystal Springs Road. The purpose of the project is to provide permanent covered wharfage, temporary boat mooring, and access for swimming. The boat well will require dredging of 150 cubic yards of material below the ordinary high water mark from an area 64 feet long by 32 feet wide to a depth of 2 feet. An additional 300 cubic yards of material will be excavated landward of the ordinary high water mark, from an area 64 feet long by 28 feet wide to a depth of 6 feet. The four slip boat house will be 64 feet long by 40 feet wide. A 52-foot long by 6-foot wide permanent open pile dock will be constructed adjacent to the boat house. 29 cubic yards of 50 percent sand and 50 percent peastone will be discharged to an area 40 feet long by 20 feet wide to a depth of 6 inches for creation of a swim area. The project is located in T29N, R8W, Section 4, Helena Township, Antrim County, Michigan. THIS NOTICE IS NOT A PERMIT The proposed project may also be regulated by one or more additional parts of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended (NREPA) that are administered by the Water Resources Division. The requirements of all applicable parts are considered in determining if it is in the public interest to issue a permit. When a permit application is received requesting authorization to work in or over the inland waters of the State of Michigan, pursuant to Part 301, Inland Lakes and Streams, of the NREPA, the NREPA provides that the department submit copies for review to the department of public health, the city, village or township, and the county where the project is to be located, the local soil conservation district, any local watershed council organized under Part 311, Local River Management, and the local port commission. Additional notification is provided to certain persons as required by statute or determined by the department. Those persons wanting to make comments on the proposed project shall furnish this office with their written comments no later than 20 days from the date of this notice. Written comments will be made part of the record and should reference the above file number. Objections must be factual, specific, and fully describe the reasons upon which any objection is founded. Unless a written request is filed with the department within the 20-day public comment period, the department may make a decision on the application without a public hearing. The determination as to whether a permit will be issued or a public hearing held will be based on evaluation of all relevant factors defined in Sections 30106 and 30311, or permit criteria defined by other appropriate parts of the NREPA. These Sections address the effect of the proposed work on the public trust or interest including navigation, fish, wildlife, and water quality among other criteria. Public comments received will also be considered.
