EQUINE BOARDING AGREEMENT This Equine Boarding Agreement (the Agreement ) is being entered into by Bentfork Farms at 4060 Airline Rd. McDonough, Ga. 30252 And Boarder s Name 1. Term. The term of this agreement shall be monthly commencing on the date set forth above, and shall renew automatically for successive periods thereafter unless cancelled on 30 days written notice by either party. 2. Boarder represents and warrants that that they are the owner of record of Horse, or that they have express authority of the owner of record to enter into this agreement and to house Horse with Stable. If boarder is not the owner of record of Horse, Boarder nonetheless agrees to be fully bound by the terms of this agreement and liable for all sums hereunder.
b. Identification of Owner of Record if Different than Boarder. If Boarder is not the owner of record of Horse, the owner of record is: Name: Address: Phone (cell/home) Email 5. Boarding Fee. Board is due on the 1 st day of each month. Payment received after the 5 th of the month will be subject to a $25 late fee plus $5 in late fees for each additional day thereafter on which Board plus accrued late fees remain unpaid. There will be a $25 fee for returned checks. Payments shall first be credited to accrued late fees and returned-check charges. Stable s Services. a. Stable agrees to provide a covered stall for horse which will be mucked daily. b. Horse will provided with routine daily turnout time. However, Stable cannot guarantee a given turnout schedule. c. Horse will be fed age appropriate pellets/grain and hay/pasture. Any and all other supplements will be responsibility of the boarder. d. Stable shall have the right to use reasonable and customary restraints and training implements to move Horse should they be necessary if, for example, horse refuses to move or becomes a danger to itself or others. Further, if Horse becomes a danger to itself or others, Stable need not muck horse s stall or provide turn-out time. In such event, if boarder is unable to resolve the issue in a reasonable amount of time he/she may be asked to remove horse from the premises. e. Blanketing will be provided as is deemed reasonably necessary for the health of the horse by the Stable. All blankets will be proved by the boarder. In the event that additional blanketing is requested by the owner there will be an additional fee as outlined in Extra Services outlined below.
7. Extra Services. The following services may be provided upon request of the boarder for extra fees as outlined. a. Complete stall rest $5/additional per day b. Immediate Colic Care $50 initial onset c. Extended Colic Care $100 per day d. Medical care (Injections, bandaging, soaking, topical dressings) $5 per application e. Handling for non-routine farrier/vet care $10 per visit f. Additional blanketing needs $25 per month g. Use of day facilities for guest horses $10 per day h. Overnight stay w/stall & hay $20 per day i. Hauling/Transport $25 minimum trip(+$1 mi. over 20) 8. Horse s Physical Condition/Special Care. Except as specified in this section, to Boarder s knowledge, Horse is currently sound, disease-free and in good condition and not in any need of any special care. Boarder agrees to provide written proof of current vaccination and negative coggins prior to arrival and exposure to other horses. Exceptions and/or special needs: 9. Horse s Behavior. Boarder states that the Horse exhibits the following behavioral traits: 10. Veterinary Care. a. Boarder agrees and understands that it is Boarder s responsibility to provide Horse with proper veterinary care and services. Boarder understands that if Horse is or appears sick or injured, stable will first try to contact Boarder. If Boarder is unavailable, or Horse has an emergency, Boarder gives Stable permission to contact Boarder s choice of veterinarian if listed below. If that vet is not available within a reasonable amount of time then Stable may contact the vet of their choosing and Boarder understands that they will be fully responsible for all charges so incurred. Veterinarian Name: Contact# b. Boarder agrees that Stable will keep Horse current on rotational worming schedule as recommended by veterinarian. All vaccines and immunizations which are prevailing and
recommended in Stable s locale will be the responsibility of the Boarder on an annual basis. 11. Farrier Care. Boarder agrees and understands that it is his/her responsibility to provide Horse with proper hoof care. Boarder understands that he/she may use the farrier provided by the Stable on a routinely scheduled basis, or may choose to use a farrier of choice as listed below which may incur a handling charge if Boarder is not available to supervise/handle the Horse personally. Neither Boarder nor their guests or agents shall feed, turn-out, walk, work, ride, saddle, injure, whip, harass, or otherwise use or interact with any other horse at Stable without permission of Stable or that horse s owner. b. Absolutely no smoking in barn c. Substance or Alcohol abuse is not tolerated and may cause Boarders and their guests to be banned from the property. 13. Safety and Release from Liability. BY SIGNING THIS AGREEMENT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOU OR YOUR CHILD S PRESENCE AND/OR PARTICIPATION IN EQUINE ACTIVITIES AT STABLE, INCLUDING INJURY, DEATH OR PROPERTY DAMAGE ARISING OUT OF NEGLIGENCE OF STABLE. READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT. YOUR SIGNATURE INDICATES YOUR UNDERSTANDING OF AND AGREEMENT TO ITS TERMS. a. Helmets and Safety Gear. I understand that it is the recommendation of Stable to wear a riding helmet and utilize other safety gear appropriate to my level of experience while on a horse. I accept full responsibility for accident or injury to myself, family members or my guests if I or they choose not to use recommended safety gear. b. Horses are Inherently Dangerous. I also understand that engaging in equine activities is an inherently-dangerous activity, and that, by so doing, I expose myself to dangers both known and unknown. Horses are large unpredictable animals which may be dangerous no matter how much training they may have nor what level of experience I have, and no matter what the situation. I agree and understand that Stable cannot control the horses it boards, and that I shall release and hold harmless Stable from any injury arising out of or related to equine activities at Stable s facilities.
c. I am Responsible for my own Conduct and That of my Horse. I understand that I will ride and handle my horse and will conduct myself at my own risk while I am on Stable s property. d. RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK. I take full responsibility for myself and for any guest that I may bring onto the property and will not hold stable, its owners, agents or employees responsible for accident or injury to myself, my guests, or my agents. I will ensure that an individual RELEASE AND WAIVER OF LIABILITY be signed by each guest I invite that will be riding or handling a horse while on the property. e. Death or Injury to Horse. Stable, its owners, trainers, agents or employees will not be held responsible for injury or death of horse absent active negligence on their part. 14. Stable s Remedies. a. If Boarder breaches this Agreement, if Horse becomes sick, disabled, injured or a danger to itself or others, or if Stable ceases to be able to provide services to Boarder and Horse hereunder, Stable reserves the right to require owner s immediate removal of Horse. b. Right of Lien. Stable may exercise a right of lien as provided by the laws of the State of Georgia for any amount due for board and services which are uncollected. Stable will have the right to attach a lien to your horse after 60 days of non-payment or partial payment and can then sell horse to help recover its loss after 10 days from date of written notice to the owner. 15. Governing Law and Venue. This agreement shall be governed by the laws of Georgia. Venue for resolution of disputes shall be proper in Henry County, Georgia.
