21440 Pacific Coast Highway, Malibu, California, 90265 (310) 456-6547 Rules and Regulations 2015-2016 The Beach Club is for the enjoyment of members in good standing, their immediate families and accompanied guests. Members are defined as owners of record whose Association assessments, including interest and penalties, have been paid to date. Immediate family is defined as the homeowner s parents, children and their spouses and/or significant others. In the case of trusts, businesses, organizations, governmental entities or multiple owners, only one owner or one person can be designated (in writing) as the Association member, subject to the approval of the Board. Only the immediate family, as defined above, may use the Beach Club facilities without the member being present, however, they have no guest or party privileges when using the Club independent of the member. We encourage a family atmosphere and expect that everyone using the facilities will learn, respect, and abide by the rules of the Club. Amplified Music: No amplified music of any kind is permitted in the dining area or in the vicinity of neighbors homes without prior approval from the Manager. Even when approved, there can be no music in the barbecue area, and all music must be off by 10pm. Announcements: For information on Club activities, policy changes, Board meeting dates and other subjects, please refer to the Club bulletin board posted near the entry and the La Costa Breeze Newsletter/ Emails. Behavior: It is expected that members, their families and guests will exhibit behavior appropriate to a familyfriendly environment. This precludes the use of profanity or other abusive or offensive language or behavior. BBQ Area: Please leave grills and cook areas clean. The sink in the BBQ area is only for hand washing. Please be careful not to put food or sand in the sink. The refrigerators are for day use only. Camping: Overnight camping is prohibited with the exception of overnight events organized and supervised by the Club. Chairs, Umbrellas, Beach Toys, Etc.: Members may use the equipment provided by the Club for their convenience, but are responsible for returning equipment to the storage area when leaving the Club. If the storage bins are locked, please return items to either the men s or women s restrooms for safekeeping. Children: Members are responsible for the behavior, proper supervision and safety of their children at the Club facilities and in the ocean - even while lifeguards are on duty. This includes monitoring use of play equipment, removing sand prior to showering, and supervision on all Malibu La Costa properties. Children 15 and under must be supervised by an adult parent or guardian.

Clean-Up: All members, family members and guests are responsible for leaving the Club clean. Please place all recyclables and garbage in designated waste receptacles and wipe tables clean. If the kitchen is used, please make sure that it is orderly and clean, and that no food or trash is left behind. Food left in the refrigerators overnight will be disposed of. Clothing and personal belongings left overnight will be moved to the lost and found. Commercial Use of the Beach Facilities: No part of the Beach and Tennis Club may be used for commercial or revenue-producing activity or any other activity not related to the personal enjoyment of the facilities by its members without written permission of the Board of Directors. When permitted, use shall be in accordance with Club rules and any other requirements specified by the Board. Damage to Club Facilities and Equipment: Members are responsible for any damage caused by themselves, their family members, tenant members or guests. Disputes Regarding Rules and Usage of Club Facilities: Where possible and practical, it is the policy of the Board of Directors to have its Club Manager communicate with members regarding rule violations and/or enforcement of Club rules. Complaints regarding the operation and/or management of the Club should be submitted in writing to the Board of Directors. The Board will consider and respond to the complaint within 30 days of its next scheduled Board meeting (not to exceed 60 days from the date of complaint submission). Dogs: Dogs have limited access to the Beach Club. Dogs, on leash, are allowed to access the surf-line through the dog door on the east side of the Club. Dogs must remain on leash at all times when passing through the Club area. No dogs are allowed to remain in the dog free zone above the deck-line of the adjacent houses. Anyone with a dog must pick up after the dog and dispose of waste in the receptacle provided for that purpose. Dog waste bags are available at near the dog door entrance inside the Club. Eating and Drinking on the Beach: No food is allowed on the sand. All food is restricted to the picnic table area and brick walkway. Only unbreakable beverage containers are allowed on the sand. Glass is forbidden. Please place trash in containers and recycle aluminum cans/plastic bottles in the recycle bins provided. Fires: No fires are allowed on the beach with the exception of those sponsored by the Club. Fireworks: Storage, possession, or use of fireworks of any kind is not permitted on Malibu La Costa property in accordance with State law. Fishing: Fishing is only permitted when approved by a lifeguard or when the Beach Club is not officially open. Front Gate and Front Door: The front gate and front door must remain locked at all times. Please make sure that the gate and door lock when leaving the Club. Do not prop open entry doors when waiting for guests. Request that guests use their cell phones to announce their arrival, and please notify the weekend host/hostess when expecting guests. Gates to the Picnic Area: If you are the last to leave the picnic area, make sure that the gates to the beach are closed to help keep neighborhood dogs out of the Club area. Gas Appliances (Stoves, Ovens, and Barbecue): Do not leave appliances turned on after use, or unattended during use. If you are the last to leave the barbecue area, make sure that the gas lines have been properly closed (valves perpendicular to the ground). Do not allow unattended children in the barbecue area, or in the kitchen when appliances are in use. Gas Heat: The Club provides heat lamps for the comfort and enjoyment of the members. Please follow directions and use only as intended, shutting off the timer and valve after use. Please ensure that gas heaters have been properly extinguished and the gas turned off. Please only use as necessary.

Guests: Guests may use the Beach Club only when accompanied by a member. Immediate family of members (as defined above) are only entitled to bring guests when the member is present. Please refer to the attached Guest Policy form for the number of guests that are allowed and the related guest fees. Any group of more than 8 guests is considered a party, and must follow party rules. Guest fees apply during summer weekends (Memorial Day Weekend- Labor Day Weekend) and occasional Club Events. Injury or Death: The Malibu La Costa Owners Association, Inc. assumes no responsibility for death or injury to its members, members families, guests or tenant members. Members, family members, guests and tenant members use the club facilities and beach at their own risk. Keys: The beach club key is for the exclusive use of members and their immediate family as defined above, with one key issued per property. Members may lose the right to use the Club facilities if the key is given to anyone not authorized to enter the premises. Kayaks: Members may store their kayak(s) at the Club at their own risk with the understanding that any kayak(s) stored at the Club may be used by any other member with permission of staff. The use of life jackets is required. To y kayaks will be locked while not in use. The Club will NOT store paddles. The Club assumes NO responsibility for personal property left at the Club. Lights: There are four switches in the kitchen for the lights over the picnic tables. The lights at the entrance are controlled by a motion sensor. The switch for the storage and ping-pong area is on the west entrance wall. Please be sure that all lights, including bathroom lights, are turned off if you are the last to leave the Club. Locks: Member keys unlock the front door and both restrooms. The member key does not unlock the kitchen, which will be opened and closed by staff - 1) during regular hours during the summer season 2) for scheduled parties or 3) upon request when possible. Kitchen and bathroom doors will lock automatically when closed. Please do not leave the bathroom or kitchen doors open. Please do not leave the front door propped open. Lockers: Club locker space is limited and can be used only while the member is on site. Please do not leave belongings in a locker overnight. If you use a personal lock, please remove it with your belongings when you leave. If a personal lock is left on a locker over night, the lock and the contents of the locker may be removed by the Club manager and disposed of or placed in the Lost and Found. Lost and Found: Articles that are left at the Club will be placed in the Lost and Found. Please give anything you find to a staff member. Periodically, unclaimed items will be donated. If you are looking for a lost or left item, contact the Club Manager. Motorized Flotation Devices: There is no beach access or storage for such devices permitted on Club property. The use of motorized flotation devices is prohibited by the City of Malibu. Parking: There is absolutely NO PARKING allowed in the red zone in front of the Club. This area must be clear at all times for emergency vehicles and to assure that individuals using the cross walk in front of the club are visible to oncoming traffic. It is recommended that members & their guests who park across the highway from the Club cross PCH at the traffic signal at Rambla Pacifico. Parties: Groups in excess of 8 guests (including child guests over 5) constitute a party as defined by Club rules and are subject to party rules. Parties in excess of 50 require Board approval. Any request for a party using outside vendors (caterers, party planners, music, valet parking, etc.) must supply a description of what is anticipated along with the party request; the Board reserves the rights to ask for clarification or modification to parties to comply with Club rules or to preserve the enjoyment of the Club by other members. Refer to the attached party policy sheet for details and contact the Club Manager.

When sponsoring a party, the member is required to respect the rights of other Club members, and be on the premises at all times, including during the set-up and clean-up of the party. The member is responsible for informing their guests and vendors of Club rules and policies, and ensuring that guests and vendors abide by these rules. The club is not responsible for or capable of overseeing vendors working on behalf of individual members. Violators of Club rules may be subject to sanction, including fines and revocation of party and guest privileges. Likewise, members are asked to be respectful of approved parties and their authorized guests. All issues of rule enforcement are to be referred to the Club Manager or Lifeguard on duty. Please refer to Party Request Form for additional party rules and fees. Personal Property: Members are responsible for their personal property. The Association assumes no responsibility for loss or damage to personal property. Plumbing: Please help maintain the Club s septic system by removing as much sand as possible before using the restrooms and showers. Flush only toilet paper down the toilet. The kitchen sink does not have a garbage disposal, so please scrape dishes into trash prior to rinsing in the sink and make sure that the drain is cleared of any debris. Respect for Neighbors: Please respect the comfort and privacy of the Club s neighbors. Avoid loud conversation and music in the barbecue and Volleyball areas. All music must be off by 10pm. Do not allow dogs or children to play under neighbors homes. Rule Enforcement: Members are not to enforce Club rules. Any issue pertaining to rule enforcement is to be directed to the Club Manager or Lifeguard on duty. If necessary, rule enforcement will be referred to the Board of Directors for disciplinary actions. Violators of Club rules may be subject to sanction, including fines and revocation of party and guest privileges. Signing In: Members and their guests are required to sign in when they enter the club and to identify themselves when asked by a Staff Member. To assure proper billing please print clearly your first and last name, your address, along with signing and dating the guest forms. Storage of Personal Equipment: There is no space to store surfboards, skim boards, stand-up paddle boards or any other personal equipment. Kayak storage is available on a space-available basis. The Club accepts no liability for personal property. Smoking: The picnic area, entrance areas, restrooms and brick walkways are smoke-free zones. Cigars and cigarettes are allowed only on the beach between the volleyball court and the ocean. Please keep extinguished cigarette or cigar butts in the trash, not the sand. Swimming: Members and guests swim at their own risk. The ocean is not private property nor is it owned by the Association. Swimmers must observe and obey the instructions of the Lifeguard. Parents and/or guardians are responsible for their children. Swimmers must recognize that there are risks associated with swimming. The ocean can be dangerous. Table Reservations: In order to ensure the maximum enjoyment of everyone when the Club is crowded, members are requested to use no more than two tables per party of eight and three tables for parties over eight. When additional tables are required, party rules may apply. See Club Manager for details. Table reservations are available for the 4th of July. See Club Manager IN PERSON to reserve your table(s). Phone calls, e-mails and phone messages will not be considered. Table usage for parties is according to the rules outlined in the Party Policy form.

Tenant Members: Tenant members shall have the same responsibilities as members. Tenant members must sign up for the Tenant Membership Program on an annual basis, and abide by its procedures and regulations. Ask Club Manager for details. Tennis Courts: Tennis membership is separate from and in addition to beach club membership. Please refer to Tennis Rules regarding court Valet Parking: When the Club hires a valet parking service, it is available to all members and their authorized guests. If a member hires valet parking service for a party at the Club, the valet parking service must be made available to all members and their authorized guests at no charge. Volleyball Court/Ping Pong: Equipment is available from a staff member. If demand warrants, staff will schedule the use of the court or ping pong table. Please return equipment after use. Warning and Information Signs: These signs will be posted by Club staff. Please read and observe all signs. The Board of Directors reserves the right to modify these rules at any time. Anyone in violation of these rules may be asked to leave by beach club staff. Failure to abide by these rules may result in disciplinary action or suspension of membership privileges.

Guest Fees and Party Policies 2014-2015 Guest fees apply during summer weekends (Memorial Day Weekend- Labor Day Weekend) and occasional Club Events. Children (5 years and older) - $3.00. Adults (13 years and older) $5.00 STATUS DEFINITION WEEKDAYS WEEKENDS Member or tenant in good standing Members and their immediate family (as defined in the Rules & Regulations) whose dues have been paid to date. No fees for up to 8 guests. Fees apply to guests. Member s child under 15 Guests Adult supervision required. Must be accompanied by member. No fee for child and supervising adult guest. No fee for up to 8 guests. No fee for child. Fee applies for supervising adult guest. Guest fees apply to all guests. Eligibility: Only a member in good standing as defined in the Rules & Regulations is eligible to have a party at the Beach Club. This privilege does not extend to the immediate family of a member if the member is not present. Any member who hosts a party must be on the premises for the entire duration of the party, including the set-up and clean-up of the party. All parties are scheduled on a first-come, first-served basis. SUMMER PARTY RULES: During the summer, parties of up to 30 people (including the member family and their guests) are allowed from Friday at 4pm until Saturday at 2pm provided the member follows all party rules and procedures. No parties are allowed after 2pm on Saturday, on Sunday, or on National holidays during the summer. Summer is defined as Memorial Weekend until Labor Day. At all other times, regular party rules and fees apply. This does not apply to local nonprofit organizations, such as Little League, schools etc. or other non-profits approved by the Board. Insurance: Parties in excess of 30, including the member family and their guests require a certificate of insurance additionally insuring Malibu La Costa Owner s Association, Inc. Certificate of Insurance must be provided to Club Manager at least 7 days prior to party. Multiple Guests and Party Fees: When the total number of guests exceeds eight (including children over 5), party rules apply. A lifeguard is required for parties exceeding 15. For party requests, please call Club Manager. Note: on weekdays, there are no guest fees for parties of 8 or less. Multiple Member Party: When two or more members coordinate parties together, the rules apply as if it were a single member party. Party Fees: When the total number of guests exceeds 8 (including children over 5), party rules apply. All members are required to provide pre-authorized credit card form with the party reservation to be used for billing

purposes. Party fees must be paid no later than the completion of the event, or will result in penalties. For party requests, please call the Club Manager. Party Form: Please request the Party Form from Club Manager. Please complete and return it to Club Manager at least 7 days prior to party. Table Seating: Tables are available on a first come, first serve basis and are limited to one per member for groups of 8 or less. Party rules apply for more than 8 guests and requires approval from Club Manager. For the 4th of July, tables may be reserved by signing up in-person with Club Manager (no e-mails, phone calls or messages, please). Vendors: The Beach Club must be noticed of all vendors who will be working at a party during the party application process. Members must supervise their vendors and be on the premises at all times. The Beach Club is not responsible for or capable of monitoring vendors. The member is responsible for ensuring that the vendors follow Beach Club rules. The Board of Directors reserves the right to modify these rules at any time. Anyone in violation of these rules may be asked to leave by a Beach Club staff member. Failure to abide by these rules may result in disciplinary action or suspension of membership privileges.
