1. Name The association shall be called the European Blokart Association, abbreviated to EBA, hereafter to be referred as the EBA. The EBA is governed by its constitution. The bodies of the association are Directors Committee (DC) and the General Assembly (GA) which is the EBA Reps. The constitution and the resolutions of the GA are applicable to all its members. The official website of the association is : www.blokartassociation.eu 2. Objectives The association is recognized as the governing body for the sport of Blokart sailing and racing in Europe. The EBA is a non-profit organization. Funds and resources are only allowed to be spent on purposes defined by the constitution. No person is entitled to payments that are not connected to activities in the sport or the objectives of the association. Specific aims of the EBA shall be : To represent the European participants of the sport at an International level (IBRA) To ensure that national EBA representatives are nominated from blokart sailors that are members of their country or regional association/club and that these representatives are duly elected by the members of that organization. To meet in person every two years on or about the time of the European championships or more often if needed and to allocate the venue for the following Europeans. To ensure the application of the EBA rules at European and Open National championships. To foster and to promote the sport of Blokart sailing/racing in general. To act as an advisory body on the organization and regulation of the blokart racing in Europe. To maintain a list of recognized member organizations. To support Member Association. The EBA will also endeavor to : 1. Follow legal guidelines including health and safety and insurance requirements. 3
2. Promote friendship and fair play. 3. Protect the environment where the sport takes place. 3. Membership : Membership of or registration in the EBA is open to any person who Blokart races, regardless of race, age, gender, sexual orientation or ability, who completes a registration form on the official EBA website. Full membership is restricted to blokart pilots and must be member of a EBA recognized organization. Only full members can vote for or be an national representative of the EBA. Membership fee is only applicable for full members who race nationally or internationally. Membership runs from January to December annually. Payment of fee and list of members must be performed by the EBA recognized organization. The membership fee is determined by the Directors Committee. 4. Representatives : Each European country should have 1 representative. Every recognized organization can have 1 representative. Each rep should be elected by the racing members of their country s National Association. 5. Election of representative : The DC can co-opt by absolute majority any blokart pilot as rep if necessary or if that pilot is an asset to the EBA. The DC can refuse a rep by absolute majority if there is just cause to do so e.g. violation of constitution. Any recognized organization can put there rep forward to the DC but only from the national Association/Club. Each Rep is voted in as rep by their national association/club the duration of this mandate is determined by their national association/club. 4
6. EBA Officers (DC) President Must be a Rep Vice President must be a Rep Secretary Can be either a voting Rep or a non voting appointment. Treasurer Can be either a voting Rep or a non voting appointment. o Each officer must be voted in every 2 years by the Reps of each Member Organisation. o All DC Members must be EBA Rep. the roles of Secretary and Treasurer may be filled by a non EBA Rep in a non voting capacity at the discretion of the DC. o Proxy voting is allowed by email or letter to the President in advance of any meeting. 7. General Assembly (GA) GA is made up of national Country Reps. 8. European championships EBA will publish closing date by which applications to host the European Championships must be received. EBA will vote on which application is to be successful. A list of criteria will be given to the host Association/Club. Must be a recognized Association. EBA will provide a spreadsheet of requirements which much be met. The host will need to have organized a National Event previously. The host must follow EBA Racing Rules and any rule change must be put to the EBA at the start of the event planning. Rules cannot be changed without the prior consent of the EBA. 9. Recognised organisations or clubs All organisations and clubs need to be registered/listed on the EBA website. Individual blokart racing members also need to be listed on the EBA website under their club or national association. All racing pilots participating in an open national and European Championships must be a member of the National Association thus registered as a full member of the EBA 5
10. Finance Each Association will make a payment determined by the EBA, this payment only relates to the racing members and will be payable per member. The EBA Treasurer will keep full records of all monies. Monies will only be used for necessary running costs. The EBA will also make a payment to the Host Association of the European Championships if the event has been run in accordance with EBA rules. Payment will be made within 3 months of the completion of the Event at the discretion of the EBA. 11. Alterations to the Constitution Any proposed alterations to the Constitution may only be considered at a meeting of the EBA Committee convened with the required written notice of the proposal. Any alteration or amendment must be proposed by the Country Representative of the EBA and seconded by another Country Member. Such alterations shall be passed if supported by not less than two thirds of all Country Representatives. 12. Dissolution If at any meeting of the EBA a resolution be passed calling for the dissolution of the association, the Secretary shall immediately convene a special general meeting of the EBA to be held not less than one month thereafter to discuss and vote on the resolution. If at that special general meeting, the resolution is carried by at least two thirds of the committee present at the meeting the committee shall thereupon or at such date as shall have been specified in the resolution, proceed to realize the assets of the EBA and discharge all debts and liabilities of the EBA. After discharging all debts and liabilities of the EBA, the remaining assets shall not be paid or distributed amongst the members of the EBA but shall be given or transferred to some other voluntary organization having objects similar to those the EBA or if this isn t possible then to any charity chosen by majority. 6
