The Constitution and By-Laws Of Bankstown Taxi Drivers Golf Club As Amended 8 th October 2013 The Constitution and By-Laws Of Bankstown Taxi Drivers Golf Club The following constitution shall only be amended by way of a general meeting. 1. The Name of the Club shall be known as Bankstown Taxi Drivers Golf Club. 2. THE OBJECTS FOR WHICH THE BANKSTOWN TAXI DRIVERS GOLF CLUB IS FORMED ARE: a. To provide social activities for Bankstown Taxi Drivers Golf Club members. b. To foster and encourage goodwill and fellowship between Bankstown Taxi Drivers Golf Club members. c. To raise money to enable Bankstown Taxi Drivers Golf Club to function as such. d. To do all such things that is conducive or incidental to the attainment of the above objectives or any of them. 3. Non Profit Clause: The income and property of Bankstown Taxi Drivers Golf Club whence so ever derived shall be applied solely towards the promotion of the objectives of the Bankstown Taxi Drivers Golf Club. No portion thereof shall be paid or transferred directly or indirectly by way of dividend, bonus or otherwise whatsoever by way of profit to the members of Bankstown Taxi Drivers Golf Club. Nothing herein shall prevent the payment in good faith of remuneration to any officer or servant of Bankstown Taxi Drivers Golf Club or any member of Bankstown Taxi Drivers Golf Club in return for any services actually rendered to or reasonable and proper rent for premises let by any member to Bankstown Taxi Drivers Golf Club. 4. Dissolution Clause: Bankstown Taxi Drivers Golf Club shall not be dissolved except at general meeting of Bankstown Taxi Drivers Golf Club specially convened for the purpose, and by a resolution carried by a majority or four-fifths of the vote recorded in respects of the same. If upon the winding up or dissolution of the Bankstown Taxi Drivers Golf Club there remains, after the satisfaction of all its debts and liabilities, any property whatsoever, the same shall not be paid to or distributed among the members of Bankstown Taxi Drivers Golf Club but shall be

given or transferred to some other institution/s having objects similar or in part similar to the objects of Bankstown Taxi Drivers Golf Club and it is exempt from income tax under section 23 of the Income Tax Assessment Act, such institution/s to be determined by the members of Bankstown Taxi Drivers Golf Club at/or before the time of dissolution, or in default thereof by the Chief Judge of such court as may have, or acquires jurisdiction in the matter. 5. Financial Procedure: True accounts shall be kept of the sums of money received and expended by Bankstown Taxi Drivers Golf Club, and the matters in respect of which receipt and expenditure takes place and of the property, credits and liabilities of Bankstown Taxi Drivers Golf Club and, subject to any reasonable restrictions as to time and manner of inspecting same, that may be imposed by Bankstown Taxi Drivers Golf Club for the time being, shall be open to inspection of the members. Club auditors are to be appointed by the committee and shall examine accounts every year. 6. Membership: Each member of Bankstown Taxi Drivers Taxi Golf Club shall be encouraged to become an affiliated member of Golf NSW and pay the fee from time to time applicable excepting where a member currently pays an affiliation fee to Golf NSW, no further fee shall apply. Exceptions to members that have attained the age of 75, affiliation shall be voluntary. All new members shall make application on the standard nomination form of Bankstown Taxi Drivers Taxi Golf Club and must be proposed by a financial member and seconded by a committee person of Bankstown Taxi Drivers Golf Club. All applicants shall play a minimum of three (3) games as a visitor before being nominated for membership. Visitors may only play three (3) games per calendar year before being required to join Bankstown Taxi Drivers Golf Club. 8. LIFE MEMBERSHIP AND HONORARY MEMBERS: Life Membership can only be conferred upon a member of Bankstown Taxi Drivers Golf Club by resolution passed at an Annual General Meeting. No member shall be made a Life Member unless in the case of exceptional or distinguished service to Bankstown Taxi Drivers Golf Club and only on the recommendation of the Committee endorsed by two-thirds 2/3 majority of the members present and entitled to vote at any Annual General Meeting. Life and Honorary Members are entitled to attend all committee meetings and the Annual Presentation. 9. The Annual General meeting of members of the Club shall be held in October of each forthcoming year. 10. COMMITTEE: a. Committee shall consist of the President, Secretary, Treasurer, Captain, Vice Captain and Handicapper. b. The Committee shall be elected at the Annual General Meeting and shall hold office until the ensuing Annual General Meeting. c. Proxy nominations shall be accepted, providing the written consent of the nominee is presented to the Annual General Meeting prior to such nomination. d. Such elections may be on a show of hands, as decided by those present at the meeting. Should there be more than the required number of nominations for any position on the Committee an election by ballot shall take place. 11. Match and Playing Committee: a. The Match and Playing Committee shall consist of Captain and Handicapper / committee member. b. The Match and Playing Committee shall adjudicate all disputes referred to them by the Captain and their decision shall be final and binding by all members. 12. Duties of Committee Members: President: The President shall preside at all meetings conducted and organised by Bankstown Taxi Drivers Golf Club including the Annual General Meeting, Extraordinary General Meetings, Committee Meetings and to be pro-tem to all other meetings. The President shall be available to assist any other committee member with their duties.

The President shall make himself familiar with the Rules of Debate and in the conducting of meetings. Secretary: The Secretary shall conduct correspondence and attend to all secretarial duties on behalf of Bankstown Taxi Drivers Golf Club. He shall maintain a register of members. He shall have custody of all property, documents and records belonging to Bankstown Taxi Drivers Golf Club. He shall perform such additional duties as the committee may determine and shall present a report to the President for the Annual Report. The Secretary shall post such notices that require publication among members. He shall keep accurate minutes in a minute book and record all matters discussed at all meetings of Bankstown Taxi Drivers Golf Club for reference. Treasurer: The Treasurer shall receive and disperse all monies in accordance with the Bankstown Taxi Drivers Golf Club directions for the committee. He shall keep a correct account of all transactions and lodge in an approved bank all monies received. The Treasurer shall present a financial statement to date at each meeting of the Committee, and shall present an audited financial report to the Annual General Meeting. Until otherwise resolved by the Committee all cheques drawn on Bankstown Taxi Drivers Golf Club bank account shall be signed by any two [2] of President, or Secretary or Treasurer and no cheque shall be drawn or any payment made without the endorsement of the Committee. Captain: The Captain shall be responsible for the proper conduct of all Bankstown Taxi Drivers Golf Club matches and Gala Days. He shall be responsible for the orderly hit off on all Bankstown Taxi Drivers Golf Club days. The Captain shall have absolute control of play at all times and shall adjudicate any disputes arising on the course. The nature of any dispute shall be handed to the Captain in writing and within fifteen [15] minutes of completion of the round and be signed by protesting parties. The Captains decision in all such disputes shall be final and binding on all players and visitors, notwithstanding that the captain may, at his absolute discretion refer any dispute to the Match and Playing Committee for opinion or decision. The Captain shall be a member of the Match and Playing Committee. Vice Captain: The Vice Captain shall assist the Captain in the performance of his duties. In the absence of the Captain the Vice President shall assume the duties of Captain with the same powers. The Vice Captain shall be a member of the Match and Playing Committee. Handicapper: The handicaps of players shall be left to the handicapper as per the Australian Handicap & Course Rating Systems set down by Golf Australia. 13. Meetings: The Committee shall convene as directed by the President at regular intervals. 14. Quorums: At a Committee Meeting four [4] members shall form a forum. At General Meeting twelve (12) members shall form a quorum. If no Quorum be present thirty minute [30] minutes after the time fixed for meeting, such meeting shall lapse and such meeting recalled within fourteen [14] days. 15. Amendments: No resolution of the Committee shall be altered or rescinded unless seven (7) days notice in writing and in the hands of the Secretary by the Mover of such alteration or rescission. Notices of motion or any submission for inclusion on the agenda of any General meeting shall be in writing and in the hands of the Secretary twenty eight [28] days prior to the advertised date of the meeting at which they are to be resolved. Any alteration to Bankstown Taxi Drivers Golf Club Constitution may be effected only with a three fifths (3/5) majority at a general meeting providing that twenty eight days (28) days notice is given of the proposed amendment. 16. Debate: Members are allowed to speak only once to the question, any rise to a point of order, question through the chair and exception to an amendment. A mover of a motion shall be given the right of reply.

17.Ruling of the Chair: Any decision or ruling from the Chairman may be dissented from and overruled by a majority of voters present, but the motion to dissent shall not be spoken to except by the mover of the motion who shall be allowed five [5] minutes to reply. 18.Club Conduct: The General Committee shall have the right to disqualify and/or suspend any member guilty of conduct detrimental to the interests of the Club. A special Committee Meeting shall be called to consider the case of an offending member. Such member to be cited to appear will be notified the nature of the charge prior to this meeting. In the event of a member failing to appear, the matter will be dealt with in his absence. A majority vote against the member may determine disqualification, suspension or other punishment. 19.Dress Code: Members are required to adhere to the dress codes set out by Bankstown Taxi Drivers Golf Club and the golf clubs where Bankstown Taxi Drivers Golf Club play golf. The following attire is not acceptable; * Football or sporting type shorts (e.g. tennis shorts). * Shirts or tops displaying large motifs or advertising. * Shirts without collars (an exception applies to women s attire and shirts that are specifically designed for golf). * Denim jeans of any description. * Track suit pants / tops or any type of gymnasium attire. * Thongs or bare feet. * Drawstring pants or shorts (e.g. board shorts). * Socks with sports motifs or stripes (e.g. football socks). 20.Miscellaneous: Any member of Bankstown Taxi Drivers Golf Club, whether a member of a Committee, a member of a Sub-Committee of Bankstown Taxi Drivers Golf Club, shall not be given any gratuity or shall not derive any profit, benefit or advantage from Bankstown Taxi Drivers Golf Club, excepting that: - a. Any member may apply or submit accounts to the Treasurer for payment, who shall submit same to a meeting of the Committee, and on approval of the Committee the Treasurer pay such member amounts so approved. b. The President, Secretary, Treasurer and Handicapper shall be entitled to an annual honorarium in the amount as determined by the members in attendance at the Annual General Meeting. Bankstown Taxi Drivers Golf Club By-Laws. The Following By-Laws may be changed by the Committee from time to time at any committee meeting. 1. Nomination of Competition: Any member not wishing to play 18 holes must nominate his/her intention before hit off unless injury or sickness occurs during play. A full nine holes competition cannot be played unless arranged by the Match Committee prior to hit off unless weather conditions prevail. 2. Current Life Members: J.A. Ashtom, C Buchanan, K Hazel, A Lythall, G Porter, W Davidson, P Cotterill 3. Free Days: A member must play 20 outings per year to be entitled to play free at annual outings. Visitors will be charged as ruled by the committee. 4. COMPETITION RULES: a. Play shall be in order, and at times arranged by the committee. b. Play shall be governed by the rules of golf, and the local rules of the courses.

c. All disputes and doubts arising on any point shall be lodged within fifteen (15) minutes of the completion of round, to the Committee, whose decision shall be final. d. Players shall at all times observe the Etiquette of Golf. 5. DECISIONS OF A COUNTBACK RESULT: a. In the event of a Count back being necessary, it shall be decided in the following manner. Count back over the last nine holes, if no result, count back over the last six holes, if a tie still results, count back over the last 3 holes. If a tie still exists, count back hole by hole from the 18 th.. b. Cards must be fully marked and counter signed otherwise card will be disqualified. c. In the event of a tie in Gold Medals, there will be a sudden death playoff on day of event. Patron and other Major Trophies will be on a count back system. A tie in monthly medals will be played on the following month. 6. CONDITIONS OF PLAY: a. Without contravening local rules, the ball shall be played as it lies. b. The Captain or acting Captain shall enjoy complete control of each days play, and set rules and regulations, hitting off order and playing groups. 7. HANDICAPS: a. The handicaps of players shall be left to the handicapper as per the Australian Handicap & Course Rating Systems set down by Golf Australia. b. The Maximum handicap for Members shall be 48, except for Match play Championships, where a maximum of 36 shall apply. Any member/player who has a current affiliated handicap shall play off that handicap without submitting three (3) cards. 8. MAJOR TROPHIES: a. Major Trophies shall be played over one (1) round using the Stableford Scoring System. b. In the event of a tie at competition, the result shall be made by the count back system. c. A member must have played five (5) games to qualify for these events. 9. NEAREST THE PIN: a. The nearest the pin shall be determined by the ball that comes to rest nearest the pin (including hole in one) on the putting surface from the tee shot. b. The Trophy is open to all players, including visitors, on designated par 3 s, including the jackpot hole. 10. NEAREST HOLE YEARLY TROPHY: a. Shall operate on all par 3 s, including the jackpot hole. b. This trophy does not include a hole in one. c. Only BTDGC Members are eligible for this trophy. 11. JACKPOT HOLE: a. Shall operate on one (1) designated Par 3 hole per round. b. Can only be won when a member s tee shot comes to rest within one (1) metre of the hole and include a hole in one. The jackpot to be shared if won by more than one player on any one day. c. Only BTDGC Members who have played a minimum of 5 games over a 12-month period are eligible to win this trophy. 12. MATCH COMMITTEE: a. Shall consist of Captain and handicapper. b. With the option of co-opting one (1) or two (2) committee men.

13. MEDAL OF MEDALS: a. Only Members who have won a monthly medal and competed in at least 4 Medal rounds throughout that year are eligible for the Gold Medal. b. In the event of a tie after completing the round, the result shall be decided using the Sudden Death System. 14. COUNTBACK AND SUDDEN SYSTEMS: a. Countback System See under Competition. b. Countback System shall not be used for Club Championships, Medal of Medals or Monthly Medal rounds. 15. SUDDEN DEATH SYSTEM: a. Play is to commence at first hole played and continue in playing order until a decision is reached. b. Full handicap differential shall apply and strokes are to be given in accordance to Match play Index of course being played. c. All sudden- death playoffs are to be treated as Match play. 16. CLUB CHAMPIONSHIPS: a. Shall be played over 54 completed holes of Stroke Play. b. A player to be eligible to play in the Club Championships must have played ten(10) games with the BTDGC from the completion of the previous years Championship up to the commencement of the next years Championships. c. Each player shall retain his commencing handicap throughout the Championships, regardless of any alterations that may occur. d. In the event of a tie, the result shall be determined by an 18 hole event playoff, at a time, date and course to be determined by the Committee. e. The event is open to BTDGC members only. 17. COCK OF THE WALK CHAMPIONSHIPS: a. To qualify, play shall be over one (1) round of 18 holes with top sixteen (16) players being eligible to play off. b. In the Event of a tie after 18 holes, count back shall apply. c. The final shall be played over a maximum of 36 holes or a minimum of 18 holes on one day. Number of holes to be played shall be mutual consent of the two players concerned, and the Committee to be notified prior to commencing. d. In the event of a tie, the Sudden Death System Applies. e. All cock of the walk matches will be played on or before the date specified and at a BTDGC fixture. Forfeit will be automatic.
