Masterson Station Pool Rules & Pool Hours: *Current Pool Hours as of 1/17/2017: May 27-August 13 Monday-Friday 10am-9pm Saturday 10am-9pm Sunday 12pm-9pm August 14-Sept 4 Monday-Friday 10am-9pm Saturday 10am-9pm Saturday Sunday 12pm-9pm Sunday 4pm-8pm 10am-8pm 12pm-8pm Pool hours will be published in the MSNA Newsletter and MSNA Website each session. The pool will be open for use during the times listed on the schedule. No one will be allowed in the pool during other hours with the exception of supervised swim practice or lessons. All times are subject to change due to weather and season, special activities, swim meets or maintenance. Advance notice will be posted whenever possible.

The club manager or head guard is authorized to close the pool should, in his or her judgment, circumstances warrant. Pool Membership: A Masterson Station Neighborhood Pool Membership is available to all homeowners of the Association, in good standing. A limited number of Non-MSNA Pool Memberships may be available for an additional fee as determined by the Pool Committee and Board of Directors. Membership to the pool is established by mailing a completed application form (MSNA member application), (Non-MSNA member application) to: Masterson Station Neighborhood Association, INC., 328 Masterson Station Drive, Lexington, KY 40511. Or attend one of the pool membership drive dates outlined in the information packet. Applications can also be dropped off at the office during normal business hours. If you have any questions, please call 859-246-0911. Upon receipt of a completed application, membership eligibility will be verified as to the status of assessments and architectural or covenant violations. Once eligibility is established, a valid photo must be taken. Masterson Station Pool Rules & Pool passes that include the individual s photo, name, as required will then be issued to each individual age 16 or older living in the household. Members may purchase a season pass for a babysitter who is employed by the member and is at least 16 years of age for $50.00. This pass is only valid when accompanied by a valid member pass. A member s failure to stay in good standing with the HOA may result in temporary suspension of membership privileges.

General Rules: Members and guests must register at the gate before entering the pool area and should be prepared to present membership cards and guest passes to the guard on duty. No one will be allowed in the pool without a valid membership/guest pass at any time during the season. All persons using the pool/parking lot do so at their own risk. Masterson Station Neighborhood Association and the Pool Management Company assume NO responsibility for any accident or injury in connection with such use or for any loss and/or damage to personal property. All personal possessions are to be removed from the pool and dressing room areas at the end of the day. All members must obey the instructions of the lifeguards. In the event of a dispute, a member shall first follow the instructions of the lifeguards or staff and then report the incident to the Association Management. Use of the pool may be temporarily suspended for special events, weather conditions, pool contamination, swim meets, or when other situations dictate. For pool contamination, the pool will close in compliance with the Fayette County Pool. The lifeguard will close the pool when severe weather, like lightning, thunder, hail or heavy rain, is in the area. The pool will remain closed for 30 minutes following the last lightning flash or thunder roll. The pool will reopen at the discretion of the pool manager. The pool deck will be cleared during periods of severe weather. The pool manager may permit members and guests to remain in sheltered areas and the bathhouse during these times. Persons shall not use the pool unless they are officially open and lifeguards are on duty. Unauthorized use of the pool will constitute trespassing and ALL violators will be prosecuted.

Masterson Station Pool Rules & Persons must stay clear of lifeguard stations and not loiter at the check-in desk. All persons are required to wear a clean bathing suit or attire intended only for the pool. No street clothes, cut-offs, or shorts. All persons are required to take a shower prior to entering the pool. Individuals leaving the pool area or enclosure shall take a shower prior to returning. Parents are responsible for the safety and conduct of their minor children. Members are fully responsible for the conduct of their children and guests while on the premises. Failure to cooperate with this rule will be grounds for immediate suspension of pool privileges. Personal music devices are restricted to ipod type devices and must be waterproof, battery operated and used with headphones. Loud music is prohibited. Profane language is not permitted in the pool enclosures. Pool lounge chairs are available on a first-come, first-served basis. Reserving chairs for persons who are not on the pool premises is prohibited. Pool deck furniture is not to be moved outside the fenced pool area nor placed in the pool. Situations arising that are not specifically covered by pre-established rules shall be handled by the Pool Management, and MSNA Board of Directors. Health and Sanitation:

Food and Drink may only be consumed 5 feet away from pool edge. Swim privileges shall be refused to all persons having any communicable disease, to include: a cold; coughs; inflamed eyes; or any infection to include: ear discharge; nasal discharge; poison ivy/oak or has an open sore, open wound, blisters or is wearing a bandage. Glass and other breakable containers are prohibited at the pool. Paper or plastic cups and/or non-breakable containers must be used. Any broken glass will be the responsibility of the member for all costs related to clean up- including possible draining of pool and possible shutting down of pool and inconvenience to pool members. This amount may be in excess of $2,000. Don t bring glass to the pool! No play equipment or wheeled vehicles (except wheelchairs and strollers), permitted in pool areas. No pets are permitted (exception would be service dogs). All refuse must be placed in containers provided for this purpose. Nothing should ever be thrown in the pool. Masterson Station Pool Rules &

Alcoholic beverages are permitted at the pool. Overly intoxicated persons (as determined by lifeguard) will not be allowed in the pool area or may be asked to leave the pool area at any time. Members and/or their guests who are overly intoxicated may lose their pool membership as determined by Management. Spitting of water or any other unhygienic action is not permitted in the pool area. Do not chew gum in or around the pool facilities. The Masterson Station Clubhouse and Pool are NON-SMOKING facilities. However, smoking is permitted outside the fenced area ONLY and must be done at least 30 feet from the gate. Any injuries occurring on pool property should immediately be reported to Pool Management where upon emergency personnel may be contacted as conditions warrant. An injury report will be completed and forwarded to the Board of Directors. Swimming lessons will be available on a fee-for-service basis. Arrangements for lessons may be made directly with the pool management company. Check with any lifeguard on duty for more information. Safety (Main Pool): Adults are defined as being 18 years of age or older. Children age 12 to 16 must have a valid pool pass once they have completed the following: Must pass a swim test or present a swimming certificate from the American Red Cross to be admitted unaccompanied by an adult The swim test is given by a lifeguard or by the Pool Manager. Persons unable to demonstrate to the lifeguards their ability to swim are not permitted in water deeper than their shoulder height. Children under the age of 12:

Are not required to have their own pool pass Shall not be left in the pool area unattended. This rule will be rigidly enforced. If any doubt occurs as to the child s ability to swim, the lifeguard may ask the child to leave the pool and to be accompanied by a parent, guardian, or babysitter for future visits. Must be accompanied and supervised by an adult or care provider at least 16 years old. A 10 minute adult (18 years or older) swim will be called at the end of every hour of pool operation daily and ending at closing. Only one child, 5 and under, per adult is allowed in the pool during this adult swim break. Masterson Station Pool Rules & Boisterous and/or rough play, running, pushing, dunking and wrestling will NOT be permitted in the pool area. Standing or sitting on another person s shoulders is not permitted. Somersaults, back flips and other careless actions from the pool edges are prohibited. These actions will result in disciplinary action which may include suspension of pool privileges. The uses of rafts or inner tubes are NOT permitted. All toys must be approved by the lifeguard prior to us in or around the pool. Hard or watersoaked balls, towel, hats, paper cups, Popsicle sticks, plastic straws, etc., are not permitted in the pool as they may endanger other swimmers and possibly cause damage to the filtration equipment. All flotation devices must be Coast Guard Approved, which means they cannot contain air. Plastic inflatable objects are not acceptable. The use of these items is dangerous and lifeguards will enforce this rule rigidly. Swim suits with inserts and life vests that contain no air are allowed in the swimming area. Life preservers (type 12-14) are permitted unless the lifeguard determines that they are unsafe. Kick boards and water wings are

permitted if they are approved by the lifeguard. If permitted all of these items must be used while under the supervision of an adult. Lap lanes are for lap swimming only. DO NOT hang or pull on the lane line ropes. Diving is prohibited in the shallow water(less than 5ft) at all times, except for supervised swim meets. Race starts are only permitted when supervised by approved swim team coaches during regularly scheduled practices or meets. Safety (Baby Pool) The wading pool is limited to children 5 years of age or younger. No lifeguards are on duty at the wading pool. As such, each child must be accompanied by a person 16 years of age or older who remains inside the fence and who will be responsible for the behavior and safety of the child. However, lifeguards shall monitor rule compliance in the wading pool area. Children not yet toilet trained are encouraged to use the baby pool rather than the main pool, but regardless MUST wear Swim Diapers under their bathing suits. Disposable or cloth diapers are NOT ALLOWED. Playthings must be limited to small floating and non-breakable items. The only floatation devices allowed in the pool are U.S.C.G. approved life vests. An adult must accompany any child wearing a flotation device in the water. Masterson Station Pool Rules & Safety (Diving Area): Only one person at a time will be allowed on the diving board.

Users must delay mounting the diving board until the area is clear of swimmers. Consecutive bouncing, racing dives, dives which propel the diver back towards the diving board or other dangerous actions on the diving board are prohibited. The area in front to the board is for diving only and no swimming will be allowed in front of or under the board. Diving or jumping from the sides of the diving board will not be permitted. No device is allowed to be worn when jumping from the diving board. Guests: For 2017, the guest pass policy will be implemented again on a trial basis and will be re- evaluated at the end of the season. The guest policy for the 2017 season is as follows: All adults (18 or older) in the household of a MSNA Member will be credited one guest pass with pool membership. Each pass allows for the indicated member to bring one guest to the pool area. A guest pass is required for non-swimmers as well as swimmers. Have to be 18 years or older to bring a guest. Each adult (18 years or older) is limited to bringing 4 guests per visit. Guest passes will be taken at time of admittance and the passes must be signed on the back by the pool member at time of admittance. Guests must be accompanied by pool member at all times. Pool members are responsible for the conduct and safety of their guests. Please call the clubhouse to make arrangements on purchasing of additional guest passes.

A total of 24 guest passes may be purchased per household (Not per adult) per season. Pool Management has the right to restrict guest access when pool use is heavily occupied. Attempts to duplicate guest pool passes or circumvent guest pass rules will result in revoking pool membership without refund. In addition the members household and occupants will not be allowed to join the MSNA pool for the next year. This will be strictly enforced. Guest Passes are non-refundable. 6 Masterson Station Pool Rules & Disciplinary actions: Failure to comply with these rules, or any part thereof, shall be considered sufficient cause for members to be deprived the use of the pool by the Pool Manager on duty and/or the Facilities Committee, for a period to be determined by the same. Willfully defacing or destructing property will not be tolerated and will be grounds for immediate suspension of pool privileges. Members will be liable for loss or damages caused by them or their guests. The Pool Manager shall report all such suspensions to the Association Management as soon as possible. Suspension of a minor dependent will result in a parent or legal guardian appearing before the Facilities Committee before privileges are reinstated. More serious violations will require a meeting with Pool Management, Facilities Committee and the Board of Directors before any such reinstatement. Failure to comply with a suspension order will result in permanent revocation of pool membership without refund.

A member who feels at any time that the pool is not being operated in the interest of the community should contact the Property Manager, or Facilities Committee. Revised January 17, 2017
