Lake, Boat and Lakeside Greenbelt Regulations Landings Community Association for Warren Lake Version 12.3 Final Approved by the Landings board March 1, 2016 Introduction With the increased population pressure in our area, and increased usage of our greenbelts, additional lake management has been implemented by the Landings HOA board. New canoe racks and large boat cable posts are being provided for use by Landings members. It will allow more open shoreline for fishing and swimming access, improve the boat organization, ease boat access to the lake, and improve safety and security of boat storage for all Landings boat owners. Effective May 1, 2015, boats on the Greenbelt shorelines can ONLY be stored on these racks or attached to a large boat cable post in a designated area. In addition, a new lake access and launch area has been created, allowing improved boating, fishing and swimming access to the lake for all homeowners. Rules # 1 3 below were enacted by the Landings Board of Directors on March 2, 2015. Rules # 4 19 were adopted in 2007 and modified in 2012 by the Landings Board. Based on input from a homeowner survey, these rules were revised by the board on March 1, 2016. 1) Boat Rules a) The Breakwater, Skysail, Mariner and Inlet greenbelt abutting shoreline is for Landings homeowner use and enjoyment. It is not a storage area for unauthorized boats. b) Five types of Warren Lake surface rights privileges are available for five different users: i) Landings boat owners using the lake with daily launch and remove - with applicable rules # 1) a, c, and e ii) Landings homeowners abutting the shorelines who are using boats - with rules 1) a, c, e, and f iii) Landings home owners who want to store their boats on the greenbelt shoreline - with rules, with rules 1)a, c, d, e iv) Jamestown and Warren Shores boat owners who want to use the lake - no storage or launch option. Storage rules set by each HOA. with rules 1)a, c v) Harbor Walk homeowners who want to use the lake and launch - no storage option, but a single launch and retrieval each year option. Storage rules set by Harbor Walk HOA. with rules 1)a, c, e c) Basic Warren Lake Boat Registration Stickers can be purchased by any homeowner of record in any of the five Homeowner Associations ( Landings, Warren Shores, Jamestown, Harbor Walk Phase II or Harbor Walk Phase II North). At the time of purchase, the boat owner must sign an agreement to abide by these rules. This basic sticker allows a boat to be used on Warren Lake. It allows for the identification of lost, abandoned, or non-registered boats. This sticker only allows a boat to use the surface of the lake. It does NOT allow a boat to be stored on a Landings greenbelt abutting shoreline. With this Basic Warren Lake registration sticker, a Landings home owner can launch their boat from the Breakwater Greenbelt boat ramp. The cost is shown in the Attachment A - Warren Lake Fee Schedule. d) Annual Boat Storage Registration Stickers of 2 types can be purchased by Landings homeowners from Touchstone Property Mgmt for storage on greenbelt shorelines. At the time of purchase, the boat 1

owner must sign an agreement to abide by these rules. Purchasing either of these boat storage stickers will also allow the boat to be used on the surface of Warren Lake. A maximum of 1 boat storage sticker per homeowner address can be purchased before June 1 of each year. If space is available, one additional boat storage sticker per homeowner address can be purchased after June 1. Touchstone Property Management will use a system to allocate and sell boat storage registration stickers to the available storage locations. These two types of stickers include: i) Canoe Rack Registration Sticker Owners of canoes, kayaks, and small boats that can fit on a single canoe rack arm may purchase an annual canoe rack registration sticker. This annual registration sticker will specify the exact location where the boat must be stored, including which greenbelt shoreline (either Breakwater, Skysail, or other greenbelt shoreline), and canoe rack and specific arm location. This annual sticker must be purchased each year and affixed by April 1 of each year. (1) Limited canoe rack spaces are available, from approximately April 1 to March 15 of the following year. Twelve additional spaces for kayaks only will be added in 2016 at the lowest level of the Breakwater racks. All the boats on these racks must be removed to allow for a 1 week transition period to accommodate the following year s renter. The exact dates of this transition period to be specified by the board annually. (2) Price of this registration is shown in the Attachment A Warren Lake Fee Schedule. (3) Canoe \ kayak must be placed on the reserved arm upside down to prevent rain water accumulation and mosquito breeding. An owner can fasten or lock the canoe to the rack with a rope or cable. The owner must also secure the boat to the rack on both ends with tie downs so it does not blow off the rack with high winds. (4) Any single canoe or up to two kayaks must fit within the volume of the space of the single rack arm allocated and cannot infringe on neighboring boat storage. Only tan or earth-tone colored commercial grade covers can be used over the boat. This must be secured so the cover does not flap in the wind. No tarps are allowed. (5) Removable interior cross braces may be added to the canoe rack by the boat owner. No extensions to the fixed rack arm width or length are allowed. See Attachment B for a Diagram of Allowable Kayak Cross Braces. (6) For violations to any of these rules, refer to Attachment C. Boat Violations Rules. ii) Large Boat Registration Sticker Owners of boats that are too large to fit on a single canoe rack arm can purchase a summer large boat registration sticker. This summer only registration sticker will specify the exact location on the shoreline where the boat must be stored, including which greenbelt (Breakwater, Skysail or other greenbelt shoreline), along with the boat post number. The sticker must be purchased and affixed by April 1 of each year. (1) Limited shoreline post spaces are available, and to reduce collisions, spaces may be allocated by the type of boat. (2) An owner must fasten the boat to the designated post with a rope or cable. The reserved space is available from April 15 Oct 15, after which time the boat must be removed from the greenbelt shoreline area. (3) Price of this large boat registration is shown in the Attachment A Warren Lake Fee Schedule. 2

(4) To avoid mosquito breeding, all boats must have water drainage so rain water does not accumulate in the boat. This applies to paddleboats also. Covers that drain water are typically needed for sailboats and paddleboats. (5) No winter storage of boats on the greenbelt shoreline area space is allowed. All boats on the greenbelt shoreline area must be removed by Oct 15. (6) All large boats must fit within the volume of the space allocated and be managed to not drift or infringe on neighboring boat storage. (7) Only tan or earth-tone colored commercial grade boat covers can be used over the boat. This must be secured so the cover does not flap in the wind. No tarps are allowed. (8) For violations to any of these Large Boat registration rules, refer to Attachment C - Boat Violations Rules. e) Boat Launching - With a Basic Warren Lake Boat registration sticker, Landings home owners can launch or remove their boats as many times per year as desired over the Breakwater greenbelt concrete boat launch. No motorized vehicles are allowed on the Skysail greenbelt. With a Basic Warren Lake Boat registration sticker, Harbor Walk home owners can launch their boats one time per year and remove them one time per year using the Breakwater greenbelt concrete launch ramp. Boats can only be launched or removed from the designated launch path at the Breakwater greenbelt. i) The launch path is designated for launching and removal only. No storage of trailers, even temporarily is allowed on the greenbelt or shoreline. ii) Use courtesy as there is a single path for only one launching or removal at a time. iii) For violations to any of these Boat Launch rules, refer to Attachment C - Boat Violations Rules. f) Landings Lakeside Homeowners Boat storage rules - Any Landings homeowner who desires to use their property s abutting shoreline for their own personal boat storage, may use it year round with the following rules: i) Lakeside homeowners cannot reserve an annual boat storage registration sticker for the greenbelt shorelines, as these storage locations are limited, and the lakeside homeowners can store their boats on their own shoreline (see below). ii) If the homeowner wants to use a boat on Warren Lake, they must pay a Lakefront Homeowner shoreline storage fee. See the Attachment A Warren Lake Fee Schedule. iii) Each Boat must have a current annual Basic Warren Lake boat registration sticker for lake use. (see the attached Warren Lake Fee Schedule). iv) To avoid mosquito breeding, all boats must have water drainage so rain water does not accumulate in the boat. This applies to paddleboats also. Covers that drain water are typically needed for sailboats and paddleboats. v) Boats cannot infringe on neighboring home owner s abutting shoreline space. vi) No restrictions or interference is allowed with Landings homeowners approved use of the shoreline, including shoreline walking, fishing or winter cross country ski recreation. vii) Winter storage - To protected all boats and surrounding structures from wind and storm and to allow safe and unimpeded winter use of the shoreline, all boats must be moved up to touch the high water line, with their masts lowered or secured and canopies lowered by Oct 15. The high 3

water line is defined as the water s edge when the water is at full pool and up to the spillway of the dam. viii) Only tan or earth-tone colored commercial grade covers can be used over the boat. This must be secured so the cover does not flap in the wind. No tarps are allowed. ix) For violations to any of these Boat Launch rules, refer to Attachment C - Boat Violations Rules. 2) Gatherings on the greenbelt or shoreline. a) Only Landings homeowners and 4 guests per resident family are allowed at a time on the greenbelt or shoreline. The only exception is for a Landings Community Association sponsored event, such as the spring cleanup picnic. b) No heavy party equipment (including but not limited to BBQs, tents). can be taken on the shoreline or greenbelt. Lawn chairs, blankets or small coolers are acceptable for day use only. c) No alcohol or drug use of any type. d) Gatherings are allowed from 9 AM to 9 PM only. e) Use of greenbelts must be respectful and not disturb the peace of neighbors. 3) Pet rules a) Per the Landings Covenants page 17, article VI section 14, All pets must be on leash at all times outside of the owner s yard. b) Pick up after your pet and dispose of waste properly as pet excrement produces bacteria, disease and pollutes Warren Lake. c) Plastic bags and receptacles available at dog waste stations around the lake. d) Loud or abusive pets that disturb the peace and tranquility of neighbors or homeowners must be taken off the greenbelts or shoreline. The following lake rules were approved by the Landings HOA Board of Directors on Feb 6, 2012, and reapproved as edited on March 1, 2016. 4) No gas motor powered boats are allowed on the lake. Only electric motors with a maximum of 70 pounds of thrust are allowed. Boats must remain wakeless. 5) The use of the lake by non-members will be allowed only if they are accompanied by a member of an authorized association. This includes daytime use only of a non-member s watercraft, which must be registered by the member. Non-member use is limited to a maximum of two (2) watercraft and five (5) persons without the prior written approval of the Landings Homeowners Association. 6) Each person in a watercraft must wear or have on-board an approved US Coast Guard life jacket. 7) Swimming, fishing, boating or camping by non-members shall be forbidden, except as stated above. 8) No lake use by members, or by member s guests, shall interfere with the use, operation, or maintenance of the Warren Lake Reservoir Company. 9) No scuba diving shall be permitted. 10) Loitering on or swimming from the dam is prohibited. This rule is to prevent people from injuring themselves and disturbing the peace of nearby homeowners. 11) Pack out what you bring onto the lake or shoreline. Littering is prohibited. NO trash receptacles are provided. 12) No permanent structures may be left on the greenbelt or the lake surface rights area (including but not limited to non HOA provided boat racks) except as approved by the board of directors. 4

13) There will be a designated area marked by a green painted curb across from 725 Breakwater Drive to enter and exit the greenbelt when launching boats. Please use this entrance only. Sprinkler systems are expensive, so it is critical to respect the boat launch access path. You are responsible for damages incurred if access is not respected. Cars and light trucks only allowed. 14) Swimming and boating is always at the full risk of the homeowner. No lifeguards, rescue service, certified water testing or other responsibilities are being taken over by the HOA. Use of the lake is always at the homeowners own risk. 15) Dock rules for Landings Homeowners a) The Dock rules for the Landings HOA property shoreline which is totally covered by riprap are still under discussion and have not been finalized. b) Dock rules for the remainder of the lake shoreline are as follows: Small moveable docks are permitted on the lake in front of lakeside homes if owned and maintained by lake side homeowners. Docks are to be less than 16 feet in length and made of sturdy lightweight material. The dock must be insured by the homeowner for liability. The dock must be small enough to be moveable by two people without machinery (generally under 250 pounds). The docks cannot be locked to a permanent anchor and must be maintained by the owner when on the shoreline. Maintained means moved up or down as the water level fluctuates. Between November 1 and May 1 the dock must be moved back off the shoreline onto the homeowner s lot for the winter months. Only 1 dock per lakeside lot. No docks may be placed on the common greenbelts or on the shoreline in front of the common greenbelts. Note that while docks are below the high water line, they will be on the property of the Warren Lake Reservoir Company (WLRC) and could be moved or damaged by the WLRC in their normal reservoir operations. Docks are governed by the surface rights purchase agreement between the WLRC and the Landings HOA. 16) Boats or watercraft are defined as any watercraft more than 5 feet in length. 17) No overnight camping or open fires on any surface governed by these lake rights is permitted. 18) All moorings & designs must be approved by the Lake Committee before deployment. NO EXCEPTIONS. 19) All activity on the shorelines must abide by the current city ordinance. 5

Attachment A 2016 Warren Lake Fee Schedule 1) Basic Warren Lake Boat Registration Stickers - $1 per year 2) Annual Boat Storage Registration Stickers a) Canoe Rack Registration Sticker - $25 per year b) Large Boat Registration Sticker - $50 per year c) Lakeside Homeowner shoreline storage fee per lot - $25 per year Attachment B Diagram of Allowable Kayak Cross Braces ---------------------------------------------------------------------------------------------------- Attachment C Boat Violation Rules Violators of any of the rules in Section 1 will be tagged and cited. If not cured in 15 days, a $50 fine will be imposed. If not cured within 15 additional days, the boat will be impounded with a $100 additional fine for 1 st time offenders in order to reclaim the boat. This impoundment fee increases to $250 for repeat offenders. Impounded boat owners will not be able to buy any boat storage registration sticker for the remainder of the current year or the next year. If an impounded boat is not claimed in an additional 30 days, the boat will be sold. Proceeds will be used for the Lake Improvement Fund of the Lake Committee. Notification by email will be sent within 5 days after an initial violation, and again when a boat is impounded. This email will be sent to the boat owner at the email address entered on the Landings boat registration form. 6
