The Coast Guard makes navigability determinations regarding specific waterways or portions of waterways in order to determine its jurisdiction on those waterways. These navigability determinations are made for Coast Guard use at the request of Coast Guard officials and are subject to change or modification pursuant to Title 33 Code of Federal Regulations, Section 2.45. SECTION I. NAVIGABLE WATERS OF THE UNITED STATES BY DEFINITION UNDER 33 CFR 2.36(A)(1) OR (2): These waters include the territorial seas of the United States and all internal waters of the United States that are subject to tidal influence. Internal waters that are subject to tidal influence are too numerous to list by name. SECTION II. INTERNAL WATERS DETERMINED TO BE NAVIGABLE WATERS OF THE UNITED STATES. This list represents waterways for which the Coast Guard has made a navigability determination. Omission of a waterway from this list does not mean the waterway is not navigable.
