2016 2017 STUDENT CODE OF CONDUCT (SCOC)

2016-2017 SCOC Texas Education Code Chapter 37 requires a Board of Trustees of an independent school district to adopt a student code of conduct for the district. The Texas Association of School Boards (TASB) provides participating districts with recommended additions and/or deletions each year based on policy updates.

STUDENTS WITH DISABILITIES, PG. 9 In accordance with the Education Code, a student who receives special education services may not be disciplined for conduct meeting the definition of bullying, harassment, or making hit lists (see glossary) until an ARD committee meeting has been held to review the conduct.

MANDATORY EXPULSION UNDER FEDERAL LAW, PG. 28 Bringing to school or possessing at school, including any setting that is under the district s control or supervision for the purpose of a school activity, a firearm, as defined by federal law. Note: Mandatory expulsion under the federal Gun Free Schools Act does not apply to a firearm that is lawfully stored inside a locked vehicle, or to firearms used in activities approved and authorized by the district when the district has adopted appropriate safeguards to ensure student safety.

MANDATORY EXPULSION UNDER THE TEXAS PENAL CODE, PG. 28 A handgun, defined by state law as any firearm designed, made, or adapted to be used with one hand. (See glossary.) Note: A student may not be expelled solely on the basis of the student s use, exhibition, or possession of a firearm that occurs at an approved target range facility that is not located on a school campus, while participating in or preparing for a school-sponsored, shooting sports competition or a shooting sports educational activity that is sponsored or supported by the Parks and Wildlife Department, or a shooting sports sanctioning organization working with the department. [See policy FNCG(LEGAL).] An illegal knife, as defined by state law. (See glossary.) A club, as defined in state law. (See glossary.) Possessing, manufacturing, transporting, repairing, or selling a prohibited weapon, as defined in state law. (See glossary.)

GLOSSARY, PG. 35 Firearm is defined by federal law (18 U.S.C. 921(a)) as: Any weapon (including a starter gun) that will, is designed to, or may readily be converted to expel a projectile by the action of an explosive; The frame or receiver of any such weapon; Any firearm muffler or firearm weapon; or Any destructive device, such as any explosive, incendiary or poison gas bomb, or grenade. Such term does not include an antique firearm. Handgun is defined by Texas Penal Code 46.01(5) as any firearm that is designed, made, or adapted to be fired with one hand.

GLOSSARY, PG. 36, 37 Illegal knife is defined by Texas Penal Code 46.01(6) as a: Knife with a blade of over five and one-half inches; Hand instrument designed to cut or stab another by being thrown; Dagger, including, but not limited to, a dirk, stiletto, or poniard; Bowie knife; Sword; or Spear. Prohibited weapon under Texas Penal Code 46.05(a) means: An explosive weapon; A machine gun; A short-barrel firearm or firearm silencer, unless registered with the U.S. Bureau of Alcohol, Tobacco, Firearms, and Explosives or classified as a curio or relic by the U.S. Department of Justice; Knuckles; Armor-piercing ammunition; A chemical dispensing device; A zip gun; or A tire deflation device.
