Introduction By notice dated September 24, 2010, the Federal Energy Regulatory Commission (Commission) solicited motions to intervene on Power Company and Milner Dam Inc. (Licensees) application for a License Amendment for the Milner Hydroelectric Project, FERC No. 2899-144. hereby moves to intervene in this proceeding pursuant to 18 C.F.R. 385.210 and 385.214. Motion to Intervene A. Interest of the Intervenors is a national non-profit 501(c)(3) river conservation organization founded in 1954. We have over 6,000 members and 100 local-based affiliate clubs, representing whitewater paddlers across the nation. s mission is to conserve and restore America s whitewater resources and to enhance opportunities to enjoy them safely. As a conservation-oriented paddling organization, American Whitewater has an interest in the Milner reach of the Snake River affected by this project. A significant percentage of members reside in and neighboring states a short driving distance from the regionally significant recreational resource the Milner reach of the Snake River provides. We support the proposed license amendment of article 415 to include April as a month when whitewater releases are

potentially available at the Milner Project. The proposed amendment will enhance the ability of members to use the Snake River and areas surrounding the Project for recreational and aesthetic purposes, including but not limited to whitewater recreation, viewing the scenic river canyon, and enjoyment of the outdoors. We appreciate the efforts of the Licensees to consider the issues and suggestions raised by the boating community to improve implementation of this license article through the proposed amendment. B. Grounds for Intervention Intervention by is in the public interest as required by 18 C.F.R. 385.214(b)(2)(iii). has significant undeniable interests in the preservation, restoration, and enhancement of the Snake River s natural and recreational resources. Interests of recreational boaters include access to public waters, and opportunities for whitewater recreation on the section of the Snake River impacted by the project. No other party to the proceeding will be able to adequately represent those interests. has a direct and substantial interest in the outcome of this proceeding. C. Conclusion Granting intervenor status to will not delay this proceeding. No other party represents s interests in this proceeding.
