Welcome to Spirit Xtreme s All Star Cheerleading Program! On behalf of the incredible staff and wonderful All Star Families already training at Spirit Xtreme, we welcome you and encourage you to become a part of our family the Xtreme Nation! The goal of Spirit Xtreme is to be a gym that touches the heart of each athlete, parent, and coach in an uplifting and positive environment. A gym family that is a community where our athletes can grow! We hold our staff and athletes to high standards of sportsmanship and integrity. We are a family oriented program, and are very proud of the life lessons learned each day at Spirit Xtreme. We hope to stand out in the competitive cheer arena by providing a character building approach to competitive cheerleading that we all live each day. We set a standard of excellence that is followed through with the names of our teams: Rejoice, Joy, Faith, Love, Hope, Sparkle, Shine, Mighty, Believe, Heart, Trust, Courage, Honor, Xcellence, and Loyalty. All Star Cheerleading Overview All Star cheerleading has evolved into one of the most exciting, fast paced and strenuous sports scored by a panel of judges. Our sport is broken down into competitive levels by age and ability level. The United States All Star Federation (USASF) is the main governing presence in our industry, and Spirit Xtreme forms our teams based upon the age and ability levels specified by them. The talent level and expectations of these athletes increase with each year. Our mission is to positively impact the lives of cheerleaders at all ages and ability levels. Our focus when forming teams for the 2018-2019 season will be to place highly competitive teams on the mat where the hard work of the athletes is rewarded throughout the season. The USASF Age Groups are as follows: Tiny 5-6 years old as of August 31st, 2018 Mini 5-8 years old as of August 31st, 2018 Youth 5-11 years old as of August 31st, 2018 Junior 8-14 years old as of August 31st, 2018 Senior 11-18 years old as of August 31st, 2018 Our competitive All Star program offers teams for athletes 5 to 18 years old of all ability levels from the beginner to the elite. In addition to our All Stars teams, we offer All Star Prep teams that have no tumbling requirements and require less time and financial commitment. At Spirit Xtreme, evaluations are fun and relaxed. We will have a spot on an All Star or All Star Prep team for ALL athletes. All Star cheerleading is scored based on the execution of tumbling, jumping, dancing, motion technique, tosses, stunting, performance and choreography. ALL are important in putting together a successful team. Athletes will be placed on teams based upon their age and ability levels in ALL of the above mentioned categories. Spirit Xtreme Tiny and Mini teams are limited travel teams. Limited travel teams will compete at competitions within driving distance which may require overnight lodging and are NOT eligible for The Summit. 2018-2019 Specific Skill Expectations Jumps: Athletes at all levels should have correct arm placement, pointed toes, and the ability to land with their feet together. Level 3 athletes should have at least a level toe touch. Level 4 and 5 athletes should have superior jump height, technique and extension. More specific jump details are provided on the following page. Athletes with jumps below our expectations may be required to take an additional jump class. Overall Placement: If an athlete demonstrates an exceptional strength in another area besides tumbling, like jumps, dancing, basing, back spotting or flying, they may be placed on a squad that is higher than their individual tumbling skills. On the reverse side, simply having the necessary tumbling skills does not mean that an athlete will automatically make that level. We are looking for well rounded athletes with strong work ethic. If an athlete demonstrates a weakness in a specific skill area, demonstrates low work ethic, or has a history of missing classes or practices, they may be placed on a team lower than their tumbling skill level. Evaluation Information The first and most important aspect of evaluations at Spirit Xtreme is that the atmosphere be relaxed and comfortable. We want each athlete to be excited and let us help them reach their potential. Our parent viewing area will be CLOSED during our Evaluation clinics. Whether it is in our All Star program or our All Star Prep program, we have a team for ALL ages and ALL ability levels! Informational Parent Meeting: Do you have questions regarding our competitive All Star program? Would you like to find out more about Spirit Xtreme? Join us at our parent information meeting! All Star Program Wednesday, April 11th 7:30p.m. Required for Team Evaluations: 1. Read through this packet carefully. All Star Cheerleading is a select sport and requires a large time and financial commitment. Please make sure you and your athlete fully understand this commitment. 2. Checks made out to Spirit Xtreme for your Down Payment of $250 and the Evaluation Fee ($30 fee if paid by 4/13, $50 fee if paid after 4/13). 3. New athletes to Spirit Xtreme: Turn in a 2018 Gym Registration/Release form and pay the $35 annual insurance and gym registration fee. 4. New athletes turn in USASF Athlete Membership Form along with $30 Membership Fee. Returning athletes turn in USASF Membership Fee $30. 5. Turn in Copy of Birth Certificate (New Athletes Only) 6. Evaluation Details *Age is determined by their age as of August 31st, 2018. If you are not available during your designated evaluation time, a private evaluation can be scheduled in the gym office upon completion of registration. Evaluation Results: Athletes will be assigned a practice group to workout with over the next couple of weeks as teams are formed. Athletes may be placed in more than one practice group. Group Clinics will begin Thursday, May 10th. Group Practices: May 10th-17th Team Rosters Announced: Saturday, May 19th 2018-2019 Teams Practices Begin: Sunday, May 20th with a celebration party at our official Xtreme Team Reveal!

Team Expectations ATTENDANCE POLICY All Star Competitive Cheerleading is a select sport. It takes a full commitment from both the athlete and the family. Both parents and the athlete must be aware of the attendance requirements. The ability of all athletes to attend all practices maximizes the team s ability to reach its full potential. Cheerleading is more of a team sport than any other sport. We have no back ups or second string athletes. When one athlete misses a practice, it affects three to four other athletes who cannot stunt and affects the entire team who cannot fully execute the pyramid. Plus, the absent athlete hurts the formations and tumbling sequences. It is very important for athletes to be fully committed to their teams. All Practices are mandatory. We do understand that throughout the entire year, there will be graded school events, school cheer commitments, and major family events such as weddings. With the exception of a death in the family or an athlete s summer vacation days (as listed below), any athlete who misses a practice for ANY reason will receive a skill work assignment by their coach to complete at the conclusion of practice. Athletes must notify coaches of the absence in writing with at least 7 days notice. Absences should be emailed to absence@spirit-xtreme.com. If an athlete no shows a practice, they will incur a $100 fine. This includes absences during the summer that were not included on the athlete s vacation days. Please understand that multiple absences will affect the athlete s role in the routine through lost spots in formations and/or changed stunting roles. Recurring absences will result in an athlete being moved to a different team within our program or removed from the Spirit Xtreme program all together due to lack of commitment. If an athlete is sick, they attend practice. Athletes who are sick will not be required to participate; however, they must be present at practice. Athletes who are vomiting, running fever, or considered contagious the day of practice should call the gym office to seek guidance. During the ONE week prior to Show-offs, local and regional competitions, and the TWO weeks prior to National competitions there are NO absences allowed. Missing a practice during these weeks will automatically incur a $100 fine regardless of the reason and may result in the removal of the athlete from the team for the upcoming competition. Fines will be run on the card on file. Choreography: Choreography dates are very important and require mandatory attendance. Please make your plans now and notify your school coaches, work, family, etc. If you already have a scheduled conflict during these dates, please make sure you include them on the Event/Conflict Form and turn in with your registration forms. Competitions: THERE ARE NO EXCUSED ABSENCES FROM A COMPETITION. Every athlete is expected to attend every competition. If an athlete is ill on the day of a competition, they will be expected to show up and do their best to compete. In the case of severe illness, the parents will be expected to stay in frequent communication with the coaches. If an athlete NO SHOWS a competition the athlete will be dismissed from the program immediately and will be charged the total entry fee for the team/athletes that were affected by the athlete not showing. Vacations and Summer: We try to balance the importance of family time and the needs of the team. We will allow a maximum of three weeks for summer vacations between June 4th through August 17th. Advanced notice in writing will be required by June 1st. We ask that you try to schedule your vacations to minimize the amount of practice time missed, and when possible, take advantage of the All Star summer break from July 2nd-8th and August 6th-13th. A Summer Athlete Fill In requirement will be explained at the initial parent meetings. All athletes must be available to return to practice after Christmas break on Sunday, January 6th.

Team Expectations Practices: June 4th - August 17th: During the summer, we follow a revised practice schedule, so that all of our athletes will have the weekends to spend with their families. Teams will have their normal scheduled weekly evening practice and their weekend practice will be moved to one day during the week between the hours of 12:00-4:00p.m. August 27th-April 2019: Teams will practice once during the week and on the weekend. We will practice for 1 1/2 hours during the week and 2-3 hours on a Sunday between 1:00-8:30p.m. Practices will be held Monday-Sunday. If there is a reason that you cannot practice on a particular day, please note that on your Event Conflict Form. Most teams will increase to 3 practices a week during Nationals season (January/February/March). All team athletes are expected to attend every practice. Practices may also be adjusted for extenuating circumstances such as football playoffs. We provide these possible extra practice dates months in advance. Practice Wear: Each team athlete is expected to wear the correct practice outfit including matching bow to each practice. Shoes must be worn to every practice, hair must be pulled back in tight high ponytails, no jewelry of any kind. Athletes may condition for not wearing the complete or correct practice outfit. Required Tumbling: All athletes are required to take team tumbling. Team tumbling is included in monthly tuition and is an hour dedicated by all of our coaches to the tumbling progression of our athletes. If athletes are not available during the scheduled team tumbling times, they must register for a tumbling class or a standing private lesson. Team athletes receive a 50% discount off of monthly class rates for additional tumbling classes. Flyers: All flyers are required to take a Stretch/Flex/Fly Class for $40 per month. Regardless of age or level, great flexibility, beautiful body positions, sharp motions, and incredible performance are a necessity as a flyer. We will be incorporating some additional strength and flexibility elements into our Flyer class for a more disciplined and detailed Flyer class experience. Maintain Skills: Athletes are expected to maintain the skills they threw at tryouts throughout the season and may be made an alternate or moved to another team if they lose those skills. Once made an alternate, athletes are not guaranteed their spot back due to choreography changes, etc. Athletes must also be successful at stunting their assigned role to remain on the mat.

Team Expectations Parent Viewing Area: Parents will be asked to follow a drop off policy during weekend practices. This allows for greater focus by our athletes during their team practice time and also allows our parents to celebrate the growth of the team from week to week. If the viewing area becomes a negative environment at any time in the year, the viewing area will be closed. We want our athletes, families and coaches to feel safe coming to the gym. Spirit Xtreme is a home made for builders. We build each other up and not tear each other down. There will be no negativity allowed and those involved will be dismissed from the program. Competitions: We expect to attend 6-7 competitions for the 2018 2019 season. Please check the dates carefully and remember to be flexible with your schedules. We may elect to add events that are not listed here as many competitions dates are still TBD by competition companies. All competitions are mandatory. We will only consider excusing an absence for a major event if we are notified PRIOR to evaluations. We will finalize our competition schedule in late July/early August. It is likely that we will travel to out of town events. Bids to The Summit/Worlds: Travel teams (Youth to Senior) will accept all bids to The Summit. Athletes may be added or removed from the team prior to competition.

2018-2019 Important Dates Please check all of these dates carefully. All events and competitions are mandatory. We will only consider excusing a conflict if we know prior to placement on a team. Financial guidelines All athletes must have their 2017-2018 Spirit Xtreme account paid in full to be eligible for 2018-2019 season. If you are placed on a team and choose not to take the spot, no part of your deposit/commitment fee will be returned. Refusing a spot on a team prevents someone else from making that team and can leave the team without the proper number of bases, flyers, etc. If there is a major reason why you would not be able to cheer on a particular team or if there are particular days/times that you cannot practice, please attach a note to your athlete information sheet, so that we will not consider you for that team. All athletes are required to pay an annual gym registration during the year. This fee is paid when turning in your tryout evaluation form and annually in January of each year. The fee is $35 and includes a Spirit Xtreme T-shirt. Current team or class athletes do not pay an additional fee until January 2019. Spirit Xtreme s program is a 12 month commitment. Tuition charges begin in May 2018 and continue through April 2019. By agreeing to take a spot on a team, you are agreeing to a twelve month financial commitment and will owe tuition all twelve months. If anyone breaks this commitment prior to receiving any part of their uniform, warm up, or practice clothes, the items become the property of Spirit Xtreme. If an athlete is unable to finish the year due to injury with doctor s note or family relocation, Spirit Xtreme will balance your account determining the fees and tuition that have been spent. You will receive a credit for any fees or tuition that have been paid to Spirit Xtreme, but not used. Please be aware that if you choose the monthly installment plan, you may owe additional fees that were not yet covered through your prorated monthly fees. Competition entry fees cannot be refunded for any reason (including injury) once they have been paid out. Resignations must be in writing. Payment Policy: All tuition and fees will be electronically processed. Spirit Xtreme will be using ACH (Automatic Draft) for monthly tuition payments. Tuition will be drafted on the 1st of the month. Any changes to your ACH account including amounts, adds, drops, account numbers, card expirations, etc. must be submitted in writing using our ACH change form in order to activate your request. All accounts with a balance due by the 10th of the month will automatically be charged a $20 late fee. NOTE: If an athlete s account falls past due by more than 30 days with no communication, the athlete will be present but must sit out of all practices. When an account falls 60 days past due with no communication, the athlete will be choreographed out of the competition routine.

Financial obligations We understand the financial commitment made by families for the athlete. Spirit Xtreme offers two payment plans for you to choose from. * A 5% discount will be given to families who would like to pay for the year in full. This payment must be made by cash, cashier s check or personal check and is required to be paid in the gym office by May 14th to be honored. An ACH Form is still required to be on file. * The second plan allows you to pay off the program fee over the 12 month period of May 2018 to April 2019. Everyone who chooses the monthly plan must sign up for automatic payment (ACH) or debit/ credit card. The person responsible for the financial payment must fill out the financial information and sign the authorization for the credit card payment. This includes non-custodial parents or other family members who are assuming responsibility for the account. Payments Begin May 15th. All remaining monthly payments will be billed on the first of the month. 2018-2019 Fees Include: Down Payment/Commitment Fee: Down Payment of ($250) This fee is due with your evaluation forms. Monthly Expense: 12 Months of all star practices and team tumbling, entry fees for local and national competitions, practice clothes (3 sets with matching bows), choreography fees, music fees, Xtreme Retreat weekend (including lodging, meals and activities), BTBM fees and numerous other expenses. Tuition is not prorated for holidays or gym closings. Material, Uniform, Property Rights Agreement Material Agreement As a member of Spirit Xtreme All Star Program, any material (cheers, chants, pyramids, partner stunts, transitions, dances, music, routines, etc.) may not be used or taught for any purpose to anyone outside the Spirit Xtreme program. All material is owned by Spirit Xtreme and may not be reproduced or taught in any manner without prior written consent from Spirit Xtreme, Inc. This includes posting on YouTube, Facebook, or other internet websites. Anyone violating this agreement may be expelled immediately from Spirit Xtreme. Uniform Agreement Any and all parts of the Spirit Xtreme uniforms may only be worn during specific and official Spirit Xtreme activities. This uniform may not be worn for any other activity without prior written consent from Spirit Xtreme. No part of the uniform may be loaned to any person that is not a current member of the program. Property Rights Agreement The name Spirit Xtreme or any part of the trademark or logo may not be used without prior written consent from Spirit Xtreme. The company name and entity are solely owned by Spirit Xtreme. No Spirit Xtreme or Spirit Xtreme related team names may be sold or used without prior written consent from Spirit Xtreme. Any violation of this agreement may result in legal action.

Beyond The Blue Mat Spirit Xtreme s goal is to touch hearts and build athletes of character. Separate from physical training and competition preparation, our athletes participate in team building, celebratory and philanthropic events throughout the year. These events or part of these events are put on by Beyond The Blue Mat. These events/gifts typically include but are not limited to such things as: The Xtreme Experience Team Nationals T-Shirts Competition Gifts Community Service Events End of year banquet In addition, Beyond The Mat will organize opportunities for our athletes to participate in community service and philanthropic projects. These events and gifts are managed and paid for through a budget and bank account which is maintained by a volunteer treasurer and is separate from the gym s finances. Spirit Xtreme collects these fees and transfers to BTBM. Athletes will not be asked to pay additional fees or to participate in fundraising for Beyond The Blue Mat events throughout the year. Beyond the Blue Mat events are organized and run by the BTBM Steering Committee made up of a chairman, a treasurer, a secretary, event chairmen, and team moms. Any Spirit Xtreme parent or guardian is welcome (but not required) to participate on one of the event committees.

Parent Compliance I have received a copy of the Spirit Xtreme All-Star Team Information Packet. I have all of the information provided in this packet and agree to abide by all of the rules and regulations of Spirit Xtreme. In addition, I will commit myself to the time involved in practices, choreography, camp and competitions. I am fully aware that competition cheerleading is a large financial responsibility, and I will commit to Spirit Xtreme as per the financial requirements of a team member. I am fully aware that any items purchased and not received due to breaking the commitment or to dismissal are non refundable and become the property of Spirit Xtreme. I understand that a 30 day written notice is required in order to stop tuition and/or fee charges through either payment options. Any tuition and/or fees paid before this notification period will not be refunded under any circumstances. If my child loses any part of their practice clothes, I understand that I must purchase a replacement immediately. I understand that as a member of Spirit Xtreme I am a reflection of the company and will conduct myself in a manner in line with Spirit Xtreme beliefs. I will be a positive role model for my child and will encourage sportsmanship by showing respect at all times. I will demonstrate positive support for all athletes, coaches, and spectators at every practice and competition. I understand that my actions in the viewing area and at competitions are a reflection of Spirit Xtreme and should be of strong moral character. I will be a positive role model for my child and will encourage sportsmanship by showing respect and courtesy, and by demonstrating positive support for all athletes, coaches, and spectators at every practice and competition. I will maintain a positive attitude by remembering that children participate in cheerleading to have fun and that the sport is for children, not adults. I will teach my child that doing one s best is more important than winning, so that my child will not feel defeated by the outcome of a competition or his/her performance. I will encourage my child to be a humble winner and a gracious loser. I will attend parent meetings, check emails frequently and check the website frequently to retrieve information that Spirit Xtreme has prepared. I know that it is my responsibility as the parent to know what is going on and that I must keep other parents/care givers informed of all information, dates, and changes. I will plan ahead and compromise to have my athlete at every practice. I understand that teams depend on my child and will not miss due to illness, homework, my personal job, trips and other non emergency situations. I understand the Attendance Policy and will abide by the guidelines.

Athlete Compliance Spirit Xtreme expects a commitment of excellence from their athletes. Each team will set team goals, and we expect each athlete to set their own personal goals. Parents please read through the following expectations with your athlete. I understand that I am a reflection of Spirit Xtreme when in uniform or practice clothes, at competitions or in the gym. I will conduct myself with high morals following all guidelines set forth in this packet. I will not use inappropriate language or participate in inappropriate, immoral behavior. I will not participate in the illegal consumption of tobacco, alcohol or drugs. I understand that all of my actions both inside and outside of the gym are a reflection of Spirit Xtreme and should reflect strong character. I will keep parents and Spirit Xtreme informed of all school cheer events, classes or field trips before the 7 day advance notice required by Spirit Xtreme. I will be on time to all practices, competitions, and events. I will keep track of what I am to wear and come ready to practice or compete. I will arrive at all competitions on time with my uniform, hair and makeup completed to Spirit Xtreme standards. I understand I should have no jewelry on, my shoes should be on, and my hair should be up BEFORE the start of practice. I will bring a good attitude and strong work ethic each time I practice or compete even if I do not feel well or have conflicts at school. I will not disrupt practice with bad behavior. I will do my best to influence my team in a positive manner. I will not disrespect any team member, coach, parent or competitor from Spirit Xtreme or any other gym for any reason at any time. This includes any form of bullying and also includes venting or being disrespectful on Facebook, Twitter, Instagram or any other forum. I will learn and obey all Spirit Xtreme policies and procedures. I understand that this is a full 1 year commitment and other athletes as well as my coaches are depending on me. I will not disrespect any coach, team member, parent or competitor from Spirit Xtreme or any other gym. I understand that all material, music and routines are the property of Spirit Xtreme and are not to be used for any other purpose. I understand that attending another gym tryout will forfeit my spot on the team immediately. Spirit Xtreme Code of Conduct We hold our staff, athletes, and parents to a higher standard. We do care about what your athletes are doing in and outside of the gym. Dismissal: Grounds for Dismissal from Spirit Xtreme include, but are not limited to: Smoking, drinking of alcoholic beverages or use of drugs. This will warrant immediate dismissal from the team. Challenging the authority of the coach or person in charge, by athlete or parent, will be automatic dismissal from the team. Abusive behavior, inappropriate language, lying, stealing or any other negative form of behavior is grounds for dismissal. Each athlete will follow all additional rules and guidelines given by the coach or person in charge. Any negative behavior towards a Spirit Xtreme athlete or coach or to another gym, via any medium (i.e. Facebook, Twitter, Instagram, internet, cell phone...) Any unsportsmanlike behavior, via any medium, will result in dismissal from team. No inappropriate pictures or language to be used on any medium. Athletes are to never approach an official or judge or a competition to voice a negative opinion. Doing so will result in dismissal. Attending a tryout at another gym while under contract with Spirit Xtreme will result in immediate dismissal. Leadership - Any infraction may result in dismissal from team. Each athlete must be aware that no person has a right to be on Spirit Xtreme. It is a privilege. Each athlete and parent must be aware of the responsibilities required and the commitment he or she is making to the team. Each athlete must be willing to cooperate with and be helpful to the coach or any person in charge. Each athlete must realize the manner in which they conduct themselves while representing Spirit Xtreme, directly reflects on the entire team, coach and gym. Each athlete will be willing to work hard, take directions, and strive for excellence. Expectations - Any infraction may result in dismissal from team. Athletes will set and maintain the highest examples of behavior. Athletes will maintain the proper appearance with no extremes in apparel, hair, make-up, piercings or tattoos. Athletes will be on time to all activities. Athletes will do everything in their power to achieve personal and team goals. Each athlete is responsible for finding out any missed information. Athletes will not post routine videos or music to the internet without permission. Competitions - Any infraction may result in dismissal from team. Athletes are required to attend all competitions through the awards ceremony. If parents are unable to stay for the whole competition, other arrangements must be made so that the athlete can stay. The highest standard of sportsmanship is expected from coaches, athletes and parents. Athletes must be prepared for competition: Uniform clean, shoes, and hair and make up as specified by Spirit Xtreme. Safety - Any infraction may result in dismissal from team. Jeopardizing the safety of oneself or any other athlete is grounds for disciplinary action or dismissal. There is NO gum, candy, jewelry, food or drinks near the gym floors. Spirit Xtreme Parental Obligations Rules and Regulations - Any infraction may result in dismissal from team. Any negative behavior towards a Spirit Xtreme member, Spirit Xtreme gym, Spirit Xtreme staff or to another gym via any medium, will result in dismissal of your athlete from team. Parents will make sure that your athlete is on time to practice Parents are to inform the coach if the athlete is to be late or absent. Parents are to fulfill any financial obligations on time. Parents are to encourage and support Spirit Xtreme to be the best they can be. Whoever signs the release form is financially responsible, but all parents are responsible for knowing the policies and procedures of Spirit Xtreme. Parents need to maintain manners and civility at all events. Any negative behavior towards a Spirit Xtreme athlete or coach or to another gym, via any medium (i.e. Facebook, Twitter, Instagram, internet, cell phone...) will result in dismissal from team. Any unsportsmanlike behavior, via any medium, will result in dismissal from team. Parents are to never approach an official or judge or a competition to voice a negative opinion. Doing so will result in dismissal. Parents will not post routine videos or music to the internet with permission. Parents are not to use the Spirit Xtreme contact list, parent emails, or phone list for anything negative. There will be no tolerance on this issue. Facilities No gum in the gym area. No food in the gym area. The team room is available for athletes to eat. No pets (dogs, cats, etc) are allowed in the gym at any time. Children who are not athletes of Spirit Xtreme should not be left unattended at the gym. The team room is for team athletes only and should not be used as a play area.

SPIRIT XTREME MEMBERSHIP AGREEMENT THIS MEMBERSHIP AGREEMENT is entered into for the 2018-2019 cheerleading season, commencing on May 1, 2018 and to end on April 30, 2019, by between SPIRIT XTREME ( SX ) and BOTH the participating all star cheerleader and the parent guardian of the all star cheerleader ( member ). I. POLICY AND EXPECTATION The member has read and fully understands all policies, rules and expectations required to be a part of SX. The member is entering into this all-star cheerleading program on their own free will. The member understands what will be expected of them both as a parent guardian and an all star cheerleader. The member will conduct themselves in a sportsmanlike manner and uphold the standards that are expected to be a part of SX. II. FINANCIAL COMMITMENT The member has read and fully understands the amount that is asked for in the Financial Obligations portion of the All Star Team Information Packet to be a participant of SX. The member understands, should their monthly amount not be paid and show a balance due, then SX will reserve the right to remove the member from participation until the amount is paid in full. If the member has a due balance for longer than 30 days, SX reserves the right to dismiss the member from the program and pursue a legal remedy and/or turn to collection. III. RELEASE AND ASSUMPTION OF RISK As the member, I understand and acknowledge that the activities that I or my child engage in while on the premises or under the auspices of SX pose known and unknown risks which could result in injury, paralysis, death, emotional distress, or damage to me, my child, to property, or to third parties. I expressly agree and promise to accept and assume all of the risks, know and unknown, connected with SX related activities, including by not limited to performance of stunts and/or use of trampolines. I elect for myself and my children to participate in such activities in spite of the risks. I hereby voluntarily release, forever discharge, and agree to hold harmless and indemnify SX from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my child s participant in SX activities. I certify that my child has health, accident and liability insurance to cover bodily injury or property damage that may be caused or suffered while participating in this event or activity, or else I agree to bear the costs of such injury or damage to my child. TERMINATION OR DISMISSAL If the member should fail to follow any of the mentioned expectations, policies and/or obligations listed in the All Star Information Packet SX will reserve the right to dismiss the member from the program. If the member should decide to quit or stop attending the required participant involvement, then there is a buyout requirement set forth as the following. BUY-OUT requirement to exit the program is the amount of three 3 monthly fees. This amount is the amount paid by the member as described in the Financial Obligations portion of the All Star Team Information Packet. The buy-out amount must be paid in full upon departure. If the buy-out amount is not paid within thirty 30 days from the departure then SX reserves the right to pursue a legal remedy and/or turn to collections. V. LEGAL Should SX required to incur attorney s fees and costs to enforce any part or in while the expectations policies and/or obligations listed in the All Star Team Information Packet, the member will indemnify and reimburse SX for such fees and costs. This agreement and any action related thereto will be governed, controlled, interpreted, and defined by and under the laws of the State of Texas, without giving effect to any conflicts of laws principles that require the application of the lay of a different jurisdiction. If any part of the All Star Information Packet or any provision of this agreement is, for any reason, held to be invalid or or unenforceable, the other parts and/or provisions will be unimpaired and the invalid or unenforceable part and/or provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
