ONE YEAR FREE UNLIMITED DATA ROAM PROMOTION TERMS & CONDITIONS OF SINGTEL MOBILE S DATAROAM SAVER (DAILY) PLAN AND EASYDATA ROAM ADD-ON LUCKY DRAW ( Lucky Draw ) This Lucky Draw is carried out by SingTel Mobile Singapore Pte Ltd ( SingTel Mobile ) and is subject to these terms and conditions ( Terms ). By registering or taking part in this Lucky Draw, all persons participating herein (each a Participant ) agree to be bound by these Terms. 1. This Lucky Draw is open to all NRIC-registered SingTel Mobile Postpaid subscribers who: (i) Are aged 18 and above as at the start of the Promotion Period (as defined in Clause 4 below); (ii) Have subscribed to SingTel Mobile s DataRoam Saver (Daily) or EasyData Roam add-on at any time during the Promotional Period and remains subscribed to the said plan for the rest of the Promotional Period not prohibited in any manner by any person, entity, authority or law anywhere in the world from participating in this Lucky Draw; and (iii) Are not the immediate family members of or employees of Singapore Telecommunications Ltd ( SingTel ), its agencies and other parties which are directly involved and/or associated in organizing, promoting and/or conducting this Lucky Draw. 2. By participating in this Lucky Draw, each Participant represents and warrants that he/she has met the eligibility criteria set out under Clause 1 above. 3. Participants shall participate in the Lucky Draw on his/her own account, and shall not submit forms or participate on behalf of other persons. SingTel Mobile may from time to time in its absolute discretion decide on the eligibility for participation in the Lucky Draw. 4. The promotional period runs from 31 October 2013 till 30 March 2014, both dates inclusive (the Promotional Period ).
5. The draw for the Lucky Draw winners will be conducted as stated in the table below and winners will be notified 2 weeks from the draw date. ( Draw Date ) or such other date as SingTel Mobile may determine at its sole and absolute discretion, at 31B Exeter Road, #04-00, Comcentre II, Singapore 293733. The prizes for the Lucky Draw shall be as follows ( Prizes ): Weekly winner for ONE year free unlimited data roam: Inclusive of: Free EasyData Roam Subscription for 12 months (total worth $12) Free DataRoam Saver (daily) subscription, capped at $500 per month for 12 months (total worth up to $6,000) Excludes: Pay-per-use usage charges on non-preferred network, if any Roaming voice or video calls usage charges Roaming SMS usage charges 7. Winners shall be notified via SMS and/or phone from fourteen (14) working days from the Draw Date based on the submitted contact details. Winners shall ensure that they remain contactable at all times. If SingTel Mobile is unable to contact any winner for any reason whatsoever, it shall at its sole discretion draw another substitute winner. 8. Prizes are not transferable, exchangeable or redeemable for cash. Winners are responsible for collecting their Prizes in person. Winners will be advised of the date, time and venue for the collection of Prizes separately. 9. Winners will be required to personally submit the following verification documents to be eligible to collect any Prize: Original passport and mobile contract or proof of subscription confirmation from the Participant s purchasing channel. The award of Prizes shall be subject to such verification to the full satisfaction of SingTel Mobile. 10. SingTel Mobile s decision on all matters relating to this Lucky Draw shall be final and binding. No further correspondence regarding this Lucky Draw, these Terms or any decision made by SingTel Mobile in connection therewith and/or the results will be entertained. SingTel Mobile reserves its absolute right to determine an outcome and act as it deems fit in any dispute and/or issues relating thereto. 11. Where Prizes contain a specified validity period during which it should be utilized, no requests for extensions or replacements whatsoever will be entertained. 12. Any trademarks, graphic symbols, logos or intellectual property contained in any materials used in connection with this Lucky Draw, in particular that relating to the Prizes, are the property of their respective owners. SingTel Mobile and its affiliates and contractors are not affiliated with, or endorsed or sponsored by, such owners and their relevant affiliates. 13. By entering into this Lucky Draw, each Participant agrees that SingTel Mobile, its respective affiliates, subsidiaries, advertising and promotions agencies, and their
respective officers, directors, and employees (the Relevant Organisers ) shall not be liable for injury, loss, claims or damage of any kind arising out of or in connection with participating in this Lucky Draw, the Participants acts omissions or negligence, and/or from the acceptance or use/misuse of the Prizes awarded. Each Participant agrees to waive and release the Relevant Organisers from the above-mentioned claims and liabilities. This includes, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, to the extent not prohibited by applicable written laws. 14. To the maximum extent permitted by law, each Participant agrees to indemnify SingTel Mobile against any losses, damages, costs, expenses, claims or liabilities of any kind arising in connection with his/her participation in the Lucky Draw. 15. By participating in this Lucky Draw, Participants hereby consent to and authorize, SingTel Mobile to use at its sole discretion, without further compensation to the Participants, any of their names, addresses, personal details, photographs, videotapes or any likeness of them for packaging, promotional, advertising, marketing, feedback and/or publicity purposes (where not prohibited by written law), and to the use of statements or any creative content made by or attributed to winners of this Lucky Draw, and any rights in connection therewith. 16. SingTel Mobile may at its sole discretion make Prize substitutions without prior notice to any person. Any Prizes won or accepted shall be given on an as- is basis and are not exchangeable or returnable. SingTel Mobile expressly disclaims any warranties express or implied in connection with any Prizes to the fullest extent permitted by applicable laws. The Prizes may be subject to additional terms and conditions, and Participants agree to comply with all terms and conditions applicable to the Prizes. 17. SingTel Mobile is not responsible or liable for delayed, lost, stolen, incomplete, late or misdirected entries and submissions caused by any reason whatsoever, including but not limited to service delays, interruptions, failures or overloads, telephone lines, and/or postal/internet services. 18. SingTel Mobile reserves the right to vary or modify these Terms in such manner as SingTel Mobile deems fit, without giving notice or reason, and without any liability to Participants. Any such changes shall be binding and will take effect immediately upon such amendment. 19. SingTel Mobile reserves the right to pursue legal action against any person which it believes has undertaken fraudulent activities or other activities harmful or prejudicial to this Lucky Draw, the entry submission process or the web site www.singtel.com/dataroam. 20. SingTel Mobile reserves the right, without prior notice and at any time to terminate or cancel the Lucky Draw, in whole or in part, or modify this Lucky Draw in any way, without liability to any person. If any part of these Terms is held to be unenforceable or illegal, such illegal or unenforceable part shall be severed from the Terms without affecting the validity of the remaining Terms.
21. These Terms shall be governed by Singapore law and each Participant agrees to submit any claim, dispute or controversy to the non-exclusive jurisdiction of the courts of the Republic of Singapore.
