FISHING VESSEL SAFETY REGULATIONS AMENDMENTS 1. The long title of the Small Fishing Vessel Inspection Regulations is 1 following: Fishing Vessel Safety Regulations 2. Act «Loi» Act means the Canada Shipping Act, 2001. amidships «milieu du navire» amidships means the mid-point of the length of a fishing vessel. closed construction «bateau ponté» closed construction, with respect to a fishing vessel, means a fishing vessel of which more than 50 per cent of the length is covered full width, at or above the gunwale level, by decks or permanent enclosures. existing «existant» existing, when used with reference to a fishing vessel, means a fishing vessel that is not new. fishing vessel «bâtiment de pêche» fishing vessel means a Canadian vessel that is used or is to be used for commercially catching, harvesting, or transporting fish or other living marine resources. ice covered waters «eaux prises par les glaces» length «longueur» length for Parts I and II means, (a) in the case of a vessel that is registered under the Act or required by the Act to be registered, (i) the distance from the fore part of the uppermost end of the stem to the aft side of the head of the stern post except that if a stern post is not fitted to the vessel the measurement shall be taken to the foreside of the head of the rudder stock, or 2

(ii) if the vessel has no rudder stock or has a rudder stock situated outside of the hull at the stern, the distance from the foreside of the foremost permanent structure to the aft side of the aftermost permanent structure of the vessel, not including guards or rubbing strakes, and (b) in the case of a vessel other than a vessel described in paragraph (a), the horizontal distance measured between perpendiculars erected at the extreme ends of the outside of the hull. major modification «modification majeure (importante)» major modification new «neuf» new for Parts I and II, when used with reference to a fishing vessel or article, means that the construction of the fishing vessel or article was commenced on or after January 6, 1965, and includes any foreign fishing vessel brought under Canadian registry whether or not its construction was commenced before or after that date. open construction «bateau non ponté» open construction, with respect to a fishing vessel, means a fishing vessel other than one of closed construction. operating position «poste de commande» operating position owner «propriétaire» owner readily accessible «facilement accessible» readily accessible means capable of being reached easily and safely under emergency conditions without the use of tools. sailing ship «voilier» ou «navire à voile» sailing ship means (a) a ship propelled wholly by sails; and (b) a ship principally employed in fishing not exceeding 200 tons, gross tonnage, provided with masts, sails and rigging sufficient to allow it to make voyages under sail alone, and that, in addition, is fitted with a mechanical means of propulsion other than a steam engine. «appareil de signalisation sonore» subsidized vessel [Repealed, SOR/79-905, s. 1] TP 127 «TP 127» TP 127 means the Ship Safety Electrical Standards, issued by the Department of Transport, as amended from time to time. 3

Section 3 of the Regulations and the heading before it are replaced by the following: PART 0.1 INTERPRETATION 3.01 (1) The following definitions apply in this Part. accessible «accessible» accessible means capable of being reached for inspection, removal or maintenance without removal of any elements of the permanent fishing vessel structure. accommodation space «local d habitation» accommodation space means any space enclosed on all six sides by solid divisions for the use of persons on board, includes areas such as the wheelhouse, galley, common areas and washroom (toilet spaces) except where otherwise mentioned-but does not include a machinery space. breadth «largeur» breadth means the maximum breadth of a vessel measured amidships to the moulded line of the frame in the case of a vessel with metal shell plating, and in any other case, to the outer surface of the shell plating. classification society «société de classification» classification society means a classification society that is a member of the International Association of Classification Societies (IACS). Convention «Convention» Convention means the 1977 Torremolinos Convention as amended by the 1993 Protocol. Convention length «longueur de convention enregistrée» Convention length, in respect of a vessel, means 96% of the total length on a waterline at 85% of the least moulded depth measured from the top of the keel, or the length from the fore side of the stem to the axis of the rudder stock on that waterline if that is greater. In vessels designed with a rake of keel, the waterline on which the length is measured shall be parallel to the designed waterline. decked vessel «bâtiment ponté» engine space «compartiment moteur» engine space means any space that contains a permanently installed propulsion engine or auxiliary engine, including any connected spaces. EPIRB «RLS» EPIRB means an emergency position indicating radio beacon. hull length «longueur de coque» 4

hull length, in respect of a fishing vessel, means the distance measured from the forward end of the foremost outside surface of the hull shell to the aft end of the aftermost outside surface of the hull shell. IMO Resolution MSC.81(70) «résolution MSC.81(70) de l OMI» IMO Resolution MSC.81(70) means the annex to International Maritime Organization Resolution MSC.81(70), Revised Recommendation on Testing of Life-Saving Appliances. IS Code «recueil SI» IS Code means the Annex to International Maritime Organization Resolution MSC.267(85), International Code on Intact Stability, 2008, adopted on 4 December 2008. lifebuoy «bouée de sauvetage» lifebuoy means a SOLAS lifebuoy or a small vessel lifebuoy. lifejacket «gilet de sauvetage» lifejacket means a standard lifejacket, a SOLAS lifejacket or a Class 1 or Class 2 lifejacket. life raft «radeau de sauvetage» life raft means a SOLAS life raft, a reduced capacity life raft or a coastal life raft. LSA Code «recueil LSA» LSA Code means the annex to International Maritime Organization Resolution MSC.48(66), International Life-Saving Appliance (LSA) Code. machinery space «tranche des machines» machinery space means any space containing propelling machinery, steering gears, boilers, steam and internal combustion engines, generators and major electrical machinery, oil filling stations, refrigerating, stabilizing, ventilation and air-conditioning machinery, and similar spaces, and trunks to the spaces. near coastal voyage, Class 1 «voyage à proximité du littoral, classe 1» near coastal voyage, Class 1 has the same meaning as in the Vessel Certificates Regulations. near coastal voyage, Class 2 «voyage à proximité du littoral, classe 2» near coastal voyage, Class 2 has the same meaning as in the Vessel Certificates Regulations. near coastal voyage, Class 2, restricted 5 miles «voyage à proximité du littoral, classe 2, limité à 5 milles» near coastal voyage, Class 2, restricted 5 miles means a near coastal voyage, class 2, during which the vessel engaged on the voyage is always within 5 nautical miles of shore. near coastal voyage, Class 2, restricted 2 miles «voyage à proximité du littoral, classe 2, limité à 2 milles» near coastal voyage, Class 2, restricted 2 miles means a near coastal voyage, class 2, during which the vessel engaged on the voyage is always within 2 nautical miles of shore. new vessel «bâtiment neuf» new vessel means a Canadian vessel for which construction started or which was imported and registered for the first time in Canada more than one year after the day on which these Regulations come into force. 5

permanently installed «fixé à demeure» permanently installed means securely fastened so that tools must be used for removal. person overboard retrieval device «dispositif de récupération des personnes par-dessus bord» person overboard retrieval device means a lifting harness or other apparatus that a person on board the vessel can use to retrieve [and reboard] a person after an accidental fall overboard, [even if the person overboard is unconscious][without the assistance of the person overboard]. power-driven «à propulsion mécanique» power-driven in respect of a fishing vessel, means that the fishing vessel is propelled by an engine or has an engine on board to propel it. product certification body «organisme de certification de produits» product certification body means a body that is accredited by the Standards Council of Canada, or by any other national accreditation organization that is a member of the International Accreditation Forum Multilateral Recognition Arrangement, to give third-party written assurance that a product meets the specified requirements for the product, including granting of initial certification and maintenance of the certification. pyrotechnic distress signal «signal de détresse pyrotechnique» pyrotechnic distress signal means a rocket parachute flare, a multi-star flare, a hand flare, or a buoyant or hand smoke signal. reboarding device «dispositif de remontée à bord» reboarding device means a ladder, fitting, handhold or other apparatus that does not include any part of the vessel s propulsion unit and that assists a person to gain access to the vessel from the water. recommended practices and standards «normes et pratiques recommandées» recommended practices and standards means the recommended practices and standards for marine use issued by a marine classification society, standards development organization, industrial or trade organization, government, government agency or international body. recovery boat «embarcation de récupération» recovery boat means a boat that is auxiliary to the fishing vessel that can be used in reduced capacity life raft «radeau de sauvetage a capacite reduite» reduced capacity life raft means a life raft that meets the standards and tests for a SOLAS life raft set out in sections 1.2, 4.1 (except paragraph 4.1.2.1), 4.2 (except paragraph 4.2.6.3.4) and 4.3 of the LSA Code, in section 5 of Part 1 of IMO Resolution MSC.81(70), and in the Canadian modifications set out in TP 14475. sheltered waters voyage «voyage en eaux abritées» sheltered waters voyage has the same meaning as in the Vessel Certificates Regulations. SOLAS «SOLAS» SOLAS means the International Convention for the Safety of Life at Sea, 1974. survival craft «bateau de sauvetage» 6

survival craft has the meaning assigned by subsection 2(1) of the Life Saving Equipment Regulations. towing «remorquage» towing means the action of pulling a vessel or an object astern or alongside, or pushing a vessel or an object ahead, but does not include pulling or pushing, in the course of the fishing vessel s normal operations, a floating object or vessel that has a significantly smaller displacement than the fishing vessel s displacement. TP 1332 «TP 1332» TP 1332 means the Construction Standards for Small Vessels, published by the Department of Transport. TP 14475 «TP 14475» TP 14475 means the Canadian Life Saving Appliance Standard, published by the Department of Transport. undecked vessel «bâtiment non ponté» undecked vessel means a vessel which is not a decked vessel. unlimited voyage «voyage illimité» unlimited voyage has the same meaning as in the Vessel Certificates Regulations. watertight «étanche» watertight means capable of preventing the passage of water through the structure in any direction under a head of water for which the surrounding structure is designed. weathertight «étanche aux intempéries» weathertight means that in any sea conditions water will not penetrate into the vessel. Suitable boat (2) For the purposes of these Regulations, the reference to a suitable boat in the definition of survival craft in subsection 2(1) of the Life Saving Equipment Regulations is to be read as a recovery boat. Incorporated documents (3) Except as otherwise indicated in these Regulations, any reference in these Regulations to a document is a reference to that document as amended from time to time. Inconsistencies (4) In the event of an inconsistency between a provision in a document incorporated by reference and a provision in these Regulations, the provision in these Regulations prevails. Date of construction, manufacture, rebuilding (5) For the purposes of these Regulations, a reference to the date of construction, manufacture or rebuilding of a fishing vessel is to be read as a reference to the date on which the actual construction, manufacture or rebuilding starts. 7

APPLICATION Application 3.02 (1) This Part applies in respect of (a) a fishing vessel that is less than 24 metres in Convention length; and (b) an existing fishing vessel that is 24 m in Convention length or more but not more than 24.4 m and that is not more than 150 gross tonnage. Responsibility 3.03 Unless otherwise indicated in this Part, the authorized representative and the master of a fishing vessel must ensure that the requirements of these Regulations are met. DIVISION 1 GENERAL REQUIREMENTS Safe Operation Designed to operate safely 3.04 The authorized representative must ensure that the fishing vessel is designed, constructed and equipped to operate safely in its area of operation. Condition of machinery and equipment 3.05 (1) A fishing vessel, its machinery and equipment must be maintained in a safe operating condition. Maintenance records (2) The authorized representative of a fishing vessel must maintain records on the maintenance of the vessel, its machinery and equipment. Records Record keeping seven years 3.06 (1) A record that is required to be maintained under this Part must be kept for a period of seven years after the day on which it was first established. Modifications affecting stability (2) However, a record of a modification or series of modifications that affect the stability of a fishing vessel is kept, in the case of a fishing vessel that has undergone a stability assessment, until a new stability assessment is conducted that takes into account the modification. Transfer of records (3) Upon transfer of a fishing vessel to a new owner, the authorized representative of a fishing vessel must transfer any records required to be maintained under this Part to the new owner. Prohibition Operational Limits Prohibition Freezing spray 3.07 (1) It is prohibited for anyone to operate or to permit a person to operate a fishing vessel in an area for which a freezing spray warning is issued by Environment Canada, unless the stability assessment for the vessel demonstrates the vessel s ability to operate safely in freezing spray conditions. Accumulated ice (2) If a freezing spray warning is issued by Environment Canada for an area in which a fishing vessel is operated or is intended to be operated, the vessel must carry on board a means to remove accumulated ice from the vessel. 8

General Prohibitions Before putting into service 3.08 It is prohibited for the authorized representative of a fishing vessel to operate or permit another person to operate a fishing vessel unless, before it is first put into service, the authorized representative has informed the Minister of (a) the intention to operate the fishing vessel or permit its operation; (b) the physical characteristics of the fishing vessel; and (c) the nature of its operations. Exceeding design limitations 3.09 It is prohibited for anyone to operate or permit another person to operate a fishing vessel under circumstances that exceed its design limitations. Towing 3.10 It is prohibited for anyone to operate or permit another person to operate a fishing vessel for the purposes of towing, other than to fish or to manage fishing gear, unless the vessel complies with the requirements set out in paragraphs (a) to (f) of section 521 of the Small Vessel Regulations. Careless operation 3.11 It is prohibited for anyone to operate a fishing vessel in a careless manner, without due care and attention or without reasonable consideration for other persons. Danger or risk to safety of persons 3.12 It is prohibited for anyone to operate or permit a person to operate a fishing vessel in environmental conditions or in circumstances that may cause a danger or a risk to the safety of persons on board unless a lifejacket required by these Regulations, or a personal flotation device that meets the requirements set out in section 33*** is worn, (a) by all persons on board, in the case of a vessel that has no deck or deck structure; and, (b) by all persons on the deck or [in the cockpit], in the case of a vessel that has a deck or deck structure. General Requirements Watertight closure 3.13 A watertight closure on a fishing vessel must be kept closed while at sea unless it is necessary for it to be open for the operation of the vessel. Stowage of tools and spare parts 3.14 Tools and spare parts required for routine maintenance and simple repairs to machinery, electrical equipment and installations must be carried on board a fishing vessel and securely stowed in a readily accessible location. Fuel Prohibitions and Requirements Cooking by open fire or with gasoline 3.15 It is prohibited for anyone to heat or cook by means of open fires or with gasoline. Storage and handling 9

3.16 Gasoline and other liquid fuels having a flashpoint below 38 degrees Celsius used for vessel propulsion, auxiliary or domestic use purposes on board must be stored and handled in a manner consistent with the manner for storage and handling of a flammable liquid. Prohibition Engine space blower 3.17 It is prohibited for anyone to start a gasoline-powered fishing vessel before the engine space blower has been operated for a period of not less than four minutes immediately before the engine is started. Leakage of fuel 3.18 (1) It is prohibited for anyone to permit leakage of fuel within or from a fishing vessel. Discharge of fuel or oil (2) It is prohibited for anyone to permit fuel or oil to be discharged from a fishing vessel except in accordance with the provisions relating to discharges of oil or oily mixtures in Part 2, subdivision 4 of the Vessel Pollution and Dangerous Chemicals Regulations. Fuelling (3) It is prohibited for anyone to fuel a gasoline-powered fishing vessel that is at dockside or beached unless; (a) in the case of a vessel is equipped with a portable fuel tank, the tank is first removed from it; or (b) in the case of a vessel is equipped with a fixed fuel tank, the person fuelling it is the only person on board. Fuelling a fixed fuel tank (4) It is prohibited for anyone to fuel a gasoline-powered fishing vessel that is equipped with a fixed fuel tank unless all electrical equipment is switched off, all doors, windows and ports are closed, all engines are shut off and all open flames, including pilot lights, are extinguished. Portable container (5) It is prohibited for anyone to carry liquid fuel on board a fishing vessel in a portable container that has not been designed to carry the fuel. Storage of portable fuel tank (6) A portable fuel tank containing fuel carried on board a fishing vessel must be stored as far away as practicable from heated surfaces, heat or ignition sources, machinery space and accommodation spaces. Permanently installed fuel tank (7) It is prohibited for anyone to fill a permanently installed fuel tank by means of a funnel, nozzle or similar device unless continuous contact is maintained between the shipboard filling pipe and the filling device immediately prior to and during the fuelling operation. Portable fuel burning equipment or appliance 3.19 Any portable fuel burning equipment or appliance used on a fishing vessel must be (a) used only in a well-ventilated location in an open space or on an open deck; (b) well secured to prevent its movement while in use; and (c) when not in use, stored in a well-ventilated location that is isolated from heat and ignition sources. 10

Safety Procedures Written procedures 3.20 (1) Written procedures must be established and implemented to familiarize persons on board a fishing vessel with (a) the location and use of all safety equipment; (b) all safety measures necessary for the protection of the persons on board, in particular those relating to the prevention of persons falling overboard, the rapid retrieval of persons who have fallen overboard, the protection of limbs from rotating equipment and the avoidance of ropes, nets and other fishing equipment that may pose a safety hazard; (c) in the case of beam trawling and purse seining operations, the quick release of loads that can be activated in an emergency; (d) all measures necessary for preventing fires or explosions on the vessel; and (e) if the vessel has a deck or deck structure, measures necessary to maintain [watertight][weathertight] integrity and to prevent downflooding of the vessel. Exercises respecting procedures (2) Exercises must be conducted to ensure that the crew is at all times proficient in carrying out the procedures. Record of exercises (3) A record of the conducted exercises must be maintained. DIVISION 2 SAFETY EQUIPMENT Requirements Prohibition 3.21 (1) It is prohibited for anyone to operate or permit another person to operate a fishing vessel unless the type of safety equipment required by these Regulations is carried on board the vessel and. (a) in the case of safety equipment that was acquired on or after the date of coming into force of this Division, the equipment meets the requirements of these Regulations; or (b) in the case of safety equipment that was acquired before the date of coming into force of this Division the equipment meets the requirements of these Regulations as they read before that date, as long as the equipment is serviceable or, in the case of equipment that bears an expiry date, has not expired. Safety equipment in excess of requirements (2) Any safety equipment on board the fishing vessel that exceeds the quantity required by these Regulations must also meet the requirements of these Regulations. Other equipment (3) Equipment that is not required by these Regulations may be carried on board the fishing vessel if (a) it is not likely to be confused with the safety equipment; or (b) it is pyrotechnic distress signal that is expired, according subsection 44.1(3) 11

Delayed application (4) This Division does not apply until one year after the coming into force of these Regulations. Safety Equipment Standards and Approval Mark or label indicating approval by Minister 3.22 (1) An immersion suit, anti-exposure suit, emergency boat, recovery boat, rescue boat, referred to in these Regulations must bear a mark or label indicating that it is of a type that is approved by the Minister. Applicable standards and test (2) The Minister must approve a type of equipment listed above if it is shown to meet the applicable standards and tests referred to in Schedule X. EPIRB (3) An EPIRB must meet the requirements set out in sections 25 to 27 of the Ship Station (Radio) Technical Regulations, 1999. Mark or label Small Vessel Regulations 3.23 (1) A personal flotation device, lifejacket, lifebuoy, self-igniting light, life raft, or a pyrotechnic distress signal referred to in these Regulations must bear a mark or label indicating that it is of a type approved by the Minister under the Small Vessel Regulations. Alternative mark or label (2) A [replacement] personal flotation device required by these Regulations meets the requirements of subsection (1) if it was of a type approved by the Director of Ship Safety of the Department of Transport or by the Department of Fisheries and Oceans and bears a mark or label indicating that it was approved by one of those departments or by the Canadian Coast Guard. Personal flotation device (3) A personal flotation device referred to in these Regulations must (a) be fitted with retro-reflective tape and a whistle; and (b) have an outer covering of a highly visible colour, except for an inflatable personal flotation device which must have an internal bladder of a highly visible colour. Substitute Safety Equipment Equivalent level of safety 3.24 (1) If the Minister determines that there are circumstances in which equipment other than the safety equipment required by these Regulations provides a level of safety at least equivalent to that provided by the required safety equipment, the other equipment may be substituted for the required safety equipment in those circumstances. Factors (2) To determine the level of safety provided by the substituted equipment in the circumstances, the Minister must assess the following factors: (a) the nature of the activity; (b) the environmental conditions; (c) the nature of the risks to which persons on board are exposed; (d) the specific characteristics of the equipment; (e) the recommended practices and standards to which the equipment conforms; 12

(f) the manner in which the equipment will be used; and (g) the ability of the equipment to protect a person from injury. Mark or label (3) The substitute equipment must bear a mark or label indicating that it conforms to the recommended practices and standards applicable to that type of equipment. Safety Equipment Accessibility and Maintenance Requirements for safety equipment 3.25 (1) The safety equipment required by these Regulations must (a) be in good working order; (b) readily accessible and available for immediate use; and (c) except for a life raft, maintained and replaced in accordance with the manufacturer s instructions or recommendations. Alterations (2) Safety equipment must not be altered in a way that may compromise its performance or the integrity or readability of a marking required by a standard related to it. Extinguishers (3) A portable fire extinguisher and a fixed fire extinguishing system required by these Regulations must be kept fully charged. Language of mark or label 3.26 A mark or label on the safety equipment required by these Regulations, and any manufacturer s instructions or recommendations, must be in English and French. First Aid Kit Contents 3.27 A fishing vessel must carry on board a first aid kit that is packed in a waterproof case capable of being tightly closed after use and that must be (a) a marine emergency first aid kit that contains the following: (i) an up-to-date first aid manual or up-to-date first aid instructions, in English and French, (ii) 48 doses of analgesic medication of a non-narcotic type, (iii) six safety pins or one roll of adhesive first aid tape, (iv) one pair of bandage scissors or safety scissors, (v) one resuscitation face shield, (vi) two pairs of examination gloves, (vii) 10 applications of antiseptic preparations, (viii) 12 applications of burn preparations, (ix) 20 adhesive plasters in assorted sizes, (x) 10 sterile compression bandages in assorted sizes, (xi) 4 m of elastic bandage, (xii) two sterile gauze compresses, 13

(xiii) two triangular bandages, (xiv) a waterproof list of the contents, in English and French; or (b) a first aid kit that meets the requirements of the Marine Occupational Safety and Health Regulations or of provincial regulations governing workers compensation, with the addition of a resuscitation face shield and two pairs of examination gloves if the kit is not required to contain them. Life Saving Appliances Personal Life Saving Appliances Lifejacket 3.28 (1) A fishing vessel must carry on board a lifejacket of an appropriate size for each person on board, except that the lifejacket must not be a Class 2 lifejacket if the voyage is beyond a near coastal voyage, Class 2. Substitute to a lifejacket near coastal voyage, Class 2? (2) Instead of the lifejacket referred to in subsection (1), a fishing vessel that is not more than 12 m in maximum length and that is engaged on a near coastal voyage, Class 2 or a sheltered waters voyage may substitute a personal flotation device that meets the requirements of section 3.23 if (a) the personal flotation device meets the following additional requirements: (i) it provides a minimum of 100 N of buoyancy and has a turning capability, or (ii) it is designed to provide thermal protection; and (b) in the case of a vessel that has no deck or deck structure that is underway, it is worn by everyone on board at all times or in the case of a vessel that has a deck or deck structure that is underway, it is worn when on deck or in the cockpit; and Substitute to a lifejacket sheltered waters voyage? (3) Instead of the lifejacket referred to in subsection (1), a fishing vessel that is not more than 12 m in maximum length and that is engaged on a sheltered waters voyage or that is within two nautical miles from shore on a lake or river may substitute a personal flotation device that meets the requirements of section 3.23 if, in the case of a fishing vessel that has no deck or deck structure that is underway, it is worn at all times or, in the case of a vessel that has a deck or deck structure that is underway, it is worn when on deck or in the cockpit. Additional personal life saving appliances 3.29 (1) A fishing vessel must carry on board the following additional personal life saving appliances: (a) a reboarding device, unless the vertical height that must be climbed in order to reboard the vessel is not more than 0.5 m; (b) a person overboard retrieval device, unless the vessel carries a recovery boat or the vessel is single-handed; (c) for the maximum length of vessel set out in column 1 of the table to this subsection, the additional personal life saving appliances set out in column 2. 14

Visual Signals Requirement to carry on board 3.30 (1) A fishing vessel of a maximum length set out in column 1 of the table to this subsection must carry on board the visual signals set out in column 2. More than 15 m (c) a signalling mirror (a) a watertight flashlight; (b) 12 pyrotechnic distress signals, not more than six of which are smoke signals, and if the voyage is beyond a near coastal voyage, class 2, at least six of the signals are rocket parachute flares and the smoke signals are buoyant smoke signals; and (c) a signalling mirror Exception (2) The pyrotechnic distress signals are not required if the fishing vessel is equipped with a two-way radio communication system that enables communication with the shore and the vessel is operated (a) in a river, canal or lake in which it cannot at any time be more than one nautical mile from shore; (b) exclusively within the confines of an aquaculture facility; or (c) within 500 m of shore. Expiry (3) The pyrotechnic distress signal expires four years after its date of manufacture. Life Rafts and Other Life Saving Appliances Requirement to carry on board 3.31 (1) A fishing vessel that is engaged on a voyage set out in column 1 of the table to this subsection, of a length set out in column 2, must carry on board the safety equipment set out in column 3. 4. Near coastal voyage, class 2 Not more than 12 m (c) if the water temperature is less than 15 C, an immersion suit or an anti-exposure work suit of appropriate size for each person on board. (a) one or more life rafts or a combination of life rafts and recovery boats with a total capacity that is sufficient to carry the total number of the persons on board; or (b) both of the following: (i) an EPIRB or a means of two-way communications, unless the vessel is already carrying an EPIRB required by the Ship Station (Radio) Regulations, 1999; and (ii) if the water temperature is less than 15 C, an immersion suit or an anti-exposure work suit of appropriate size for each person on board. 5. Sheltered waters or near coastal voyage, class 2 limited 2 miles Any length (a) one or more life rafts or recovery boats with a total capacity that is sufficient to carry the number of the persons on board; or (b) both of the following: (i) an EPIRB or a means of two-way communications, unless the vessel is already carrying an EPIRB required by the Ship Station (Radio) Regulations, 1999; and (ii) if the water temperature is less than 15 C, an immersion suit or an anti-exposure work suit of an appropriate size for each person on board. Written procedures (2) Instead of carrying the equipment referred to in paragraph (b)(ii) of item 5 of the table, a fishing vessel engaged on a sheltered waters voyage may carry equipment, written procedures or a combination of both for protecting all persons on board from the effects of hypothermia or cold shock resulting from swamping, capsizing or falling overboard. Substitute recovery boat (3) The requirement to carry on board a recovery boat may be met by carrying a seine skiff, an emergency boat or a rescue boat. Requirements for life rafts 3.32 A life raft that is carried on board a fishing vessel must be (a) marked with the date and place of last service; (b) serviced at the intervals set out in section 2 of Schedule IV to the Life Saving Equipment Regulations at a service station that is accredited by the manufacturer of the life raft; and (c) except for a coastal life raft packed in a valise-type container, stored in a manner that allows it to automatically float free if the vessel sinks. Launching appliance 3.33 A life raft or recovery boat must be equipped with a launching appliance unless it is capable of being launched safely and rapidly by manual means. 17

Vessel Safety Equipment Bailers and bilge pumps 3.34 (1) A fishing vessel that is not more than 9 m in hull length must carry on board a bailer or a manual bilge pump. Manual bilge pump (2) A fishing vessel that is more than 9 m but not more than 12 m in hull length must carry on board a manual bilge pump. Dimensions bailer (3) A bailer must be made of plastic or metal, have an opening of at least 65 cm and have a 2 capacity of at least 750 ml. Piping or hose (4) A manual bilge pump must be fitted with or accompanied by sufficient length of piping or hose to enable water to be pumped from the bilge space of the fishing vessel over the side of the vessel. Operation of bilge pump (5) A manual bilge pump must be capable of being operated from a position above the deck. Manual propelling device 3.35 A fishing vessel with no deck structure that is not more than 6 m in hull length must carry on board a set of oars, a paddle or another device that uses human power to propel the vessel. Anchoring and mooring equipment 3.36 (1) A fishing vessel must be provided with (a) equipment used for anchoring that meets the requirements of recommended practices and standards and that is arranged in such a way that the anchor can be deployed and retrieved effectively and reliably; (b) means to fix the anchor rode to the vessel and to protect it against chafing; and (c) equipment and fittings arranged in such a way that the vessel can be effectively secured alongside or moored. Anchor dragging (2) The anchoring equipment must be resistant to dragging under normal operating conditions taking into account the fishing vessel s displacement and windage area. Navigation Equipment Compasses Navigation Safety Regulations 3.37 (1) A compass that is required to be carried on board a fishing vessel under the Navigation Safety Regulations must be [capable of being] illuminated. Choice (2) A fishing vessel that is not more than 8 m in maximum length and that navigates within sight of seamarks must carry on board either a compass that meets the requirements of the Navigation Safety Regulations and that can be illuminated or a hand-held compass. Depth Detectors 3.38 A fishing vessel must be provided with means for determining the depth of water under the vessel, unless it is equipped with lead lines in accordance with the Navigation Safety Regulations. 18

Firefighting Equipment Requirement to carry on board 3.39 (1) A fishing vessel of a maximum length set out in column 1 of the table to this subsection must carry on board the firefighting equipment set out in column 2 as indicated in that column. More than 9 m but not more than 15 m (b) a 2A:10B:C fire extinguisher at each access to a space fitted with a fuelburning cooking, heating or refrigerating appliance; (c) a 10B:C portable fire extinguisher at the entrance to the engine space; (d) a fire axe; and (e) a bucket 4. More than 15 m (a) a 2A:20B:C portable fire extinguisher; (b) a 2A:20B:C portable fire extinguisher at the following locations: (i) at each access to a space fitted with a fuel-burning cooking, heating or refrigerating appliance, and (ii) at the entrance to each accommodation space; (c) a 20B:C portable fire extinguisher at the entrance to the engine space; (d) a fire axe; and (e) two buckets Exception (2) A fishing vessel that is not power-driven and is not equipped with an electrical system is not required to carry on board the portable fire extinguisher set out in paragraph (a) of items 1 to 4 of the table to subsection (1). Reduced number of extinguishers (3) The total number of portable fire extinguishers may be reduced by one if one or more or the remaining fire extinguishers are arranged so that they are readily accessible for each of the locations referred to in paragraph (b) of item 1 and paragraphs (b) and (c) of items 2 to 4. Bucket requirement 19

(4) The bucket set out in items 3 and 4 of the table to subsection (1) must have a capacity of 10 L or more and be fitted with a lanyard of sufficient length to reach the water from the location in which it is stored. Standards for portable fire extinguisher 3.40 (1) A portable fire extinguisher that is required by these Regulations to be carried on board a fishing vessel must (a) bear a mark indicating that it is certified for marine use by a product certification body; or (b) be of a type that is approved by the United States Coast Guard. Imported vessel (2) A portable fire extinguisher that is carried on board a fishing vessel imported into Canada and that does not meet the requirements of subsection (1) must be certified for marine use by a product certification body or a classification society. Classes of fires 3.41 In any reference in these Regulations to the classification of a portable fire extinguisher, the letters in the classification refer to the following classes of fires: (a) Class A fires, namely, fires in combustible materials such as wood, cloth, paper, rubber and plastic; (b) Class B fires, namely, fires in inflammable liquids, gases and greases; (c) Class C fires, namely, fires that involve energized electrical equipment where the electrical non-conductivity of the extinguishing media is of importance; and (d) Class K fires, namely, fires in cooking appliances that involve combustible cooking media such as vegetable or animal oils or fats. Exception 3.42 A fishing vessel may carry on board a portable fire extinguisher that is not marked with a classification set out in column 1 of the table to this section if the fire extinguisher contains an extinguishing agent set out in column 2, 3 or 4 of a net weight that corresponds to the classification set out in column 1, and if the fire extinguisher meets the requirements of these Regulations in all other respects. Extinguishing agent

3.44 (1) A portable fire extinguisher required by these Regulations must contain an extinguishing agent capable of extinguishing any potential fire in the compartment for which the fire extinguisher is intended and shall not weigh more than 23 kg. Alternate rating (2) A portable fire extinguisher required by these Regulations may be rated for Class K fires instead of Class B fires if it is intended for use in an area with cooking appliances that involve combustible cooking media and as long as the Class A and Class C ratings are maintained. Carbon dioxide fire extinguisher (3) A portable carbon dioxide fire extinguisher must be fitted with an electrically nonconductive horn. Exception 3.45 A portable fire extinguisher that is carried on board a fishing vessel and that meets the requirements of subsection 36(1) of the Small Fishing Vessel Inspection Regulations that applied before the day on which these Regulations came into force, may be carried on board the vessel. Mounting (1) The portable fire extinguisher set out in the table to section 3.42 must be mounted with a clamp or bracket that provides a quick and positive release. Gas extinguishing agent (2) It is prohibited for a portable fire extinguisher intended for use in an accommodation space, or stored in an accommodation space, to contain a gas extinguishing agent. DIVISION 3 STABILITY Application Application 3.46 (1) This Division applies in respect of a fishing vessel that is propelled or designed to be propelled by an engine. Wooden vessels (2) This Division does not apply to a wooden fishing vessel that was originally designed to be human powered but has been modified for propulsion by an outboard motor and (a) has no deck or deck structure; (b) is not mass produced; and (c) has been constructed following traditional methods that have been proven to be effective and reliable over time. Adequate Stability All vessels 3.47 (1) The stability of a fishing vessel must be adequate to safely carry out its intended operations. Presumption *(2) The stability of a fishing vessel is deemed to be adequate where (a) in the case of a fishing vessel of not more than 9 m in hull length, the owner of the vessel demonstrates, on request of the Minister, that the stability of the vessel is adequate to safely carry out its intended operations; 21

(b) in the case of a fishing vessel of more than 9 m in hull length, the vessel has successfully passed a stability assessment conducted by a competent a person. Demonstration of stability (3) A demonstration of stability, on request of the Minister, that the fishing vessel can safely carry out its intended operations may be accomplished, (a) in the case of a new vessel of not more than 6 m, by a verification of documents showing compliance with [Section of 4 TP 1332] in respect of its intended operations; and (b) in all other cases, by means of one or the following methods: (i) showing compliance with recommended practices and standards in respect of the vessel s intended operations (ii) showing compliance with first principles of stability; or (iii) a physical test that subjects the vessel to typical manoeuvres with a typical load in a controlled setting. Record of Modifications Keeping of records 3.48 The authorized representative must ensure that records are kept with respect to a modification or a series of modifications that affect the stability of a fishing vessel. Prohibition Required assessment vessels of more than 9 m 3.49 (1) No person shall operate or permit another person to operate a fishing vessel of more than 9 m in hull length unless the vessel has successfully passed a stability assessment conducted by a competent person. Type of assessment (2) A stability assessment may be full or simplified, except in the following circumstances in which case the fishing vessel must undergo a full stability assessment: (a) a vessel carrying fish in bulk that exhibit free surface effect, unless (i) the fish are carried in pails, boxes, or totes that individually do not exceed one third of the breadth (B) of the vessel, or (ii) the fish hold or deck is divided by two longitudinal divisions to carry fish; (b) a vessel carrying fish that exhibit free surface effect in containers such as live wells, totes or tanked fish holds none of which exceed one third of the breadth (B) of the vessel or, if the width exceeds one third of the breadth, each of which meet the following requirements: (i) they are designed to be operated at maximum capacity only, (ii) the operation of filling the tank is done before departure or in calm water only, (iii) an alarm is fitted to indicate when the tank is not full; (c) a vessel fitted with an anti-roll tank; (d) a new vessel that is 18 m and more in hull length. Existing vessels with a choice of assessment 3.50 (1) In the case of an existing vessel for which a choice may be made between a full or a simplified stability assessment, the vessel that engages on a voyage of the class set out in column 1 of the table to this subsection is not required to undergo the stability assessment until after the number of months set out in column 2 that follows the day on which this Division comes into force.
