Before starting of the Meeting, President Board Jabalpur has given out the following points i. Digitazation of Land Records ii. State Govt. Dues point should be raised in Civil Military Liasion Conference iii. Sanitary Inspector and Safaiwalas can go anywhere for Sanitation purpose and should act as eyes and ears iv. Installation of CCTV cameras on all entry points for security reasons. v. Additional land should not be given for any construction. vi. Recovery should be done by Tax Administration vii. Anti national activity should be checked in Religious structures falling in Area. viii. Security should be given top priority ix. Police be requested to monitor people regarding unlicenced weapons in. x. Proper monitoring and transparency of work and committees to monitor on regular basis. xi. Potholes be filled on priority. xii. SHO should visit hotels, restaurants etc for anti malaria and anti dengue inspection. xiii. Dustbins should be installed at various points during festival season. xiv. Medical camp should be planned and organized in other wards of area. After that Vice President and elected members of Board Jabalpur has given representation before the Board regarding complaint of Shri C K Kharate Engineer of his behavior and misconduct. Board resolved that show cause notice should be given to him seeking explanation and a report to this effect shall be put up by the CEO in next Board Meeting. 1. Extension of Engagement of Hon. Consultant and other staff Ref: CBR No.19 dated 23.03.2015, CBR No.18 dated 30.11.15 and CBR No.19 Dated 29.02.16. To consider further engagement on contractual basis for a period of 11 months of OPD Consultants, OT panel doctors, Counselors, Radiologist and Sonography Assistants and with effect from 05.10.2016 to 04.09.17 at the already approved rates as their period of engagement will expire on 03.10.2016, as per list enclosed for ready reference. The services of these staff is essential keeping in view the demands of the public and in the interest of administration to provide better medical services to the public. In addition to above, the period of engagement of following staff is also necessary to cope up with the need of hospital at the rates approved by Board/nerrik rates for 11 months w.e.f 05.10.2016 to 04.09.2017, as their date of engagement will also expire on 03.10.2016 1. Starting of Papsmear test in MN Hospital Lab To consider and approve starting of Papsmear test in the hospital lab as there are so many cases reporting to the hospital. Resolution No. 3 Considered, scrutinized and approved. 4. Encroachment and unauthorized construction on Sy.No.121(pt), B. No. 25, Ashok Marg, Jabalpur. To consider report dated 09-08-2016 of Engineering Section stating that Shri Triloki Nath Kakkar &Arun Kakkar S/o Shri Triloki Nath Kakkar B. No. 25, Ashok Marg, Jabalpur. has constructed the following Encroachment and unauthorized construction:- Encroachment and unauthorized construction on defence land by casting of 19 nos. RCC pillars on Ground Floor on Part of Sy.No. 121, B. No. 25 (pt), Ashok Marg, Jabalpur. The Ground Floor area is admeasuring (1)46 x39 +20 x32 =2434 sqft (approx). Filling work of plinth is in progress on the day of visit. The site in question comprises the Sy.No. 121(pt), B. No.25(part), Ashok Marg, Jabalpur. The site is situated outside Civil and Bazar area placed under the DEO Jabalpur Circle Jabalpur from land point of view. Report of Engineering Section is placed on the table for issue of notice and prosecution u/s 244, 247, 248 and 249 of s Act, 2006. Resolution No. 4 Considered and resolved that notice u/s 248 & 249 of the s Act, 2006, be issued to Shri Triloki Nath Kakkar &Arun Kakkar S/o Shri Triloki Nath Kakkar for stop & removal of encroachment and unauthorized Construction failing which another notice u/s 320 of the Act ibid be issued, to remove the encroachment and unauthorized Construction and on their failure to comply, the same be removed by the agency of the Board at the risk and cost of defaulter as per. Act, 2006. The Board also authorized the CEO to initiate prosecution u/s 244 & 247 of the s Act, 2006, against the defaulter. 4

Mutation of House No.263, Sy.No.143/137, Sadar Bazar, Jabalpur To consider and approve the applicant s application dated 09-06-2016 for mutation of site comprising GLR Sy.No.143/137 house bearing No.263 & A as B-3 land under the the Board Jabalpur in favour of Dr. Amolak Chand held on old grant terms. The applicant Shri Mayank Moonoth S/o Shri Kamal Chand Moonoth grandson of late Shri Amolok Chand vide their application dated 14-05-2016 and 09-06-2016 submitted the documents alongwith Will dated 02-11-2011 duly registered from Sub Registrar and death certificate of Shri Amolak Chand Jain. The applicant has also submitted the sale deed with plan duly executed and registered from Sub-Registrar from Jabalpur and on perusal of the sale deed it has been observed that subject property has already been transferred from old grant to free hold right vide Govt. of India Ministry of Defence, DG,DL&C letter No. 702/81/L/L&C/81 dated 11-10-1982 and it has also been confirmed from the DEO Jabalpur letter No.GR-66/25 dated 19-09-2016 but it has also been observed from the current GLR extract that in the remarks column the Govt. of India, Ministry of Defence sanctioned mentioned wrongly. In view of the above mutation can be carried out from the GLR in favour of the applicant including the amendment in the GLR of column No. 7,8,9, 10,11 shown private land as well as remarks column No.15 including the Govt. sanctioned as stated above. Relevant document along-with report of Engineering Section is placed on the table. Resolution No. 5 Considered and approved as the aforesaid subject property has already been transferred from old grant to free hold rights by Govt. of India vide their letter as stated in the Agenda. As such mutation may also be carried out in comprising GLR Sy.No. 143/137 in favour of the applicant according to registered Will dated 02-11-2011 submitted by their family including the amendment in the GLR of column No.7,8,9 & 10 shown as private land. 6. Supply of Seasonal Plants Tenders were called on 23-08-2016 for the supply of seasonal plants. Resolution No. 7 The Board considered the matter in detail item wise and approved the estimates accordingly except for 14, 15, 65, 66, 68, 69 which are deferred till next Board Meeting. The Board further approved to get the work executed through the concerned T.C. Contractor. In respect of essential works in Karondi area and providing patch work WBM of potholes at empire crossing to YMCA Mandla Road, Jabalpur (item No. 106), the Board deliberated on the matter. The Board is conscious of the fact that these are essential works concerned with life and security of the residents. In this regard, Board also noted that it is duty of every Board to provide civic amenities in Area as provided under section 62(viii), (x), (xii), (xiii), (xiv) and (xv) of Act 2006. The Board has also been provided discretionary function under section 64(iii) of the s Act, 2006 to reclaim unhealthy localities. The Board also noted that Board is a deemed municipality under section 10 of the s Act, 2006 which states, Board (1) For every cantonment there shall be a (2) Every Board shall be deemed to be a municipality under clause (e) of article 243 P of the Constitution for the purposes of (a) receiving grants and allocations; or (b) Implementing the Central Government schemes of social welfare, public health, hygiene, safety, water supply, sanitation, urban renewal and education. The Board also notes that the Board is the only body working as municipal body in the. The Board also notes that if any locality is not provided essential services like proper sanitation, public health, hygiene, water supply, urban renewal due to its category of land, then no other agency is there to provide the residents in such localities with these basic minimum essential requirements for a healthy living. The troops are surrounded all over by such localities and if due to non-provision of these basic minimum services if epidemic like dengue, chicken-gunia, malaria spreads, it will certainly affect the health and hygiene of the troops as well. The Board also notes that SWACHH BHARAT ABHIYAN is also being implemented by the Govt. of India, under which providing toilets / public group latrines, effective sanitation, proper disposal of liquid and solid waste are important components. The Board notes that if such basic minimum essential facilities are not provided by the Board due to classification of land, the Board will fail in its primary duty and purpose of SWACHH BHARAT ABHIYAN will not be fulfilled. The Board also notes that the Hon ble Supreme Court of India has held in Chameli Singh v/s State of UP (1996) Supreme Court Cases at page No. 549 that In any organized society right to live of a human being is not ensured by meeting only the animal need of man. It is secured only when he is assured of all facilities to develop himself and is freed from restrictions, which inhibit his growth. All human rights are designed to achieve the object. Right to life guaranteed in any civilized society implies the right to food, water, decent environment, education, medical care and shelter. As is enjoined in the directive principals, the state should be deemed to be under an obligation to secure it for it s citizens, of course subject to its economic budgeting 21

In Municipal Council Ratlam (MP) v/s Vadhchand and ors AIR 1980 SC 1622 the Hon ble Supreme Court through Justice Krishna Iyer, upheld the order of High Court and directed the Municipality to take immediate action within its statutory powers to construct sufficient number of public latrines, provide water supply and scavenging services, to construct drain, cesspools and to provide basic amenities to the public. In the case of Sudama Singh & others v/s Government of Delhi & another, the Hon ble Supreme Court has ruled that The Government will be failing in its statutory and constitutional obligation if it fails to identify spaces equipped infrastructurally with the civic amenities that can ensure a decent living to those being relocated prior to initiating the moves for evictions. Preventing any of the civic services will be the violation of Article 21 of Constitution of India which ensure the Right to Life. In view of the above, the Board considered and approved the above estimates in respect of Karondi area (except for 65, 66, 68, 69 69) and filling up of potholes from empire crossing to YMCA, Mandla Road and work be got executed from approved contractor. The CEO is accordingly authorized to incur the expenditure in this behalf. 8. Grant of Bonus to Board Employees for the 2016-2017 To consider the Govt. of India, Ministry of Finance letter No. 7/4/2014-E-IIIA dated 29-08-2016 vide which the amount of Bonus has been revised to 7000 w.e.f. 01-04-2014 i.e. for the accounting year 2014-15. The Board is requested to consider the same for Board employees. Relevant letter is placed on the table. Resolution No. 8 Considered and approved. It was resolved to send a proposal to PDDE, CC, Lucknow for the same. 9. Reimbursement of Medical bill Following employees have submitted their medical bills for reimbursement of claim.
