2 THE CORPORATION OF THE TOWN OF WHITCHURCH-STOU FFVILLE BY-LAW NO TR BEING A BY-LAW TO REGULATE TRAFFIC IN THE TOWN OF WHITCHURCH-STOUFFVILLE WHEREAS the Municipal Act, R.S.O. 1990, c. MA5, as amended, authorizes a municipality to pass by-laws for regulating traffic on highways; AND WHEREAS the Traffic Act, R.S.O. 1990, c. H.8, as amended, provides that the municipal corporation or other authority having jurisdiction over a highway may by by-law designate the date on which a reduced load period shall start or end and the highway or portion thereof under its jurisdiction to which the designation applies; AND WHEREAS the Traffic Act R.S.O. 1990, c. H.8, as amended, authorizes the Council of a City, Town or Village and the Trustees of a police village by By-law to prescribe a rate of speed for motor vehicles driven on any highway or portion of highway under its jurisdiction in any built up area; AND WHEREAS the Traffic Act R.S.O. 1990, c. H.8, as amended, provides that the Council of a municipality may by by-law provide for the erection of stop signs at intersections on highways under its jurisdiction; AND WHEREAS the Traffic Act R.S.O. 1990, c. H.8, as amended, provides that the Council of a municipality may by by-law provide for the erection of yield signs on highways under its jurisdiction; AND WHEREAS the Municipal Act, R.S.O. 1990, c. MA5, as amended, authorizes a municipality to pass by-laws for prohibiting or regulating the obstructing, encumbering, injuring or fouling of highways or bridges. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF WHITCHURCH-STOUFFVILLE ENACTS AS FOLLOWS: 1. Definitions In this By-law: (a) (b) (c) (d) (e) (f) (g) "authorized sign" means any sign, or marking on a roadway, or curb or sidewalk, or other device placed or erected on a highway under the authority of this By-law for the purpose of regulating, warning or guiding traffic; "bicycle" includes a tricycle and unicycle but does not include a motor assisted bicycle; "Director of Public Works" means a person appointed by the Council of the Town of Whitchurch-Stouffville as the Director of Public Works; "heavy vehicle" means any vehicle having a gross weight including the vehicle, object or contrivance or load exceeding 5 tonnes, but does not include a passenger vehicle, an ambulance, police vehicle, fire department vehicle or any vehicle or equipment used for maintenance or improvement of the highway or public utility; "highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles, and includes the area between the lateral property lines thereof; "intersection means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines or two or more highways that join one another at an angle, whether or not one highway crosses the other; "motor assisted bicycle" means a bicycle, (i) (ii) (iii) that is fitted with pedals that are operable at all times to propel the bicycle, that weighs not more than fifty-five kilograms, that has no hand or foot operated clutch or gearbox driven by the

3 By-law TR Page 2 motor and transferring power to the driven wheel, (iv) that has an attached motor driven by electricity or having a piston displacement of not more than fifty cubic centimetres, and (v) that does not have sufficient power to enable the bicycle to attain a speed greater than 50 kilometres per hour on level ground within a distance of 2 kilometres from a standing start; (h) (i) Ul (k) (I) (m) (n) "motorcycle" means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a motor scooter, but does not include a motor assisted bicycle; "motor vehicle" includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in the Traffic Act, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car, or other motor vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, selfpropelled implement of husbandry or road-building machine within the meaning of The Traffic Act; "motorized snow vehicle" means a motorized snow vehicle as defined in The Motorized Snow Vehicle Act; "Municipal Law Enforcement Officer" means a person appointed by By Law to enforce the Town's By-laws. "official sign" means an authorized sign approved by the Ministry of Transportation of Ontario; "Peace Officer" means a Municipal By-law Enforcement Officer or a member of the York Regional Police Force or the Ontario Provincial Police Force; "pedestrian" includes an invalid in a wheelchair and a child in a baby carriage; (0) "pedestrian crossover" means any portion of a roadway designated by bylaw of the Municipality, at an intersection or elsewhere, distinctly indicated for pedestrian crossing by signs on the highway and lines or other markings on the surface of the roadway as prescribed by the regulations. (p) (q) (r) (s) (t) (u) (v) (w) (x) "Police Officer" means a police officer who is a member of the York Regional Police Force, or Ontario Provincial Police Force; "private property" means any property that is not municipal property; "private roadway" means any private road, private driveway, lane, ramp or other means of vehicular access to or egress from a property, building or structure, and it may include part of a parking lot. "roadway" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and, where a highway includes two or more separate roadways, the term "roadway" refers to anyone roadway separately and not to all of the roadways collectively; "Schedule" means a schedule referred to in this By-law and forming part of this By-law; "school crosswalk" means a crosswalk marked by authorized signs designating it as a school crossing location; "sidewalk" means that part of a highway not being part of the roadway that has been improved by paving or other means for pedestrian traffic; "Town" shall mean the Corporation of the Town of Whitchurch-Stouffville; "traffic control signal" means any device, manually, electrically or mechanically operated for the regulation or control of traffic;

4 By-law TR Page 3 (y) (z) "U-turn" means the turning of a vehicle within a roadway, or where a highway is divided, the turning of a vehicle from one roadway to another roadway, so as to proceed in the opposite direction; "vehicle" includes a motor vehicle, trailer, traction engine, farm tractor, road-building machine and any vehicle drawn, propelled or driven, by any kind of power, including muscular power, but does not include a motorized snow vehicle or a street car. 2 Application and General Requirements: (a) (b) (c) (d) (e) This By-law applies to all highways under the jurisdiction of the Corporation of the Town of Whitchurch-Stouffville. The Schedules referred to in this By-law shall form part of this By-law and each entry in a column of such a Schedule shall be read in conjunction with the entry or entries across therefrom and not otherwise. The Director of Public Works, or his or her designate, is hereby authorized to issue permits on behalf of the Town respecting the movement of vehicles, loads, objects or structures in excess of the dimensional or weight limits pursuant to the relevant provisions of the Traffic Act. The Director of Public Works, or his or her designate, is hereby authorized to place or erect and to maintain such authorized signs and traffic control signals as are required to give effect to the provisions of the safety or convenience of the public. No person shall place, maintain or display upon or in view of any highway, any sign, signal, marking or device which purports to be or is an imitation of or resembles an authorized sign or traffic control signal, or which conceals from view or interferes with the effectiveness of an authorized sign or traffic control signal. 3. General Traffic Provisions (a) (b) The driver or operator of a vehicle emerging from a driveway, laneway or building or bus loop onto a highway before driving onto a sidewalk or footpath shall yield the right-of-way to pedestrians upon the sidewalk or footpath. Where U-turns are not prohibited under the provisions of Section 10 such a turn shall be made only where it can be made in safety and without interfering with other traffic. (c) (d) (i) (ii) (i) (ii) No person shall intersect a funeral or other properly authorized procession while it is in motion except under the direction of a Police Officer. The driver of a vehicle in a funeral or other procession shall drive as near to the right hand edge of the roadway as practicable and safe. No person shall drive a motor vehicle upon a sidewalk or footpath on a highway except for the purpose of directly crossing the sidewalk or footpath. No person shall drive a motor vehicle over a raised curb except at a place where there is a ramp or rolled curb. 4. Pedestrian's Rights and Duties (a) (b) Except where traffic control signals are in operation or where traffic is being controlled by a police officer, a pedestrian crossing a highway at a place other than a pedestrian crossover shall yield the right-of-way to all vehicles upon the roadway, but nothing in this section shall relieve the driver of a vehicle from the obligation of taking all due care to avoid an accident. No pedestrian shall proceed over or go under a barrier permanently installed on a sidewalk.

5 By-law TR Page 4 (c) (d) No person shall play or take part in any game or sport upon a roadway; no person upon roller skates, or riding in or by means of any coaster, toy vehicle or sirnilar device shall go upon a roadway except for the purpose of crossing the roadway, and when so crossing such person shall have the rights and be subject to the obligations of a pedestrian. The highways set out in of Schedule I at the locations set out in of the said Schedule are designated as pedestrian crossovers and shall be indicated as such as prescribed by the regulations made under the Traffic Act. 5. Regulations for Bicycles (a) (b) No person shall ride a bicycle upon a sidewalk on any highway. No person shall ride a bicycle on the highways set out in of Schedule II between the limits set out in of the said Schedule. 6. Prohibited Pedestrian Crossings (a) Where an authorized sign to that effect is displayed, no pedestrian shall enter on or cross the roadway of the highways set out in of Schedule III at the locations set out in of the said Schedule. 7. Restricted Width of Vehicles (a) (b) The highways set out in of Schedule IV between the limits set out in of the said Schedule are hereby designated pursuant to the relevant provisions of the Municipal Act, and no person shall drive a vehicle thereon having a greater width than that set out in Column 3 of the said Schedule. Each designation made under subsection (a) shall be effective upon the erection of authorized signs at each entrance to the highway indicating the limitation of the width of vehicles permitted on the highway. 8. One-way Traffic (a) (b) (c) The highways set out in of Schedule V between the limits set out in of the said Schedule, are, during the times or days set out in Column 3 of the said Schedule, hereby designated for one-way traffic only in the direction set out in Column 4 of the said Schedule. The highways set out in of Schedule VI having been divided into clearly marked lanes for traffic between the limits set out in of the said Schedule, each of the said lanes indicated in Column 3 of the said Schedule, is, during the times or days set out in Column 4 of the said Schedule, hereby designated for traffic moving in the particular direction set out in Column 5 of the said Schedule. Each designation made by subsections (a) and (b) above shall be effective upon the erection of official signs indicating such designation. 9. Left or Right Turn Only Lanes (a) (b) The highways set out in of Schedule VII having been divided into clearly marked lanes for traffic between the limits set out in of the said Schedule, the centre lanes thereof are hereby designated for left or right turns only. Each designation made by subsection (a) shall be effective upon the erection of official signs indicating such designation. 10. Turning Movements (a) When an authorized sign to that effect is displayed, no vehicle in any intersection or portion of highway set out in of Schedule VIII proceeding in the direction or emerging from a property set out in Column 2 of the said Schedule, shall be turned in the direction set out in Column 3 of the said Schedule, during the times or days set out in Column 4 of the said Schedule.

6 By-law TR Page 5 (b) When an authorized sign to that effect is displayed, the driver of a vehicle entering a highway set out in of Schedule IX from a highway set out in of the said Schedule shall turn the vehicle either to the right or the left and shall not proceed across the highway set out in the said into the road set out in Column 3 of the said Schedule. 11. Through s, Stop Signs and Yield Signs (a) (i) The highways set out in of Schedule X, between the limits set out in of the said Schedule, are, except as provided in subsection (ii) hereby designated as through highways for the purposes of The Traffic Act. (ii) The designation in subsection (i) of a highway or portion of highway as a through highway shall not include any intersection thereon where traffic control signals are installed or where the highway intersected is a King's or a highway vested in The Regional Municipality of York and forming part of the Regional Road System established pursuant to The Regional Municipality of York Act. (b) (c) The erection of stop signs is hereby authorized at each of the intersections set out in of Schedule XI for the control of traffic entering the intersection from the highway or portion of highway set out in of the said Schedule. The erection of yield right-of-way signs is hereby authorized at each of the intersections set out in of Schedule XII for the control of traffic entering the intersection from the highway or portion of highway set out in column 2 of the said Schedule. 12. Heavy Traffic (a) (b) Except as provided in subsection (b) when authorized signs to that effect are displayed, no person shall move, drive or operate a heavy vehicle on the highways set out in of Schedule XIII between the limits set out in of the said Schedule during the times or days set out in Column 3 of the said Schedule. Subsection (a) shall not apply to; (i) (ii) any vehicle actually engaged in making a delivery to or a collection from premises which cannot be reached except by way of a highway or portion of highway referred to in the said section or to prohibit the use of such vehicles for such purpose, provided that in making such delivery or collection the said highway or portion of highway is travelled only in so far as is unavoidable in getting to and from such premises. to a privately owned vehicle driven to or from the owners residence abutting thereon without alternate access where permitted as per Schedule XIII. 13. Reduced Load Restrictions (a) Where authorized signs have been erected and are on display no person shall move, drive or operate a vehicle in excess weight of 5 tonnes per axle on highways set out in of Schedule XIV between the limits set out in during the period from the 1 st day of March to the 30th day of April, inclusive in each and every year. 14. Speed Limits (a) When any road or portion of road set out in of Schedule XV has been marked to comply with the regulations made under The Traffic Act, the maximum rate of speed thereon shall be the prescribed maximum rate of speed set out opposite thereto in of the said Schedule. 15. Speed on Bridges (a) When authorized signs to that effect are displayed, no person shall drive,

7 By-law TR Page 6 move or operate any vehicle over any bridge set out in of Schedule XVI at a speed greater than the speed set out in of the said Schedule. 16. Signal-light Traffic Control Systems (a) Subject to the approval of the Ministry of Transportation of Ontario, the erection and operation of signal-light traffic control systems, consisting of sets of green, amber, and red, or green arrow, green, amber and red signal lights, either alone or in connection with "walk", "wait" and "don't walk" pedestrian control signs or symbols, for the control of traffic, at the locations described in Schedule XVII are hereby authorized. 17. Penalty Provisions for Traffic Infractions: (a) Every person who contravenes any provision of this By-law, is upon conviction, is guilty of an offence and is liable to a fine as provided for pursuant to the Provincial Offences Act, exclusive of costs. 18.
