1 ARMY GOLF CLUB WA INC BY-LAWS SECTION 1 MANAGEMENT Committee of Management 1.1 The Committee of Management shall exclusively exercise its responsibilities in accordance with the powers vested upon it by the Club s Rules. Affiliation 1.2 The Club shall be affiliated with Golf WA and accordingly shall comply with GolfWA s By-Laws. 1.3 GolfWA membership fees shall be met from the general revenue of the Club. 1.4 Liaison with Golf WA is to be maintained through the Committee of Management by the elected delegate. SECTION 2 ASSEMBLY Home Course 2.1 The home course is Hamersley Public Golf Course, Marmion Avenue, Karrinyup The Gleneagles Tavern facilities and environs shall be used as the Club s clubrooms and the venue for meetings and the repository for trophies and honour boards, subject to the conditions set by the tavern s management. SECTION 3 DUTIES AND RESPONSIBILITIES Duties of the Elected Officers President In addition to the duties stated in Rule 11, the President shall: 3.1 Be responsible for the overall conduct and supervision of the administrative and financial matters of the Club. 3.2 Supervise and mentor the Captain in his duties. 3.3 Check and sign minutes from all Club meetings. 3.4 Sign all official correspondence.

2 Captain 3.5 Responsible for matters concerning the conduct of play. 3.6 Chairman of Match Committee Meetings. 3.7 Maintain a record of all competition and events results. 3.8 Receive and record the competition fees and transfer all moneys received to the Treasurer. 3.9 Understudy the President Act as Chairperson in the President s absence. Vice Captain 3.11 Understudy and assist the Captain Act in the absence of the Captain Member of the Match Committee Secretary In addition to the duties stated in Rule 12, the Secretary shall: 3.14 Be responsible for the administrative aspects of the club s management Process applications for membership and renewal Be responsible for all official correspondence Be a member of the Match Committee. Assistant Secretary 3.18 Understudy the Secretary 3.19 Act as the Secretary in his absence Treasurer 3.20 The Treasurer is to carry out all duties as stated under Rule 13. Assistant Treasurer 3.21 Understudy the Treasurer Acts as the Treasurer in his absence. Handicapper 3.23 Maintain the players handicaps register.

3 3.24 Examine players cards and amend handicaps Forward return of players handicaps to Golf WA Member of the Match Committee. Assistant Handicapper 3.27 Understudy the Handicapper Act as the Handicapper in his absence Member of Match Committee. Golf WA Delegate 3.30 Represent and present the position of the Club at all Golf WA meetings 3.31 Disseminate information from Golf WA to Club members Co-ordinate Club participation in Golf WA events. Property Member 3.33 Responsible for the accounting and security of Club Trophies Maintain Trophy Register Ensure respective trophies are available for presentation at events and competitions Organise engraving and embossing of trophies and honor boards Social Member 3.37 Responsible for the planning and conduct of club social events Webmaster 3.38 Responsible for all administration and maintenance of the Club Website Provide liaison between the Committee of Management and the Website Provider Responsible for updating club records on a weekly basis. Assistant Webaster 3.41 Undertudy Webmaster Act as Webmaster in his absence.

4 Duties of the Match Committee 3.43 Responsible for fixture events on an annual basis Conduct all Club competitions and events Advise on and supervise the adherence to the Rules of Golf 3.46 Adjudicate disputes and hear appeals Is governed by the Committee of Management A quorum for Match Committee meetings shall be three. In the absence of a quorum the Chairman may co-opt another member from the Club to assist the Match Committee Selection of individuals or teams to represent the Club in outside competitions. SECTION 4 ADMINISTRATION (General) Membership and Subscriptions 4.1 Membership shall be capped at 60, with the exception of current serving members and returning Members 4.2 Members who have not paid their subscriptions as at 1 February of each year shall convert to visitor status until such time as the subscription fees are paid in full. 4.3 New members joining prior to 30 June are required to pay the full subscription. 4.4 New members joining after 1 July shall pay a pro rata subscription fee of 1 twelfth of the annual subscription per month, including the month of joining, until December of that year. 4.5 Pro rata subscription is only available to members on initial membership application and is not available to members after their first year of joining the club. 4.6 The issue or purchase of a Club shirt to members joining after 1 July shall be dependent upon stocks available. 4.7 New membership is to be applied for in writing using the form at Annexure A of the Rules. All new applications for membership are to be processed as per Annexure C of the By-laws. 4.8 Returning members renewing their memberships, are to also complete the personal particulars form at Annexure A of these By-laws. General Meetings In addition to Rules 16 to 20, general meetings are to adhere to the following: 4.9 In the event of a tied vote, the Chairman shall have the casting vote. Budget 4.10 The Committee of Management shall budget for the majority of moneys received during the playing season to be used during the same period. Provision shall be made for startup capital to be carried forward to the next season Notwithstanding By-Law 4.10, the Committee of Management may present reasons at a General Meeting to carry forward any surplus for purchases of a major nature.

5 Expenditure 4.12 The Committee of Management shall expend Club moneys for the day-to-day management of the Club, such as for the conduct of competitions, the provision of prizes, embossing and stationery, etc Expenditure of a nature outside the parameters of the day-to-day management of the Club shall be presented for approval at a General Meeting or a Special General Meeting called for that purpose The President shall be authorized to expend an amount not exceeding the amount approved at the Annual General Meeting on Club social activities such as the 19th Hole subject to the availability of funds. Social 4.15 Social events shall be held as determined by the Committee of Management A variety of social events may be considered including a presentation night and end of season function. SECTION 5 ADMINISTRATION (Playing Activities) Playing Season 5.1 The playing season shall commence on 1 February and cease on 30 November of each year. 5.2 The Match Committee shall compile and issue a yearly fixture schedule, ensuring a variety of competitions and events. 5.3 A minimum of two competitions/ events shall be held at the home course each month. 5.4 A summer competition shall be conducted during the period 1 December to 31 January of each year, alternating weekly between the home course and other courses selected by the Match Committee. Handicaps 5.5 There shall be three grade handicaps for club competitions as follows: a. A Grade0 16, b. B Grade17 21, and c. C Grade All members are to have a Golflink handicap. The Club Handicapper shall apply the provisions of the Australian Golf Handicap System as advised by Golf WA. Competitions 5.7 The premier Club competition shall be the Club Championships, conducted once in each playing season to determine the Club Champion and respective Grade Champions. 5.8 The Match Committee shall issue to each playing member a copy of the Club s Competition and Event Rules for competitions and events subject to specific rules. Local Rules of Golf 5.9 The Club Captain shall advise players prior to the event or competition of any local Rule of Golf that applies at the time. Sponsorship 5.10 Sponsorship from organizations and individuals shall be arranged through the Committee of Management.

6 5.11 Sponsorship shall not be limited to the donation of trophies or prizes and may take the form of monetary donations, social functions, provision of uniforms and equipment Whilst sponsorship is greatly appreciated, sponsors are to be advised that the type of game to be played utilizing that sponsorship is entirely up to the Match Committee. However, any request will be considered on its merits. Prizes 5.13 All Club competitions and events shall attract a prize for the winner, runner up and third place getter, winners of Club trophies shall also be eligible for the award of prizes The Match Committee shall determine the value and nature of respective Club prizes in accordance with the availability of funds as advised by the Committee of Management Sponsorship trophies and prizes for winners, runners up and third place shall not attract the award of supplementary prizes from the Club, unless the sponsorship is inadequate or limited to the award of the trophy to the winner, necessitating the Club to take up the shortfall Where a member is unable to attend the presentation of prizes, they are to offer their apologies to the Match Committee Notwithstanding By-Law 5.15, the Match Committee may determine the final distribution of prizes Members who are not financial at the commencement of the playing season, i.e. 1 February are ineligible to win any trophy or prize until such time as their membership subscriptions are paid in full. Any such payment must be made prior to the commencement of the competition Novelty events within competitions shall attract ball prizes funded from the day s competition fees and may be augmented by sponsor s prizes. Players equaling or bettering their handicap shall also receive ball prizes When a financial member achieves an Eagle, the member shall be awarded six balls up to and including the first six weeks after the last Eagles Nest has been won. Thereafter the Eagles Nest builds by one ball per week to a maximum of 12 balls. In the event there is more than one winner, the Eagles Nest shall be shared equally When a financial member achieves an Albatross the prize shall be 24 golf balls When a financial member achieves a Hole-in-One, the prize shall be 24 golf balls with the playing ball suitably mounted as a trophy paid for by the Club The Eagles, Albatross and Hole-in-One competition apply to both the playing season and the summer competition The Eagle, Albatross and Hole-in-One competition shall not apply when temporary greens or tees are in play. Visitors 5.25 Visitors shall not be eligible to win a Club competition trophy or prize or any of the place getter prizes conducted on the day Visitors with a valid handicap who pay the competition fee for the day shall be eligible to win novelty events including achieving playing to or better than their handicap.

7 5.27 Visitors without a valid handicap, who pay the competition fee, shall only be eligible to win Nearest Pin, Straightest Drives and Longest Drive prizes. Club Shirts 5.28 All financial members will receive a club shirt at the start of the playing season. As per Para 4.6, where a new member joins the club after 30 June, a club shirt may only be issued at the discretion of the Committee of Management Members should only wear the current club shirt at Club competitions and when representing the Club at Golf WA events In the event of a shortage of shirts, members may continue to wear the previous Club shirt until such time that they receive a new one. Dress Standards 5.31 The minimum dress standards shall be in accordance with standards of the course being played, however as a general guide: 5.32 Men Shirt with collar, trousers, slacks or shorts and appropriate footwear Women Shirt/blouse with collar, slacks, skirt or shorts and appropriate footwear. Note: Many golf courses will only allow players to play with soft spike shoes. SECTION 6 SAFETY (Work safe Legislation) 6.1 All members should be aware of their obligations under the provisions of the Work Safe (WA) legislation and to the safety of fellow golfers. 6.2 The practice of hitting up to the playing group or ground staff in front and other practices such as throwing golf clubs are considered unsafe and shall be a breach of the Clubs By-Laws. SECTION 7 COMPLAINTS, ADJUDICATION AND APPEALS Code of Conduct 7.1 All members of the Club are to adhere to the Club Code of Conduct attached at Annexure B. 7.2 A breach of the Code of Conduct may result in disciplinary action and/or suspension from the club. Disputes Match Disputes 7.3 Match disputes are to be brought to the Match Committee prior to submission of score cards. 7.4 The Match Committee s decision is final and no correspondence will be entered into. Minor Complaints 7.5 Minor complaints involving slow play or another member s behaviour may be brought to the Captain s attention at the end of the day s play. 7.6 The Club Captain, at his discretion and without prejudice, may forward the complaint to the Committee of Management, if he believes the behaviour is ongoing

8 Formal Complaints 7.7 A member who has reason to believe that another member has committed a breach of a rule under the Club s Rules or the By-Laws, may lodge a complaint in writing to the Committee of Management, detailing the date/time, the name of the member alleged to have committed the breach and the nature of the breach itself. 7.8 A complaint between two or more members, of a personal nature, will not be accepted under By-Law 7.7, unless mediation has first been attempted. 7.9 The Club President is to acknowledge receipt of the complaint in writing within seven days of its receipt The President is to inform the member of the allegation and allow him or her a reasonable time to respond to the allegations 7.11 The Committee of Management may interview other members of the Club to gather further information regarding the allegations Where the Committee of Management believes that the allegations are founded they may: a. Issue a formal caution to the member, a. Suspend the member from play with the Club for a specified period, b. Rescind Club membership for a specified period The parties in dispute may appeal the decision of the Committee of Management and have the dispute resolved at a Special General Meeting for that purpose and the decision of the Special General Meeting shall be final In dealing with an appeal under 7.13, the General Meeting may: a. uphold the appeal and quash any direction or penalty issued by the COM, b. uphold the appeal and reduce any direction or penalty issued by the COM, c.quash the appeal and uphold any direction or penalty issued by the COM, or d. quash the appeal and impose a more severe direction or penalty than issued by the COM AUTHORISATION These By-Laws of the Army Golf Club WA Inc were accepted and authorized by the Committee of Management, on 24 June SECRETARY Date... 11 ARMY GOLF CLUB WA INC BY-LAWS ANNEXURE B ARMY GOLF CLUB WA INC CODE OF CONDUCT Players will play the game in accordance with the Rules of Golf as set by the Royal and Ancient Golf Club St Andrews and the USGA. Always play within the spirit of the game. Players should never argue with the officials of the club. Any grievances should be directed to the Executive Committee, Match Committee or the President in writing. Be a good sport and acknowledge the good play of your fellow competitors. Control your temper and do not yell out abuse or throw clubs as this brings the club into disrepute. This includes loud swearing. Failing to complete a round effects everyone in your group. Do not walk off during the round, unless it is an emergency. Treat all players as you would like to be treated. Avoid making noise or talking whilst other players are playing a stroke, especially when congregating around the first tee. Wait until the group ahead is out of range before hitting up. If in doubt, wait. If you hit a ball towards other players call out FORE in order to warn them. Take responsibility for your own actions. Treat all course staff and other players with respect and do nothing that would bring the club into disrepute. Avoid the use of mobile phones. If you must have your phone turned on, have it set to vibrate alert. Use discreetly without interfering with other players or causing undue delay. If you are too busy that you can t play without using your phone constantly you probably should be somewhere other than the golf course. Do not use social media or group , to; insult, defame or otherwise abuse other members of the club. Any member found in breach of this Code of Conduct may be dealt with in accordance with By- Law 7.12.

14 ARMY GOLF CLUB WA INC BY-LAWS ANNEXURE D Army Golf Club Count Back System 1. This count back system shall apply to all competitions unless advised in the rules for a particular event. 2. For 18 hole events the best score for the last nine holes shall be used and if a tie still exists, the last six, if still tied the last three holes, if still tied then hole by hole back from the eighteenth. 3. In 54 hole events such as the Club Championships, the last 18 holes shall be used, using the method outlined in 2.) above. 4. In all cases of a count back, handicaps and fractions thereof shall be applied where applicable ie. stroke rounds. Note. In all cases, the last holes are as per the score card and not necessarily the order they were played in. For example if a player/s involved in the countback started on the back nine and the other player/s started on the front nine the last holes are as numbered on the score card and that shall be considered as rub of the green.

15 In Stableford and Par competitions handicaps have already been applied as per the examples below, in stroke, the players handicaps are halved and may include fractions of a shot ie as per the below example. Example 1: Player 1 has 39 points with two points on the last &23 points on the back nine. Player 2 has 39 points with three points on the last & 17 points on the back nine. Player 1 wins because they had the higher stableford score on the back nine. Handicaps have already been applied using the stableford scoring system. Example 2: Player 1 with a handicap of 25, had a net 70 with a gross score of 45 on the back nine. Player 2 with a handicap of 30, had a net 70 with a gross score of 47 on the back nine. Player 1 net score on the back nine is 32.5 ( = 32.5) Player 2 net score on the back nine is 32 (47 15 = 32) Player 2 therefore wins the count back. Example 3: Player 1 finishes a Par round with a score of +6 with +4 on the back nine. Player 2 finishes a Par round with a score of +6 with +3 on the back nine. With the handicaps already applied Player 1having had the better back nine wins.

16 ARMY GOLF CLUB WA INC BY-LAWS ANNEXURE E CONSEQUENCES OF SUSPENSION OR EXPULSION 1. A member awarded a period of suspension from the club, as per Rule 9, is ineligible to participate in any club event or meeting, even as a visitor, for the duration of the suspension. 2. A suspended member is not eligible to vote, either by proxy or in person, at any club meeting. 3. Once a period of suspension has been served, the member s status will revert back to their former status, prior to the suspension being imposed. 4. A member that is expelled from the club under Rule 9, will have their membership revoked and will lose all rights as a member. As a consequence, they are: a. ineligible to participate in any club event or meeting, even as a visitor; and b. not eligible to seek reimbursement of membership fees. 5. An expelled member may not reapply for membership within 12 months from the date of their expulsion.
