1 Pennsylvania Pennsylvania currently offers casinos, pari-mutuel horse race betting, racinos, charitable gaming, and a state lottery. In July 2004, Governor Ed Rendell signed a bill legalizing slot machines at 4 racetracks and slot parlors throughout the state. The bill was passed in order to bolster the racing industry and help the state raise additional money to cut property taxes and fund economic development. In November 2006, Mohegan Sun at Pocono Downs was the first casino to open in Pennsylvania. On 8 January 200, Governor Rendell signed a bill into law which allowed for live table games in Pennsylvania racinos. Properties began offering table games in July 200. In 202, Pennsylvania decided to privatize their state-run lottery. Camelot Global Services, which also runs the British lottery, looked poised to take the reins with an offer of $34 billion over the course of 0 years. However, in late 203, Governor Tom Corbett dropped the privatization plan due to strong opposition from the voters. The law also established the Pennsylvania Gaming Control Board (PGCB) to oversee all aspects of the state s casino industry. In 200, Pennsylvania expanded into table games. Pennsylvania taxes slot revenue at 54%. Table games are taxed at the lower rate of 4%. In 2006, the state moved to limit the impact of casino money on politics. In November 2006, it approved a measure that prohibited politicians and their families from having any financial interest in casinos and prohibited state gaming regulators from taking any role in political campaigns. The measure also prohibited political contributions from gambling companies and from some individuals in the gaming industry. In 2007, Peter DePaul sued to overturn the measure, contending it violated his freedom of expression to support any political campaign he wanted. DePaul was one of the investors behind the Foxwoods Casino project in Philadelphia. In April 2009, the state Supreme Court handed DePaul a temporary victory. It ruled that the measure was unconstitutional based on inconsistencies in state law. The state legislature corrected the inconsistencies and the ban on political contributions is still in place.. In November 2006, Mohegan Sun at Pocono Downs became the first casino to open in Pennsylvania. For the most part, the casino development process in Pennsylvania has been smooth and drama free. The exception to that rule has been the Philadelphia licenses. Philadelphia Entertainment & Development Partners was awarded a Category 2 license in 2006, and originally planned to open a Foxwoods-branded casino in Philadelphia. That casino was never built, however. On 6 December 200, the PGCB voted 6- to revoke the Foxwoods Casino project s $50 million license. This action followed numerous problems with the project including difficulty settling on a location, opposition from local organizations, and financing problems. 2 Pennsylvania United States SugarHouse was awarded its gaming license in December Like the Foxwoods Casino proposal, the SugarHouse Casino faced significant community and political opposition, as well as litigation. Despite the political and civic delays, SugarHouse Casino opened in September 200. A second Philadelphia license has yet to be issued. As of this writing, the Board is in the process of considering applicants for the license. The Board has not indicated when it will reach its final decision. In September 2008, a statewide smoking ban in all public indoor facilities went into effect. An exception was made for some bars, private clubs, and casinos. In December 2008, it was reported that slots in smoking sections of Pennsylvania casinos performed better by 60-20%. Under state law, half of Pennsylvania's slot machine casinos are prohibited from serving free alcoholic drinks. Casinos free of this restriction may offer one free drink a day. On 7 January 200, Senate Bill 7 was signed into law, which authorized the first table games in the state. Racetracks and standalone casinos were allowed 250 gaming tables for a fee of $6.5 million. Resorts (Category 3 licensees) were allowed 50 gaming tables for a licensing fee of $7.5 million. A 6% tax was imposed in the first year, and dropped to 4% in subsequent years. Each table game operator was required to pay 2% of their gross table game revenue to their local community. Properties began offering table games in July 200. In November 203, Gov. Tom Corbett signed into law legislation that allows bars, restaurants, and taverns to offer daily drawings, raffles, and pull tab games. Mohegan Sun at Pocono Downs, owned by the Mohegan Tribe, operates under a commercial license subject to the same rules and regulations as similar racinos in the state. The following year, in March 972, the lottery debuted with weekly drawings of 50-cent tickets and a grand prize of $ million. The Pennsylvania Lottery remains the only state lottery that exclusively designates its proceeds to benefit older citizens. Proceeds originally helped the elderly with property tax relief. Since then, however, the scope has expanded to funding a host of services for seniors, including rent rebates, free and reduced-fare transit, low-cost prescription drug programs, longterm living services, and statewide senior centers. In its more than 40 years in operation, the lottery has contributed more than $24.7 billion to elderly programs. Initially, the Pennsylvania Lottery was mandated to contribute 30 cents of each dollar earned to businesses across Pennsylvania and 40 cents to players in the form of prize money. In 2008, the legislature passed Act 53, which granted the Pennsylvania Lottery temporary relief from the 30% minimum return. The Lottery was given the latitude to return a minimum of 27% with the understanding that it help the Lottery grow sales and net revenues. The lower return rate went into effect almost immediately and the lottery expects that relief from the 30% minimum will be extended indefinitely. In 202, Pennsylvania decided to privatize their lottery and requested bids from organizations globally. In early 203 Camelot Global Services was selected to manage the Pennsylvania lottery. The UK company was the sole bidder in 202. The bid deadline was extended more than a week to allow lottery employees to present a competing bid, which was not accepted. Camelot would have paid $34 billion over 20 years to the Pennsylvania state government to operate the lottery. But in late 203, Gov. Tom Corbett dropped the plan under intense political pressure and strong opposition from the voters. The Pennsylvania State Horse and State Harness Racing Commissions (PA Racing) regulate the horse racing industry with a common mission. They are both part of the Pennsylvania Department of Agriculture. There are six horse racing tracks in operation within the state: Harrah s Philadelphia, Penn National, The Meadows, Parx Racing, Pocono Downs, and Presque Isle Downs. Pennsylvania s horse racing industry experienced a resurgence after the 2004 Race Horse Development and Gaming Act turned the tracks into racinos. The Act established the Pennsylvania Race Horse Development Fund (PRHDF) to help the viability and quality of horse racing in Pennsylvania. Under the 2004 casino law, the PRHDF receives 2% of slots revenue from racetrack casinos and 6% from non-track casinos in Pennsylvania. Through 2009, the PRHDF distributed money to racetrack owners hosting live horse racing (to augment live horse racing purses), Thoroughbred breeding, Standardbred breeding, the Sires Stakes Program, and health insurance and pension benefits for horsemen. In 200, it also began directing money to the state s General Fund to make up budgetary shortfalls. Starting in 202, PRHDF began distributing funds directed to the Farm Products Show Fund as well. In 203, more money was taken from the fund for agricultural programs. In 204, another $4.2 million from the PRHDF was redirected to the State Racing Fund. In January 2008, Governor Edward G. Rendell consolidated the administration offices for Thoroughbred and Standardbred racing. The reorganization allowed for a single point of contact for the Pennsylvania Gaming Control Board with respect to licensing and enforcement. PA Racing remained as two separate commissions under Agriculture. 5 Online Gaming Pennsylvania is widely seen as a state likely to license and regulate online gaming in the near future. Since first bringing casino gaming to the state last decade, Pennsylvania has consistently expanded the amount of gaming in the state. The state started with slot machines, then added table games, and then authorized its bars and taverns to offer limited forms of gaming. Each step was deemed necessary, either to protect the nascent industry or to expand revenue coming into the state. State lawmakers have shown a similar pragmatic approach to online gaming. In April 203, House Bill 235 was introduced by Rep. Tina Davis to legalize online gambling in Pennsylvania. The legislation called for the Pennsylvania Gaming Control Board to regulate the licensing, operation, and responsible participation of Internet gambling. The bill also called for the proceeds from the licensing and operation of Internet gaming in the state of Pennsylvania to be split between the Property Tax Relief Fund and the State Lottery Fund. Applicants for Internet gambling licenses in Pennsylvania would be limited to entities that hold an existing slot-machine license in the state. Included in the measure were online poker, other non-house-banked games, and traditional casino table games. The bill, however, didn t go anywhere. In June 203, Rep. Tina Pickett, the chair of the Gaming Oversight Committee, voiced concern about bringing online gambling to the state of Pennsylvania. Pickett said she was worried both by how online gaming could impact brick-and-mortar casinos and the possibility of bringing more gambling to the state. The legislation wasn t taken up. But the Senate did request a study on Internet gaming. The findings of the study were made public in spring of 204. Among the findings: People who gamble online are typically people who don t visit casinos and they wager much smaller amounts than people who visit casinos. These findings are critical because the chief objection to online gaming has been that it might cannibalize the land-based casino industry. In June 204, Sen. Edwin Erickson introduced legislation to license and regulate online gaming in the state. The bill would license all forms of online gaming, but no substantive action had been taken on the bill as of press time. Also in the summer of 204 Parx Casino launched a play for fun site using WMS software and announced a separate deal with GameAccount to run a simulated gaming website. The impact of the GameAccount deal on the WMS site was unclear as of press time. Charitable Gaming Pennsylvania allows eligible charitable organizations to conduct bingo. Also, under the Local Option Small Games of Chance, charities are allowed to offer punchboards, daily drawings, raffles, and pull-tabs. Slot machines, table games and video poker are excluded from charitable gaming activities. In May 2008, the House passed a bill (HB 2204) that would allow charities to increase the maximum payouts from $4,000 to $0,000 and to increase the number of games per week from two to four. The bill went to the Senate Finance Committee for review, where it was subsequently tabled. In April 2009, the state House and Senate introduced legislation to raise the individual daily payout to $,000, the weekly payout limit to $20,000, and the bingo daily payout to $8,000. The legislation did not pass.
