1 ON-COURSE PHYSICAL THERAPY SERVICES SERVICE LEVEL AGREEMENT 1. Purpose and Objectives This document provides a service level agreement for The Injured Jockeys Fund (IJF) on behalf of The Jockeys Injury Management (JIM) Team and the Racecourse Association (RCA), on behalf of its member racecourses. The document sets out the standards required for the On-Course Physical Therapy Service (Service) for jockeys at all fixtures where a member of the JIM team is scheduled to attend. The Jockeys Injury Management (JIM) Team is defined as those physical therapists who are part of the team managed by the IJF and who fulfil the criteria outlined below. Timescales, Review Points and Management Communication The Injured Jockeys Fund (IJF) assumed management responsibility for the Jockeys Injury Management (JIM) Team in 2015, and this SLA supports the contractual relationships between the JIM Team and racecourses from that time. This SLA will be reviewed as required, and at least once every year, with input from both the IJF and Racecourse Association (RCA) and consultation with the, Professional Jockeys Association (PJA) and British Horseracing Authority (BHA). The review process will be managed by the RCA/IJF. There will also be regular on-going communication across all above mentioned organisations. 4. Contact Information The British Horseracing Authority is the British Horseracing Authority Chief Medical Adviser. 3 The Racecourse Association (RCA) is RCA Ltd, the Racecourse Services Director or Racecourse Services Manager. Contact Number Contractual Arrangements Physical Therapists will be contracted by racecourses, and an example letter of agreement is attached at Appendix A for information. A signed copy of the letter should be copied to the RCA for information. Any racecourses which use an alternative letter of agreement are asked to inform the RCA, to ensure the terms can be considered in implementing this agreement. 6. Jockeys Injury Management (JIM) Team Management The Injured Jockeys Fund (IJF) will have responsibility for the management of the Jockeys Injury Management (JIM) team, including continued professional development and appraisal. The IJF aims to: Lead and support all members of the JIM Team in developing and promoting high quality innovative care to jockeys on the racecourse; Coordinate care and good communication within the JIM Team; Raise the profile of the JIM Team in order to ensure the sustainability of the On Course Physical Therapy Service; Develop the Team in order to ensure all therapists achieve the ACPSM Bronze standard where possible; and Ensure that all members of the Team, as a minimum, comply and abide with the On-Course Physical Therapy Services SLA. The IJF s responsibilities include, but are not limited to: General Ensure all members of the JIM Team, as a minimum, comply with the requirements of their contracts with racecourses, this SLA (including all Appendices), and British Horseracing Authority General Instruction 11. In the event of non-compliance of a member of the JIM Team with any or all of their contract with racecourses, this SLA (including all Appendices), and British Horseracing Authority General Instruction 11 relevant details will be obtained by the IJF, and if appropriate they will issue a written warning to the Page 3 of 21

4 Therapist. In the eventuality of a further breach, review the position of the Therapist as a member of the JIM team, in liaison with the Racecourses with which the Therapist is contracted. Provide the JIM Team with a branded bag and name tag. Providing therapists with a poster highlighting which member of the JIM Team is working on a particular day and where they can be found Provide an up to date Disclosure and Barring Service Certificate if required. Reimburse each therapist for taping up to the value of 100 per annum. Represent the JIM Team in relevant Industry discussions including the annual review of this SLA. Obtain commitment from the JIM Team to respect and uphold the rights, dignity and individual sensibilities of all patients; maintain the highest personal and professional standards; and not to cause offence to the public, jockeys or other members of the racecourse medical team. Record Keeping Provide a tablet computer and suitable support in order to allow Therapists to access and use the Jockeys Computerised Record System (TM2) Maintain and update the Jockeys Computerised Record System as required. Maintain accurate computerised sessions via TM2 Ensure adequate training for JIM Team Members in the use of TM2 and issues relating to confidentiality Obtain commitment from the JIM Team Members to maintain confidential computerised records using TM2, including the recording of appointments and consultation in the correct format to enable a full audit. Collate statistics using the TM2 system to record usage numbers and plan for future cover Provide a suitable alternative to be used in the event of an IT failure Continued Professional Development and Appraisal Provide JIM Team members with feedback regarding individual performance and behaviour. Provide 2 free CPD sessions a year. Provide an independent biannual appraisal to each JIM Team member. JIM Team Members will be expected to meet the biannual appraisal requirements. 7. Professional Jockeys Association Responsibilities The Professional Jockeys Association will have responsibility for: Page 4 of 21

5 Scheduling a JIM Team member for all qualifying fixtures for 2016, as detailed in Section 8 of this document Allocating each JIM Team member with a metal badge and PASS Card to enable access to racecourses Seeking views and collating feedback from service users to inform the appraisal process and service development. Providing the Injured Jockeys Fund (IJF) with anonymous feedback from the biannual questionnaire regarding individual performance and behaviour. 8. Scheduling Racecourses can arrange cover via the Jockeys Injury Management (JIM) Team or by recruiting their own Physical Therapist (altogether-therapist(s)). A JIM Team member will be allocated for qualifying fixtures, as detailed in Annex B, no less than 3 months in advance of each fixture. In the event of a diary an alternative member of the JIM Team will be allocated. JIM Team members should inform the PJA as soon as possible, and ideally with at least 3 months notice, if they are unable to attend a fixture. Where Racecourses choose to recruit their own Therapist it is recommended they consult the Injured Jockeys Fund, who can assist in the recruitment process Any new Therapists who satisfy the criteria or have equivalent graduate qualifications may wish to work on racecourses and in this regard they will be required to apply to The British Horseracing Authority for sanction by the BHA Medical Advisory Committee, as per BHAGI 11 through the Injured Jockeys Fund, with supporting evidence that they are required to work at least one racecourse. Each application will be considered on its own merits by the Committee. 9. Qualification The following professional standards must be met by all Therapists: Be a qualified Chartered Physiotherapist, currently registered with the CSP Have at least 5 years post-qualification experience in clinical practice Have suitable post-graduate experience of working with sports people (elite or professional preferred) Page 5 of 21

6 Have minimum Professional Indemnity Insurance of 5 million and 1 million Public Liability Insurance ensuring the cover in place covers professional sports men and women Have a current Disclosure & Barring Service Certificate available for review Have completed first aid training through an organisation approved by the Health & Safety Executive (HSE) under the Health and Safety (First-Aid) Regulations This training is to be certificated and in date as per the HSE Regulations for First Aid at Work Be a current member of the HCPC, CSP or an equivalent recognised professional body Be nominated by a racecourse Be registered with the BHA Medical Department and cleared by the BHA Integrity Services Department Proof of continued professional development of education (CPD, CME) must be provided as part of the biannual appraisal process and if requested to do so by the Injured Jockeys Fund or The BHA Medical Department 10. Registration All Therapists must register on an annual basis with the British Horseracing Authority Medical Department. This can be done online via The following information must be provided: Full Registration Professional Body Basic Life Support and Automated External Defibrillation training in last 12 months (with evidence) Indemnity cover for work at Racecourse (with evidence) Disclosure and Barring Service Check (with evidence) Failure to provide the required information outlined above will result in removal from the BHA Register, and will mean the Therapist will not be able to provide services on a racecourse until registration has been completed. The following optional information may also be provided: Current Appraisal (with evidence) Trauma Course in last 3 years (with evidence) Page 6 of 21

7 Moulage practice on course in last 12 months (with evidence) 11. Confidentiality and Record Keeping All Therapists are expected to keep up to date treatment records in line with professional standards and to record all appointments and consultations on TM2 in the correct format to enable full audit. Therapists are expected to share confidential computerised records, via the TM2 computer system, subject to the jockey s authorisation. These will be collated and used by the IJF in order to record usage numbers and plan for future cover. If, for any reason, access to TM2 or a computerised alternative is unavailable, Therapists should maintain complete and accurate paper records. Therapists must treat jockeys information and treatment records as confidential and use them only for the purpose for which the information has been provided. Only with the written permission of the patient can Therapists release any personal or confidential information to anyone who is not authorised to receive it. Therapists must respect and uphold the rights, dignity and individual sensibilities of all patients. Therapists must also adhere to the conditions of any relevant data protection laws and always follow best practice for handling confidential information. Best practice is likely to change over time and they are required to keep up to date. 12. Conduct on the Racecourse Therapists are expected to: Attend fixtures allocated to them by the PJA where reasonable, practical and possible, and give the PJA a minimum of three months notice where possible, when unable to attend a fixture. Inform the racecourse of any non-attendance at the earliest opportunity. JIM team members can inform the PJA who will either arrange alternate cover or inform the racecourse of any non-attendance on their behalf. Any racecourses using a non-jim team member can call the PJA to arrange alternative cover if required. Page 7 of 21

8 Arrive at the racecourse a minimum of 90 minutes before the first race and sign in with the Clerk of the Scales. They should not leave until after jockeys have weighed in following the last race. Adhere to the Rules of Racing in respect of the Weighing and Changing Rooms and the participants within it as appropriate. These include no betting and no alcohol to be consumed while working. In respect of mobile phones Therapists should observe the general rules relating to their use in the weighing room and changing room areas. If a call needs to be made for exceptional reasons the Therapist must notify the Clerk of the Scales, be familiar with the definition and Codes of Conduct relating to Inside Information (available via the BHA Website and Schedule (A)5 of the Rules of Racing) and observe the general guidelines relating to it, liaise with other members of the Racecourse Medical Team, communicate and cooperate with them and relevant others. Wear suitable professional clothing (i.e. a collared shirt of either white, blue or red, smart trousers or knee length shorts and suitable shoes) and name tag that identifies their profession at all times when on the racecourse (e.g. James Griffin, Chartered Physiotherapist) 1 Behave in a professional manner and be respectful of professional colleagues. Work within the facilities provided by each individual racecourse Display posters provided in a prominent position in the changing room or tea room Not dispense any medication Not bring needles onto the racecourse with the exception of those used specifically for the purpose of acupuncture. Provide all disposable materials. 1 The IJF will arrange to have two items of clothing embroidered for each JIM Team physio if requested and the clothing sent to the IJF. It was agreed that skirts are not suitable attire for JIM team members while working. According to the CSP standards physiotherapists should not treat patients while wearing jewellery. Any therapist feeling uncomfortable walking into the weighing room in the agreed attire should enter the racecourse wearing whatever they feel appropriate and then change in the weighing room. 9 Provide their own specialist equipment (ultrasound etc.), calibrated and maintained as required by statute with appropriate documentation being available for inspection on request. Liaise with other members of the Racecourse Medical team, communicate and cooperate with them and other carers. Facilitate the referral of jockeys on to relevant consultants as appropriate with the consent of their GP Help educate jockeys in the prevention and management of injuries and all relevant aspects of their health and fitness. Report to the SRMO (or RMO in absence of the SRMO) if they become aware of any circumstance which may put Jockeys or others at risk. Ensure that advertising in respect of their professional activities is accurate and professionally restrained. Not sell, supply, endorse or promote the sale of services or goods in ways which exploit the professional relationship with their patient. Not accept any gifts or tips from jockeys. Adhere at all times to the highest personal and professional standards which reflect credit on their profession and the IJF. Their own behaviour, approach and dress should not cause offence to the public, jockeys and other members of the medical services. All aspects relating to Therapists behavior will be appraised biannually with feedback from jockeys regarding individual Therapists in the form of a questionnaire. 13. Racecourse Facilities The minimum requirements for the Jockeys Treatment Room (JTR) are detailed in British Horseracing Authority General Instruction 11, Annex 2, Part D. This states: Suitably furnished accommodation situated near to the jockeys changing room is to be provided for a separate JTR for physiotherapy treatment, which contain the following: Page 9 of 21

10 a) Adequate heating, lighting, power and hot water supply b) A height adjustable treatment couch with a breathing hole. c) Sufficient floor space allowing free movement around the whole of the treatment couch d) Connectivity to the HRS-RACO Wi-Fi network e) In locations where there are no means of direct communication with other medical staff, access to the RMO radio channel is required f) A TV monitor screening live coverage of the racing allowing the therapist to observe and prepare for any acute injuries g) Clinical waste bin h) Chair and desk/table It has been identified that some racecourses may need to apply for dispensation from some or all of these requirements, due to their individual physical and logistical arrangements. Where racecourses are unable to meet the requirements above, the following table provides an outline of the essential, important, ideal and ultimate facilities that they should consider for Therapists to work within. 11 14. Funding and Payments Therapists will invoice racecourses directly for their services, with a payment term of 28 days. A grant of up to will be made to racecourses for each qualifying fixture where a therapist is employed. Details of qualifying fixtures are attached at Appendix B. This grant will be paid through the racecourse s raceday account on a monthly basis, at month end. This grant includes the Therapist s fee, travel, equipment and all other expenses. This grant is dependent upon the racecourse contributing a sum of up to per qualifying fixture. If the cost of the Therapist s services exceeds the combined total of the grant and the racecourse s contribution, the racecourse will be responsible for settling any balance. If the cost of the Therapist is less than then the racecourse will inform the British Horseracing Authority and the grant will be amended accordingly to be proportional to the total cost of the service. The JIM Team members will operate on a minimum fee of per fixture. If a fixture is abandoned the following will apply in relation to the grants for any qualifying fixtures. Where a grant is being made this is on the basis that the racecourse will be incurring costs in relation to the therapist. On the day of racing the full fee will be charged by Therapist to the racecourse. Abandonment before the race day no fee will be charged by Therapist to the racecourse, and as such no grant or racecourse contribution will apply. This policy is supported by the PJA, RCA, IJF and the BHA. In order to determine that all parties have contributed in the proposed manner and also to determine levels of contributions required for the next year the British Horseracing Authority may request statements from racecourses setting out the Page 11 of 21

12 actual costs incurred by them for the provision of Therapists. These should be supported by invoices on request. 15. Notice Period Termination of this agreement requires a minimum of six months notice by either party. Should a therapist wish to terminate their agreement with a racecourse, this will be in line with the Term and Termination provisions outlined in the relevant section of their letter of agreement. Should a Therapist wish to terminate their association with the JIM Team 90 days notice should be given 16. Warranties and Remedies The Injured Jockeys Fund (IJF) warrants that Therapists will provide Services in a professional manner consistent with relevant Industry and Professional standards. If the Racecourse Association (RCA), on behalf of their members, consider that a breach of this warranty has occurred then notification should be given in writing. The IJF will then investigate to ensure compliance with the warranty. Failure of a Therapist to adhere to or implement any of the above will firstly result in a written warning from the IJF explaining the area of failure. In the eventuality that the above is breached on a second occasion the IJF will be compelled to: Review a Therapist s position as a member of the JIM Team. Write to the racecourses associated with the Therapist to explain the reasons for removing them from the JIM Team. Notify the BHA of any non-compliance of the BHA requirements. It is envisaged that problems associated with this SLA can be addressed and fully resolved by the IJF and RCA, however, should matters prove problematic, or further issues are identified outside the standard review they should be escalated as appropriate in line with the procedures of each organisation. 14 APPENDIX A [TO GO ON RACECOURSE LETTERHEAD] [Name and address] [Date] Dear [Name] PHYSICAL THERAPY SERVICES [Name of Racecourse] ("us" or the "Racecourse") would like you to provide physical therapy services (the Services ) to the Racecourse, on the terms set out in this agreement. 1 Provision of Services 1.1 The Professional Jockeys Association (who manage the scheduling of physiotherapists on our behalf) will notify you in advance of the days on which we would like you to provide the Services. If you are unable to provide the Services on a particular day for any reason, after being informed by the Professional Jockeys Association that we would like you to provide Services on that day, you should inform the Racecourse and the Professional Jockeys Association at your earliest opportunity. 1.2 We are not obliged to offer you the opportunity to provide the Services, and you are not obliged to accept any request to provide Services. 1.3 By signing and returning this letter you agree that you have read, understood and will comply at all times with: (a) (b) all relevant provisions of the British Horseracing Authority General Instructions ("BHAGI"), in particular BHAGI 11 (a copy of which is attached); and the On-course Physical Therapy Service SLA (the "SLA") (a copy of which is attached) as amended, renewed or varied from time to time. You further agree to provide evidence of such compliance immediately upon request.

15 APPENDIX A 1.4 Whilst providing the Services you should report to [the SRMO/Clerk of the Course]. 1.5 You are responsible for providing your own materials and specialist equipment required for the Services. 2 Fees 2.1 In consideration of the provision of the Services, we will pay you a fee of per [[8] hour] day which will be payable within 28 days of receipt by us of an invoice from you setting out the days on which you have provided the Services. 2.2 If a race day on which you are scheduled to provide your Services is abandoned on the day of racing, you will be entitled to invoice the Racecourse for one day's work. If the race day on which you are scheduled to provide your Services is abandoned before the day of racing, you will not be entitled to any payment. If you do not provide Services on a race day, whether by reason of illness, injury or otherwise, you will not be entitled to any payment. You agree that, save as otherwise agreed by the Racecourse, you will bear your own costs in providing the Services. 2.3 You will be responsible for all tax liabilities arising in connection with all payments made under this Agreement. 3 Term and Termination 3.1 The arrangement in this letter is terminable by either party giving not less than [ninety] days prior written notice. 3.2 We may also terminate the arrangement in this letter with immediate effect and without the right to compensation to you if we consider that: you have not performed the Services in a proper manner, you have failed to comply with BHAGI and/or the SLA you are no longer a member of the Jockeys Injury Management Team, or you have behaved inappropriately for any other reason. 4 Status 4.1 You agree that you are providing the Services as an independent, self-employed contractor. These terms constitute a Contract for Services and not a Contract of

16 APPENDIX A Employment and nothing in this letter shall constitute or be construed as constituting or establishing any employment or worker relationship, partnership or joint venture between you and the Racecourse for any purpose. You hereby acknowledge that you are in business on your own account and that the Racecourse is a client or customer of your business undertaking and that you are not a worker of the Racecourse for any purpose. 4.2 You are free to be engaged and/or provide services for any other client or customer, save where there is any conflict with the provision of Services under this agreement. 5 General 5.1 You acknowledge that you may be held liable for any loss, liability or costs (including reasonable legal costs) incurred by the Racecourse in connection with the provision of the Services by you, including in relation to any negligent or reckless act, omission or default in the provision of the Services. You will indemnify the Racecourse on a continuing basis (to the maximum extent permitted by law) against all liabilities arising at any time from any such acts or omissions (including losses or expenses arising from personal injury or property damage). 5.2 You consent to the Racecourse processing your personal data (including sensitive personal data as defined by the Data Protection Act 1998) for administrative purposes and for the purposes of complying with applicable laws, regulations and procedures. You further consent that the Racecourse may, when necessary for these purposes, make such data available to third parties including without limitation its advisers, service providers, regulatory authorities and the British Horseracing Authority, to any potential purchasers of the Racecourse or its business and as required by law. 5.3 This agreement shall be in substitution for any previous understanding or agreement (whether written, oral or implied) relating to the Services between you and the Racecourse.
