1 PRE-LEASING CHECKLIST What do I need to provide to lease a slip? Membership Application. Payment Info For Hold Fee - Credit/Debit/Check - NO CASH. Boat registration numbers (OH numbers). You can your application to Tony DiVenere at contactus@olderiveryachtclub.com or mail to the club 4900 Whiskey Island Drive, Cleveland, OH LEASING PAPERWORK Before the start of the season you will need to contact the manager and stop into the office and handle the following paper work: 1) Fill out and sign the membership application if you haven t submitted it already. 2) Have your instant background / credit check ran, if you didn t submit your app already. 3) Pay balance (if a deposit is paid) or in full. Credit/Debit/Personal Check NO CASH. 4) Fill out and sign the credit card authorization form. 5) Sign the Rules and Regulations acceptance form. 6) Sign the Key Fob agreement. 7) Sign the ORYC liability waiver form. 8) Receive your membership card. 9) Receive your boat membership ID sticker. 10) Receive your vehicle parking passes (2 max). 11) Receive your entry key fobs (2 max). 12) Receive a folder with copies of all your paperwork. Please remember, that your boat may not go in to the slip until ALL the above has been completed. There are No Exceptions!

Members not spending the total amount of $75.00 per month will be automatically charged for the difference. The amount will automatically be charged to the credit card number on file with Olde River Yacht Club. A non-refundable deposit of $500 is required to reserve a dock. The balance of $ is due in full by May 1. Under no circumstances may a boat be put in to the slip without full payment. Boats can enter the water as early as 4/15 provided the balance in full has been received. Boats must be removed from the slip by 10/31. 3 OLDE RIVER YACHT CLUB RULES AND REGULATIONS (Updated December 27, 2017) Vessels and Docking 1. All members shall comply with all federal, state and local statutes, ordinances, rules and regulations pertaining to the ownership, operation and maintenance of vessels. 2. When a vessel enters the Olde River Yacht Club basin, it immediately comes under the jurisdiction of the Olde River Yacht Club Condominium Unit Owners Association, Inc. All members shall comply with these Rules and Regulations, as from time to time amended by Olde River Yacht Club Board of Managers. 3. Fueling of vessels in the club basin is prohibited. 4. Members and/or vessel operators and invitees shall adhere to all speed regulations when operating within Olde River Yacht Club waters, entrance channels and adjacent waters. Vessels operating at night in the basin shall be properly equipped with navigational lights and shall be operated in accordance with all applicable provisions of federal and state maritime operating procedures. NO VESSEL SHALL BE OPERATED IN OLDE RIVER YACHT CLUB WATERS SO AS TO CREATE A WAKE AND UNDER NO CIRCUMSTANCES SHALL A VESSEL BE OPERATED IN EXCESS OF THE ESTABLISHED SPEED LIMIT. 5. Only acceptable pleasure vessels, in good condition and under their own power, shall be permitted in the basin. No barges shall be permitted at any time. Only one vessel shall be permitted to occupy a boat slip, excluding dinghies or boats 12' in length or under, providing that the addition of the second vessels does not cause the primary vessel to exceed the length limitations as defined in Rule 24. Floating jet docks or other PWC storage devices may not share a slip with another vessel, unless the member owns both adjacent slips. 6. Members are solely responsible for the proper mooring of their vessels and are required to maintain mooring lines in good condition and of sufficient strength to secure their vessels at all times. In the event of adverse weather, members shall take all necessary precautions for the safety of their vessels. 7. Members shall maintain their vessels in seaworthy condition, with due regard to fire and safety hazards, and shall be responsible for pumping out their vessels when needed. Vessels showing any unusual leakage must be immediately repaired or removed from Olde River Yacht Club. It is the responsibility of the owner of any vessel showing unusual leakage to report the hazard immediately to Olde River Yacht Club. Should any vessel sink in the Olde River Yacht Club waters, it shall be the responsibility of the owner thereof to remove the vessel within forty-eight (48) hours without cost or expense to Olde River Yacht Club or damage to any Olde River Yacht Club property. In the event such sunken vessel is not removed as provided herein, the member's vessel shall be removed by Olde River Yacht Club at the member's sole cost and expense.

4 8. Each member and/or operator of a vessel using Olde River Yacht Club, or the waters thereof, entrance channels or waters adjacent to Olde River Yacht Club, assumes all risk of loss or damage to such vessel or property owned by the member, which may be sustained in Olde River Yacht Club, the entrance channels or adjacent waters. Olde River Yacht Club shall have no liability or responsibility therefore. 9. Refuse, trash, and/or garbage shall not be thrown overboard. Garbage shall be deposited in cans supplied for the purpose. Please dispose of items that do not fit in cans in the dumpsters supplied. No person shall discharge sewage, waste water, fuel, oil, spirits, flammable liquids, or oily bilge water into the waters, entrance channels or adjacent waters of Olde River Yacht Club. Charcoal or open flame fires will not be permitted on docks or vessels at any time. No flammable, combustible, hazardous fluids, chemicals or substances (other than fuel and oil in the vessel's engine system) shall be kept in any slip, vessel or on Olde River Yacht Club Property. However, solvents and cleaning substances may be kept in dock boxes, if stored in a safe manner and in accordance with applicable fire codes and insurance requirements. All used oil, batteries, antifreeze and the like, shall not be disposed of in Olde River Yacht Club dumpsters. Boat owners and contractors also agree to follow all local, state and federal laws regulating disposal of hazardous materials. 10. Advertising or soliciting shall not be permitted on or from any vessel moored at Olde River Yacht Club, nor shall "For Sale" or For Charter" or "For Hire" or any other signs be placed on vessels at any time. Olde River Yacht Club employees are authorized to remove signs in violation of this provision. 11. No unit or vessel shall be used for commercial fishing, party boats, or charters within the Club basin without the written permission of Olde River Yacht Club. 12. The use of spotlights, floodlights and/or other lighting in such a manner as to affect the safety and/or comfort of others is prohibited. Without limiting the generality of the foregoing, Olde River Yacht Club shall provide lighting for the common areas of the property. No member shall permit lighting on or near his slip or vessel which adversely affects such lighting scheme. 13. Dockside electric and water is provided as a convenience only, with no guarantee to its availability. Only marine approved electrical cords and adapters may be used at Olde River Yacht Club. Hoses must be white, marine style. Cords and hoses may not be allowed to fall in to the water. No separate generators shall be used by any member to provide electrical power between the hours of 8:00 pm and 8:00 am. 14. Major repairs and/or refitting of vessels at dockside is prohibited. The extent of repairs or maintenance permitted to be performed in the basin shall be at the sole discretion of Olde River Yacht Club. Any outside contractor must first register with Olde River Yacht Club and provide proof of adequate insurance, workers compensation and such other requirements as Olde River Yacht Club may deem necessary prior to commencing any repairs. Management reserves the right (at its sole discretion), to stop any unsafe and/or unacceptable work being performed on any boat. Welding and open flames of any kind are prohibited at all times. All work shall be limited to daylight hours only unless otherwise authorized by management. 15. No fishing, swimming, diving or other water sport is permitted in the Club basin. Windsurfers are not allowed to operate or sail in Olde River Yacht Club waters. 16. Laundry of any type or any item of personal or unsightly nature shall not be hung or spread to dry or air in public view from any vessel or slip.

5 17. In the event that a vessel is to be loaned to or boarded by persons, in the absence of a member and/or operator, Olde River Yacht Club must be notified in advance as to allow Olde River Yacht Club to verify authorization. 18. Noise shall be kept at a minimum at all times. Members shall use the utmost discretion in operating main engines, radios, televisions and/or other equipment so as not to create a nuisance or disturbance in the club and basin area. 19. All members shall supply adequate and satisfactory proof of insurance to Olde River Yacht Club. Olde River Yacht Club shall not be in any way responsible for loss, theft or damage of or to any vessel. 20. Members are required to provide credit card information to Olde River Yacht Club to be used to pay for any outstanding balances incurred by the member, their family or guests. This may include any past due balances for dockage, restaurant and bar tabs, and any unpaid fines that may have been levied against the member. 21. Vessels operated by guests of members may occupy docks, if available, designated by Olde River Yacht Club. All guests shall check in with the Manager upon their arrival. Olde River Yacht Club shall establish and maintain a uniform rate schedule for use of docks by guests. 22. A Lessee of a water slip of a Unit Owner shall be required to complete an agreement to abide by the rules and regulations of the Club. Lessees shall be entitled to Club privileges, other than voting rights, the same as if such lessee were a Unit Owner. 23. All halyards must be tied off at night and in the members absence. 24. No member may moor a boat that is longer in length than the lineal footage of such slip, as set forth in Exhibit 3 to the Declaration, without the prior written approval of Olde River Yacht Club. The length of the boat, which includes the bowsprits, booms, pulpits, swim platforms and other projections or overhangs, may not exceed the dock length by more than 5% the total length of the slip. Any such projections may not encroach over any slip, dock, or finger pier, and cannot interfere with navigation over basin waters, channels, and adjacent waters. Approval by Olde River Yacht Club will not be given if the boat length will interfere with other member s abilities to navigate the waterway and channels. 25. A member may utilize a hydro-hoist or similar submersible docking device, provided the device does not extend beyond the boundaries of the slip unit and provided it does not interfere with ingress and egress of the adjacent member. In addition, the docking device may not be attached to the pier, other than with mooring lines / ropes. 26. There shall be no alterations or attachments to the docks, decks, posts or bulkheads, without express written consent of the management. This includes mounting of satellite dishes, steps, handles, signage, and anything else temporarily or permanently screwed or affixed. 27. Docking members will be issued an annual membership sticker to identify their vessel. This sticker should be placed in a conspicuous area on the transom or the side of the boat facing the dock, so as to be easily seen by Olde River Yacht Club personnel.

6 Property Access 28. Strict enforcement of the following entrance rules is necessary for a tight gate" and to protect property and avoid overcrowding and the presence of undesirables. We need the cooperation of every member. Please help the guards to do their duty and protect your property. 29. All members in good standing will receive membership cards, parking passes and entry fobs. 30. Vehicles must come to a full stop at the guardhouse when entering, to be identified by the Guards. Members may be asked to present their membership card. Members should have their Olde River Yacht Club parking permit mounted on the lower left side of the windshield. 31. The privilege of the Club facilities shall be extended to the immediate families of all members, which, for the purpose of these rules, shall be; the spouse, or the significant other listed on the official application, of such member and their parents, sons and daughters. 32. When not accompanied by the member, immediate family members of a member must present identification. Members and Guests 33. All members may have guests. Members, with the exception of Social members, are limited to 6 guests that will be using the common areas of the property. Having 7 or more guests constitutes an event. All events must have written permission from management and be scheduled at least 7 days in advance. Olde River Yacht Club may place limits on events and guests on the property. Other than parking limits, Olde River Yacht Club does not limit the number of guests that you may have on your boat. The above limits only apply to guests who will be using the common areas of the property. 34. Social members are limited to 1 guest. 35. Members must register all guests with their full name, on the guest roster at the guardhouse to be allowed to enter to the property. Guests must present proper identification to the guard at the gate. Guests driving in will be issued a 1-day parking permit. Any guests or employees of members arriving with a member, must be signed in by the member on guardhouse guest roster. 36. Persons declaring themselves to be guests of a member, and are not on the guest list, may be directed by the guard to a parking spot to wait in their car for the members' arrival. 37. Members having guests will be held responsible for the conduct of their guests while in the clubhouse or on the Club premises, and for all indebtedness or liability incurred by such guests. 38. Owners employing crew on their boats may admit the employee as an "employee guest". The employee is entitled only to access of the sponsoring member's boat and to the use of the Club for toilet, shower, and food facilities. 39. Members, their families and guests, shall at all times, when on the Club property, conduct themselves in a reasonable and prudent manner. Children shall refrain from boisterous, disorderly or discourteous behavior. 40. Members shall be liable for damage to any Club property resulting from willful, careless, or negligent acts of themselves, their family, their tenants, invitees, licensees, or guests. 41. Members must provide emergency contact information to Olde River Yacht Club management.

7 Children 42. All children under sixteen years of age must be accompanied by a responsible adult when entering and or utilizing Olde River Yacht Club. Members are directly responsible for their children and their guests' children and their conduct in the Club and on the Club premises. 43. Children are not permitted to play roughly or romp in the clubhouse. Children are not permitted to play tag, run or romp on the docks at any time. Children under 12 years of age, or those of any age who cannot swim are asked to wear life jackets while on the docks. 44. Minors are not permitted in any bar unless accompanied by their parents. Children will be the direct responsibility of their parents or legal guardians, including full supervision of them while within Olde River Yacht Club and including full compliance by them of these Rules and Regulations and all other rules and regulation of Olde River Yacht Club. 45. Minor children are not permitted in the pool / Jacuzzi / patio area after 10:00 p.m. Club Property and Common Areas 46. The sidewalks, slips, docks, piers, catwalks, parking areas, entrances, common areas, and like portions of Olde River Yacht Club shall not be obstructed, carpeted, nor used for any purpose other than for ingress and egress to and from Olde River Yacht Club; nor shall any carts, tables, maritime equipment or other objects be stored anywhere on Olde River Yacht Club property, except in the vessels, and in dock boxes. No lockers, chests, cabinets or similar structures shall be installed by a Member without the prior written approval of Olde River Yacht Club, which approval may be withheld in Olde River Yacht Club's sole discretion. 47. No tents or other structures are to be erected on Club property without written approval, in advance, from management. Tents or canopies must be properly secured and must be removed by dusk. Canopies and any personal items (including but not limited to; picnic tables, chairs, grills, etc.) left out overnight, will be considered abandoned property and WILL BE DISCARDED by club personnel. Owner shall be held responsible for any personal or property damage caused by canopies. 48. Bonfires, fire pits and the like, are not allowed on Olde River Yacht Club property. 49. Pets shall be leashed within the confines of Olde River Yacht Club, and are only permitted if they do not disturb other members. Owners shall clean up after their pets. Pets are not permitted in the clubhouse or the pool area at any time. 50. With the exception of approved contractors, actively engaged in business, no commercial vehicles are permitted on Olde River Yacht Club property. This includes limousines, livery vehicles, busses, RVs, trucks and vans with company logos, and/or any vehicle that requiring more than a single parking space. Trailers of any kind are prohibited on Olde River Yacht Club property. 51. All automobiles or similar vehicles must be parked in areas designated by Olde River Yacht Club. Any member wishing to park a vehicle because of an extended cruise, shall register the vehicle with Olde River Yacht Club prior to departing on the cruise; provided, however, that, even if registered, the vehicle shall not remain on Club property for more than seventy-two (72) hours, unless specifically authorized in writing by the management.

8 52. The management may, at any time, establish a temporary rule excluding guests, and/or limiting the number of cars on the premises, when, in its opinion, the facilities of the Club will be overtaxed. 53. The speed limit is 5 miles per hour on Club grounds. 54. Members may park their cars along the waterfront areas near their boats, but do not have the right to any particular place. Non-boat owning members, crew, and guests must use the north area for parking. The areas adjacent to the bulkheads are for Members only. 55. The club will not be responsible for any loss or damage in connection with vehicles parked or operated on the premises. 56. No motorized vehicle, bicycle, skateboard, carts or other wheeled vehicle shall be ridden, driven, stored or otherwise permitted on the piers, docks, sidewalks, bulkheads, or other portions of Olde River Yacht Club property not specifically designed or designated for such use. 57. No notices of any kind shall be posted on Club property except on the regular Club bulletin boards. Such notices must be submitted to the Club Manager's office for approval prior to posting. 58. No bathing suits or bare feet are allowed in the clubhouse at any time. Casual clothing in good taste is acceptable clubhouse attire in evening hours. 59. There is no smoking in the clubhouse or bathhouse areas, this includes vapes and electronic cigarettes. No pipes of any kind may be smoked in the clubhouse or pool area. 60. Food and beverages may be brought to the Olde River Yacht Club by members for consumption on their boats or at the Club picnic grounds. At all other places, food and beverages shall be served by the Club employees from Club facilities. Members may not bring in food or beverages to the clubhouse or pool area. Per State of Ohio law: No outside alcoholic beverages may be brought in to the clubhouse or pool area at any time. This includes times when the restaurant or bar is closed. 61. All slip lessees, owners of self-occupied slips, and social members are subject to a $75 monthly minimum spending requirement in the restaurant and/or bar for the months May - October. Members failing to spend the minimum will have the balance charged to the credit card on file with the Club. 62. Consumption of alcoholic beverages by minors is absolutely prohibited and will not be tolerated. Minors trying to obtain or seen consuming alcoholic beverages on the premises will be ordered to leave the grounds. Second offenders will have their club privileges suspended indefinitely. 63. No professional entertainers of any kind shall be permitted to perform on Club property, except by special written request and permission from the Club Manager. Club Employees 64. Except for services specifically provided by Olde River Yacht Club to members, employees of Olde River Yacht Club are not to perform, or be requested to perform, personal services for members. Olde River Yacht Club management is solely responsible for directing and supervising employees of Olde River Yacht Club. In the event that any Olde River Yacht Club employee does perform such services for a member, (regardless of when or where they are performed), such employee shall be considered as acting as agent of the member and such performance shall be deemed outside of the scope of the employee's employment, and Olde River Yacht Club shall not be responsible in any manner for such

9 employee's actions, including, but not limited to, such employee's tortious acts, injuries and remuneration. 65. Employees are not permitted to leave the Clubhouse or premises on errands for members. Employees may leave for Club business, only with the approval of the Club Manager. 66. All employees of the Club shall be under the direction and supervision of the Club Manager. 67. No reprimand shall be given to employees by any member. All complaints and suggestions must be made in writing, addressed to the Board of Managers dated and signed by the member. SWIMMING POOL / JACUZZI RULES 68. (a) Hours of Operation (subject to change at the direction of the Board of Managers) Mondays (except for holidays) CLOSED Tuesday Noon 12:00 am Adults Noon 10:00 pm - Children Wednesday through Sunday 8:00 am - 12:00 am Adults 8:00 am - 10:00 pm - Children (b) Pool gates shall be locked 30 minutes after the cabana bar closes. (c) Unauthorized entry into the pool / Jacuzzi area during non-hours of operation shall result in the violator being assessed a fine of $ for the first offense, $ for the second offense, and $ for the third offense. 69. Admission (a) All persons entering the pool area may be required to present their membership card or pool pass. (b) No lifeguard is on duty at Olde River Yacht Club. All persons entering the pool and/or Jacuzzi do so at their own risk. 70. Valuables and lost articles Olde River Yacht Club cannot be responsible for valuables or for lost articles. 71. General Rules (a) Club Employees have the authority to eject from the pool area any person who behaves in a fashion detrimental to the safety and enjoyment of others. (b) Children are not to be left at the pool unattended unless they are of sufficient size, strength and swimming skill to care safely for themselves. (c) Children under 16 are not permitted to use the Jacuzzi. No Exceptions. (d) A soap and hot water shower, with bathing suit removed, must be taken before entering pool. (e) Anyone with an open cut, sore, abrasion, wearing bandages, any communicable rash or disease will be barred from the pool. (f) No running, jumping, or "horseplay" on pool deck. (g) No swimming floats or scuba equipment in pool. Water hockey, ball games, are permitted only at scheduled times. (h) Enter and leave pool area at the gates only.

10 (i) (j) (k) (l) (m) (n) (o) (p) (q) (r) (s) No glass or glass containers of any kind are permitted in the pool area. Ash trays are provided. Do not throw cigarettes on the ground. Chairs or any pool equipment are not to be borrowed or removed from the deck areas for any reason. No bobby pins are to be worn in pool. Legitimate swim suits must be worn. No shorts, cutoffs, Bermuda s, or gym trunks will be allowed in pool. No pets are permitted in pool area. (This is also a violation of the County Health Code.) Members must accompany their guests, and are responsible for the behavior of their guests. Identification may be requested of any person using the pool, by any member or the management. No diving is permitted. Everyone must exit the pool if lightning is seen, or thunder is heard in the area. The pool will remain closed until 30 minutes has passed without thunder or lightning Swim diapers are required for small children. Please Note: 72. Violation of any of the rules and regulations or any misconduct or immoral or offensive behavior by a member, or such members invitees, licensees lessees or agents, which might injure a person, cause damage to property, be considered in bad taste by Olde River Yacht Club or cause harm to the reputation of Olde River Yacht Club, shall be cause for immediate removal from Olde River Yacht Club of the vessel and persons in question, upon order of Olde River Yacht Club, and shall be deemed sufficient reason to take further action by Olde River Yacht Club including involuntary sale as provided in Article XV (B) of the Declaration. 73. The violation of any of the Rules and Regulations of The Olde River Yacht Club may result in fines being levied against the unit Owner and/or Lessee. The following schedule of fines shall apply. First Offense: Verbal warning, together with fine of $ at the discretion of The Olde River Yacht Club Condominium Unit Owners Association Board of Managers. Second Offense: Fine of $ to $ and possible termination of membership, at the discretion of The Olde River Yacht Club Condominium Unit Owners Association Board of Managers. Third Offense: Fine of $ to $ and possible termination of membership, at the discretion of The Olde River Yacht Club Condominium Unit Owners Association Board of managers. These sanctions and fines are in addition to those provided by Paragraph 50 of the Rules and Regulations and Article XV (B) of the Declaration. End
