For that reason, I write this letter. Selected excerpts from your letter are in the following paragraphs (with my underlining added): I am familiar with the facts, and the law, having been the Assistant Attorney General in charge of the investigation and indictment of Megrahi in Your action in releasing Megrahi is as inexplicable as it is detrimental to the cause of justice. Indeed, your action gives comfort to terrorists around the world who now believe that regardless of the quality of the investigation, the conviction by jury [three Scottish judges] after the defendant is given all due process, the terrorist will be freed by one man s exercise of compassion. Your actions make a mockery of the emotions, passions and pathos of all those affected by the Lockerbie tragedy: the medical personnel who first faced the horror of 270 bodies strewn in the fields around Lockerbie, the hundreds of FBI agents and Scottish police who undertook an unprecedented global investigation to identify those responsible; the prosecutors who worked for years to see justice done. But most important, your action makes a mockery of the grief of the families who lost their own on December 21, You apparently made this decision without regard to the views of your partners in the investigation and prosecution of those responsible for the Lockerbie tragedy. You have given the family members of those who died continued grief and frustration. You have given those who sought to assure that the persons responsible would be held accountable the back of your hand. You have given Megrahi a jubilant welcome in Tripoli, according to the reporting. Where, I ask, is the justice? Relying upon considerable evidence widely publicized in Europe that is also available on the Internet including numerous reports by the United Nations representative who was present throughout 1

2 the trial and appeal proceedings, I find your letter particularly inappropriate as you referred to: Your concern for the victims families charge. Your cause of justice charge. Your comfort to terrorists around the world. Your due process and your Where, I ask, is the justice? charges. Your all affected by the Lockerbie tragedy charge. Your without regard to the views of your partners in the investigation and prosecution of those responsible for the Lockerbie tragedy. The considerable evidence that has been revealed about criminal manipulations in the investigation and prosecution of the alleged Libyan bomber includes, for instance, Approximately a dozen multi-page reports on the investigation and trial by Professor Hans Koechler, the United Nations representative that was assigned by the UN Security Council to observe and report on every level of the trial and appeal process. Even in polite government writings, his official reports condemn the investigative and prosecution process under FBI control in its entirety. Several of the hundreds of comments from his multiple reports: o My conclusion after the announcement of the trial verdict in January 2001, and again after the appeal decision in March 002, was that a miscarriage of justice may have occurred. o A general pattern of the trial consisted in the fact that virtually all people presented by the prosecution as key witnesses were proven to lack credibility to a very high extent, in certain cases even having openly lied to the court. o The Opinion of the Court is exclusively based on circumstantial evidence and on a series of highly problematic inferences. o The hopeless, indeed Kafkaesque, situation which the lone Libyan prisoner finds himself in is further aggravated by the fact that his second appeal has suffered enormous delays-- seen in the context of deliberate withholding of evidence, are tantamount to an obstruction of justice. The 800-page report dated June 28, 2007, by the Scottish Criminal Cases Review Commission (SCCRC) that stated in polite judicial language that a miscarriage of justice may have occurred during the trial. The sworn affidavits by key witnesses stating that FBI personnel paid for the main planted evidence and the primary testimony that was perjured. Dozens of articles in the British media. Decision by the Scottish Criminal Cases Review Commission that a major miscarriage of justice had occurred, reports by the United Nations representative, and the sworn affidavits by witnesses to planted evidence and perjured testimony, gives the lie to your statement that implied members of the investigative and judicial team agreed that justice was done. Evidence that surfaced after the trial showed a deliberate scheme to obstruct justice. Sequence of the FBI Investigation: The overwhelming evidence during the early part of the FBI investigation showed that the bomb was placed on Flight 103 by the Syrian-based terrorist group, PFLP-GC, and that they were contracted and paid $2 million to commit the terrorist act. The reason for the bombing was retaliation against the United States after the U.S. Navy shot down an Iranian airliner that had just departed from Abadan, Iran, on a scheduled flight on a heavily traveled civil airway. The reckless and irresponsible shooting down of the Iranian airliner resulted in horrific experiences for the 290 people on board. The evidence that Iran 2

3 contracted with the Syrian-based group included, for instance: The repeated statements by Iranian leaders that they would retaliate in kind. The intercepted messages between Iran and the PFLP-GC. The evidence of payment of $2 million by Iran to the Syrian-based Palestinian terrorist group, PFLP-GC. War Plans by President George H.W. Bush (Sr.) Caused FBI Shifting of Blame and Fabricating Evidence On August 2, 1990, Iraq invaded Kuwait. President Bush now needed a coalition of Middle East countries to either assist or not impede the U.S. attack upon Iraq. If the Syrian-based terrorist group, PFLP-GC, was now charged with placing the bomb on Flight 103, and Iran identified as paying to carry out the contract, there would be major difficulties with forming a coalition to attack Iraq. That is when FBI personnel carried out the scheme to shift blame for the 270 murdered in the Lockerbie bombing to Libya. Evidence surfacing after the trial of the falsely-charged Libyan reveals the FBI personnel fabricated and planted a timer fragment and paid witnesses millions of dollars for perjured testimony. Anatomy of the FBI Scheme: To falsely charge Libya, it was necessary to purchase and then plant miles from the main wreckage a half-thumbnail-size portion of a timer fragment, that was miraculously found embedded in mud, miles from the main wreckage, and claim that it was part of the explosive mechanism that the manufacturer had sold to Libya. FBI agents then purchased the timer fragment from Ulrich Lumpert, a former employee of the Mebo manufacturer. After the trial, Lumpert signed an affidavit that he hand-manufactured the timer and sold it to FBI personnel, and provided perjured testimony during the trial. When the timer was first made available, FBI agents were advised that there was no solder on it, indicating it had never been a part of any circuit board. Miraculously, the next morning FBI personnel presented the same timer fragment that now had evidence of solder on it. The head of the FBI forensic lab, Thomas Thurman, presented the timer fragment as being from Pan Am Flight 103. His reports were later described as fabricated and he was forced to resign from the FBI. To find Libyans that could be charged with carrying out the placement of the bomb, FBI personnel paid a CIA-informant, Majid Giaka, to testify that he saw months earlier two Libyans placing an unaccompanied suitcase on a flight departing Malta, KM 180, that would connect at Frankfurt with the first leg of the Pan American Flight 103. CIA reports withheld by FBI personnel from the defense, and discovered after the trial, stated that the CIA informant was unreliable. Information about the million-dollar payment for the perjured testimony, and settlement in the United States, was withheld from the defense. The airline on which the bag was allegedly placed denied that there was an unaccompanied bag on that flight. In the judgment rendered by the three Scottish judges, sitting as jury, at the end of the trial, they stated of that witness, Abdul Giaka: His testimony was at best exaggerated, at worst simply untrue. FBI agents made millionaires out of a small Malta clothes merchant, Tony Gauci, and his brother Paul Gauci, for giving testimony that children s clothes shown to them by FBI agents that were allegedly in the suitcase were purchased months earlier by the FBI-selected bomber, al Megrahi. FBI agents produced fragile children clothes that they claim were in the suitcase containing 3

4 the bomb, clothes that miraculously survived one of the most powerful blasts ever used to down an airliner. FBI agents used Malta clothes merchant, Tony Gauci, having him testify that the child s clothes shown to him were purchased at his store months earlier by a Libyan. During 23 prior questionings, he repeatedly gave different descriptions of the alleged purchaser that were far beyond the description of the FBI s selected bomber. At trial, after seeing the picture of al Megrahi on a magazine cover, and being offered the opportunity to become a millionaire, suddenly positively identified the FBI-selected defendant as the person to whom he sold the clothes several years earlier. FBI personnel withheld from the trial that they paid $2 million to Tony Gauci, effected the immigration to the United States of him and his family, and placed him in the witness protection program with an income. And also paid $1 million to the brother, Paul Gauci, to insure Tony Gauci s continued cooperation in the scheme. It is doubtful that fragile child clothes would have survived, much less been recognizable, if the fragile material in a child s clothes was next to what experts believe was at least three pounds of plastic explosives, that were of such enormous strength and heat that the huge 747 instantly burst into six major sections. Admissions of Planted Evidence and FBI-Paid Perjury After the trial ended, the CIA informant, Majid Giaka, admitted that he gave perjured testimony that he saw two Libyans place a suitcase on a connecting flight departing from Malta. Ulrich Lumpert, the former employee of the Swiss company, Mebo, which manufactured the circuit board and timer, signed a sworn affidavit stating: FBI agents purchased the thumb-size timer fragment from him, which he hand-manufactured (rather than the machine-manufactured units that were sold to Libya and the East German secret police, Stasi). FBI agents paid him for the timer fragment and the perjured testimony that he gave under instructions from FBI agents. Edwin Bollier, the owner of the Swiss manufacturer that made and sold the circuit boards to Libya and the East German secret police, Stasi, signed a sworn affidavit stating: FBI personnel offered him $4 million to testify that the timer fragment was one that was sold to Libya, and that he refused to testify falsely. The timer fragment was not from the circuit boards sold to Libya. The statement from a Scottish police officer that the CIA planted the tiny fragment of circuit board crucial in convicting a Libyan for the Lockerbie bombing. (Report dated August 28, 2007, by UN Investigator Hans Koechler, and published in Scotland on Sunday, August 28, 2005.) The Consequences of These Actions by FBI Personnel The actual murderers of 270 people, the Syrian-based PFLP-GC, and the contracting agent, Iran, were protected from the consequences of their crimes. The actual murderers were free to perpetrate other terrorist acts against U.S. targets. A country that had no role in bombing of Pan Am Flight 103 was saddled with the reputation of having participated in the killing of 270 people, and to escape the economic loss to its citizens from sanctions based upon their alleged guilt was forced to pay several billion dollars to U.S. family members. An innocent Libyan had been denied his freedom and taken from his family for 17 years, and 4

5 mislabeled by the same FBI personnel as a mass murderer throughout the world. The successful carrying out of the FBI scheme gave comfort to terrorists that they can get away with mass murder for political convenience of U.S. politicians. Made a mockery of the emotions of surviving family members who thought that the guilty paid for their crimes when in reality the guilty were protected by the FBI scheme and innocent people were set up for blame. The actual murderers in Syria were free to continue their terrorist activities against U.S. targets. The message was that terrorists could commit horrific acts, killing hundreds of Americans, and not even be named, if the proper political considerations existed. Made a mockery of the term, Justice. Continued the corrupt culture in the FBI-DOJ that I have been documenting from when I was a federal agent responsible for preventing airline disasters. Role of FBI Director in These Offenses Your admission, having been the Assistant Attorney General in charge of the investigation and indictment of Megrahi in 1991 indicates that any irregularities or misconduct or crimes that FBI personnel may have committed during the trial and prosecution would be either directed by you or done with your knowledge. The evidence reveals the world s worst at that time series of sordid frauds perpetrated in relation to what at that time was the world s worst terrorist attack upon a U.S. airliner. And it was followed by much worse series of ripple effects from the same culture. Similar Concurrent FBI DOJ Culture and Series of Catastrophic Ripple Effects What has been stated to this point is only a sampling of the heavily documented reports widely known in Europe. What is stated in this next section is based partly on my personal experiences, starting as a government airline safety inspector and then during the subsequent years as the head of a coalition of several dozen former government agents including some from the FBI, CIA, FAA, DEA, Customs, etc., and other insiders. These are professionals that during their government duties discovered serious corruption of people in various overt and covert government operations. My Qualifications and Credibility I am highly and unusually qualified to make these statements. Starting many years ago as a key federal airline safety inspector with years of prior experience as a Navy Patrol Plane Commander and an international airline captain, years of government service, and later as the head of a coalition of dozens of other former government agents and insiders, I we as a group have discovered areas of serious misconduct in various overt and covert government operations that have resulted in a continuing series of tragic consequences for national security and the lives of many Americans. Much of our findings are in over a dozen not-for-profit documentary books published since 1978 on these matters. My background can be found at and by putting my name in a search engine such as google.com. I have written not-for-profit documentary books on these matters. Part of this following information is extracted from such books. Concurrent FBI Conduct Resulting in 1993 bombing of the World Trade Center An FBI female agent in the New York City offices provided to her supervisor information received from a previously reliable informant. That information contained the names and addresses of al Qaeda members, information that they were building a bomb to commit a terrorist act, and information where the bomb was being constructed in a self-storage unit in Jersey City. Instead of acting on the information, FBI management disciplined the agent. The forewarned terrorist attack then did occur. Another agent, the head of a multi-drug task force that was having great success at targeting ethnic groups involved in drug sales in the New York-New Jersey area, which included al Qaeda members 5

6 funding their terrorist plans. FBI-DOJ prosecutors filed false charges against him and he was sentenced to prison. President George Bush (Sr.) pardoned him before leaving office. That FBI culture became an obstacle to arresting other al Qaeda members. Another FBI agent in the New York City offices, under FBI Supervisor Lindley DeVecchio, during this same time frame while the FBI agents were carrying out their scheme in the Lockerbie matter, was repeatedly blocked by DeVecchio as the agent was investigating a CIA operation sending arms to Iraq during the Reagan-Bush administration (These were the arms that enabled Iraq to invade Kuwait.), and also crimes by Mafia groups. That highly decorated former Vietnam helicopter pilot also attempted to report irregularities of his supervisor, DeVecchio, who was later exposed as being involved in serial murders with a Mafia capo known as the killing machine. When the FBI agent was blocked from carrying out his official duties, he then reported the matters to members of Congress. As usual, they covered up, passed his complaint to the Department of justice, and that was followed by false charges. That agent is now imprisoned at Dannemora, New York, where he may die before his eventual release. The Calamitous Consequences from FBI-DOJ Culture: Same Time Frame as the Lockerbie Scheme Based on inside information that I received over a ten-year span from a Mafia mole who was in communication for several years with the mastermind of the 1993 World Trade Center bombing, al Qaeda terrorist Ramzi Yousef. That mole was giving periodic notices of planned terrorist attacks on U.S. targets that he learned directly from Yousef. While local FBI agents considered the information highly creditable, high-level Department of Justice officials blocked the dissemination of that information from the FBI itself and from other government entities that could have taken steps to prevent the forewarned terrorist attacks. Reason for Deep-Sixing Advance Notice of Several Planned Al Qaeda Terrorist Attacks The reason for withholding the most valuable information the United States had ever received about planned terrorist attacks was the scheme DOJ personnel contrived in Washington to discredit the mole. The mole was scheduled to testify in several murder trials about the serial murders that his father, a Mafia capo known as the killing machine had perpetrated with the help, and direction, of FBI supervisor Lindley DeVecchio. By falsely discrediting the Mafia mole, the FBI supervisor could escape prison, as well as other FBI-DOJ personnel who had known of this conduct and covered up. Expected Tradeoffs Did Occur: Greatest Number of Catastrophic Terrorist Successes Against U.S. Targets The subsequent forewarned terrorist attacks did occur, killing nearly 4,000 persons. The forewarned terrorist attacks included: Downing of TWA Flight 800. The intent of al Qaeda operative Ramzi Yousef was that downing an airliner departing the local New York City airport would result in a mistrial for Yousef and other al Qaeda members. U.S. embassy bombings in Kenya and Tanzania. Hijackings of U.S. airlines. The 9/11 commission investigating the 9/11 hijackings was controlled by the same FBI-DOJ personnel involved in the scheme to protect the FBI supervisor and the withholding of advance information on the hijackings that they now had to cover up for. Precise details and evidence of the above matters are found in the not-for-profit documentary books, including History of Aviation Disasters: 1950 to 9/11; Crimes of FBI-DOJ, Mafia, and alqaeda; FBI- CIA, the Mob, and Treachery; and Lockerbie to 9/11: Massive Frauds and Consequences. Boston FBI Offices While You Were in Charge In my book about the serial murders by New York City FBI supervisor Lindley DeVecchio, I also 6

7 describe the evidence of two FBI agents in the Boston office involved with organized crime in murders. I understand these murders occurred while you were the head of that office. San Francisco FBI Offices While You Were in Charge Much of the criminal activities that I and my coalition discovered and reported occurred while I resided in the San Francisco area. During part of this time, you were in charge of that office. Some of the criminal activities that my coalition discovered and which I reported to you were described in one of several of my letters to you, including the one dated October 18, Basically, I offered to provide evidence of such major ongoing crimes involving people in certain government offices: The pattern of corrupt activities that I personally discovered during my official duties as a FAA airline safety inspector that made possible a series of preventable aviation disasters. That culture continued for decades, and played a primary enabling role in the easy hijackings of four airliners on September 11, The corrupt actions by CIA personnel that arguably affected their intelligence responsibilities and ability or willingness to obtain information on planned terrorist attacks. Pattern of corrupt activities that I had been documenting for years. This pattern covers an extensive area and is highly documented in my books. In addition to the deep-sixing of advance information on several planned terrorist attacks, the conduct that I documented further aided and abetted the series of successful terrorist attacks upon U.S. targets. Sampling of what I discovered of this FBI-DOJ culture: FBI-DOJ personnel repeatedly refused to act on my information and evidence of high-level corruption that I first discovered during my official federal safety responsibilities that was enabling a continuing series of forewarned and preventable aviation disasters, including terrorist hijackings. Department of Justice prosecutors at Sacramento, California, charged me with criminal contempt of court for attempting to report to a federal judge the federal crimes that I and my coalition had discovered. Under the strict requirements of the federal crime reporting statute, Title 18 USC 4, 1 anyone knowing of a federal crime must report it to a federal judge or other federal official. The federal crimes I sought to report also involved employees of the U.S. Department of Justice. Among the criminal conduct that was stated in that federal filing was conduct that at a later date enabled four groups of terrorists to hijack airliners on 9/11. Upon filing those papers, instead of receiving my information, U.S. Attorney David Levi and cooperating federal judges charged me with criminal contempt of court. I was then denied the right to a jury trial and sentenced to six months in prison, while nearing 70 years of age. (Details in, the book, History of Aviation Disasters: 1950 to 9/11.) While in prison, federal judges and Department of Justice trustees corruptly seized and liquidated the $10 million in real estate assets that funded my exposure activities. The seizure and liquidation violated due process requirements of notice of hearing, a hearing, and legal cause. All of the above matters and many more of similar nature are detailed in my various notfor-profit documentary books. Summary The horrific consequences of the deep-seated culture of FBI and other Department of Justice employees have been occurring for years, and their sordid conduct in the Lockerbie matter is part of that culture. It would be laughable if the consequences of the FBI-DOJ wasn t so horrific. I hardly think that you are in a position to state what you did of Scottish Cabinet Secretary Kenny MacAskill. Matter of fact, what you said of him would be more appropriate of the FBI personnel involved in the Lockerbie scheme. 7

8 FBI personnel and those who were complicit to their actions on both sides of the Atlantic should be thankful that al Megrahi was released on condition that he drops his appeal. That appeal had overwhelming evidence of the greatest aviation disaster-related fraud in the worst aviation terrorist attack at that time. What should be surprising to the American public is that the easily discovered misconduct by FBI agents in the Lockerbie matter was not reported by U.S. media or members of Congress. Both groups being fully aware of the shocking conduct. Based on my years of findings, I suspect FBI personnel knew they would be protected by these two groups.
