6 By The Numbers Division III % 31% 21% 26% Bylaw 13 Bylaw 17 Bylaw 14 Other Bylaws Standard Penalties Secondary and III Violations The Committee on Infractions (COI) gives the NCAA enforcement staff authority to: Process Secondary/ III cases; and Impose appropriate penalties using case precedent. Any standard penalty imposed by the staff is the "minimum threshold" penalty for that violation. Institutions and conferences can impose more significant penalties than the NCAA minimum. The COI retains authority to make the ultimate determination of the level of violation. Standard Penalties Secondary and III Violations Facts: Assistant men's tennis coach had impermissible off-campus contact with a sophomore in high school. Two-for-One Penalty 6
7 Standard Penalties Secondary and III Violations Penalties should: Affect the area in which the violation occurred (e.g., financial aid violation = financial aid penalty); Be designed to affect the involved sport program, not just the involved individual; and Go beyond just eliminating the advantage (e.g., two-for-one). Standard penalty document. Standard Penalties Secondary and III Violations Division I: The institution should be required to count the impermissible contact as one of the permissible off-campus contact opportunities with the prospective student-athlete and reduce the remaining contacts by one. Divisions II and III: The institution should be required to preclude the entire men's tennis coaching staff from any recruiting activities with the prospect for two weeks when otherwise permissible. Two- for-one Penalty Standard Penalties Secondary and III Violations Resources to Determine Penalties: Secondary infractions database (LSDBi). Requests and Self-Reports Online (RSRO). Bylaws (Division I) and (Divisions II and III). Standard penalties documents. Secondary/ III enforcement staff. III violations resulting in head coach suspension (Division I). 7
8 Additional Penalties Division I Head Coach Suspensions for Certain III Violations Effective August 2013, these penalties are imposed for ALL sports. Additional violations specifically for football and men's basketball. In addition to head coach suspensions, penalties can include: Suspension of assistant coach from all coaching-related activities for one or more contests. Often Bylaw 13 (recruiting) violations. Additional Penalties All Divisions Coaching Staff Suspensions Longstanding legislated penalty. Support compliance efforts. Often Bylaw 14 (eligibility) violations. 11 Secondary/ III Processes What's new? IV Reporting Basics IV violations are reported to and processed by the conference office. "If it ain't on the list, it ain't IV." - Chris Strobel, beloved Director of Enforcement for Secondary/ III Infractions Using RSRO: Optional Identifying "not applicable" under conference action is not appropriate when submitting IV violation. No decision by NCAA staff. Sample IV Violations Division I Use of Tobacco Products (Bylaw ) Schedule Cards (Bylaw ) Student-Athlete Statement (Bylaw ) Drug Testing Consent Form (Bylaw ) Squad Lists (Bylaw ) Printed Recruiting Materials (Bylaw ) Requirements for Offer of GIA (Bylaw ) Effect of Violation of Conference Rule (Bylaw ) Declaration of Playing Season (Bylaw ) Remember: If it ain't on the list, it ain't a IV violation! Find a complete list on the NCAA Division I enforcement webpage. 11
12 Nullification Divisions II and III Effective August 1, DIII nullifications. AMA New Interpretations Philosophy Division I only. Role of enforcement staff. The process: Submit interpretation request to AMA first. Staff review. Decision. Of the 300 plus DI self-reports considered between August 2014 and April , approximately 25 percent were determined not to be a violation by AMA due to NIP. Letters of Inquiry Enforcement receives information that violation may have occurred If information is specific If information appears credible Letter of Inquiry sent to institution by with link to Box Institution is required to follow up Institution is required to respond Institution should follow up even if information not from enforcement If violation(s) = RSRO If no violation(s) = Letter An anonymous credible source source. can be a credible source. 12
